Regulations on job titles, grade codes, and professional standards for specialized grades in product and commodity quality control

and Public Official Lawprofessional quality control of products and goods

Pursuant to Decree No. 117/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of civil servants in state agencies; and Decree No. 09/2007/NĐ-CP dated January 15, 2007 of the Government amending and supplementing certain articles of Decree No. 117/2003/NĐ-CP dated October 10, 2003 of the Government on recruitment, utilization, and management of civil servants in state agencies;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 48/2008/NĐ-CP dated April 17, 2008 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Minister of Science and Technology in Circular No. 1277/BKHCN-PC dated May 27, 2009 regarding issuance of this Circular on job titles, grade codes, and professional standards for specialized grades in product and commodity quality control;

The Ministry of Home Affairs hereby stipulates job titles, grade codes, and professional standards for specialized grades in product and commodity quality control as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates job titles, grade codes, and professional standards for specialized grades in product and commodity quality control.

Article 2. Applicability

This Circular applies to civil servants working in agencies performing the function of product and commodity quality inspection at ministries, ministerial-level agencies, government agencies, and provincial people's committees under the central government.

Article 3. Job titles, grade codes of specialized grades in product and commodity quality control include:

1. Senior Quality Control Inspector of Products and Commodities: Grade code 13.280;

2. Principal Quality Control Inspector of Products and Commodities: Grade code 13.281;

3. Quality Control Inspector of Products and Commodities: Grade code 13.282;

4. Intermediate Quality Control Inspector of Products and Commodities: Grade code 13.283.

Chapter II

PROFESSIONAL STANDARDS FOR SPECIALIZED GRADES IN PRODUCT AND COMMODITY QUALITY CONTROL

Article 4. Senior Quality Control Inspector of Products and Commodities

1. Responsibilities

A Senior Quality Control Inspector of Products and Commodities is the highest level of professional staff in the agency responsible for product and commodity quality inspection; assists the leadership of ministries, sectors, provincial people's committees under the central government in directing, managing, and organizing the implementation of product and commodity quality inspections.

2. Tasks:

a) Leads in developing programs, plans, policies, and inspection methods and procedures for product and commodity quality inspections within the assigned area or nationwide to direct their implementation;

b) Leads and directs product and commodity quality inspections; handles violations of laws and proposes forms of punishment for violations related to product and commodity quality in complex cases;

c) Leads and directs the establishment of management systems for product and commodity quality. Leads the summary, report writing, and evaluation of the situation regarding product and commodity quality inspections; makes recommendations for amendments and supplements to policies and regulations related to product and commodity quality inspections and management;

d) Leads in drafting legal documents concerning product and commodity quality inspection; implements research projects and applies advanced scientific and technological progress to the field of product and commodity quality inspection;

đ) Leads and guides inspection techniques in the field of product and commodity quality inspection; proposes measures to adjust the inspection management system and procedures; compiles materials and textbooks for training, enhancing, and disseminating experience in product and commodity quality inspection.

3. Competence:

a) Possesses deep knowledge in the specialized field of product and commodity quality inspection; has the ability to take responsibility as head or deputy head of inspection teams; organizes and guides lower-level civil servants in the same field to perform assigned tasks;

b) Leads and directs lower-level Quality Control Inspectors in the same field to effectively implement product and commodity quality inspection activities;

c) Has the ability to organize and coordinate effectively with relevant agencies and organizations to carry out product and commodity quality inspection work;

d) Has the ability to analyze, synthesize, and generalize product and commodity quality inspection activities to propose solutions to improve the effectiveness of state management over product and commodity quality;

đ) Has the ability to develop programs and compile specialized materials for training and enhancing knowledge for lower-level civil servants in the same field;

e) Has the ability to independently conduct scientific research and apply advanced scientific and technological progress to serve product and commodity quality management work.

4. Qualifications:

a) Holds a bachelor's degree or higher in relevant fields suitable for product and commodity quality inspection;

b) Holds a certificate in specialized training for the Senior Quality Control Inspector grade of products and commodities;

||| c) Holding a certificate in advanced civil service management training for the Senior Specialist grade;

d) Hold a Master's Degree in Political Theory;

đ) Has a foreign language proficiency level C or higher (one of five languages: English, French, Russian, Chinese, German) or another language as required by the position;

e) Has computer skills (proficient in using Microsoft Word, Microsoft Excel, Internet for professional purposes);

g) Has held the Principal Quality Control Inspector grade of products and commodities or equivalent grade for at least six years;

h) Leads or participates in scientific research projects related to product and commodity quality inspection that have been accepted and evaluated as meeting requirements.

Article 5. Chief Quality Control Inspector of Products and Goods

1. Responsibilities:

The Chief Quality Control Inspector of Products and Goods is a specialized civil servant of the product and goods quality inspection agency; assisting the leadership in directing, managing, and organizing the implementation of product and goods quality inspections.

2. Tasks:

a) Leading or participating in the development of programs, plans, and product and goods quality inspections to direct and organize their implementation within the assigned scope;

b) Leading and implementing product and goods quality inspections and proposing professional inspection measures (verification, collection of evidence, documentation of violations); handling violations of product and goods quality laws within the assigned authority and scope of responsibility;

c) Implementing professional management practices for product and goods quality inspections (management information, statistical data, file retention, inspection procedures and processes according to leadership requirements). Summarizing, reporting, evaluating the situation, drawing lessons from product and goods quality inspection work; recommending measures to improve quality inspection mechanisms to competent authorities during each period;

d) Leading or participating in the development of regulatory documents on product and goods quality inspection; implementing research projects and topics in the field of product and goods quality inspection;

đ) Organizing and guiding inspection practices for civil servants in the same specialty; participating in compiling (partially or specifically) materials and textbooks for training, enhancing, and disseminating experience for lower-level civil servants in the same specialty;

3. Competence:

a) Having specialized knowledge and skills in product and goods quality inspection; capable of assuming responsibilities as team leader or deputy team leader for inspections; organizing and implementing guidance and product and goods quality inspections within the assigned tasks;

b) Leading and effectively implementing quality inspection activities;

c) Capable of effectively coordinating with related agencies and organizations during the product and goods quality inspection process;

d) Possessing the ability to synthesize and generalize activities related to product and goods quality inspection specialties to propose solutions to enhance the effectiveness of product and goods quality inspection work;

đ) Possessing the ability to develop programs and compile professional materials for training and enhancing knowledge for lower-level civil servants in the same specialty;

e) Possessing the ability to conduct scientific research to serve product and goods quality management;

4. Qualifications:

a) Holds a bachelor's degree or higher in relevant fields suitable for product and commodity quality inspection;

b) Holding a certificate for training in the chief quality control inspector specialty;

c) Holding a certificate for training in the state administration specialist position;

d) Having a language proficiency level of B or higher (one of five languages: English, French, Russian, Chinese, German) or another language as required by the job position;

đ) Having computer office skills (proficiently using Microsoft Word, Microsoft Excel, Internet for professional purposes);

e) Having at least nine years of experience in the quality control inspector position or equivalent position.

Article 6. Product and commodity quality control officers

1. Responsibilities:

Product and commodity quality control officers are specialized civil servants of product and commodity quality inspection agencies; they assist agency leaders in organizing the implementation of product and commodity quality inspections.

2. Tasks:

a) Participate in building plans and proposing inspection methods for product and commodity quality to organize their implementation;

b) Organize the implementation of inspections and propose inspection measures such as verification, collection of relevant documents and evidence related to product and commodity quality inspections; handle violations of laws on product and commodity quality within their authority or propose recommendations to competent authorities to handle violations according to the law;

c) Implement professional inspection procedures (information gathering methods, file management checks, data retention), ensuring strict, accurate, and principled management according to industry requirements. Report inspection results and propose professional inspection methods to superiors;

d) Participate in drafting specialized regulations on product and commodity quality inspections; provide professional guidance for lower-level civil servants in the same field;

3. Competence:

a) Understand the procedures, processes, and professional inspection practices for product and commodity quality; have the ability to independently and proactively conduct product and commodity quality inspections within assigned tasks;

b) Proficiently perform professional inspection tasks for product and commodity quality;

c) Have the ability to effectively coordinate with organizations and individuals during the implementation of product and commodity quality inspection tasks;

d) Have the ability to synthesize and report activities related to professional inspection tasks for product and commodity quality;

4. Qualifications

a) Holds a bachelor's degree or higher in relevant fields suitable for product and commodity quality inspection;

b) Hold a certificate in product and commodity quality inspector vocational training;

c) Hold a certificate in state administration vocational training for clerical positions;

d) Possess a foreign language proficiency level B (one of five languages: English, French, Russian, Chinese, German) or another language as required by the job position;

đ) Having computer office skills (proficiently using Microsoft Word, Microsoft Excel, Internet for professional purposes);

Article 7. Intermediate product and commodity quality control officers

1. Responsibilities:

Intermediate product and commodity quality control officers are specialized civil servants of product and commodity quality inspection agencies; they carry out product and commodity quality inspections.

2. Tasks:

a) Implement approved inspection plans for product and commodity quality;

b) Directly verify, collect documents, and gather evidence related to product and commodity quality of organizations and individuals within their assigned scope of work;

c) Handle violations of laws within their authority or recommend competent authorities to address violations of product and commodity quality in assigned cases;

d) Manage files, documents, statistics, and retain records accurately according to professional management and inspection requirements for product and commodity quality;

3. Competence:

a) Have the ability to independently and proactively conduct product and commodity quality inspections within assigned tasks;

b) Master inspection procedures for product and commodity quality;

c) Have the ability to effectively coordinate with organizations and individuals during the implementation of product and commodity quality inspection tasks;

d) Have the ability to manage and retain records, documents, and data according to professional management and inspection requirements for product and commodity quality;

4. Qualifications

a) Hold a high school diploma or higher in a relevant field suitable for product and commodity quality inspections;

b) Hold a certificate in intermediate product and commodity quality inspector vocational training;

c) Hold a certificate in state administration vocational training for staff positions;

d) Possess a foreign language proficiency level A or higher (one of five languages: English, French, Russian, Chinese, German) or another language as required by the job position;

đ) Having computer office skills (proficiently using Microsoft Word, Microsoft Excel, Internet for professional purposes);

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Implementation organization

This Circular serves as the basis for Ministries, ministerial-level agencies, government-affiliated agencies, provincial People's Committees under central cities to implement recruitment, utilization, and management of civil servants in the product and commodity quality inspection sector;

Article 9. Effective Date

1. This Circular takes effect 45 days from the date of issuance.

2. Ministers, heads of ministerial-level agencies, government-affiliated agencies, Chairpersons of provincial People's Committees under central cities are responsible for enforcing the provisions of this Circular./.
