DECREE

Regarding the regulations on traditional flags, insignia, symbols, customs flags, badges, rank insignias, uniforms, and customs identification cards

THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Customs Law dated June 29, 2001;

At the proposal of the Minister of Finance,

DECREE:

Chapter I:
GENERAL PROVISIONS

Article 1. Scope of application

This Decree stipulates the regulations on traditional flags, insignia, symbols, customs flags, badges, rank insignias, uniforms, and customs identification cards.

Article 2. Applicability

The subjects to which this Decree applies are officials, civil servants, and employees (hereinafter collectively referred to as civil servants) currently working in the Customs sector.

Article 3. Purpose of Use

1. The traditional flag of Customs shall be used in commemorative rallies for holidays, traditional days, displayed in the traditional house, and other significant activities of the Customs sector.

2. The Customs flag shall be affixed to patrol and control vehicles of Customs.

3. The Customs symbol shall be used to attach to the Customs flag and traditional flag, printed on certain types of documents, forms, specialized work equipment, souvenirs, and other emblems of Customs, or part of the Customs symbol (the keyhole shape, anchor, swallowtail) shall be attached to the Customs badge and rank insignia to distinguish the Customs rank insignia from other rank insignia.

4. The Customs badge shall be affixed to the peaked cap and soft hat of Customs.

5. The Customs badge is a single pine branch worn on the lapel of the Customs uniform, reflecting the aesthetic sense and solemnity of Customs officials.

6. The Customs rank insignia shall be worn on the shoulder of the Customs uniform to distinguish the positions of leadership at various levels and the ranks of professional staff.

7. The Customs uniform includes: coat, trousers (ceremonial, spring-summer, autumn-winter), peaked cap, soft hat, tie (caravat), belt, shoes, and other seasonal uniforms (protective clothing, gloves, socks...).

8. The Customs identification card is a type of document certifying the image, name, age, position, rank, and unit of each Customs official, issued by the Director General of the General Department of Customs for use and presentation when necessary in performing customs inspection, supervision, and control functions according to the provisions of the law.

Chapter II:
SPECIFIC PROVISIONS

Article 4. The traditional flag of Customs

The traditional flag of Customs is rectangular, with a width of 1.40 meters and a length of 2.10 meters. The background fabric of the flag is red, with a five-pointed yellow star in the center, above the left corner there are two lines of capitalized yellow letters: "BẢO VỆ LỢI ÍCH CHỦ QUYỀN QUỐC GIA" (arranged in two lines: the top line reads "Bảo vệ", the bottom line reads "Lợi ích chủ quyền quốc gia", the end of the last letter does not exceed the right edge of the star), below the two lines of text is the symbol of Vietnam Customs.

Article 5. The Customs flag

The Customs flag has an isosceles triangle shape, blue fabric, the base side is 2/3 the height, with the Customs symbol in the middle, specifically:

- The flag hung on large patrol boats has a base side of 0.60 meters and a height of 0.90 meters;

- The flag hung on other patrol means such as speedboats, boats, trucks, three-wheeled motorcycles has a base side of 0.3 meters and a height of 0.45 meters.

Article 6. The Customs symbol

The Customs symbol is a circle with a blue sea background; inside is a red shield shape; within the shield, above is a five-pointed yellow star, in the center are the keyhole, anchor, and swallowtail shapes all in yellow; above is the capitalized yellow letters "HẢI QUAN VIỆT NAM"; below is the capitalized yellow letters "VIET NAM CUSTOMS" in English; on both sides of the outer circle are two golden everlasting branches; around the symbol's outer edge is a red border.

Article 7. The Customs badge

The Customs badge is a metal ring-shaped badge, 60mm high, 54mm wide, with the National Emblem of the Socialist Republic of Vietnam at the top, with a diameter of 28mm. Below the National Emblem is the keyhole, anchor, and swallowtail shapes all in yellow, at the bottom are the capitalized yellow letters "HẢI QUAN" on a red background, surrounding the Customs badge is a golden pine branch.

Article 8The Customs badge

The Customs badge is a single golden pine branch made of metal, worn on the lapel of the spring-summer, autumn-winter, and ceremonial uniforms. Specifically, the badge of the General Department of Customs leadership has an additional golden star made of metal attached to the inner edge of the pine branch.

Article 9. The Customs rank insignia

1. The Customs rank insignia consists of: the rank insignia background, the rank insignia button, the five-pointed star with raised patterns, horizontal stripes; and a part of the Customs symbol including the keyhole, anchor, and swallowtail shapes attached to the rank insignia background, specifically:

a) The rank insignia background is made of velvet fabric, blue sea color. The rank insignia of the General Department of Customs leadership has a golden floral pattern background.

The size of the rank insignia: rectangular, one end tapering to a point, with dimensions 48mm wide, 120mm long, the pointed end slanting 18mm.

b) The rank insignia button is made of silver metal, 20mm in diameter, with a raised five-pointed star between two ears of rice; it is attached to the small end of the rank insignia background.

c) A part of the Customs symbol is a keyhole, anchor, and swallowtail shape made of gold metal for leadership and silver metal for professional staff.

d) The horizontal stripe of the rank insignia: 6mm wide, made of gold metal to distinguish positions for leadership; silver metal to distinguish different ranks of professional staff.

e) The star on the rank insignia background: a gold metal star with raised patterns, 18mm in size. The star is arranged in a vertical row in the center of the rank insignia, indicating the leadership positions at various levels (General Department, Bureau, Branch, Team under Branch and equivalent positions); department heads have two stars, deputy department heads have one star. The rank insignia of professional staff does not include stars.

2. Regulations on rank insignia for each level

a) Leadership of the General Department of Customs: the rank insignia background is orange-yellow color, with raised golden floral patterns, the small ends and vertical edges of the insignia are bordered in red, the border width is 3mm; the larger end of the insignia has three horizontal yellow stripes, above which is a golden keyhole, anchor, and swallowtail shape; in the center of the insignia background is a golden star, including:

- The rank insignia of the Director General: two golden stars;

- The rank insignia of the Deputy Director General: one golden star.

b) Leadership of Bureaus, Departments, and equivalent positions: the rank insignia background is blue sea color; the larger end of the insignia has three horizontal yellow stripes; above which is a golden keyhole, anchor, and swallowtail shape; in the center is a golden star, including:

- Badge for the Chief level: two gold stars;

- Badge for the Deputy level: one gold star.

c) Leaders of Customs Branches, Control Teams, and equivalent positions: the badge background is navy blue; the top of the badge has two horizontal yellow stripes; above it is a golden keyhole, anchor, and swallowtail; in the center of the badge background is a golden star, including:

- Badge for the Chief level: two gold stars;

- Badge for the Deputy level: one gold star.

d) Leaders of Teams under Customs Branches, Groups under Control Teams, and equivalent positions: the badge background is navy blue, the top of the badge has one horizontal yellow stripe, above it is a golden keyhole, anchor, and swallowtail; in the center of the badge background is a golden star, including:

- Badge for the Chief level: two gold stars;

- Badge for the Deputy level: one gold star.

đ) Professional and technical staff: the badge background is navy blue, the top of the badge has horizontal stripes and "V" stripes lying horizontally made of silver metal representing the rank of customs officials; in the center of the badge is a keyhole, anchor, and swallowtail made of white metal; specifically, the stripes for each rank are:

- Senior Customs Inspector rank and equivalents: three horizontal stripes made of silver metal (III).

- Principal Customs Inspector rank and equivalents: two horizontal stripes made of silver metal (II).

- Customs Inspector rank and equivalents: one horizontal stripe made of silver metal (I).

- Intermediate Customs Inspector rank and equivalents: two "V" stripes lying horizontally made of silver metal (>>).

- Customs Officer rank and equivalents: one "V" stripe lying horizontally made of silver metal (>).

Article 10. Customs Uniforms

1. Formal Attire

a) Winter Coat: grayish pink color, with inner lining, pointed collar, and tucked-in neck. The back has shoulder pads, which have two buttons. The chest has four large buttons (diameter 22 mm) made of gold-colored metal with a raised shield shape in the middle, inside the shield is a keyhole, anchor, and swallowtail. The back of the coat has a slit.

- Men's Coat: both front panels have four pockets, flap (batwing style) protruding outward.

- Women's Coat: both front panels have two lower pockets, flap (batwing style) protruding outward. The buttons on the pockets are similar to those on the chest, upper pocket buttons are 16 mm in diameter, lower pocket buttons are 22 mm in diameter.

b) Summer Coat: similar in color and style to the winter coat, but different from the winter coat in that it is short-sleeved and does not have inner lining.

c) Pants: grayish pink color, tailored like European-style suits, suitable for both winter and summer formal attire.

2. Spring-Summer Attire

a) Spring-Summer Pants

- Black-blue pants tailored like European-style suits for both men and women.

- Women: black-blue shorts, longer than the knee, with a back slit.

b) Spring-Summer Coat

- Men's Coat: tailored like a bomber jacket, turned-down collar, sky blue color, short sleeves, buttoned up, chest has two protruding batwing flaps, a row of white plastic buttons. The back has shoulder pads, which have two buttons. The waistband has a pleat, side slits with two buttons.

- Women's Coat: tailored like a fitted shirt, turned-down collar, sky blue color, short sleeves; front panels have two lower pockets; a row of white plastic buttons; designed to wear badges on the shoulders; back has a stitched seam; cuffs are folded outwards.

3. Autumn-Winter Attire: same style, same color, and used by all customs forces, specifically:

a) Autumn-Winter Coat in black-blue color, including:

- Men's Coat similar to formal attire; differences from formal attire include: the collar and lapel are the same size; both front panels have four pockets, flap (batwing style) protruding outward.

- Women's Coat tailored like a vest, shoulder pads have buttons for wearing badges.

b) Autumn-Winter Pants tailored like European-style suits in black-blue color for both men and women.

4. Inner shirts for formal attire and autumn-winter attire include: white long-sleeve shirt with standing collar to tie a necktie, suitable for both men and women.

5. Hats.

a) Pi-shaped hat with a brim, crown, and visor made of the same fabric; a gold ribbon made of metallic thread placed at the front above the black shiny visor; hat band is black. There are two types of pi-shaped hats, including:

- Black-blue pi-shaped hat, embroidered with the capitalized words "VIETNAM CUSTOMS" in gold in the center of the visor, height 8 mm, used for spring-summer and autumn-winter uniforms.

- Grayish pink pi-shaped hat, the same size and style as the black-blue pi-shaped hat, used for formal attire.

b) Soft Hat: similar to the soft hat of the Navy, black-blue color, with a brim, above which is embroidered with a keyhole, anchor, and swallowtail in gold, below which is embroidered with the capitalized words "VIETNAM CUSTOMS" in silver.

c) Wool Hat: similar to the wool hat of the Border Guard, above which is embroidered with a keyhole, anchor, and swallowtail in gold, below which is embroidered with the capitalized words "VIETNAM CUSTOMS" in silver.

6. Necktie

7. - Black leather shoes with low-cut and laces, suitable for all customs officials and used in spring-summer, autumn-winter, and formal attire.

- Special waterproof, heat-resistant, and puncture-proof paper fabric boots are provided exclusively for anti-smuggling patrol forces.

8. Raincoat

- Dark purple raincoat. Patrol and control forces on land and sea are additionally equipped with one set of non-waterproof nylon rain pants; the left sleeve of the coat has the customs emblem printed on it.

9. Cold Weather Gear, including:

- Black-blue down jacket with the customs emblem printed on the left sleeve of the coat.

- Long-sleeved gray sweater with heart-shaped neckline, the customs emblem is embroidered on the left sleeve of the coat.

10. Other Anniversary Attire, including: white belts and gloves used during festivals and major conferences; gray gloves for patrol and inspection forces during winter; protective work pants and jackets for inspection and supervision forces.

11. Specific standards for each type of attire to be issued annually to customs officials are stipulated by the Minister of Finance.

12. Customs Identification Card

Article 11. 1. The Customs Identification Card is issued to customs officials as prescribed in Clause 8, Article 3 of this Decree.

2. The Customs Identification Card is rectangular, measuring 88 mm in length and 65 mm in width. Both sides of the card are specified as follows:

- Front Side: red background, with a 4 mm wide gold border around the edge; above is the capitalized words "SOCIALIST REPUBLIC OF VIETNAM" in gold. In the center is the emblem, measuring 25 mm in height and 25 mm in width. Below is the capitalized words "CUSTOMS IDENTIFICATION CARD" in gold.

- Front side: red background, with a yellow border 4 mm from the outer edge; at the top, there is a row of capitalized yellow letters reading "CỘNG HOÀ XÃ HỘI CHỦ NGHĨA VIỆT NAM". In the center, there is an emblem, measuring 25 mm in height and 25 mm in width. At the bottom, there are capitalized yellow letters reading "GIẤY CHỨNG MINH HẢI QUAN"

- Backside: light yellow color, with printed patterns, in the center is an embossed image of a keyhole, anchor, and white swallow wings.

- From top to bottom on the left side is the customs emblem, height 15 mm, width 15 mm; a photograph of the person to whom the customs identification card is issued, size 3 x 4 cm, wearing customs uniform; below the photo is the identification number which is the customs officer's code number.

- From top to bottom on the right side are capitalized letters: "SOCIALIST REPUBLIC OF VIET NAM"; the next line: "INDEPENDENCE - FREEDOM - HAPPINESS"; the capitalized word "IDENTIFICATION CARD" is printed in red; name, date of birth, position, unit; date of issuance of the identification card; signature and stamp of the issuing authority's title holder.

Article 12. It is strictly prohibited for agencies, units, organizations, and individuals to produce, store, transport, buy, sell, and use customs flags, symbols, insignia, badges, uniforms, and identification cards contrary to the provisions of this Decree.

Chapter III:
IMPLEMENTING PROVISIONS

Article 13. This Decree takes effect fifteen days from the date of publication in the Official Gazette and replaces Decree No. 18/2000/NĐ-CP dated May 29, 2000 of the Government regarding customs insignia, badges, emblems, symbols, traditional flags, flags, and uniforms of the Vietnam Customs.

Article 14. The Ministry of Finance shall provide guidance on the implementation of this Decree;

Article 15The Minister of the Ministry, Head of a ministry-level agency, Head of a government agency, Chairman of the People's Committee of provinces and centrally governed cities shall be responsible for implementing this Decree./.
