 DIRECTIVE

On Implementing the Law on Gender Equality

_________________

The Law on Gender Equality was adopted at the tenth session of the Eleventh National Assembly on November 29, 2006, and took effect from July 1, 2007. This is a law institutionalizing the Party's and State's viewpoints and policies on gender equality to protect the legitimate rights and interests of men and women; it also reaffirms the strong determination of the State to further concretize and implement international treaties on human rights and gender equality to which Vietnam is a member.

To raise awareness among cadres, civil servants, and the people about the Law on Gender Equality and prepare conditions for its implementation, the Prime Minister requests that Ministries, ministerial-level agencies, agencies under the Government, People's Committees of provinces and centrally-administered cities focus on doing the following tasks:

I. ORGANIZING PROPAGANDA, DISSEMINATION, AND EDUCATION ON THE LAW ON GENDER EQUALITYLAW ON GENDER EQUALITY EDUCATION

1. The Population, Family, and Children Committee shall take the lead and coordinate with the Ministry of Justice to organize propaganda, dissemination, and education on the Law on Gender Equality throughout the country; guide state agencies, political organizations, and political-social organizations to effectively, practically, and appropriately disseminate information and educate on the Law on Gender Equality according to each target group.

2. Ministries, ministerial-level agencies, and agencies under the Government shall organize training sessions on the Law on Gender Equality for cadres and civil servants within their agencies; guide and monitor the propaganda, dissemination, and education on the Law on Gender Equality in their respective fields from central to local levels; develop guidelines for propaganda, dissemination, and education on laws related to gender equality within their administrative management scope until 2020.

3. The Ministry of Culture, Sports, and Tourism shall take the lead and coordinate with the Central Steering Committee for Ideology and Culture, and the Ethnic Minorities Committee to direct and guide mass media agencies, public communication means, and grassroots cultural information systems to focus on propagating the Law on Gender Equality; promote and mobilize the people to uphold good customs and traditions of the nation that align with the goal of gender equality.

4. Vietnam Radio, Vietnam Television, and central and local public communication agencies shall increase the broadcasting time for introducing the Law on Gender Equality, diversify forms of social mobilization to understand this Law.

5. People's Committees of provinces and centrally-administered cities shall direct the propaganda, dissemination, and education on the Law on Gender Equality for cadres, civil servants under their jurisdiction and local residents; coordinate with the Vietnam Fatherland Front and its affiliated organizations, especially Women's Unions at all levels, to propagate, disseminate, and educate the Law on Gender Equality to people at communes, wards, and towns.

II. REVIEWING CURRENT LEGAL DOCUMENTS; BUILDING AND PERFECTING LEGAL PROVISIONS IN ACCORDANCE WITH THE OBJECTIVES OF GENDER EQUALITY

1. The Population, Family, and Children Committee shall take the lead and coordinate with Ministries, ministerial-level agencies, agencies under the Government, and People's Committees of provinces and centrally-administered cities to review current legal documents within their management areas to amend, supplement, abolish, or promulgate new ones within their authority or propose relevant authorities to amend, supplement, abolish, or promulgate new legal documents to ensure the objectives of gender equality, basic principles of gender equality, and the State's policies on gender equality.

The review of legal documents must be completed before December 31, 2007.

2. From now until July 1, 2007, the Population, Family, and Children Committee shall take the lead and coordinate with the Vietnam Women's Union, the National Committee for Women's Advancement, and relevant ministries and sectors to draft and submit to the Government:

a) A decree detailing certain provisions of the Law on Gender Equality (including the division of responsibilities for state agencies managing gender equality) to be submitted to the Government in May 2007;

b) A decree on administrative penalties for violations of gender equality to be submitted to the Government before May 31, 2007.

3. After July 1, 2007:

a) The Population, Family, and Children Committee shall take the lead and coordinate with the Vietnam Women's Union and relevant ministries and sectors to draft a decree on measures to ensure gender equality (including incorporating gender issues into the drafting of legal documents), to be submitted to the Government by the end of 2007;

b) The Ministry of Planning and Investment shall take the lead and coordinate with Ministries, ministerial-level agencies, agencies under the Government, and People's Committees of provinces and centrally-administered cities to study and draft or submit to competent authorities for issuance guiding documents on statistical work, information, reporting on gender equality, and the development of national and regional gender development indices;

c) The Ministry of Culture, Sports, and Tourism shall take the lead and coordinate with the Ministry of Justice, the Central Committee of the Vietnam Fatherland Front, and the Vietnam Women's Union to research and draft and implement programs for information, education, and communication on gender and gender equality through publications, radio and television programs, and other forms;

d) The Ministry of Education and Training shall take the lead and coordinate with Ministries, ministerial-level agencies, agencies under the Government, the Central Committee of the Vietnam Fatherland Front, and the Vietnam Women's Union to research and draft and implement programs to integrate gender and gender equality into educational curricula, ensuring effectiveness and practicality.

III. IMPLEMENTATION

1. Ministers, heads of ministerial-level agencies, heads of agencies under the Government, Chairpersons of People's Committees of provinces and centrally-administered cities are responsible for implementing this Directive.

2. The Population, Family, and Children Committee shall monitor, inspect, urge, and report periodically every six months and annually to the Prime Minister on the implementation of this Directive.

3. It is requested that the Vietnam Fatherland Front and its affiliated organizations, particularly the Vietnam Women's Union, supervise the implementation of legal provisions on gender equality and this Directive within their functions and duties.

This Directive takes effect fifteen days after its publication in the Official Gazette./.
