CIRCULAR

Issued Domestic air passenger transport service on regular basic economy classlists of jobs and workplaces prohibited from usinglabor of minors

Pursuant to the Labor Code on June 18, 2012;

Pursuant to Decree No. 106/2012/NĐ-CP dated December 20, 2012 stipulating the functions, tasks, relations, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

At the proposal of the Director of the Occupational Safety and Health Inspectorate;

The Minister of Labor, Invalids and Social Affairs issues this Circular stipulating the list of jobs and workplaces prohibited from using labor of minors.

Article 1.

1. This Circular hereby promulgates the list of jobs and workplaces prohibited from using labor of minors (hereinafter referred to as minor labor).

2. This Circular applies to all enterprises, agencies, organizations, cooperatives, households, and individuals that hire or use labor under labor contracts (hereinafter referred to as employers).

Article 2.

1. Employers shall be responsible for reviewing the jobs and workplaces where minor labor is currently working; they shall not assign minor labor to perform jobs or work at workplaces listed in this Circular.

2. Departments of Labor, Invalids and Social Affairs shall be responsible for:

a) Coordinating with Health Departments and local Trade Unions to regularly urge, inspect, and supervise the implementation of this Circular;

b) Strengthening inspections to promptly detect and handle violations of laws regarding the use of minor labor;

c) Annually compiling and reporting to the Ministry of Labor, Invalids and Social Affairs on the implementation of this Circular along with reports on occupational safety and health conditions in their respective areas.

Article 3.

1. This Circular takes effect from August 1, 2013.

2. Repeal Circular No. 09/TT-LB dated April 13, 1995 of the Joint Ministry of Labor, Invalids and Social Affairs - Health concerning harmful working conditions and jobs prohibited from using minor labor.

3. During the implementation process, if there are difficulties or obstacles, please report them to the Ministry of Labor, Invalids and Social Affairs for consideration and resolution./.
