MINISTER OF THE MINISTRY OF SCIENCE AND TECHNOLOGY AND ENVIRONMENT

Pursuant to Decree No. 175/CP of the Government dated October 18, 1994, guiding the implementation of the Environmental Protection Law;

Pursuant to Decision No. 46/2001/QĐ-TTg of the Prime Minister dated April 4, 2001, on the management of export and import goods during the period from 2001 to 2005;

Pursuant to Decision No. 46/2001/QĐ-TTg of the Prime Minister dated April 4, 2001 on the management of export and import of goods during the period 2001-2005;

Considering the proposal of the Director of the Environmental Protection Department, the Legal Affairs Department, and the Head of the Ministry's Office;

DECISION:

Article 1. Issuing provisionally with this Decision the "List of Waste Materials that Have Been Processed into Raw Materials Permitted for Import."

Article 2. Waste materials specified in the List issued with this Decision shall only be permitted for import when they have been completely cleaned of all toxic chemicals, radioactive substances, flammable and explosive materials, organic compounds of animal and plant origin posing disease risks, and medical waste.

Waste materials specified in the List issued with this Decision must also be processed to remove impurities such as oil, grease, rubber, plastic, asphalt, and other impurities.

Article 3. Organizations and individuals may only import waste materials that have been processed into raw materials for production purposes, in accordance with specific needs regarding quantity, type, and place of use. The waste materials must have a clear country of origin.

It is strictly prohibited to import waste materials that have been processed into raw materials for purposes other than production.

Article 4. Organizations and individuals importing waste materials that have been processed into raw materials listed in this Decision must follow the import procedures stipulated by current laws.

Article 5. This Decision takes effect fifteen days after the date of signature.

Article 6. The Director of the Environmental Protection Department, the Head of the Legal Affairs Department, the Head of the Ministry's Office, organizations and individuals, and relevant agencies are responsible for implementing this Decision. Any difficulties encountered during the implementation of this Decision should be promptly reported to the Ministry of Science, Technology, and Environment./.
