Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 36/CP dated April 24, 1997 of the Government promulgating the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones;

Pursuant to Decision No. 198/1998/QĐ-TTg dated October 12, 1998 on the establishment of the Hoa Lac High-Tech Park; approval of the overall planning and investment project phase 1, stage I of the Hoa Lac High-Tech Park;

Considering the proposal of the Minister of Science, Technology and Environment, the Minister, Head of the Government Organizational and Cadre Affairs Department, and the Head of the Management Board of Industrial Zones of Vietnam,

DECISION:

Clause 4 of Article 6Establish the Management Board of the Hoa Lac High-Tech Park under the Ministry of Science, Technology and Environment based on the former Project Management Board of the Hoa Lac High-Tech Park to manage the construction and development of the Hoa Lac High-Tech Park according to the approved planning and schedule, which have been approved by the Prime Minister.

The Management Board of the Hoa Lac High-Tech Park shall have legal personality, a seal with the National Emblem; it may open accounts at the State Treasury and banks.

Initially, the office of the Management Board of the Hoa Lac High-Tech Park will be located in Hanoi city.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThe Management Board of the Hoa Lac High-Tech Park shall perform management tasks and powers over the High-Tech Park as stipulated in Article 27 and Article 50 of the Regulation on Industrial Zones, Export Processing Zones, and High-Tech Parks issued together with Decree No. 36/CP dated April 24, 1997 of the Government, and with the following specific tasks and powers:

1. Based on the overall planning of the Hoa Lac High-Tech Park that has been approved by the Prime Minister, prepare and submit to the Minister of Science, Technology and Environment for approval the detailed planning, construction progress, and development plan of the high-tech park, including:

- Detailed planning of functional zones;

- Planning for the development of infrastructure projects (including infrastructure projects outside the High-Tech Park related to the residential area for workers within the High-Tech Park);

- Selection planning of priority technologies to be invested in the High-Tech Park;

Manage the detailed planning that has been approved.

2. Prepare long-term and short-term plans for the development and operation of the Hoa Lac High-Tech Park and submit them to the Minister of Science, Technology and Environment for decision or to the competent authority for consideration and decision. Implement the plans after they have been approved.

3. Guide the selection of industries and priority technologies to be invested in the Hoa Lac High-Tech Park in accordance with the science and technology development strategy for each period.

4. Take the lead or coordinate with relevant agencies to support investment promotion in the Hoa Lac High-Tech Park.

5. Organize the issuance, adjustment, or revocation of investment permits in the Hoa Lac High-Tech Park pursuant to the authorization and guidance of the Ministry of Planning and Investment; issue import and export licenses for enterprises in the Hoa Lac High-Tech Park pursuant to the authorization and guidance of the Ministry of Trade.

6. Take the lead or coordinate with relevant agencies in managing land use and clearing land for the implementation of construction and development projects in the Hoa Lac High-Tech Park.

7. Inspect and audit the implementation of investment permits, processing contracts, service supply contracts, business contracts, scientific research contracts, testing contracts, and economic disputes upon request of the parties.

8. Coordinate with state management agencies on labor matters in inspecting and auditing labor law regulations, collective labor agreements, occupational safety, and wages.

9. Manage service activities within the Hoa Lac High-Tech Park.

10. Supervise and inspect the construction of infrastructure projects inside and outside the Hoa Lac High-Tech Park related to ensure progress and quality according to the approved planning and schedule.

11. Agree with the Hoa Lac High-Tech Park Infrastructure Development Company on the valuation for leasing land attached to constructed infrastructure projects and various service fees in accordance with current policies and laws.

12. Take the lead or coordinate with relevant agencies to organize training and professional development for cadres, civil servants, and workers employed in the Hoa Lac High-Tech Park.

13. Take the lead or coordinate with relevant state agencies, the People's Committee of Ha Tay Province, and the investors in organizing the maintenance of security and social order during the construction, management, and exploitation of projects within the Hoa Lac High-Tech Park.

14. Be allowed to cooperate with foreign organizations and individuals in areas related to the investment, construction, and development of the Hoa Lac High-Tech Park according to the assignment of the Minister of Science, Technology and Environment and in accordance with the law.

15. Be invited to attend meetings of government agencies and provincial people's committees when discussing the formation, construction, development, and management of the Hoa Lac High-Tech Park.

16. Report periodically and annually on the processes of formation, construction, development, and management of the Hoa Lac High-Tech Park to the Ministry of Science, Technology and Environment, the Management Board of Industrial Zones of Vietnam, relevant government agencies, and the People's Committee of Ha Tay Province.

17. Perform other tasks assigned by the Minister of Science, Technology and Environment.

18. Manage organizational structure, personnel, budget, and facilities of the Management Board of the High-Tech Park in accordance with the law and the delegation and authorization of the Minister of Science, Technology and Environment.

Article 3. The organizational structure of the Management Board of the Hoa Lac High-Tech Park includes:

1. Director, several Deputy Directors, and members of the Management Board.

The Prime Minister appoints the Director upon the proposal of the Minister of Science, Technology and Environment, the Minister, and the Head of the Government Organizational and Cadre Affairs Department.

The Minister of Science, Technology and Environment appoints Deputy Directors and members of the Management Board upon the proposal of the Director of the Hoa Lac High-Tech Park Management Board.

2. The organization and staffing of subordinate units of the Management Board shall be decided by the Minister of Science, Technology and Environment based on the proposal of the Director of the Management Board; the staffing of the Management Board shall be determined based on annual tasks and included in the total staffing allocated to the Ministry of Science, Technology and Environment.

Article 4. The operating funds of the Hoa Lac High-Tech Park Management Board shall be allocated from the State budget; the Management Board is entitled to collect and utilize certain fees and charges within its jurisdiction in accordance with the provisions of the law. The Ministry of Science, Technology, and Environment shall take the lead in coordinating with the Ministry of Finance to develop financial regulations applicable to the Hoa Lac High-Tech Park Management Board.

Article 5.The Head of the Hoa Lac High-Tech Park Management Board shall draft the Bylaws for managing the Hoa Lac High-Tech Park and submit them to the Minister of Science, Technology, and Environment for approval.

Article 6. This Decision shall take effect fifteen days after the date of issuance. The Project Management Unit (PMU) of the Hoa Lac High-Tech Park established under Clause a, Section 1, Article 4, Decision No. 198/1998/QĐ-TTg dated October 12, 1998, shall be dissolved.

The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the Chair of the Vietnam Association of Industrial Parks, the Chairman of the People's Committee of Ha Tay Province, and the Head of the Hoa Lac High-Tech Park Management Board are responsible for implementing this Decision.
