Regulations on competition and rewards in the Inspection sector

Based on the Law on Competition and Rewards dated November 26, 2003 and the Law Amending and Supplementing Certain Articles of the Law on Competition and Rewards dated June 14, 2005;

Based on Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government detailing and guiding the implementation of certain articles of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Articles of the Law on Competition and Rewards;

Based on Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Based on Circular No. 02/2011/TT-BNV dated May 9, 2011 of the Ministry of Home Affairs guiding the implementation of Decree No. 42/2010/NĐ-CP of the Government detailing and guiding the implementation of certain articles of the Law on Competition and Rewards and the Law Amending and Supplementing Certain Articles of the Law on Competition and Rewards;

The Government Inspectorate stipulates the competition and reward work in the Inspection sector as follows:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular specifies some contents of the competition and reward work in the Inspection sector regarding the subjects of competition and reward; organization of launching competition movements; titles and criteria for competition titles; forms of reward and criteria for each form of reward; authority to decide competition titles and reward forms; procedures and files for reward proposals; competition and reward funds; rights and responsibilities of collectives and individuals in competition and reward; inspection, handling of violations, and resolution of complaints and denunciations about competition and reward in the Inspection sector.

Article 2. Applicability

1. Regular competition subjects include:

a) Individuals who are officials, civil servants, public employees, and contractual staff with at least one year of service working at the Government Inspectorate; Inspectorates of ministries and ministerial-level agencies (hereinafter referred to collectively as Inspectorates of ministries); Inspectorates of provinces and centrally-administered cities (hereinafter referred to collectively as Inspectorates of provinces); Inspectorates of departments; Inspectorates of districts, towns, and provincial cities (hereinafter referred to collectively as Inspectorates of districts);

b) Departments, Bureaus, and units under the Government Inspectorate; Inspectorates of ministries; Inspectorates of provinces; Inspectorates of departments; Inspectorates of districts; rooms and equivalent units under Departments, Bureaus, and units under the Government Inspectorate, Inspectorates of ministries, and Inspectorates of provinces.

2. Competition subjects during campaigns or special topics

Competition subjects during campaigns or special topics are specifically determined in the campaign or special topic competition launch plans of the Government Inspectorate.

3. Reward subjects include:

a) Subjects specified in Clause 1 and 2 of this Article;

b) Individuals and collectives outside the Inspection sector related to inspection work, with achievements and contributions to the construction and development of the Inspection sector;

c) Vietnamese individuals and organizations abroad, foreign individuals working in Vietnam or abroad with achievements contributing to the construction and development of the Inspection sector.

Article 3. Principles of Competition and Reward

Competition and reward work in the Inspection sector shall be carried out in accordance with Article 6 of the Law on Competition and Rewards; Article 3 and 4 of Decree No. 42/2010/NĐ-CP and the following principles:

1. Ensuring objectivity, democracy, substance, and timeliness.

2. Maintaining continuity.

3. The content, objectives, targets, measures to organize competition movements must be practical, specific, and consistent with the functions, tasks, organizational models, and linked to the requirements of implementing political tasks of the Government Inspectorate and each agency and unit within the Inspection sector.

4. Implementing decentralization, strengthening responsibility linked to the authority of heads of agencies and units in competition and reward work in line with decentralization in organizational management, personnel management, and reward fund management.

Chapter II

RESPONSIBILITIES AND POWERS OF INDIVIDUALS AND ORGANIZATIONS FOR COMPETITION AND REWARD WORK

Article 4. Responsibilities and authorities of individuals and organizations in the work of competition and reward

1. The General Inspector of the Government shall direct the work of competition, launch competitions, examine and decide to present commendation titles and reward forms for collectives and individuals who have achieved outstanding results in the competition movements launched by the General Inspector of the Government; submit to competent authorities for examination and presentation of commendation titles and national-level reward forms for individuals and collectives under the Government Inspectorate; agree on rewards for collectives and individuals under departmental and provincial inspectorates.

2. Heads of departmental and provincial inspectorates, chiefs of bureaus, departments, and units under the Government Inspectorate shall be responsible for the work of competition and reward within their managed agencies and units. They shall examine and decide on rewards for individuals and collectives within their units according to their authority; propose to the General Inspector of the Government to reward collectives and individuals who have achieved outstanding results in the competition movements launched by the General Inspector of the Government.

3. Individuals and collectives belonging to units in the inspection sector shall be responsible for fully participating in competition movements, registering and striving to achieve the results of their registered competition content. Collectives and individuals proposed for rewards must timely comply with all regulations regarding procedures, formalities, and deadlines for submitting reward application files. Collectives and individuals receiving rewards shall be responsible for maintaining and promoting their achievements, continuing to strive to achieve higher achievements and commendation titles; properly preserving reward items, not lending them or allowing others to misuse them for illegal activities.

4. The Competition and Reward Council of the Inspection Sector, the Competition and Reward Councils of departmental and provincial inspectorates; bureaus, departments, and units under the Government Inspectorate shall be responsible for advising and assisting leaders at the same level to build programs, plans, contents, and methods to organize competition movements; summarize and conclude competitions, evaluate competitions, and submit to the heads of agencies and units for decisions to present commendation titles and reward forms according to their authority or propose to competent authorities for examination and presentation of commendation titles and reward forms according to the provisions of the law.

Article 5. Forms and Contents of Organizing Competition Movements

1. The forms of organizing competition movements shall be implemented in accordance with Article 6 of Decree No. 42/2010/ND-CP and point a, item 1, Part I of Circular No. 02/2011/TT-BNV:

a) Regular competition is a form of competition that occurs daily, monthly, quarterly, and annually, launched by the General Inspector of the Government to implement the annual goals, targets, programs, and plans of the Government Inspectorate and the entire inspection sector;

b) Periodic or thematic competition is a form of competition that occurs within a specific period, launched by the General Inspector of the Government or organized to motivate collectives and individuals in the inspection sector to strive to complete key tasks or breakthrough works of the inspection sector.

2. Contents of organizing competition movements

a) The content of competition movements must closely serve and effectively support the political tasks of the Government Inspectorate, departmental inspectorates, provincial inspectorates, and the entire inspection sector. Competition targets must be practical and ensure feasibility so that every individual and collective can make efforts and actively strive to complete them. Methods of organizing competition movements should be diverse and suitable to the characteristics and nature of the tasks of the agency or unit;

b) Emphasize propaganda, mobilization, and the promotion of the sense of responsibility of each individual and collective. Strengthen supervision and urging during the implementation process;

c) Summarize and conclude competitions to accurately assess the results and effects of competition movements; promptly select, evaluate, and commend individuals and collectives with outstanding achievements; identify and nurture new factors and promote exemplary models; review and draw lessons from shortcomings.

Article 6. Registration of Competition

1. Agencies and units in the inspection sector shall organize for individuals and collectives to register for competition and submit to the Standing Committee of the Competition and Reward Council of the Inspection Sector before February 28th of each year.

2. Units in competition clusters and groups shall organize agreements and competition registrations and submit to the Standing Committee of the Competition and Reward Council of the Inspection Sector before March 10th of each year.

Chapter III

AWARDS AND STANDARDS FOR COMPETITION AWARDS

Article 7. Honorary titles and criteria for honorary titles for individuals

1. The honorary title "Advanced Worker" and "Advanced Soldier" (hereinafter referred to collectively as "Advanced Worker") shall be recognized once a year during the annual work summary of the agency or unit for individuals falling within the categories specified in Clause 1 of Article 2 of this Circular, meeting the following criteria:

a) Successfully completing assigned tasks with high productivity and quality;

b) Adhering well to Party policies, state laws, internal regulations and working rules of the agency, demonstrating self-reliance, solidarity, mutual assistance, and active participation in competitive campaigns.

c) Actively studying politics, culture, professional knowledge, and vocational skills;

d) Having a healthy lifestyle and moral conduct.

For cases involving female officials, civil servants, public employees with indefinite-term contracts, on maternity leave according to state regulations, and those who have shown bravery in saving people or property, or who were injured while fighting, serving in combat, or performing official duties and require medical treatment or convalescence as determined by health authorities, their leave time will still be counted towards the award of the "Advanced Worker" honorary title as a basis for awarding other honorary titles.

Individuals attending short-term training courses under one year, if achieving satisfactory results and complying with the training institution's regulations, may combine their work time at the agency to assess the "Advanced Worker" honorary title. For those attending training for one year or more with satisfactory academic performance, that year will be considered equivalent to the "Advanced Worker" honorary title for the purpose of awarding other honorary titles.

For individuals transferred to new positions and having worked at the previous agency for six months or more, the new agency or unit shall be responsible for considering and electing the "Advanced Worker" honorary title for such individual based on the assessment opinions from the previous agency or unit.

The "Advanced Worker" honorary title shall not be awarded to individuals who have not registered for competition; newly recruited for less than ten months; absent from work for forty working days or more (excluding vacation time); subject to administrative penalties or currently serving disciplinary measures ranging from reprimand upwards.

2. The honorary title "Model Worker at the Grassroots Level"

The honorary title "Model Worker at the Grassroots Level" shall be awarded once a year during the annual work summary of the agency or unit for individuals meeting the criteria set forth in Clauses 1 and 2 of Article 13 of Decree No. 42/2010/NĐ-CP.

a) Being a prominent individual among those who have received the "Advanced Worker" honorary title;

b) Having technical improvements or solutions to enhance the quality and efficiency of work, or research topics, or participating in scientific research groups, or applying new technologies, or summarizing practical experiences in professional work that are disseminated and applied in practice, contributing to improving the quality and effectiveness of the unit's political tasks, or the Inspection sector.

Technical improvements and grassroots-level research topics, specialized summary reports shall be reviewed and recognized by the grassroots-level Technical Improvement Review Board. The grassroots-level Technical Improvement Review Board shall be established by the head of the agency or unit authorized to award the "Model Worker at the Grassroots Level" honorary title.

3. The honorary title "Model Worker at the Ministry, Sector, Provincial, or Municipal Level"

The honorary title "Model Worker at the Ministry, Sector, Provincial, or Municipal Level" shall be awarded regularly each year for individuals meeting the two criteria stipulated in Article 14 of Decree No. 42/2010/NĐ-CP of the Government.

a) Demonstrating outstanding achievements among individuals who have continuously received the "Model Worker at the Grassroots Level" honorary title for three consecutive years;

b) The achievements, technical improvements, work solutions, and research topics of such individual have significant impacts on the Ministry, Sector, Province, or Municipality, and the Inspection sector, and shall be recognized by the Scientific and Technical Improvement Review Board at the Ministry, Sector, Provincial, or Municipal level.

The Scientific and Technical Improvement Review Board at the Ministry, Sector, Provincial, or Municipal level shall be established by the Ministry, Sector, Province, or Municipality.

4. Criteria for the honorary title "National Model Worker"

The honorary title "National Model Worker" shall be awarded annually to individuals meeting the two criteria stipulated in Article 15 of Decree No. 42/2010/NĐ-CP.

a) Being an individual with outstanding and exemplary achievements selected from those who have consecutively received the "Model Worker at the Ministry, Sector, Provincial, or Municipal Level" honorary title twice;

b) The achievements, technical improvements, work solutions, and research topics of such individual have wide-ranging impacts nationwide.

The evaluation of the extent of impact of technical improvements, work solutions, and research topics shall be recognized by the Scientific and Technical Improvement Review Board at the Ministry, Sector, Provincial, or Municipal level.

Article 8. Honorary titles and criteria for honorary titles for collectives

1. The honorary title "Flag of Excellence from the Government"

The honorary title "Flag of Excellence from the Government" is awarded annually to collectives that meet the standards set forth in Article 25 of the Law on Encouragement and Rewards; Clause 2, 4 of Article 16 of Decree No. 42/2010/NĐ-CP; Point 2, Section I of Circular No. 02/2011/TT-BNV.

Collectives eligible for the award of the "Flag of Excellence from the Government" must be outstanding and exemplary nationwide, selected from among those collectives that have been awarded flags of excellence from ministries, sectors, provinces, centrally governed cities, leading in their respective fields and professions nationwide; they must have new factors and models for the entire Inspection sector to emulate.

2. The honorary title "Flag of Excellence from the Government Inspectorate"

The honorary title "Flag of Excellence from the Government Inspectorate" is awarded annually to collectives such as ministry-level inspection bodies; provincial inspection bodies; departments and units under the Government Inspectorate that meet the standards set forth in Article 26 of the Law on Encouragement and Rewards, Article 16 of Decree No. 42/2010/NĐ-CP, and Point 2, Section I of Circular No. 02/2011/TT-BNV.

Collectives eligible for the award of the Flag of Excellence from the Government Inspectorate must be outstanding, comprehensively and excellently completing assigned tasks, meeting all encouragement targets launched by the Government Inspectorate, recognized by units within the same cluster or group as leaders of their clusters or groups; they must have new factors and models for other collectives in the Inspection sector to emulate.

3. The honorary title "Outstanding Labor Collective"

The honorary title "Outstanding Labor Collective" is awarded once a year at the end of the work year to collectives with outstanding and exemplary achievements selected from among those that have received the title of "Advanced Labor Collective" and meet the standards set forth in Article 27 of the Law on Encouragement and Rewards:

a) Internal unity, creative spirit, overcoming difficulties to excel in assigned tasks;

b) Organizing and maintaining regular, practical, and effective encouragement movements;

c) All individuals in the collective must complete their assigned tasks, with at least 70% of them receiving the title of "Advanced Worker," and some achieving the title of "Model Worker at the Base Level," with no individual being disciplined with a warning or higher;

d) Internal unity, exemplary conduct, compliance with Party policies and State laws.

4. The honorary title "Advanced Labor Collective"

The honorary title "Advanced Labor Collective" is awarded annually at the end of the work year to collectives that are exemplary among those that have completed their tasks and meet the standards set forth in Clause 1 of Article 27 of the Law on Encouragement and Rewards:

a) Internal unity, good compliance with Party policies and State laws;

b) Completing work plans with quality and effectiveness of 80% or more, contributing to the completion of assigned tasks according to their functions;

c) Organizing regular, practical, and effective encouragement movements;

d) More than 50% of individuals in the collective must achieve the title of "Advanced Worker," with no individual being disciplined with a warning or higher.

Chapter IV

FORMS AND CRITERIA FOR REWARDS

Article 9. Forms and recipients of rewards

The forms and recipients of rewards (regular rewards, rewards by campaign or topic, unexpected rewards, rewards for contributions over time, foreign rewards) of the Government Inspectorate are implemented in accordance with Points a, b, c, d, e of Section 1, Part II of Circular No. 02/2011/TT-BNV.

1. Regular rewards in the Inspection sector are annual rewards given to collectives and individuals who have achieved outstanding results after completing their annual or multi-year tasks and plans.

2. Rewards by campaign or topic are rewards given to collectives and individuals who have achieved outstanding results after completing a campaign, program, or specific topic of work initiated by the Chief Inspector General.

3. Unexpected rewards are rewards given to collectives and individuals who have achieved outstanding results in their work (inspection, handling complaints and denunciations, anti-corruption efforts; combat operations, support for combat operations; bravery in rescuing people and state property...).

Outstanding achievements are those made in unforeseen circumstances, occurring outside the normal planned work schedule that the collective or individual must undertake.

4. Rewards for contributions over time are rewards given to individuals who have participated in various stages of the revolution (holding leadership and management positions in state agencies, public institutions, political-social organizations), making significant contributions to the revolutionary cause of the Party and the nation.

5. Foreign rewards are rewards given to individuals and collectives from foreign countries who have made contributions and achievements in building and developing the Vietnamese Inspection sector.

Article 10. Forms of reward

1. National-level reward forms:

a) Orders, medals;

b) National honorary titles;

c) Ho Chi Minh Prize;

d) State Prize;

e) Certificate of Merit from the Prime Minister.

2. Forms of reward for the Inspection sector

a) Certificate of Merit from the Chief Inspector;

b) Commemorative Medal "For the Inspection Cause".

c) Letter of Commendation from the Head of a state-run unit under the Government Inspectorate having its own bank account, legal personality, and separate seal.

Article 11. Standards for forms of reward

1. The standards for national-level rewards shall be implemented according to the provisions of Chapter III of the Law on Mobilization and Reward; Chapter III of Decree No. 42/2010/ND-CP; Point 2, Section II of Circular No. 02/2011/TT-BNV.

2. Standards for awarding Certificates of Merit from the Chief Inspector General

The Certificate of Merit from the Chief Inspector General shall be awarded to individuals and collectives falling within the scope defined in Clause 1 of Article 2 of this Circular, meeting the standards set out in Clause 2 of Article 72 of the Law on Mobilization and Reward and Clauses 2 and 3 of Article 49 of Decree No. 42/2010/ND-CP.

a) For direct inspection teams performing inspection functions, handling complaints and denunciations, and anti-corruption:

Effectively perform state management functions regarding inspection work, complaint and denunciation resolution, and anti-corruption.

Conduct 100% of planned inspections, sudden inspections, wide-scale inspections, and responsibility inspections, with at least 90% of these inspections concluding within the prescribed time frame, ensuring quality and effectiveness.

Effectively carry out public reception work, timely and legally advise on resolving complaints and denunciations assigned, contributing to maintaining political security, social order, and safety, effectively serving the political tasks of ministries, sectors, and localities.

Effectively advise the head of the administrative agency at the same level on anti-corruption work; promote thrift and anti-corruption among staff members; promptly identify and recommend strict handling of corruption and waste offenders according to the law.

Build a cadre of inspectors with political integrity, discipline awareness, legal compliance, and work capacity that meets job requirements; the unit has no staff violating discipline at or above the warning level. The Party organization and mass organizations of the unit are recognized as clean and strong.

Regularly organize and actively participate in mobilization campaigns initiated by the unit and the Chief Inspector General. In the year proposed for the Certificate of Merit from the Chief Inspector General, the collective must achieve the title of "Outstanding Labor Collective" or "Victorious Unit" if it belongs to the Ministry of Defense or the Ministry of Public Security.

b) For collectives not directly performing inspection functions, handling complaints and denunciations, and anti-corruption:

Successfully complete all assigned work targets and plans comprehensively and effectively according to their functions and responsibilities.

Consistently conduct scientific research and improve working methods to enhance professional efficiency, timely and effectively supporting inspection work, complaint and denunciation resolution, and anti-corruption efforts of the agency and unit, making substantial contributions to the development of the agency, unit, and the Inspection sector.

Build a cadre of inspectors with political integrity, discipline awareness, legal compliance, and work capacity that meets job requirements; the unit has no staff violating discipline at or above the warning level. The Party organization and mass organizations of the unit are recognized as clean and strong.

Actively and effectively combat and prevent corruption and malpractice within the agency and unit; promptly identify and recommend strict handling of corruption and waste offenders according to the law.

Regularly organize and actively participate in mobilization campaigns initiated by the unit and the sector.

In the year proposed for commendation, the collective must achieve the title of "Outstanding Labor Collective" or "Victorious Unit" if it belongs to the Ministry of Defense or the Ministry of Public Security.

c) For individuals:

Have good political qualities, moral character, serve as a model in implementing Party policies and state laws, internal regulations, and work rules; successfully complete assigned tasks.

Be a role model in units achieving the title of "Model Soldier in Mobilization" for two consecutive years or individuals who have achieved outstanding results in mobilization campaigns launched by the Chief Inspector General.

3. Standards for awarding the Commemorative Medal "For the Inspection Cause"

The criteria and objects for awarding the Commemorative Medal "For the Inspection Cause" shall be carried out according to the provisions of Circular No. 06/2011/TT-TTCP dated May 19, 2011, issued by the Government Inspectorate guiding the awarding of the Commemorative Medal "For the Inspection Cause".

4. Standards for awarding Letters of Commendation from the Head of a state-run unit

a) Collectives (departments, divisions under the unit)

Successfully complete tasks; maintain unity, implement well the grassroots democratic regulations, organize good mobilization campaigns; serve as models in complying with work rules and regulations; practice thrift and oppose waste.

b) Individuals

Successfully complete work tasks and civic duties; have good moral character, unity, and exemplary behavior in following Party policies and state laws; consistently study to improve professional skills and expertise.

Chapter V

PROCEDURES, DOCUMENTS, PROCESSES FOR CONSIDERING AND DECIDING AWARDS, AUTHORITY TO DECIDE AND BESTOW HONORIFIC TITLES AND REWARD FORMS

Article 12. Procedures and Documents for Proposing Commendation Titles and Reward Forms

1. The procedures and documents for proposing commendation titles and reward forms at the national level shall be implemented according to the provisions from Article 53 to Article 65 of Decree No. 42/2010/ND-CP; Point 4, Section III, Circular No. 02/2011/TT-BNV.

2. The documents for proposing recognition of commendation titles and reward forms within the authority of the Government Inspector General (one set) include:

a) The proposal for rewarding submitted by the Chief Inspector of the Ministry, Heads of Departments, Bureaus, and units under the Government Inspectorate;

b) The report on achievements of the collective or individual proposed for rewarding, confirmed by the Head of the immediate superior unit (according to Model No. 1 attached to Circular No. 02/2011/TT-BNV);

c) The decision recognizing innovations, solutions, scientific topics, and the decision recognizing the title "Outstanding Labor Collective" (for collectives); "Model Worker at the Grassroots Level", "Model Worker at the Ministry, Sector, Provincial, and Central City Level" (for individuals);

d) The minutes of the meeting of the Commendation-Reward Council at the level of submission for rewarding; the minutes of the meeting for assessing proposals for rewarding of the competition groups (for collectives of the Ministry's Inspectorate, Provincial Inspectorates, Departments, Bureaus, and units under the Government Inspectorate);

e) The opinion of the Ministry Leaders, agencies equivalent to Ministries, People's Committees of provinces and centrally-administered cities regarding collectives proposed for awarding the "Flag of Merit of the Government Inspectorate".

3. The documents for proposing extraordinary rewards (one set) include:

a) The proposal for rewarding submitted by the agency or unit with individuals or collectives proposed for rewarding;

b) The report on achievements of the individual or collective proposed for rewarding (clearly stating actions, achievements, merits established for the purpose of rewarding), confirmed by the Head of the unit submitting the report. If the reward is for scientific research achievements or inventions, there must be a decision or certificate of recognition issued by the competent authority attached to the file (a copy);

c) The minutes of the meeting of the Commendation-Reward Council of the unit submitting the reward.

Article 13. Time Limit for Submitting Reward Proposal Documents

1. For regular commendation titles and reward forms within the authority of the Government Inspector General, the time limit is as follows:

a) For Ministry Inspectors; Provincial Inspectors; Departments, Bureaus, and units under the Government Inspectorate before December 10 each year, except in cases where the Government Inspectorate provides different guidance;

b) For competition groups before December 15 each year.

2. The documents for proposing extraordinary rewards for individuals and collectives should be submitted immediately after achieving extraordinary results.

3. For commendation titles and reward forms at the national level, it shall be carried out according to the provisions at Point 4, Section III, Circular No. 02/2011/TT-BNV.

Article 14. Acceptance and Management of Reward Documents

1. The agency responsible for Commendation-Reward Work of the Government Inspectorate has the responsibility to accept, manage, and transfer reward documents to the Office of the Government Inspectorate in accordance with the legal regulations on archiving.

2. Agencies and units within the Inspection sector have the responsibility to organize management and storage of reward documents for individuals and collectives under their management. Decisions on commendation and rewards of units with legal personality, bank accounts, and separate seals must be sent to the agency responsible for Commendation-Reward Work of the Government Inspectorate within fifteen days from the date of issuance.

3. Commendation and reward files shall be stored on paper and electronically in accordance with the provisions of the law.

Article 15. Procedure for considering commendation and award

1. Collectives and individuals who have registered for competition, achieved results and met the criteria for commendation titles and forms of reward shall all be considered for commendation. The regular consideration for commendation for individuals and collectives within the Inspection sector shall be conducted once at the end of each working year according to the following procedures:

a) Consideration for commendation titles before forms of reward; consideration for individuals before collectives; consideration for commendation titles and forms of reward in ascending order from lower to higher levels (titles such as Advanced Worker, Model Competitor at the grassroots level, Model Competitor at the Ministry, Sector, Provincial, and Central City level, National Model Competitor for individuals; advanced worker collective, outstanding labor collective, Flag of Competition at the Ministry, Sector, Provincial, and Central City level, Flag of the Government for collectives; forms of reward such as Certificate of Merit, Award of the Ministry, Sector, Provincial, and Central City level, higher forms of reward from the Prime Minister's Award upwards).

b) The Competition and Reward Councils of Inspections under Ministries; Provinces' Inspections; Departments, Bureaus, and units under the Government Inspectorate shall consider and propose the heads of their respective agencies to decide on rewards or propose the Chief Inspector General to decide on rewards according to regulations.

2. The Competition and Reward Council of the Inspection sector shall consider and propose the Chief Inspector General to decide on rewards for individuals and collectives throughout the Inspection sector; submit to the Prime Minister for national commendation titles and forms of reward for individuals and collectives under the Government Inspectorate; agree on rewards for individuals and collectives under the Ministry Inspections and Provincial Inspections when requested by the Central Competition and Reward Board.

Article 16. Authority to Decide on Bestowing Commendation Titles and Forms of Reward

1. The authority to decide on bestowing national commendation titles and forms of reward, national honor titles, Ho Chi Minh Prize, State Prize shall be implemented according to the provisions of Articles 77, 78, and 81 of the Law on Competition and Reward and Point 3, Section I, Circular No. 02/2011/TT-BNV.

2. The authority of the Chief Inspector General

a) To bestow the title "Advanced Worker", "Model Competitor at the Grassroots Level", "Model Competitor in the Inspection Sector" on individuals. The title "Advanced Worker Collective", "Outstanding Labor Collective" on units under the Government Inspectorate;

b) To present the "Flag of Competition of the Government Inspectorate" to Inspections under Ministries, Provincial Inspections, Departments, Bureaus, and units under the Government Inspectorate;

c) To present Awards to individuals and collectives (at the departmental level and equivalent) under Inspections under Ministries, Provincial Inspections, Departmental Inspections, County Inspections; collectives and individuals under Departments, Bureaus, and units under the Government Inspectorate; individuals and organizations with achievements and positive contributions to the construction and development of the Inspection sector;

d) To present the Commemorative Medal "For the Cause of Inspection" to the subjects as prescribed in Circular No. 06/2011/TT-TTCP dated May 19, 2011 of the Government Inspectorate.

3. Heads of Inspections under Ministries, Sectors, and localities; Heads of public service units under the Government Inspectorate having legal personality, separate seals, and separate accounts shall decide to recognize the title "Advanced Worker", "Model Competitor at the Grassroots Level", and present Certificates of Merit to individuals and collectives under their management.

Article 17. Organization of awarding commendation titles and forms of reward

1. The ceremonial procedures for awarding national commendation titles and forms of reward shall be implemented in accordance with the provisions of Government Decree No. 154/2004/NĐ-CP dated August 9, 2004 on state ceremonial procedures in organizing rallies, commemorative ceremonies, and awarding and receiving state honors, Orders, Medals, Excellence Flags of the Government, and Certificates of Merit from the Prime Minister.

2. The Government Inspectorate shall organize the awarding of the Excellence Flag of the Government Inspectorate and Certificates of Merit of the Chief Inspector General to the Inspectors of Ministries; Provincial Inspectors; Departments, Bureaus, and units under the Government Inspectorate; and individuals who are leaders of the Inspectors of Ministries, Provincial Inspectors, Departments, Bureaus, and units under the Government Inspectorate at the annual conference summarizing the inspection sector's work.

3. The Heads of Ministry Inspectors, Provincial Inspectors, Chiefs of Departments, Bureaus, and units under the Government Inspectorate shall organize the announcement of decisions and the awarding of Certificates of Merit of the Chief Inspector General, Commemorative Medals "For the Inspection Cause," commendation titles, and forms of reward to individuals and collectives under their management.

4. The announcement and awarding of commendation titles and forms of reward must be organized solemnly, according to the prescribed ceremonial procedures, avoiding ostentatious displays and wastefulness.

Chapter VI

THE COMPETITION AND REWARD COUNCIL OF THE INSPECTION SECTOR

Article 18. Competition and Reward Council of the Inspection Sector

1. The Competition and Reward Council of the Inspection Sector shall be established by the Chief Inspector General, responsible for advising and consulting the Chief Inspector General on competition and reward activities within the Inspection Sector. The Competition and Reward Council of the Inspection Sector consists of the Chairman, Vice Chairmen, and some members of the Council. The number and list of members of the Council shall be decided by the Chief Inspector General.

2. The Standing Body of the Competition and Reward Council includes the Chairman, Vice Chairmen, and Secretariat Members of the Council.

Article 19. Principles of Operation of the Competition and Reward Council of the Inspection Sector

The Competition and Reward Council of the Inspection Sector operates in accordance with the Council's operational regulations and the principles of centralization, democracy, and majority rule. In cases where the number of votes in favor and against by Council members is equal, the opinion of the Chairman of the Council shall be the deciding opinion.

Chapter VII

FUND FOR COMPETITION AND REWARD

Article 20. Sources and Levels of Deduction for the Competition and Reward Fund

1. The Competition and Reward Fund of the Government Inspectorate is formed from the state budget and other lawful sources of income. The Chief Inspector General decides the level of deduction for the annual Competition and Reward Fund of the Government Inspectorate, not exceeding 20% of the salary fund based on rank and grade of the number of civil servants, public officials, and employees within the establishment and the approved annual wages of laborers with contracts of one year or more.

2. The Competition and Reward Fund of self-financing units under the Government Inspectorate shall be stipulated by the unit's head.

3. The Competition and Reward Fund of Ministry Inspectors and Provincial Inspectors shall be stipulated by the Minister, the head of an agency equivalent to a ministry, and the Chairman of the People's Committee of a province or centrally governed city.

Article 21. Use of the Competition and Reward Fund

1. The Competition and Reward Fund of the Government Inspectorate shall be used to cover expenses for directing and organizing competition activities and movement, printing certificates of merit, commendation letters, certificates of merit, making commemorative medals, badges, excellence flags, certificate frames; rewarding or presenting souvenirs to individuals and collectives awarded commendation titles and forms of reward within the authority of the Chief Inspector General; and monetary rewards for individuals and collectives under the Government Inspectorate awarded national-level commendation titles and forms of reward reported by the Chief Inspector General for recognition.

2. The Competition and Reward Fund of the Government Inspectorate shall be settled annually in accordance with the prescribed regulations and policies.

Article 22. Principles for Awarding Prizes

1. The head of the agency that issues the commendation decision shall be responsible for disbursing prizes from the prize fund managed by their own level.

2. Prize money accompanying commendation titles and forms awarded to collectives and individuals within the authority of the General Inspectorate's decision shall be disbursed from the Inspectorate's Commendation Fund.

3. Commendation titles and forms awarded to individuals and collectives within the authority of the heads of public service units shall be disbursed from the Commendation Fund of such public service units.

4. For overseas Vietnamese, foreign collectives, and individuals who are awarded commendation titles and forms within the authority of the General Inspectorate, they shall be presented with commemorative gifts equivalent in value to the prize money stipulated for such commendation titles and forms.

5. At the same time point, for the same achievement, if a recipient is awarded multiple commendation titles with different levels of prize money, they shall only receive the highest level of prize money.

6. At the same time point, if a recipient achieves multiple commendation titles at different times, they shall receive prize money corresponding to each respective commendation title.

7. At the same time point, if a recipient achieves both a commendation title and a commendation form, they shall receive prize money for both the commendation title and the commendation form.

8. The amount of prize money or accompanying items for commendation titles and forms shall be implemented according to the provisions of Articles 70, 71, 72, 73, 75, and 76 of Decree No. 42/2010/NĐ-CP of the Government.

Chapter VIII

INSPECTION, VIOLATION HANDLING, COMPLAINT AND ACCUSATION RESOLUTION

Article 23. Inspection of Competition and Commendation Work

1. The Department of Competition and Commendation under the Inspectorate General has the responsibility to assist the Competition and Commendation Council of the Inspectorate Sector in inspecting competition and commendation work for units throughout the Inspectorate Sector.

2. Heads of units have the responsibility to inspect competition and commendation work within their management authority. Cluster and Group leaders have the responsibility to inspect the implementation results of competition contents and criteria signed by units within the same cluster or group.

Article 24. Handling Violations in Competition and Commendation Work

Handling violations in competition and commendation work shall be carried out according to the provisions of Article 96 and 97 of the Law on Competition and Commendation; and Articles 80 and 81 of Decree No. 42/2010/NĐ-CP dated April 15, 2010 of the Government.

Article 25. Handling Complaints and Reports

The Department of Competition and Commendation under the Inspectorate General has the responsibility to receive and coordinate with relevant Departments and Bureaus to advise the Inspectorate General on handling complaints and reports regarding competition and commendation work according to the law.

Chapter IX

IMPLEMENTATION

Article 26. Responsibilities for Implementation

The Competition and Commendation Council of the Inspectorate Sector; the Heads of Inspectors of Ministries, the Heads of Inspectors of provinces and centrally-administered cities; and the Heads of Departments, Bureaus, and units under the Inspectorate General are responsible for implementing this Circular.

Article 27. Reporting Responsibilities

1. The time for submitting reports on competition and commendation work is as follows:

a) Interim reports must be submitted to the Standing Committee of the Competition and Commendation Council of the Inspectorate Sector before July 5th each year;

b) Final reports must be submitted to the Standing Committee of the Competition and Commendation Council of the Inspectorate Sector before December 5th each year;

2. Inspectors of Ministries and Inspectors of provinces are responsible for compiling and announcing lists of collectives and individuals from their units who have been awarded national commendation titles and forms to the Standing Committee of the Competition and Commendation Council of the Inspectorate Sector for monitoring and summarizing the commendation achievements of the entire Inspectorate Sector.

Article 28. Effective Date

This Circular takes effect 45 days from the date of issuance, replacing the Competition and Commendation Regulations of the Inspectorate Sector issued together with Decision No. 2298/2006/QĐ-TTCP dated December 4, 2006 of the Inspectorate General.

During the implementation process, if there are difficulties, related agencies, units, and individuals should report them to the Inspectorate General (through the Standing Committee of the Competition and Commendation Council of the Inspectorate Sector) for research, amendment, supplementation, and completion./.
