Based on Decree No. 44/2019/NĐ-CP dated May 20, 2019 of the Government adjusting pensions, social insurance benefits, and monthly allowances (hereinafter referred to as Decree No. 44/2019/NĐ-CP);
Based on Decree No. 89/2020/NĐ-CP dated August 4, 2020 of the Government stipulating the functions, tasks, powers, and organizational structure of the Vietnam Social Security.
Considering the proposal of the Director of the Social Insurance Department;
The Minister of Labor - Invalids and Social Affairs issues this Circular guiding the adjustment of pensions, social insurance benefits, and monthly allowances for the subjects specified in Clauses 1, 2, 3, and Clause 8 of Article 1 of Decree No. 44/2019/NĐ-CP dated May 20, 2019 of the Government

Article 1. Scope of application
Article 2. Adjustment of Pensions, Social Insurance Benefits, and Monthly Allowances
As of July 1, 2019, the level of pensions, social insurance benefits, and monthly allowances of the subjects specified in Article 1 of this Circular shall be increased by 7.19% compared to the level of pensions, social insurance benefits, and monthly allowances in June 2019. Specifically:

1. Provincial People's Committees directly under the Central Government are responsible for directing the Departments of Labor - Invalids and Social Affairs and relevant agencies to publicize, disseminate, inspect, and urge the implementation of the provisions of this Circular. |

Article 3. Implementation Organization
2. The Vietnam Social Security is responsible for implementing the adjustment of pensions, social insurance benefits, and monthly allowances as prescribed in Decree No. 44/2019/NĐ-CP and guided in this Circular; prepare reports according to the model attached to this Circular and submit them to the Ministry of Labor - Invalids and Social Affairs and the Ministry of Finance before January 15, 2020.
3. The Social Security of the Ministry of National Defense and the Social Security of the People's Public Security have the responsibility to implement the adjustment of social insurance benefits and monthly allowances as prescribed in this Circular for the subjects under their management.
1. This Circular takes effect from August 15, 2019. The regimes prescribed in this Circular shall be implemented from July 1, 2019.
Article 4. Effective date
2. Circular No. 05/2018/TT-BLDTBXH dated June 29, 2018 of the Minister of Labor - Invalids and Social Affairs guiding the adjustment of pensions, social insurance benefits, and monthly allowances for the subjects specified in Clauses 1, 2, 3, and Clause 8 of Article 1 of Decree No. 88/2018/NĐ-CP dated June 15, 2018 of the Government shall cease to be effective from the date this Circular takes effect.
2. Circular No. 05/2018/TT-BLDTBXH dated June 29, 2018, of the Minister of Labor, Invalids, and Social Affairs guiding the adjustment of pension, social insurance allowance, and monthly allowance for the subjects specified in Clauses 1, 2, 3, and Clause 8, Article 1 of Government Decree No. 88/2018/NĐ-CP dated June 15, 2018, shall cease to be effective from the date this Circular takes effect.
