CIRCULAR

Supplementing some points of Circular No. 127/2008/TT-BNN dated December 31, 2008 of the Ministry of Agriculture and Rural Development on guiding the planting of rubber trees on forestry land

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Circular No. 127/2008/TT-BNN dated December 31, 2008 of the Ministry of Agriculture and Rural Development on guiding the planting of rubber trees on forestry land;

Considering the actual situation of converting degraded natural forests to rubber plantations in the Central Highlands provinces;

The Ministry of Agriculture and Rural Development supplements some points of Circular No. 127/2008/TT-BNN dated December 31, 2008 of the Ministry of Agriculture and Rural Development on guiding the planting of rubber trees on forestry land as follows:

1. Supplementing point a, sub-item 2.3.2, Clause 2, Section II as follows:

"a) For the Central Highlands provinces:

- Broadleaf evergreen and semi-deciduous forests with average wood volume per plot less than 110 cubic meters per hectare (hereinafter referred to as m3/ha);

 - Mixed broadleaf and bamboo forests with average wood volume per plot less than 65 m3/ha;

- Podocarp (deciduous) forests with average wood volume per plot less than 50 m3/ha. However, for rubber plantation projects that have been submitted to relevant agencies or provincial People's Committees before December 31, 2008 but not yet approved, with average wood volume per plot equal to or greater than 50 m3/ha and less than 100 m3/ha shall be implemented according to the project already prepared."

2. Supplementing point d, sub-item 4.3.1, Clause 4, Section II as follows:

"d) After the project is approved, the Department of Agriculture and Rural Development approves the design documents and grants permission for the utilization of forest products to the forest owner or the utilization unit decided by the provincial People's Committee. The utilization of forest products can be carried out before or simultaneously with the land clearing work for planting rubber trees."

Other provisions of Circular No. 127/2008/TT-BNN dated December 31, 2008 of the Ministry of Agriculture and Rural Development remain in effect.

This Circular takes effect 15 days from the date of publication in the Official Gazette./.
