CIRCULAR
Guidelines for the planning and construction of government offices of Party and State agencies,
political-social organizations at provincial, district, and commune levels

Pursuant to Decree No. 36/2005/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Construction;
Pursuant to Decree No. 08/2005/NĐ-CP dated January 24, 2005 of the Government on urban planning;
Pursuant to Decision No. 229/2006/QĐ-TTg dated October 12, 2006 of the Prime Minister regarding requirements for the planning of administrative office buildings;
Pursuant to the guidance of the Prime Minister in Circular No. 285/TTg-CN dated February 28, 2007, the Ministry of Construction hereby provides guidelines for the planning of administrative office buildings for Party and State agencies, and political-social organizations at provincial, district, and commune levels as follows:
I. OBJECTIVES, SCOPE OF APPLICATION AND REQUIREMENTS FOR PLANNING
1. Objective
1.1. XBuilding Party and State agency, and political-social organization office buildings at provincial, district, and commune levels into a central administrative area, addressing the issue of scattered and fragmented distribution, adapting to local natural and cultural conditions, contributing to enhancing the architectural appearance of urban and rural areas.
1.2. Creating favorable conditions for citizens and organizations to conduct transactions and implement state policies and laws.
1.3. Providing a conducive working environment for civil servants, improving the effectiveness of state management, meeting the requirements of industrialization, modernization, and integration.
2. Scope of Application
New investment and construction of Party and State agency, and political-social organization office buildings at provincial, district, and commune levels include:
2.1. Office buildings of Party agencies
2.2. Office buildings of State agencies including People's Councils, People's Committees, specialized agencies, People's Procuratorates, and People's Courts.: 2.3. Office buildings of political-social organizations including the Fatherland Front, Communist Youth Union, Vietnam General Confederation of Labor, Women's Union, Veterans' Association, and Farmers' Union.
3. Planning Requirements
3.1. The planning of office building complexes for Party and State agencies, and political-social organizations at provincial, district, and commune levels should be concentrated into a central administrative area, implemented based on detailed plans at a scale of 1/500, general urban plans at a scale of 1/2000, and rural settlement plans approved by competent authorities, serving as the basis for project implementation.
3.2. Site location requirements:
3.2.1. Consistent with urban development plans already approved by competent authorities. In cases where such plans are not included in the general urban plan or detailed urban plan, the locality must organize adjustments and supplements to the plans for approval by competent authorities.
3.2.2. Facilitating the construction of integrated technical infrastructure systems to meet current needs.
3.2.3. Meeting environmental sanitation requirements.
3.2.4. Possessing future expansion potential.
3.2.5. For office buildings of Party and State agencies, and political-social organizations at district and commune levels, the construction site must be located in the center of the district or commune.
II. PREPARATION AND APPROVAL OF DETAILED URBAN PLANS
1. Content and Tasks of Detailed Urban Plans
1.1. The tasks of preparing detailed urban plans for Party and State agency, and political-social organization office buildings at provincial, district, and commune levels can be carried out by provincial, district, or commune authorities or through consultancy services, including:
1.1.1. Determining the boundaries and area of the planning zone.
1.1.2. Establishing key economic and technical indicators concerning land use, technical infrastructure requirements, architectural space requirements, and other requirements for the planning zone.
1.1.3. Listing the necessary construction projects within the administrative complex.
1.1.4. Drafting schematic diagrams of the site boundaries extracted from detailed urban plans and rural settlement plans at a scale of 1/2000.
After the planning design tasks have been approved by the People's Committees at various levels, consulting units with the appropriate capacity shall be selected to prepare the planning project.
Contents of Detailed Urban Plans
2. 2.1. Planning Structure:
2.1.1. For provincial and district levels:
- Office building complex for Party and State agencies, and political-social organizations.
- Commercial service area including dining halls, department stores, cafes, and cultural product shops.
- Technical facilities including pumping stations, reservoirs, and other technical facilities.
- Greenery and internal roads.
2.1.2. For commune level: No commercial services or technical facilities shall be arranged.
2.1.3. The construction density for office building sites at provincial, district, and commune levels shall not exceed 50%, while for wards it shall not exceed 70%.
2.2. Overall Site Plan:
2.2. Master plan layout:
2.2.1. Depending on natural conditions, current construction status, architectural landscape of the area, determine the functional zoning structure, building density, land use coefficient, height of each project, and economic technical indicators for infrastructure and anticipated development land fund.
2.2.2. The planning of office buildings for Party and State agencies, political-social organizations at provincial, district, and commune levels shall be carried out as follows:
a/ For the provincial level
- The Party office building in one building
- People's Council, People's Committee, and political-social organizations in one building
- Specialized agencies in one or possibly two or three buildings.
- Judicial agency headquarters including the Procuracy and Court in one building or separately.
b/ For the district level
- All Party, State, and political-social organizations located in one building
- Specialized agencies in one building
- Judicial agency headquarters including the Procuracy and People's Court in one building.
c/ For the commune level: All Party, State, and political-social organizations concentrated in one building within the commune center.
2.3. Planning the system of technical infrastructure projects:
2.3.1. Determine the traffic network, road cross-sections, red line boundaries, and construction boundaries; locations of parking lots for civil servants, visitors, and underground facilities, technical systems.
2.3.2. Determine water demand and supply sources; water supply and drainage networks, stormwater and sewage discharge pipelines, and technical parameters for each project; locations and scales of pumping stations and fire water tanks.
2.3.3. Determine electricity usage needs and supply sources; locations and scales of distribution substations; outdoor lighting networks; modern information network design covering the entire area, meeting usage requirements and being laid underground in technical channels.
2.3.4. The technical infrastructure system in the office areas of Party and State agencies, political-social organizations at all levels must be constructed synchronously before implementing individual construction projects.
3. Documentation for detailed construction planning schemes
3.1. Drawings section
3.1.1. For provincial and district levels: The documentation is prepared based on the current topographic survey map with a scale of 1/500.
- Current condition maps regarding architecture, landscape, technical infrastructure systems, and land construction assessment; scale 1/2,000;
- Master plan layout drawings of projects at a scale of 1/500;
- Elevation drawings of key directions at a scale of 1/500;
- Important cross-section drawings at a scale of 1/500;
- Technical infrastructure project system planning drawings; scale 1/500;
- Red line boundary, construction boundary, and protective corridors for technical infrastructure lines drawings; scale 1/500;
- Comprehensive drawings of technical pipeline and cable layouts; scale 1/500;
- Model at a scale of 1/500 or appropriate scale.
3.1.2. For commune level: The documentation is prepared based on the current topographic survey map with a scale of 1/500, including:
- Master plan layout drawings of projects at a scale of 1/200 or 1/500;
- Elevation drawings of key directions at a scale of 1/200 or 1/500;
- Important cross-section drawings at a scale of 1/200 or 1/500;
- External technical infrastructure project system drawings at a scale of 1/200 or 1/500;
- Red line boundary, construction boundary, and protective corridors for technical infrastructure lines drawings; scale 1/200 or 1/500;
3.2. Description section
The comprehensive report includes descriptions, architectural and landscape management regulations, related legal documents, and approval request for the planning scheme.
4. Review and Approval of Detailed Construction Planning Schemes
4.1. The Chairman of the Provincial People's Committee approves the detailed construction planning scheme for the office area of Party and State agencies, political-social organizations at the provincial level.
4.2. The District People's Committee approves the detailed construction planning scheme for the office area of Party and State agencies, political-social organizations at the district and commune levels.
4.3. The Department of Construction or the Department of Urban Planning and Architecture (for provinces and cities with such departments) organizes the review of detailed construction planning schemes for the office area of Party and State agencies, political-social organizations under the approval authority of the Provincial People's Committee.
4.4. The construction management agency at the district level organizes the review of detailed construction planning schemes for the office area of Party and State agencies, political-social organizations at the district and commune levels under the approval authority of the District People's Committee.
III. IMPLEMENTATION
1. Detailed construction planning for the office area of Party and State agencies, political-social organizations at all levels forms a political-administrative zone as the basis for implementing construction projects.
2. The Chairman of the Provincial People's Committee, based on this Circular, according to the actual conditions of the locality, directs districts, the Department of Construction, and the Department of Urban Planning and Architecture to study and organize the planning of office areas for Party and State agencies, political-social organizations as political-administrative zones, in line with the requirements of administrative reform by the State in the upcoming period.
IV. EFFECTIVE DATE OF IMPLEMENTATION
1. This Circular takes effect fifteen days from the date of publication in the Official Gazette.
