REGULATIONS ON THE TEMPLATE FOR GRADUATION CERTIFICATES OF VOCATIONAL COLLEGES AND COLLEGES; PRINTING, MANAGEMENT, ISSUANCE, RECALL, REVOCATION OF GRADUATION CERTIFICATES OF VOCATIONAL COLLEGES AND COLLEGES

Pursuant to the Law on Vocational Education dated November 27, 2014;

Pursuant to Decree No. 14/2017/NĐ-CP dated February 17, 2017, of the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids, and Social Affairs;

At the proposal of the Director General of the Vocational Education Department,

The Minister of Labor, Invalids and Social Affairs issues this Circular to regulate the template for graduation certificates of vocational colleges and colleges; printing, management, issuance, recall, revocation of graduation certificates of vocational colleges and colleges.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

1. This Circular regulates the template for graduation certificates of vocational colleges and colleges; the printing, management, issuance, recall, and revocation of graduation certificates of vocational colleges and colleges.

2. This Circular applies to vocational colleges, college institutions, and higher education institutions that have registered to offer college-level training programs (hereinafter referred to as "institutions").

Article 2. Principles of Management and Issuance of Graduation Certificates of Vocational Colleges and Colleges

1. Graduation certificates of vocational colleges and colleges (hereinafter referred to as "graduation certificates") shall be uniformly managed, with institutions granted autonomy and responsibility according to Clause 3 of Article 21 of this Circular.

2. The original graduation certificate shall be issued only once. In cases where a graduation certificate has been issued to students but errors in writing or printing are discovered due to the institution's fault, the issuing institution shall be responsible for reissuing the certificate to the student.

3. All fraudulent acts in the issuance and use of graduation certificates are strictly prohibited.

4. Transparency and fairness must be ensured in the issuance of graduation certificates.

Chapter II
TEMPLATE FOR GRADUATION CERTIFICATE; PRINTING, MANAGEMENT, ISSUANCE,
RECALL, REVOCATION OF GRADUATION CERTIFICATE

Article 3. Template for Graduation Certificate

The graduation certificate shall be printed on both sides, consisting of four (4) pages, each page measuring 190 mm x 135 mm, using Times New Roman font. The front side includes pages 1 and 4 with a red background; the back side includes pages 2 and 3 with a yellow background, bordered with dark yellow patterns.

Article 4. Printing of Graduation Certificates

1. Universities have autonomy and are responsible for printing and managing graduation certificate forms in accordance with this Circular.

2. Based on the model of graduation certificates prescribed in this Circular, the principals of vocational colleges, college-level institutions, and heads of higher education establishments that have registered to offer college-level training programs (hereinafter referred to as principals) shall approve their institution's graduation certificate form and send it to the General Department of Vocational Education and Training, Provincial Departments of Labor, Invalids and Social Affairs, provincial public security agencies where the school's main office is located for reporting; they are responsible for the content printed on the graduation certificate forms and organizing the printing of such forms.

3. The printing of graduation certificate forms must be strictly secured, safe, confidential, and must be recorded in a management ledger.

Article 5. Management of Graduation Certificates

1. When issuing graduation certificates to students, schools must establish a graduation certificate issuance ledger according to the prescribed model, clearly recording the serial number and entry number in the graduation certificate issuance ledger. The establishment of serial numbers and entry numbers in the graduation certificate issuance ledger shall be carried out as follows:

a) The serial number printed on the graduation certificate form shall be continuously established in ascending natural order throughout the entire operation of the school from the time it begins self-printing of graduation certificate forms, ensuring differentiation of serial numbers for each type of graduation certificate.

b) The entry number in the graduation certificate issuance ledger shall be continuously established in ascending natural order annually from January 1 to December 31, ensuring differentiation of entry numbers for each type of graduation certificate, year of issuance, and issuing school.

2. For damaged, incorrectly written, substandard quality, unused graduation certificate forms due to changes in the form template, the principal must convene a committee to handle the situation and record the cancellation in a protocol, clearly stating the quantity, serial number, and condition of the graduation certificate forms before cancellation. The cancellation protocol must be stored in the file for monitoring and management, and the cancellation must be reported to the Provincial Department of Labor, Invalids and Social Affairs where the school's main office is located within fifteen days from the date of cancellation for monitoring and management.

This provision also applies to graduation certificates that are incorrectly written or printed, already signed and stamped.

3. In cases where graduation certificate forms are lost, schools are responsible for recording and immediately notifying the local Public Security Agency and Provincial Department of Labor, Invalids and Social Affairs where the school's main office is located for prompt handling.

Article 6. Responsibilities of Principals of Schools in Printing, Issuing, and Managing Graduation Certificates

1. Enact regulations on the printing process, management of printing, storage, confidentiality, use of graduation certificate forms, and management of issuance of graduation certificates; inspect and audit the printing, storage, use of forms, and issuance of certificates, specifying the responsibilities of each unit and individual and penalties for violations to be uniformly applied within the school.

2. Establish files for managing the printing, use, issuance, recovery, and cancellation of graduation certificate forms.

3. Appoint dedicated staff to manage and issue graduation certificates.

4. Ensure safety and fire prevention measures for the printing and management of graduation certificate forms in accordance with the law.

5. Ensure material resources and equipment for printing and fire prevention to store graduation certificate forms.

6. Define identification symbols for graduation certificate forms printed by the school to serve the purpose of confidentiality, identification, and counterfeiting prevention.

7. Specify the establishment of serial numbers and entry numbers in the graduation certificate issuance ledger as required under Clause 1 of Article 5 of this Circular. Ensure that each serial number is recorded only once on one graduation certificate form; each entry number in the graduation certificate issuance ledger is recorded only once on one issued graduation certificate.

8. Regularly direct the implementation of inspections and audits of activities related to printing, management, use of forms, and issuance of graduation certificates for units assigned tasks within the school.

9. Build a database system for managing issued graduation certificates and publicly announce information about graduation certificate issuance on the electronic information website.

10. Personally bear responsibility before state management agencies when violations occur in the activities of printing, managing, using forms, and issuing graduation certificates at the school.

11. Report in writing to the directly managing agency of the school, the Provincial Department of Labor, Invalids and Social Affairs where the school's main office is located before January 10 of the following year on the progress of printing and using graduation certificate forms; the quantity of printed graduation certificate forms, the quantity of used graduation certificate forms, and the number of issued graduation certificates in the year.

Article 7. Time limit for issuing graduation certificates

1. The rector shall be responsible for organizing the issuance of graduation certificates to students who meet the conditions for receiving such certificates within thirty working days from the date of completion of the final examination or defense of the graduation thesis (for educational institutions operating on a fixed-term system) or the last course or module in the training program (for educational institutions operating on a modular or credit accumulation system).

2. During the waiting period for the issuance of graduation certificates, students who meet the conditions for receiving such certificates shall be issued a temporary graduation certificate by the rector.

Article 8. Original Graduation Certificate Book

1. The original graduation certificate book is a document established by the school issuing the graduation certificate when issuing the original graduation certificate, recording all contents in Vietnamese as those recorded in the original graduation certificate issued by that school.

2. The original graduation certificate book must be accurately recorded, numbered, stamped with a cross-stamp, and not erased, ensuring strict management and permanent storage.

3. The format of the original graduation certificate book is specified in Appendix 3 attached to this Circular.

Article 9. Signing and Stamping of Graduation Certificates

1. When signing graduation certificates, rectors of schools must sign according to the model of signature already notified to the competent authority and clearly record their full name and position.

2. In cases where the competent authority has not appointed a rector, the vice-rector entrusted to manage the school shall have the authority to sign the graduation certificates.

3. The stamping on the signature of the authorized person issuing the graduation certificate shall be carried out in accordance with current regulations on archival work.

Article 10. Authority to Decide on Amendments to the Content of Graduation Certificates

The authority to decide on amendments to the content of graduation certificates is the rector of the school that issued the graduation certificate and manages the original graduation certificate book. In cases where the school issuing the graduation certificate has been merged, divided, or had its authority adjusted, the authority to decide on amendments to the content of graduation certificates is the head of the agency currently managing the original graduation certificate book.

Article 11. Cases for Amending the Content of Graduation Certificates

The person holding a graduation certificate has the right to request amendments to the content recorded on the graduation certificate in the following cases:

1. Being decided or confirmed by the competent authority regarding changes or corrections to household registration, determination of nationality, or determination of gender.

2. Being supplemented or adjusted by the competent authority regarding household registration, delayed birth registration, or re-registration of birth as prescribed by law.

Article 12. Documents, Procedures, and Formalities for Amending the Content of Graduation Certificates

1. Application documents for amending graduation certificates:

a) An application form for amending graduation certificates, in accordance with the model specified in Appendix 4 attached to this Circular;

b) The graduation certificate to be amended;

c) A decision allowing changes or corrections to household registration, determination of nationality, or determination of gender for cases of amending graduation certificates due to changes or corrections to household registration, determination of nationality, or determination of gender;

d) Birth certificate for cases of amending graduation certificates due to supplementation or adjustment of household registration, delayed birth registration, or re-registration of birth;

đ) Identity card, passport, or other valid identification documents with photographs of the person holding the graduation certificate;

e) The documents in the application for amending graduation certificates specified in points b, c, d, and đ of this clause may be unauthenticated copies, copies from the original book, or authenticated copies from the original;

g) If the institution with the authority to amend the content of graduation certificates receives unauthenticated copies in the application documents, it may require the applicant to present the original for verification; the verifier must sign and clearly record their name on the copy and bear responsibility for the accuracy of the copy compared to the original;

h) If the institution with the authority to amend the content of graduation certificates receives copies from the original book or authenticated copies from the original, it shall not require presentation of the original for verification. In case there are signs indicating that the copy is forged, it may verify the authenticity.

2. Procedures and formalities for amending graduation certificates are as follows:

a) The applicant for amending graduation certificates submits one set of application documents in accordance with Clause 1 of this Article to the institution with the authority to amend the content of graduation certificates. Submission can be made either directly or through postal service;

b) Within five working days from the date of receipt of complete and valid application documents, the institution with the authority to amend the content of graduation certificates shall examine and decide on the amendment; if no amendment is made, it must respond in writing and specify the reasons;

c) The amendment to the content of graduation certificates shall be carried out by a decision to amend; direct amendment on the graduation certificate is not allowed;

Based on the decision to amend, the institution with the authority to amend the content of graduation certificates shall proceed to amend the corresponding content recorded in the original graduation certificate book.

3. The main content of the decision to amend graduation certificates includes:

a) Full name, date of birth of the holder of the graduation certificate being amended;

b) Name, number, and date of issue of the graduation certificate being amended;

c) Content of the amendment;

d) Reason for the amendment;

đ) Effectiveness and responsibility for implementing the decision.

Article 13. Revocation and cancellation of graduation certificates

1. Graduation certificates shall be revoked and cancelled in the following cases:

a) Engaging in fraudulent activities during enrollment, study, examination, defense of thesis or graduation project, or in the preparation of documents to obtain a graduation certificate;

b) Issuing to individuals who do not meet the required conditions;

c) Issued by persons without authority to do so;

d) The graduation certificate has been erased or altered.

đ) Used by another person.

2. The school that issued the graduation certificate has the authority and responsibility to revoke and cancel the graduation certificate; if the school issuing the graduation certificate has merged, split, separated, or dissolved, then the agency currently managing the original record of issuance of the graduation certificate has the authority to revoke and cancel the graduation certificate.

Article 14. Public announcement of information on the issuance of graduation certificates on electronic websites

1. The public announcement of information on the issuance of graduation certificates on electronic websites aims to ensure transparency in training and issuance of graduation certificates by schools; facilitate the inspection and supervision of the issuance of graduation certificates by agencies, organizations, and individuals; reduce fraudulent and negative practices in the issuance of graduation certificates; prevent the use of fake graduation certificates.

2. Information publicly announced about the issuance of graduation certificates must accurately reflect the contents recorded on the original records of issuance of graduation certificates, and must be regularly updated and stored on the electronic website of the school that issued the graduation certificate; ensuring easy management, access, and search.

3. In cases where the graduation certificate is amended, revoked, or cancelled, such actions must also be publicly announced on the electronic website of the school that amended, revoked, or cancelled the graduation certificate.

Chapter III
ISSUANCE OF COPIES OF GRADUATION CERTIFICATES FROM ORIGINAL RECORDS

Article 15. Copies of graduation certificates from original records

Issuance of copies of graduation certificates from original records is the act of schools managing the original records basing on the original records to issue copies. The contents recorded in the copies of graduation certificates from original records must be accurate compared to the original records.

Article 16. Legal effect of copies of graduation certificates issued from original records

1. Copies of graduation certificates issued from original records have the same legal effect as the originals in transactions, except where otherwise provided by law.

2. Agencies and organizations receiving copies of graduation certificates issued from original records shall not require the presentation of the original for comparison, unless there is evidence of forgery or illegality of the copy, in which case they may request the presentation of the original for comparison or conduct verification if deemed necessary.

Article 17. Authority and responsibility for issuing copies of graduation certificates from original records

Schools managing the original records of graduation certificates have the authority and responsibility to issue copies of graduation certificates from original records. The issuance of copies of graduation certificates from original records can be carried out simultaneously with the issuance of the original or after the issuance of the original.

Article 18. Persons entitled to request copies of graduation certificates from original records

The following persons are entitled to request copies of graduation certificates from original records:

1. The person who received the original graduation certificate.

2. The legal representative or authorized representative of the person who received the original graduation certificate.

3. Father, mother, child; wife, husband; full brother, sister, or sibling; heir of the person who received the original graduation certificate in the event that person has died.

Article 19. Procedure for Issuing Copies of Graduation Certificates from Original Registers

1. The person requesting a copy of a graduation certificate from the original register must submit a request form for a copy of a graduation certificate according to the model prescribed in Appendix 4 attached to this Circular, and present a valid identity card, passport, or citizen identification card for the file receptionist to verify.

In cases where the person requesting a copy of a graduation certificate from the original register is as defined in Clauses 2 and 3 of Article 18 of this Circular, in addition to the aforementioned documents, they must also present documents proving their relationship with the person who received the original graduation certificate.

2. In cases where the person requesting a copy of a graduation certificate from the original register sends a request to receive the result through postal service, in addition to the file as prescribed in Clause 1 of this Article, they must send one (01) envelope with postage stamps clearly indicating the name, address, and contact phone number of the recipient.

3. The school managing the original register for issuing graduation certificates shall issue a copy of a graduation certificate based on the original register for the person requesting it; the content of the copy of the graduation certificate must be recorded exactly as stated in the original register. In cases where the original register cannot be stored or does not contain information about the requested content, the school has the responsibility to respond in writing to the person requesting it.

4. In cases where a copy of a graduation certificate from the original register is not issued to the person requesting it, the school must respond in writing and specify the reasons.

5. The time limit for issuing copies of graduation certificates from the original register shall be implemented as follows:

a) To be completed within a period not exceeding five working days after the school receives a complete and valid file;

b) For cases requiring multiple copies of graduation certificates, where the content of the graduation certificate is complex and difficult to check and compare, and the school cannot meet the time limit prescribed in point a of this clause, the issuance period may be extended but not more than three additional working days.

6. The person requesting a copy of a graduation certificate from the original register must pay the fee for issuing a copy.

7. The fee for issuing copies of graduation certificates from the original register shall be implemented in accordance with the guidelines of the Ministry of Finance and the Ministry of Justice regarding the level of collection, payment, management, and use of fees for issuing copies.

Article 20. Register for Issuing Copies and Management of Issuing Copies of Graduation Certificates from Original Registers

1. The register for issuing copies of graduation certificates from the original register is a document established by the school authorized under Article 17 of this Circular when implementing the issuance of copies of graduation certificates from the original register, recording all contents of the copies that the school has issued.

2. The register for issuing copies of graduation certificates from the original register must be accurately recorded, numbered, stamped, and not erased or altered, ensuring strict management and permanent storage.

3. Each time a copy of a graduation certificate from the original register is issued, it must be recorded in the register for issuing copies of graduation certificates from the original register; each entry in the register for issuing copies must be numbered, ensuring that each entry in the register corresponds uniquely to one issued copy of a graduation certificate.

4. Entries in the register for issuing copies of graduation certificates are made continuously in numerical order from smallest to largest each year from January 1 to December 31; ensuring differentiation between entries in the register for issuing copies of different types of graduation certificates, years of issuance, and identifying the issuing school.

Chapter IV
IMPLEMENTATION

Article 21. Classification and Management of Graduation Certificates

1. The Ministry of Labor - Invalids and Social Affairs shall uniformly manage graduation certificates; specify the model, printing, management, issuance, recovery, and cancellation of graduation certificates.

2. Provincial Departments of Labor - Invalids and Social Affairs under the Central Government shall be responsible for managing the printing, use of blanks, issuance of graduation certificates of schools whose main offices are located within their jurisdictions.

3. Schools shall independently manage and be responsible for printing blanks, managing, and issuing graduation certificates in accordance with the regulations of the Minister of Labor - Invalids and Social Affairs.

Article 22. Effectiveness

1. This Circular takes effect from April 26, 2017.

2. Ministries, ministerial-level agencies, governmental agencies, provincial People's Committees under the Central Government, Political-Social Organizations, the General Department of Vocational Education, Departments of Labor - Invalids and Social Affairs, secondary vocational schools, colleges, higher education institutions that have registered to offer college-level training programs, and related agencies, organizations, and individuals shall be responsible for implementing this Circular./.

(1) Record the title of the head of the school issuing the graduation certificate in Vietnamese; all capital letters, font size 14, upright typeface, bold.

(2) Record the name of the school issuing the graduation certificate in Vietnamese; all capital letters, font size 13, upright typeface, bold.

(3) Record the name of the training profession according to the Certificate of Registration for Vocational Education Activities issued by the school, based on the fourth-level training profession code, in Vietnamese; lowercase letters, font size 14, upright typeface, bold.

(4) Record the full name of the graduate according to the birth certificate; lowercase letters, font size 14, upright typeface, bold.

(5) Record "Male" or "Female" according to the birth certificate in Vietnamese; lowercase letters, font size 14, upright typeface, bold.

(6) Record the date of birth according to the birth certificate. If the day of birth is from the 1st to the 9th, and the month is January or February, add a leading zero; record the year of birth fully with four digits (Example: 07/02/1981); lowercase letters, font size 14, upright typeface, bold.

(7) Record "Excellent", "Good", "Fair", "Passing" or "Pass"; lowercase letters, font size 14, upright typeface, bold.

(8) Record "Regular" or one of the forms "Part-time", "Distance Learning", "Self-study with Guidance"; lowercase letters, font size 14, upright typeface, bold.

(9) Record the name of the province or centrally-administered city where the school issuing the graduation certificate has its main office; lowercase letters, font size 14, italic typeface.

(10) Record the date of issuance of the graduation certificate; lowercase letters, font size 14, italic typeface.

(11) Record the title of the head of the school issuing the graduation certificate in Vietnamese, all capital letters, font size 14, upright typeface, bold; the head of the school issuing the graduation certificate signs, writes his/her full name clearly, and stamps according to regulations.

(12) The school issuing the graduation certificate prints the blank when issuing the blank.

(13) The school issuing the graduation certificate records in the original book of graduation certificates when issuing the graduation certificate.

(14) Record the title of the head of the school issuing the graduation certificate in English; all capital letters, font size 14, upright typeface, bold.

(15) Record the name of the school issuing the graduation certificate in English; all capital letters, font size 13, upright typeface, bold.

(16) Record the name of the training profession according to the Certificate of Registration for Vocational Education Activities issued by the school, based on the fourth-level training profession code, in English; lowercase letters, font size 14, upright typeface, bold.

(17) Record the full name as recorded at point (4) in Vietnamese but without diacritical marks. Before the name, if male, write "Mr", if female, write "Ms"; lowercase letters, font size 14, upright typeface, bold.

(18) Record the date and year in figures, the month in English words. (For example, Vietnamese records "07/10/2018" then English records "07 October 2018"); lowercase letters, font size 14, upright typeface, bold.

(19) Record "Excellent" for "Outstanding", "Very Good" for "Good", "Good" for "Fair", "Average Good" for "Passing", "Ordinary" for "Pass"; lowercase letters, font size 14, upright typeface, bold.

(20) "Regular" is recorded as "Full-time", "Part-time" for "Part-time", "Distance Learning" for "Distance Learning", "Guided Self-learning" for "Self-study with Guidance"; font size 14, upright typeface, bold.

(21) Record the name of the province or centrally-administered city where the school has its main office in English (For example, Vietnamese records "Hanoi" then English records "Hanoi"); lowercase letters, font size 14, italic typeface.

(22) Record the date and year in figures, the month in English words. (For example, Vietnamese records "day 07/10/2018" then English records "07 October 2018"); lowercase letters, font size 14, italic typeface.

(23) Stamp the school's embossed seal.

(24) Depending on the training profession, record "TRADE LICENSEE" or "TRADE ENGINEER"; all capital letters, font size 12, upright typeface, bold.

Note:

- If the graduate is a foreigner, record the information at points (4), (5), (6), (17), (18) based on the passport.

- If the contents on the graduation certificate are handwritten, the school issuing the graduation certificate shall adjust the font size appropriately to ensure compliance with regulations and aesthetic standards.
