Pursuant to the Labor Safety Law dated June 25, 2015;
Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Labor Safety Law on technical inspection activities for labor safety, training for labor safety, and environmental monitoring in the workplace;
dated November 12, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No.95/2012/NĐ-CP The Minister of Industry and Trade issues this Circular to promulgate 18 technical inspection procedures for machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade.
1. This Circular hereby promulgates 18 Technical Inspection Procedures for machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade (Technical Inspection Procedures). The names and codes of the Technical Inspection Procedures are listed in the Appendix to this Circular.
At the proposal of the Director of the Industrial Technical Safety and Environmental Protection Department,
2. This Circular applies to organizations and individuals related to technical inspection activities, management, ownership, and use of machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade.
2. Machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade that have been inspected before the effective date of this Circular shall continue to be valid until the expiration date recorded on the Certificate of Inspection Results. At the next inspection period, it must be carried out by an inspection organization certified by the Ministry of Industry and Trade as meeting the conditions for inspection.
Article 1. Scope of Regulation and Applicability
3. For machinery and equipment within operating production lines that cannot be separated for individual inspection, the periodic inspection cycle shall be determined according to the maintenance and repair schedule of the production line but not exceeding the time limit specified by the manufacturer or the corresponding national technical regulation. Organizations and individuals managing and using such machinery and equipment must maintain and be responsible for safe working conditions.
2. Technical inspection organizations for labor safety must develop detailed inspection procedures for each specific type of machinery and equipment without contravening the Technical Inspection Procedures and corresponding national technical regulations.
Article 2. Effective Date
1. This Circular takes effect from September 15, 2017.

Organizations and individuals related to technical inspection activities, management, ownership, and use of machinery, equipment, and materials with strict requirements for labor safety under the management authority of the Ministry of Industry and Trade are responsible for implementing this Circular.
Technical Inspection Procedure for Boiler Safety
Article 3. Implementation Organization
1. The Industrial Technical Safety and Environmental Protection Department is responsible for guiding and organizing the implementation of this Circular.
2. Technical safety organizations must develop detailed inspection procedures for each specific type of machine or equipment, but such procedures shall not contravene the corresponding inspection procedures and national technical standards.
