OF JOINT CIRCULAR NO. 10/2002/TTLT-BGDĐT-BCA DATED MARCH 22, 2002
ON SECURITY AND ORDER MANAGEMENT IN SCHOOLS AND EDUCATIONAL INSTITUTIONS
AND EDUCATIONAL INSTITUTIONS
WHEREAS, Decree No. 29/CP dated March 30, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Education and Training; Decree No. 37/1998/NĐ-CP dated June 9, 1998 on the tasks, powers, and organizational structure of the Ministry of Public Security; Implementing Resolution No. 09/1998/NQ-CP dated July 31, 1998 of the Government on strengthening crime prevention work under new circumstances; To strengthen security and order management under new circumstances, the Ministry of Education and Training and the Ministry of Public Security hereby guide schools, educational institutions, and public security authorities at all levels to proactively coordinate in organizing the implementation of the following policies and contents of work:
I. GENERAL PROVISIONS
- Ensuring security and order in schools and educational institutions including education management agencies at all levels, universities, university colleges, academies, college institutes, scientific research institutes, centers, vocational high schools, high schools, elementary schools, kindergartens, production, business, and service establishments under the education sector is the responsibility of the education sector; the public security sector has the responsibility to cooperate, advise, and guide.
- Management agencies for education, schools, educational institutions, and public security authorities from central to local levels have the responsibility to coordinate their work according to the principle of parity and unity based on the functions, tasks, and powers of each unit.
- This Circular aims to strengthen the work of mobilizing cadres, teachers, workers, and employees (referred to as cadres and teachers) and students and trainees (referred to as students) to effectively participate in crime prevention and suppression activities, ensuring security and order in schools and educational institutions.
II- SPECIFIC PROVISIONS
1. For the education sector:
1.1. Educational management levels and units under the Ministry of Education and Training shall direct schools and educational institutions to perform well the following tasks:
- Coordinate with competent agencies and public security forces to develop plans and enhance political and ideological education, raising awareness of cadres, teachers, and students about the plots and activities of hostile forces aiming for peaceful evolution, and about crime prevention and social evils.
- Enhance the effectiveness of political ideology, ethics, and legal education, and regulations on security and order in the internal curriculum and extracurricular activities.
- Vigorously implement the nationwide movement "All People United to Build a Cultural Life" in schools and educational institutions.
1.2. Principals of schools and heads of educational institutions shall be responsible for educating students and trainees, cadres, and teachers to voluntarily comply strictly with state laws, regulations of the Ministry of Education and Training, and school rules; prevent students and trainees from being incited or drawn into illegal activities that disrupt security and order by bad elements, and ensure the safety of lives and property for cadres, teachers, and students. To achieve these goals, it is necessary to focus on implementing the following measures:
- Continue to implement guiding documents of the Ministry of Education and Training regarding the National Program on Crime Prevention and Drug Abuse Prevention in Schools. Closely coordinate with competent agencies and public security forces to implement inter-sectoral plans to clean up the environment and prevent drug addiction among students and trainees. Organize for units and individuals of students and trainees to sign commitments to participate in crime prevention, drug abuse prevention, and social evil prevention.
- Strengthen youth organizations and political-social organizations in schools and educational institutions (Communist Youth Union Ho Chi Minh, Student Association, Trade Union, Young Pioneer Ho Chi Minh Corps, Parents' Association...) to create comprehensive strength, effectively combat the plots and activities of hostile forces aiming for peaceful evolution, and prevent crime, drug abuse, and social evils. Create conditions for healthy student and trainee activities, especially cultural, artistic, sports activities, and competition movements organized by the Communist Youth Union, Student Association, and Young Pioneer Corps in schools and localities; do not allow students and trainees to spontaneously establish associations, clubs, newspapers, newsletters, magazines, and other forms contrary to the law. promote healthy activities of students, including cultural, artistic, physical education, and sports activities, and competitive movements organized by the Youth Union, Student Association, and Young Pioneers within schools and localities; do not allow students to spontaneously establish associations, clubs, publish newspapers, newsletters, magazines, and other forms contrary to the provisions of the law.

- Principals of schools shall directly direct student management work. Review and improve the organizational structure, arrange capable, enthusiastic, and qualified personnel to manage students and trainees. It is necessary to innovate methods and content of student and trainee mobilization work to meet the requirements of the new situation. Highlight the role of the Communist Youth Union and Student Association in student management work. Organize student and trainee self-management work well, enhancing the effectiveness of the young volunteer force in maintaining security and order.
- Regularly organize dialogues with students and trainees in accordance with the democratic regulations in schools to proactively resolve their proposals on-site, avoiding complex issues or collective complaints that cause disturbances to security and order. If the proposals of students and trainees exceed authority or complex issues that cannot be resolved immediately, they should be explained to the students and trainees and reported to higher authorities for guidance. Ensure democracy, transparency, and fairness in resolving issues related to the rights and obligations of students and trainees.
- Strictly prohibit religious activities in schools in any form. Students and trainees who follow religions may conduct religious activities at legally recognized places of worship outside the school premises. The school shall coordinate with competent agencies to formulate specific regulations and measures to ensure security and order for collective activities of students and trainees.
- Educational institutions using the Internet must implement strict measures to monitor and control the exploitation and use of information. Effectively prevent the printing, distribution, and propaganda of materials and letters with negative content among staff, teachers, students, and trainees. Establish regulations governing interactions, exchanges, and information sharing between staff, teachers, students, and trainees and foreign organizations and individuals.
- Proactively coordinate with police forces to ensure the safety of examinations and admissions. Timely detect and handle violations of examination and admission regulations, the use of illegal certificates and documents.
2. For the public security sector:
2.1. Public security agencies at all levels, according to their assigned functions and tasks, proactively coordinate closely and advise educational management agencies, schools, and educational institutions on ensuring security and order. Regularly exchange information related to plots and methods of activities aimed at influencing, enticing staff, teachers, students, and trainees to cause instability in security and order from hostile forces and other criminal groups for preventive purposes.
2.2. The cultural and ideological security force takes the lead, coordinating with relevant units and the education sector to proactively identify, warn, and combat and prevent signs of activities exploiting the guise of cooperation, aid, scholarship provision, teaching, conferences, seminars... by foreigners and hostile forces to spread propaganda, incite students and trainees, form opposition political organizations, establish associations, illegally propagate religions, etc., to prevent complex situations regarding security and order in schools and educational institutions.
2.3. Security forces at all levels responsible for internal protection of educational management agencies, schools, and educational institutions:
- Advise party committees, school principals, and heads of educational institutions to proactively prevent and manage student activities well, enhance political and ideological education, raise awareness among students about the country's political and socio-economic situation, and counter hostile forces' subversive activities.
- Proactively develop specific plans to ensure security and order in areas with schools and educational institutions. Coordinate with education sector units to review, supplement, and amend regulations concerning student work, admissions, etc. Develop regulations for handling "hot spots," preventing disturbances and riots; information security regulations in schools and education departments suitable for new circumstances.
- Coordinate with functional units to launch mass movements for national security protection throughout schools and educational institutions to create a comprehensive defense against crime both internally and externally. Promote and raise responsibility for maintaining security and order among staff, teachers, students, and trainees to proactively prevent crime from entering schools and educational institutions.
2.4. Functional forces under public security agencies at all levels coordinate to grasp the situation and strictly manage the activities of politically and criminally significant individuals in key areas, combining education, prevention, and struggle to prevent adverse impacts on security and order in schools and educational institutions.
2.5. Public security agencies at districts, towns, wards, and villages ensure security and order in areas where educational institutions are located and have plans to promptly address complex situations involving security and order among students and trainees.
III- IMPLEMENTATION:
- This Circular shall take effect fifteen days from the date of signature. All inter-sectoral documents issued by the education and public security sectors that conflict with this Circular are hereby abolished.
- Based on their functions and responsibilities, educational management agencies, schools, and educational institutions, and public security agencies at all levels, shall develop specific cooperation plans to implement this Circular.
- Hold regular coordination meetings on security and order, conducting mid-year reviews and lessons learned annually on the cooperation in protecting security and order between public security and schools and educational institutions, and developing cooperation plans for the following year.
- During the implementation of this Circular, if there are any difficulties, report them to the Ministry of Education and Training (through the Political Work Department) and the Ministry of Public Security (through A11, A25) for guidance.
