of General Statistics Office under the Ministry of Planning and Investment

Based on the Law Amending and Supplementing Certain Provisions of the Government Organization Law and the Local Administration Organization Law dated November 22, 2019;

Pursuant to the Law on Statistics dated November 23, 2015;

Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government on the functions, tasks, authorities, and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No. 85/2017/NĐ-CP dated July 19, 2017 of the Government on the organizational structure, tasks, and authorities of centralized statistical organizations and statistical organizations of ministries and ministerial-level agencies;

Pursuant to Decree No. 86/2017/NĐ-CP dated July 25, 2017 of the Government on the functions, tasks, authorities, and organizational structure of the Ministry of Planning and Investment;

At the proposal of the Minister of Planning and Investment;

The Prime Minister issues this Decision to define the functions, tasks, authorities, and organizational structure of the General Statistics Office under the Ministry of Planning and Investment.

Article 1. Position and Functions

1. The General Statistics Office is an agency under the Ministry of Planning and Investment, performing the function of advising and assisting the Minister of Planning and Investment in state management of statistics, coordinating statistical activities, organizing statistical activities, and providing economic and social statistical information to agencies, organizations, and individuals in accordance with the law.

2. The General Statistics Office has legal personality, a seal bearing the National Emblem, a bank account at the State Treasury, and its headquarters in Hanoi City.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Submit to the Minister of Planning and Investment for submission to the Government, the Prime Minister for consideration and decision, or to the competent authority for consideration and decision:

a) Draft laws, ordinances, draft resolutions of the National Assembly, the Standing Committee of the National Assembly; draft resolutions, decrees of the Government; draft decisions, directives of the Prime Minister on statistics;

b) Strategies, plans, projects, programs of action on statistics;

c) Amendments and supplements to the National Statistical Indicators List; contents of national statistical indicators within the national statistical indicator system; national statistical classification; provincial, district, commune-level statistical indicator systems and national statistical reporting regime contents;

d) Quality management standards for statistical information in the state statistical organization system;

đ) Other regulatory legal documents on statistics as prescribed by law.

2. Submit to the Minister of Planning and Investment for consideration and decision:

3. Assist the Minister of Planning and Investment in chairing and coordinating with ministries and sectors to implement the following contents:

a) Building and managing the national statistical information system, provincial and district-level statistical information systems;

b) Guiding, inspecting, and reporting on the implementation of the national statistical indicator system, the planning and investment sector's statistical indicator system, provincial, district, and commune-level statistical indicator systems, and the national census program according to the law;

c) Chairing and coordinating with relevant ministries and sectors to build and implement regulations on providing and using administrative data for state statistical activities according to the law;

d) Organizing and coordinating activities such as researching and applying advanced statistical methods; developing and applying information and communication technology; connecting and providing data and information between state statistical information systems; implementing quality management and evaluation standards for statistical information; reporting results and seeking user feedback on statistical information in state statistical activities.

4. Issuing and organizing the implementation of schedules for disseminating state statistical information; providing professional guidance within the scope managed by the General Statistics Office and as prescribed by law.

5. Implementing regulatory legal documents, policies, strategies, plans, programs, and projects stipulated in Clauses 1 and 2 of this Article after approval and issuance by the competent authority.

6. Organizing publicity, dissemination, and education on statistical laws.

7. Conducting professional reviews of the statistical indicator system of ministries and sectors including adjusted and supplemented indicators; reporting regimes for ministry and sector statistics; sectoral and field classifications; statistical data of ministries and sectors within the national statistical indicator system; census plans decided by ministries, sectors, and provincial People's Committees to organize.

8. Chairing and coordinating with ministries, sectors, and localities to conduct population and housing censuses; rural and agricultural censuses; economic censuses; and other censuses and surveys assigned by the Prime Minister. Implementing surveys outside the national census program as decided by the Minister of Planning and Investment.

9. Collecting information, compiling, and editing assigned statistical indicators according to the law.

10. Managing the centralized and unified national statistical database, connecting it with other national databases, ministry, and sector databases; providing related statistical information from the database to agencies, organizations, and individuals; ensuring confidentiality of organizational and individual information during data provision according to the law.

11. Analyzing and forecasting statistics according to the statistical program serving the development and assessment of economic and social development strategies, plans, and policies; reporting survey and census results; specialized analysis reports; reports evaluating the implementation of economic and social development strategies, plans, and policies.

12. Publishing statistical information within the national statistical indicator system, and the planning and investment sector's statistical indicator system.

10. Manage the centralized, unified national statistical database system, connecting it with other national databases and departmental databases; provide data and information related to published statistical information in the statistical database to agencies, organizations, and individuals; ensure the confidentiality of organizational and individual information during the data provision process in accordance with the provisions of the law.

11. Analyze and forecast statistics according to the statistical program serving the development, evaluation of implementation of strategies, plans, economic and social development policies; report on survey and comprehensive census results; specialized analysis reports; reports evaluating the implementation of strategies, plans, and economic and social development policies.

12. Publish statistical information belonging to the national statistical indicator system, statistical information belonging to the planning, investment, and statistics sector indicator system.

13. Implement specialized statistical inspection; inspect the use of statistical data and information of national statistical indicators, provincial-level, district-level, and commune-level statistical indicators that have been announced by competent authorities; detect, prevent, and handle violations of statistical laws within their authority or recommend relevant state agencies to handle such violations according to the law.

14. Carry out international cooperation in state statistical activities according to the division of labor and delegation of the Minister of Planning and Investment and as prescribed by law.

15. Train and enhance professional skills for personnel working in the state statistical system, statistical surveyors, and statistical collaborators.

16. Manage organizational structure, job positions, civil servant quotas, civil service grade structures, number of employees, vocational staff structures, and contractual labor; implement salary systems, occupational allowances, and other incentive systems for statisticians; organize competitions, awards, and disciplinary actions for civil servants, vocational staff, and contractual labor under the management of the General Statistics Office according to the law and the delegation of the Minister of Planning and Investment.

17. Implement administrative reform; prevent corruption, negative practices, and promote thrift and combat waste; inspect, resolve complaints and denunciations, and handle violations of the law within the scope of management of the General Statistics Office according to the law or recommend competent authorities to handle such violations according to the law.

18. Manage finance, assets, and investment projects assigned according to the law and the delegation of the Minister of Planning and Investment.

19. Provide public statistical services according to the law.

20. Manage subordinate public institutions under the General Statistics Office according to the law.

21. Perform other tasks and powers delegated by the Minister of Planning and Investment and as prescribed by the law.

Article 3. Organizational Structure of the General Statistics Office

The General Statistics Office is organized into a vertical system from central to local levels, ensuring the principle of centralized unity.

1. Central Statistical Agencies

a) Department of Methodology, System Management, and Quality Control of Statistics;

b) Department of Comprehensive Statistics and Dissemination of Statistical Information;

c) Department of National Accounts System;

d) Department of Agricultural, Forestry, and Fishery Statistics;

đ) Department of Industrial and Construction Statistics;

e) Department of Trade and Service Statistics;

g) Department of Price Statistics;

h) Department of Population and Labor Statistics;

i) Department of Social and Environmental Statistics;

k) Department of Foreign Statistics and International Cooperation;

l) Department of Organization and Cadres;

m) Department of Planning and Finance;

n) Department of Legal Affairs and Statistical Inspection;

o) Office;

p) Bureau of Data Collection and Application of Statistical Information Technology;

q) Institute of Statistical Science;

r) Journal of Numbers and Events;

s) Statistical Publishing House;

t) College of Statistics;

u) College of Statistics II.

Organizations specified from point a to point p, Clause 1, Article 1 of this Law assist the Director-General in performing state management functions; organizations specified from point q to point u, Clause 1, Article 1 of this Law are public institutions.

The Office of the General Statistics Office is organized into 6 divisions; the Bureau of Data Collection and Application of Statistical Information Technology is organized into 4 divisions and 4 Centers.

The Bureau of Data Collection and Application of Statistical Information Technology has legal personality, its own seal, a place of business, and can open an account at the State Treasury according to the law.

2. Local Statistical Agencies

a) Provincial-level Statistics Bureaus (commonly referred to as Provincial-level Statistics Bureaus) under the General Statistics Office located in provinces and centrally-administered cities.

Provincial-level Statistics Bureaus are organized into 5 divisions.

b) District-level Statistics Sub-bureaus located in districts, towns, and cities under provinces; Regional Statistics Sub-bureaus (commonly referred to as District-level Statistics Sub-bureaus) under Provincial-level Statistics Bureaus.

Provincial-level Statistics Bureaus and District-level Statistics Sub-bureaus have legal personality, their own seals; they have places of business and can open accounts at the State Treasury according to the law.

Article 4. Leadership of the General Statistics Office

1. The General Statistics Office has a Director and not more than four Deputy Directors.

2. The Director and Deputy Directors shall be appointed, relieved of duty, and dismissed by the Minister of Planning and Investment in accordance with the provisions of the law.

The Director is the head of the General Statistics Office, accountable to the Minister of Planning and Investment and to the law for all activities of the General Statistics Office. The Deputy Directors are accountable to the Director and to the law for the tasks assigned to them.

The Director shall define the functions, tasks, powers, and organizational structure of units under the General Statistics Office; appoint, relieve of duty, dismiss, accept resignation, suspend from duty the heads and deputy heads of units under the General Statistics Office in accordance with the provisions of the law and the delegation of the Minister of Planning and Investment.

Article 5. Effectiveness and Transitional Provisions

1. This Decision takes effect from May 20, 2020; replacing Decision No. 54/2010/QĐ-TTg dated August 24, 2010 of the Prime Minister on the functions, tasks, powers, and organizational structure of the General Statistics Office under the Ministry of Planning and Investment, and Decision No. 65/2013/QĐ-TTg dated November 11, 2013 of the Prime Minister amending and supplementing point a, Clause 1, Article 3 of Decision No. 54/2010/QĐ-TTg.

2. The Minister of Planning and Investment shall be responsible for:

a) Arranging the provincial-level Statistics Offices in accordance with point a, Clause 2, Article 3 of this Decision, ensuring streamlined organizational structures and reduced staffing in accordance with Party resolutions and legal provisions.

b) Arranging the district-level Statistics Offices so that there will be 486 district-level Statistics Offices by the end of 2021.

c) Arranging the district-level Statistics Offices so that there will be 420 district-level Statistics Offices by the end of 2022.

3. The Minister of Planning and Investment, Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees directly under the central government, Director of the General Statistics Office, and related organizations and individuals shall be responsible for implementing this Decision./.
