Supplementing the "Regulation on Management and Examination for Issuance of Motor Vehicle Driver's Licenses for Road Traffic"

issued together with Decision No. 4352/2001/QĐ-BGTVT dated December 18, 2001 of the Minister of Transport

On the basis of Resolution No. 13/2003/NQ-CP dated November 19, 2002 of the Government on measures to curb the increase and gradually reduce traffic accidents and traffic congestion;

THE MINISTER OF TRANSPORTATION

On the basis of Decree No. 15/2003/NĐ-CP dated February 19, 2003 of the Government stipulating administrative penalties for violations of road traffic regulations;

On the basis of Decree No. 86/2002/NĐ-CP of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Supplementing Clause 5 of Article 5 and Clause 2 of Article 13 of the "Regulation on Management and Examination for Issuance of Motor Vehicle Driver's Licenses for Road Traffic" issued together with Decision No. 4352/2001/QĐ-BGTVT dated December 18, 2001 of the Minister of Transport:

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Based on the proposal of the Director of the Vietnam Highway Administration, the Head of the Legal Department, and the Head of the Cadre Organization Department,

DECISION:

Article 1. 1. Clause 5 of Article 5 shall be amended as follows:

- Thirty days before the expiry date of the Driver's License, the holder must submit an application for renewal along with a health certificate as prescribed, to the competent authority for issuance.

- The holder whose Driver's License has been marked for a second violation of road traffic laws must retake the theory examination when renewing the Driver's License. If the Driver's License is marked for a third violation, it will become invalid. After twelve months from the date of the third marking, the violator must retake both the theory and practical examinations.

- The holder whose Driver's License is damaged but marked for a first violation of road traffic laws must retake the theory examination to obtain a new Driver's License.

- The holder whose Driver's License is damaged and marked for a second violation of road traffic laws must retake both the theory and practical examinations to obtain a new Driver's License.

- Any person who intentionally falsifies information on the Driver's License, reports loss falsely, or alters the Driver's License during the renewal process or application for a new Driver's License, upon discovery, will have their Driver's License and driving record revoked by the Driver's License management authorities.

2. Point b of Clause 2 of Article 13 shall be supplemented as follows:

- Traffic Police officers.

This Decision shall take effect fifteen days from the date of publication in the Official Gazette and shall replace Decision No. 1040/2003/QĐ-BGTVT dated April 15, 2003 of the Minister of Transport.

Article 2. The Permanent Deputy Minister, the Director of the Cadre and Civil Servant Department, the Director of the Legal Affairs Department, the Director of the Vietnam Highway Administration, and the heads of related agencies and units are responsible for implementing this Decision./.

Article 3. The Head of the Department, the Director of the Cadre Organization Division, the Director of the Legal Affairs Division, the Director of the Vietnam Highway Administration, and the Heads of relevant agencies and units are responsible for implementing this Decision./.
