Pursuant to Decree No. 20/NĐ-CP dated February 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology/2013/Decree No. 26/2013/ND-CP dated February 26, 2013 of the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology of the Ministry of Science and Technology;

On the basis of Pursuant to Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;

Pursuant to Decree No. 11/2014/NĐ-CP dated February 18, 2014 of the Government on scientific and technological information activities;

At the proposal of the Director of the National Science and Technology Information Center and the Head of the Legal Department;

The Minister of Science and Technology issues this Circular stipulating the construction, management, exploitation, use, maintenance, and development of the National Database on Science and Technology.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

Article 2. This Circular does not apply to materials listed in the State secrets directory.

Article 2. Applicability

1. Ministries, ministerial-level agencies, other state agencies at the central level, People's Committees of provinces and centrally-administered cities (hereinafter referred to as ministries, sectors, localities), specialized agencies of ministries, sectors, and localities.

2. Organizations performing the function of focal point for scientific and technological information at the ministry and provincial levels.

3. Organizations and individuals engaged in scientific and technological activities in Vietnam.

4. Other organizations and individuals related to the construction, management, exploitation, use, maintenance, and development of the National Database on Science and Technology.

5. This Circular does not apply to the Ministry of Defense and the Ministry of Public Security.

Point 1. "Component database" is a part constituting the National Database on Science and Technology, including structured information reflecting the potential, results, and activities of science and technology.

Point 2. "Catalogue information" is information created and used to announce, introduce, and promote materials.

Point 3. "Full-text information" is catalogue information together with the full electronic text of relevant materials.

Point 4. "Information security" is the protection of information and information systems to ensure the integrity, accuracy of information, and continuous exploitation and use of information systems.

Clause 1. The National Database on Science and Technology includes the following component databases:

a) Database on Scientific and Technological Organizations;

b) Database on Scientific Research Personnel and Technological Development;

c) Database on Scientific and Technological Tasks;

d) Database on Scientific Publications and Citation Indices;

đ) Statistics Database on Science and Technology;

e) Database on Technology, High-Tech, and Technology Transfer;

g) Database on Science and Technology Information in the Region and Worldwide;

h) Database on Science and Technology Enterprises;

i) Database on Intellectual Property Information;

k) Standards, Measurement, and Quality Control Database.

Clause 2. Information from the National Database on Science and Technology serves as the official source of information for national, ministry, sector, and locality management, administration, policy planning on science and technology, scientific research and technological development, and application of technology by agencies, organizations, and individuals.

1. The National Database on Science and Technology shall be built and managed according to centralized and unified principles from central to local levels based on the specific authority and responsibility of relevant organizations and individuals.

4. Ensure the rights of organizations and individuals to access, exploit, and use information in the National Database on Science and Technology in compliance with legal provisions.

Article 6. Standards to be applied

1. Building the National Database on Science and Technology must ensure compatibility with the national information system architecture, meet database standards, and technical standards for information technology and economic-technical norms; compatibility, integration capacity, information sharing, and data field expansion capability in system design and application software.

2. Designing the structure of the National Database on Science and Technology must ensure expandability and development.

Article 7. Funding for building, maintaining, and developing the National Database on Science and Technology

1. Funding for building, maintaining, and developing the National Database on Science and Technology is guaranteed by the state budget allocated for science and technology (central budget, local budget) and mobilized from other funding sources.

2. Funding for building, maintaining, and developing the National Database on Science and Technology includes:

a) Investment in physical and technical infrastructure for building, maintaining, and developing the National Database on Science and Technology;

b) Ensuring the operation of the national research and training information network serving the National Database on Science and Technology;

c) Collecting, processing, updating, and integrating information into the National Database on Science and Technology;

d) Implementing activities to ensure safety, security, and information confidentiality.

3. Ministries, sectors, and localities must balance and allocate funds in their annual budgets in accordance with the provisions of the State Budget Law and guiding documents.

Chapter II

COMPONENT DATABASE OF

 THE NATIONAL DATABASE ON SCIENCE AND TECHNOLOGY

Article 8. Database on Science and Technology Organizations

1. The Database on Science and Technology Organizations is a collection of information and data about science and technology organizations, including the following main contents:

a) General information about the organization (Name, address, field of activity);

b) Information about human resources;

c) Information about operating funds;

d) Information about physical and technical infrastructure;

đ) Information about international cooperation;

e) Information about science and technology activities and achievements;

g) Information about intellectual property.

2. The Database on Science and Technology Organizations shall be centrally built and managed at the National Science and Technology Information Center, Ministry of Science and Technology. Organizations performing the role of primary information centers for science and technology at the ministry and provincial levels have the responsibility to update information about science and technology organizations under their ministries, sectors, and localities when there are changes.

Article 9. Database on Scientific Research and Technological Development Personnel

1. The database on scientific research and technological development personnel is a collection of information about personnel involved in scientific research and technological development activities, including the following main contents:

a) General information about personnel (Name, gender, year of birth, ethnicity, title, academic degree/rank, major studied, address, telephone number, fax, email);

b) Information about the workplace of personnel;

c) Information about professional qualifications and main fields of research;

d) Information about scientific and technological tasks led and participated in by personnel;

đ) Information about scientific and technological publications, inventions, and useful solutions.

2. The database on scientific research and technological development personnel is established and centrally managed at the National Science and Technology Information Center. Organizations performing the function of central information science and technology units at the ministry and provincial levels are responsible for updating information about scientific research and technological development personnel under their management into the national database on science and technology.

3. Non-public scientific research and technological development personnel are encouraged to provide information to organizations performing the function of central information science and technology units at the provincial level in their area for updating into the national database on science and technology.

Article 10. Database on Scientific and Technological Tasks

1. The database on scientific and technological tasks is a collection of information about ongoing scientific and technological tasks, results of task implementation, and information about the application of task implementation results as prescribed in Circular No. 14/2014/TT-BKHCN dated June 11, 2014, of the Minister of Science and Technology on the collection, registration, storage, and publication of information on scientific and technological tasks, including the following main contents:

a) Information about the name of the scientific and technological task;

b) Information about the leading organization, cooperating organizations, and supervising agency;

c) Information about the task leader and key participants;

d) Objectives and main content;

đ) Research field and socio-economic objectives;

e) Research methods;

g) Information about results and products;

h) Budget;

i) Start date; end date;

k) Task status (ongoing, completed, applied);

l) Application address and scale;

m) Application effectiveness;

n) Economic effectiveness;

o) Impact on economy, society, and environment.

2. The database on scientific and technological tasks is established and centrally managed at the National Science and Technology Information Center. Organizations performing the function of central information science and technology units at the ministry and provincial levels are responsible for updating information about scientific and technological tasks according to the classification specified in Circular No. 14/2014/TT-BKHCN dated June 11, 2014, of the Minister of Science and Technology on the collection, registration, storage, and publication of information on scientific and technological tasks.

Article 11. Database on Scientific Publications and Citation Indexes

1. The database on scientific publications and citation indexes is a collection of information about publications published in scientific and technological journals, serial publications, conference proceedings, and collections of scientific reports of Vietnam published both domestically and internationally.

2. The information processed and updated into the database includes bibliographic information and full-text publication information, including the following main contents:

a) Title information;

b) Author information;

c) Information about the leading organization and primary sponsor;

d) Content description and topic information;

đ) Reference information;

e) Information about the citation index;

g) Full text or link to the full text of the scientific publication.

3. The database on scientific publications and citation indexes is established and centrally managed at the National Science and Technology Information Center.

Article 12. Scientific and Technological Statistics Database

1. The Scientific and Technological Statistics Database is a collection of information and data compiled from the official results of surveys and statistical reporting systems on science and technology at the national level, including the following main contents:

a) Comprehensive statistical information on organizations engaged in scientific and technological activities;

b) Comprehensive statistical information on scientific and technological human resources;

c) Comprehensive statistical information on funds allocated for science and technology;

d) Comprehensive statistical information on scientific and technological tasks;

đ) Comprehensive statistical information on international cooperation and integration in science and technology;

e) Comprehensive statistical information on innovation;

g) Comprehensive statistical information on industrial property activities.

2. The Scientific and Technological Statistics Database is established and centrally managed by the National Science and Technology Information Center.

Article 13. Technology, High-Tech Technology, and Technology Transfer Database

1. The Technology, High-Tech Technology, and Technology Transfer Database is a collection of comprehensive information on technology, high-tech technology, and data on technology transfer in Vietnam, including the following main contents:

a) Information on technology and equipment;

b) Information on high-tech application projects; high-tech product production investment projects; high-tech incubation bases, high-tech enterprise incubation bases;

c) Information on technology transfer from foreign countries to Vietnam; technology transfer from Vietnam to foreign countries, and domestic technology transfer.

2. The Technology, High-Tech Technology, and Technology Transfer Database is established and centrally managed by the National Science and Technology Information Center.

Article 14. Database on Science and Technology Information in the Region and Worldwide

1. The Database on Science and Technology Information in the Region and Worldwide is a collection of comprehensive statistical information on the potential and activities of science and technology in ASEAN countries and globally, including the following main contents:

a) Comprehensive statistical information on research and development human resources;

b) Comprehensive statistical information on funds allocated for research and development;

c) Comprehensive statistical information on the results of research and development activities, scientific and technological publications, patents, and useful solutions;

d) Comprehensive statistical information on innovation activities.

2. The Database on Science and Technology Information in the Region and Worldwide is established and centrally managed by the National Science and Technology Information Center.

Article 15. Scientific and Technological Enterprise Database

1. The Scientific and Technological Enterprise Database is a collection of information on enterprises engaged in producing and trading products and goods formed from the results of scientific research and technological development that the enterprise legally owns or uses, and performing scientific and technological tasks; production, trade, and other services as prescribed by law, including the following main contents:

a) General information about the enterprise (Trading name, abbreviated name, English name, address, phone number, website, email, tax code, date of establishment);

b) Information on the type of enterprise;

c) Information on the main production and business areas;

d) Information on the fields of scientific and technological activities;

đ) Information on the enterprise's scientific research, technology incubation, and technology mastery activities;

e) Information on the enterprise's intellectual property;

g) Information on the enterprise's main scientific and technological products and services;

h) Information on the enterprise's registered capital and annual revenue;

i) Information on products and services formed from the results of the enterprise's scientific research and technological development; information on additional annual revenue from the application of new technologies;

k) Information on the enterprise's annual investment funds for scientific and technological activities;

l) Information on the enterprise's technology transfer activities.

2. The Scientific and Technological Enterprise Database is established, managed, operated, and developed by the Market Development and Scientific and Technological Enterprise Management Department under the Ministry of Science and Technology and is connected to the National Science and Technology Database.

1. The Intellectual Property Information Database is a collection of information on intellectual property activities in Vietnam, including the following component databases:

a) Industrial Property Information Disclosure Database;

b) Full-text Patent Database;

c) Database on Organizations and Individuals Representing Industrial Property Rights;

d) Database on Organizations and Individuals Meeting Conditions for Conducting Industrial Property Appraisal Activities.

2. The Intellectual Property Information Database is established, managed, operated, and developed at the National Office of Intellectual Property under the Ministry of Science and Technology, and connects publicly disclosed industrial property information with the National Science and Technology Database.

Article 17. Standard Measurement Quality Database

a) National Standards Directory Database;

b) National Technical Regulations Directory Database and Local Technical Regulations Directory Database;

c) Database on Inspection, Calibration, and Testing Organizations that have registered and been designated;

d) National Quality Award Database.

CONSTRUCTION, MANAGEMENT, PROCESSING AND UPDATING THE NATIONAL DATABASE ON SCIENCE AND TECHNOLOGY

The construction and management of the National Database on Science and Technology includes the following contents:

1. Construction and development of common technical infrastructure, software, and component databases of the National Database, ensuring uniform data connection and sharing throughout the system;

2. Collection, processing, and updating information into the component databases of the National Database on Science and Technology;

3. Compilation and integration of information from the component databases of the National Database on Science and Technology;

4. Management of access rights and update rights to information within the Database;

5. Monitoring and supervision of the use of the Database;

6. Ensuring security and safety;

7. Training human resources and supporting operation and exploitation of the Database.

Article 19. Responsibility for Updating Information into the National Database on Science and Technology

1. Organizations performing central and provincial science and technology information functions are responsible for organizing the updating of information from ministries, sectors, and localities, and bear responsibility for the content of the information updated into the National Database on Science and Technology.

2. Units assigned to construct, manage, and operate component databases are responsible for: Verifying and authenticating the content of information provided by central science and technology information organizations, other organizations, and individuals before updating it into the National Database on Science and Technology; implementing the updating of information they manage, and bearing responsibility for the content of the information updated into the National Database on Science and Technology.

Article 20. Technical Infrastructure for the National Scientific and Technological Database

The technical infrastructure for the National Scientific and Technological Database includes:

1. The national research and training information network (hereinafter referred to as the VinaREN network) is the core of the scientific and technological information infrastructure, connecting organizations performing central information functions on science and technology, and domestic research institutes and universities with the international scientific and technological community;

2. Data centers and server rooms ensuring technical standards for the operation of the National Scientific and Technological Database;

3. Digitalization and content creation systems;

4. Server systems (services, management);

5. Data backup and storage systems;

6. Information security and safety systems;

7. Equipment systems serving access, exploitation, and updating of information;

8. Software infrastructure base systems.

Measures to ensure safety for the National Scientific and Technological Database include:

1. Using encrypted channels and user authentication for the following activities: System administration login; application login; automatic data transmission between servers; data entry and editing;

2. Encrypting the transmission of the National Scientific and Technological Database;

3. Applying measures to ensure the authenticity and integrity protection of data in the National Scientific and Technological Database;

4. Implementing logging of information creation, modification, and deletion to serve system management and monitoring;

5. Establishing and maintaining a backup system to ensure continuous system operation;

6. Implementing other necessary measures to ensure the safety of the National Scientific and Technological Database.

Article 22. Use of Classification Tables

In the process of building, processing, and updating the National Scientific and Technological Database, relevant organizations and individuals shall use the following classification tables:

1. The statistical classification table for science and technology issued together with Decision No. 12/2008/QĐ-BKHCN dated September 4, 2008, of the Minister of Science and Technology;

2. The content classification table "Framework Subject Headings of the National Scientific and Technological Information System";

3. International patent classification tables (IPC), industrial design classification tables (Locarno Classification Table), trademark element classification tables in trademark registration (Vienna Classification Table), goods/services classification tables in trademark registration (Nice Classification Table), and other classification tables in the field of intellectual property;

4. National standard classification tables, national technical regulation classification tables, local technical regulation classification tables, and other classification tables in the field of measurement and quality standards.

Chapter IV

EXPLOITATION, USE, MAINTENANCE AND DEVELOPMENT OF THE NATIONAL SCIENTIFIC AND TECHNOLOGICAL DATABASE

Article 23. Exploitation and Use of the National Scientific and Technological Database

1. Organizations performing central information functions on science and technology at the ministry and provincial levels have the right to exploit the full text of the National Scientific and Technological Database according to their level of authority.

2. All organizations and individuals have the right to access and use free of charge the following information on the National Scientific and Technological Database:

a) Directory of scientific and technological organizations, scientific and technological enterprises;

b) Catalog information on: scientific and technological tasks; scientific and technological documents; intellectual property information; standardization, measurement, and quality information;

c) Aggregate statistical data on science and technology;

d) Comprehensive information on technology, high technology, and technology transfer in Vietnam;

e) Information on science and technology in the region and worldwide.

3. Organizations participating in collecting, processing, and updating information into the National Database may access and exploit the National Database according to their assigned permissions; they have the right to extract data directly contributed by them to organize into separate databases serving the needs of ministries, sectors, and localities.

4. State agencies managing science and technology are granted access to the National Scientific and Technological Database to serve state management, policy planning in science and technology.

5. State agencies, political organizations, and political-social organizations have the right to request provision of information on science and technology related to state management, economic and social development requirements, national defense and security assurance, and international integration.

Article 24. Maintaining and Developing the National Scientific and Technological Database

1. Management agencies and agencies, organizations participating in building and operating the National Scientific and Technological Database shall be responsible for arranging human resources, material infrastructure and ensuring regular funding for maintaining and developing the National Scientific and Technological Database.

2. Developing information infrastructure and technical material infrastructure to meet domestic usage needs and international connectivity

a) Investing in modernizing technical infrastructure, national data centers compatible with international standards;

b) Researching and applying information technology in management, exploitation, and utilization of databases;

c) Researching and developing database software to ensure unified data connection and sharing nationwide and compatibility with international data standards.

3. Developing information content to meet management, research, and training requirements on science and technology

a) Researching and developing data structure and criteria of the National Database and component databases;

b) Developing other component databases suitable for scientific and technological development requirements.

4. Training a workforce to serve the construction of the National Database and component databases.

Article 25. Operation, Maintenance, Monitoring, and Upgrading of Technical Infrastructure and Software of the National Scientific and Technological Database

The operation, maintenance, monitoring, and upgrading of the National Scientific and Technological Database include the following contents:

1. Implementing measures to ensure physical safety and environment at electronic data centers;

2. Implementing backup measures to ensure system recovery capability when incidents occur. Backup data must be securely protected, regularly checked, and system restoration tested from backup data to be ready for use when necessary;

3. Implementing maintenance, repair measures to ensure the National Scientific and Technological Database operates continuously 24 hours a day;

4. Conducting monitoring activities to warn against actions causing loss of security in the National Scientific and Technological Database;

5. Regularly reviewing and proposing upgrade and development plans for the technical infrastructure and software of the National Scientific and Technological Database to meet actual needs.

Chapter V

RESPONSIBILITIES OF MINISTRIES, SECTORS AND LOCALITIES

Article 26. Responsibilities of the Ministry of Science and Technology

1. The Ministry of Science and Technology is the state management agency for the National Scientific and Technological Database.

2. The National Science and Technology Information Center assists the Minister of Science and Technology in performing state management responsibilities for the National Scientific and Technological Database, including:

a) Establishing regulations to ensure safety, security, backup, and data confidentiality policies of the National Scientific and Technological Database;

c) Managing administrative accounts of the National Scientific and Technological Database;

d) Specifying technical regulations, update permissions, exploitation, and use of the National Scientific and Technological Database;

đ) Leading the organization to implement the construction, updating, and integration of data and information into the National Scientific and Technological Database;

e) Coordinating with units assigned to build, manage, and operate component databases to ensure compatibility between the component database management system and the National Scientific and Technological Database management system. Inspecting the implementation of management, exploitation, and use regulations of the National Scientific and Technological Database by organizations participating in building, managing, and operating component databases;

g) Summarizing and updating the situation of management, exploitation, and use of the National Scientific and Technological Database throughout the country;

h) Training staff to construct and exploit the National Scientific and Technological Database.

3. The Market Development and Science and Technology Enterprise Management Department, Intellectual Property Department, and General Bureau of Standards Metrology and Quality Control will build, manage, and operate component databases as stipulated in Articles 15, 16, and 17 of this Circular.

Article 27. Responsibilities of Ministries and Sectors

1. Coordinate with the Ministry of Science and Technology to build and manage the National Database on science and technology within their respective areas of management.

3. Ensure material infrastructure, equipment, and allocate funds in annual budgets for organizations performing the central information function for science and technology at the ministry level to implement data collection, digitization, processing, and updating into the National Database on science and technology.

Article 28. Responsibilities of Organizations Performing the Central Information Function for Science and Technology at the Ministry Level

1. Responsibility for building and managing the National Database on science and technology

a) Participate in building and updating the National Database on science and technology;

b) Implement measures to manage access and update information within their scope of management to ensure safety and security for the National Database on science and technology system and technical information infrastructure.

a) Collect, process, and update information about science and technology organizations under the ministry or sector;

b) Collect, process, and update information about scientific research and technological development personnel within the scope of management of the ministry or sector;

c) Collect, process, update, and integrate data on science and technology tasks using state budget funds as prescribed in Circular No. 14/2014/TT-BKHCN dated June 11, 2014, issued by the Minister of Science and Technology regarding the collection, registration, storage, and publication of information on science and technology tasks.

3. Ensure the security of the administrative account for the National Database on science and technology provided.

Article 29. Responsibilities of People's Committees of Provinces and Central Cities

1. Coordinate with the Ministry of Science and Technology to build and manage the National Database on science and technology within their respective areas of management.

2. Direct the Department of Science and Technology to participate in building, updating, and managing the National Database on science and technology. Direct subordinate units to strictly fulfill the responsibility of providing relevant information about organizations, human resources, and science and technology tasks to organizations performing the central information function for science and technology at the provincial level.

3. Ensure that complete and accurate information about organizations, human resources, and science and technology tasks is updated into the National Database on science and technology.

4. Ensure material infrastructure, equipment, and allocate funds in annual budgets for the Department of Science and Technology to implement the construction, updating, maintenance, and development of the National Database on science and technology.

Article 30. Responsibilities of Provincial Science and Technology Departments

1. Coordinate with the National Scientific and Technological Information Center to build and manage the National Scientific and Technological Database according to分级和职能。

2. Direct the implementation of provincial-level scientific and technological information focal point functions to participate in building, updating, and managing the National Scientific and Technological Database.

3. Inspect and supervise the implementation of regulations on building, updating, managing, exploiting, and using the National Scientific and Technological Database within their province.

4. Ensure funding in the annual budget for organizations implementing provincial-level scientific and technological information focal point functions to carry out tasks of collecting, digitizing, processing, and updating information into the National Scientific and Technological Database.

Article 31. Responsibilities of Organizations Implementing Provincial-Level Scientific and Technological Information Focal Point Functions

1. Responsibility for building and managing the National Database on science and technology

a) Participate in building and updating the National Scientific and Technological Database on the VinaREN network platform;

b) Implement measures to manage access and update information within their scope of management to ensure safety and security for the National Database on science and technology system and technical information infrastructure.

2. Responsibility for collecting, processing, updating, and integrating data into the National Database on science and technology

a) Collect, process, and update information about scientific and technological organizations at the local level;

b) Collect, process, and update information about researchers conducting scientific and technological tasks funded by the state budget at the local level;

c) Collect, process, update, and integrate data on science and technology tasks using state budget funds as prescribed in Circular No. 14/2014/TT-BKHCN dated June 11, 2014, issued by the Minister of Science and Technology regarding the collection, registration, storage, and publication of information on science and technology tasks.

3. Ensure the security of the administrative account for the National Database on science and technology provided.

Article 32. Responsibilities of Organizations and Individuals Participating in Scientific and Technological Activities

1. Public scientific and technological organizations have the responsibility to provide and update information about their organizational and human resources for scientific and technological organizations implementing focal point information functions according to分级，to be updated into the National Scientific and Technological Database.

2. Researchers from public scientific and technological organizations conducting scientific and technological tasks funded by the state budget have the responsibility to provide and update personal information for organizations implementing focal point information functions for inclusion in the National Scientific and Technological Database.

Chapter VI

IMPLEMENTATION

Article 33. Implementation Provisions

1. This Circular takes effect from August 15, 2017.

2. In cases where the referenced documents in this Circular are replaced, amended, or supplemented, the new documents shall be applied.

Article 34. Responsibility for Implementation

1. Ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Circular.

2. During the implementation process, if difficulties arise, agencies, organizations, and individuals are advised to report to the Ministry of Science and Technology for research, amendment, and supplementation as appropriate./.
