Decision No. 10/2003/QD-BTC On the Issuance of Vehicle Safety Technical Inspection and Quality Testing Fees for Motor Vehicles and Specialized Equipment

THE MINISTER OF FINANCE

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;

BASED ON DECREE NO. 178/CP DATED OCTOBER 28, 1994 OF THE GOVERNMENT ON THE TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF FINANCE;

Pursuant to Decree No. 38/2001/PL-UBTVQH dated August 28, 2001 on fees and charges;

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to the proposal of the Ministry of Transport in Circular No. 4365/BGTVT-TCKT dated November 19, 2002, and the recommendation of the Director of the Enterprise Finance Department.

DECISION:

Article 1. This Decision annexes the Fee Level Table for Safety and Technical Quality Inspection of Motor Vehicles and Various Types of Equipment and Specialized Motorcycles, including:

1. Fees for safety and technical inspection of motor vehicles in operation.

2. Fees for safety and technical inspection of equipment and specialized motorcycles in operation.

3. Fees for safety and technical quality inspection of motor vehicles and specialized vehicles during modification.

4. Fees for quality inspection of spare parts and motor vehicles during testing for production and assembly.

5. Fees for safety and technical quality inspection of motor vehicles, equipment, and specialized motorcycles during production and assembly in Vietnam.

6. Fees for safety and technical quality inspection of imported motor vehicles, equipment, and specialized motorcycles.

7. Fees for quality inspection of equipment for inspecting motor vehicles.

Article 2. The fee levels in this table include value-added tax but do not include registration fees for certificates of quality and safety for motor vehicles, various types of equipment, and specialized motorcycles, nor do they cover accommodation, travel, and communication costs for inspection work more than 100 kilometers away from the headquarters.

Article 3. In cases where international treaties to which the Socialist Republic of Vietnam is a party provide different provisions from this Fee Table, the provisions of such treaties shall apply.

Article 4. The entities subject to payment under this Decision are organizations and individuals who have their safety and technical quality inspections conducted by the Vietnamese Inspection Authority for motor vehicles and various types of equipment and specialized motorcycles in production, assembly, importation, modification, and operation; and for inspection equipment for motor vehicles.

Article 5. Some concepts in the Fee Table are understood as follows:

1. Motor vehicles: includes automobiles, tractors, two-wheeled motorcycles, three-wheeled motorcycles, motorbikes, and similar vehicles, including motor vehicles for disabled persons.

2. Equipment and specialized motorcycles: includes transportation equipment, construction motorcycles, agricultural and forestry motorcycles participating in road traffic.

Article 6. This Decision takes effect from February 1, 2003, and replaces Decision No. 138/1999/QD-BVGCP dated December 28, 1999, of the Government Price Board on technical inspection fees, quality testing fees for various types of equipment and construction motorcycles, and related guiding documents.

Article 7. Organizations and individuals subject to payment, inspection agencies, and relevant agencies are responsible for implementing this Decision.
