CIRCULAR
Regulations on the criteria for the position of Director and Deputy Director of Education and Training under the People's Committee of districts, towns, cities under provinces, and cities directly under the central government
The Government promulgates this Decree amending and supplementing certain provisions of the Decree No. 148/2016/NĐ-CP dated October 4, 2016 of the Government guiding the implementation of certain provisions of the Market Management Ordinance.
Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government stipulating the functions, tasks, powers and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 127/2018/NĐ-CP dated September 21, 2018 of the Government stipulating responsibilities for state management of education;
At the proposal of the Director of the Department of Teachers and Educational Management Staff;
The Minister of Education and Training issues this Circular to regulate the criteria for the positions of Director and Deputy Director of Education and Training under the People's Committee of districts, towns, cities under provinces, and cities directly under the central government.
Article 1. Scope of Regulation and Applicability
1. This Circular sets out the criteria for the positions of Director and Deputy Director of Education and Training (hereinafter referred to collectively as Director and Deputy Director) under the People's Committee of districts, towns, cities under provinces, and cities directly under the central government (hereinafter referred to collectively as the People's Committee at the district level).
2. This Circular applies to:
a) Civil servants and officials who are considered for appointment to the positions specified in Clause 1 of Article 1 hereof;
b) Agencies, units, localities, and individuals related to the appointment, reappointment, removal, planning, training, and development of the positions specified in Clause 1 of Article 1 hereof;
c) Authorities with the competence to inspect, examine, and supervise the appointment, reappointment, removal, planning, training, and development of the positions specified in Clause 1 of Article 1 hereof.
Article 2. Principles of Application
1. The criteria for the positions of Director and Deputy Director stipulated in this Circular serve as the basis for authorities with the competence to inspect, examine, and supervise the appointment, reappointment, removal, planning, training, and development of the positions specified in Clause 1 of Article 1 of this Circular.
2. Civil servants and officials who are considered for appointment to the positions specified in Clause 1 of Article 1 of this Circular must meet the general criteria and specific criteria for each position as prescribed herein and other relevant laws.
Article 3. General Criteria for Directors and Deputy Directors
1. Proficient in the Party’s policies and guidelines, state policies and laws on education and training and related fields to apply them in leading and managing the education sector locally. Setting a good example in morality and lifestyle, complying with the Party’s policies and state laws.
2. Possessing forecasting ability, strategic thinking, development orientation, and practical summary skills; management change capability, information processing and communication skills in education and training.
3. Having advisory capabilities for the People's Committee at the district level and the Chairman of the People's Committee at the district level in formulating and implementing policies on education and training; capability to organize the implementation of tasks within the scope of state management of education by the Department of Education and Training as prescribed to address issues in education and training locally.
4. Possessing the ability to unite the masses, internal solidarity, democratic implementation; building a cultural working environment, promoting the creativity of members in the Department of Education and Training and subordinate educational institutions.
5. Possessing the ability to coordinate with relevant agencies, organizations, and individuals to effectively perform assigned tasks.
6. Graduated from a pedagogical university or a university and hold a certificate in pedagogical vocational training.
7. Holding a certificate in training for the position of Director and Deputy Director of Education and Training as prescribed by the Ministry of Education and Training.
8. Having at least five years of work experience in the education sector.
Article 4. Criteria for the title of Department Head
1. Ensuring the criteria stipulated in Article 3 of this Circular.
2. Have served in the position of Deputy Department Head for Education and Training or equivalent; Principal of an educational institution or equivalent.
3. Approved by the competent authority for the planning of the title of Department Head or equivalent.
Article 5. Criteria for the title of Deputy Department Head
1. Ensuring the criteria stipulated in Article 3 of this Circular.
2. Have served in the position of Principal or Deputy Principal of an educational institution or equivalent; Civil Servant at the Specialist Rank.
3. Approved by the competent authority for the planning of the title of Deputy Department Head or equivalent.
Article 6. Provisions on Application
1. Cadres, civil servants, and public officials who are considered for planning the title of Department Head or Deputy Department Head must meet the criteria according to the Party and State's planning guidelines and the criteria stipulated in Clauses 1, 2, 3, 4, 5, 6, and 8 of Article 3 of this Circular. Cadres, civil servants, and public officials who are considered for appointment to the title of Department Head or Deputy Department Head must meet the criteria stipulated in Article 3 of this Circular.
2. Based on the criteria stipulated in this document, the People's Committee of the district, the Chairman of the People's Committee of the district, and the Department of Education and Training shall implement planning, training, and development, and consider appointment, reappointment, and removal from the title of Department Head or Deputy Department Head.
3. This Circular does not apply to women aged 50 or older and men aged 55 or older currently holding the title of Department Head or Deputy Department Head. For female Department Heads or Deputy Department Heads under 50 years old or male Department Heads or Deputy Department Heads under 55 years old who have not fully met the criteria, during their term of appointment, they must ensure that they fully meet the criteria as prescribed in this Circular.
Article 7. Effective Date
This Circular takes effect from September 30, 2019.
Article 8. Responsibility for Implementation
The Chairmen of the People's Committees of provinces and centrally governed cities, the Director of the General Office of Teachers and Educational Management Staff of the Ministry of Education and Training, and related organizations and individuals are responsible for implementing this Circular.
