Guidelines for integrating disaster prevention and control content into planning and development plans for industries and socio-economic development

Pursuant to the Law on Disaster Prevention and Control dated June 19, 2013; the Law Amending and Supplementing Certain Provisions of the Law on Disaster Prevention and Control and the Law on Dike Management dated January7 May 14, 2016 Government Decree detailing some provisions and measures to implement the Law on Legislative Regulatory Documents;

Pursuant to the Planning Law dated November 24, 2017;

Pursuant to the Law on Public Investment dated June 18, 2019;

Pursuant to Decree No. 66/2021/NĐ-CP dated June 7 2021 of the Government detailing certain provisions of the Law on Disaster Prevention and Control and the Law Amending and Supplementing Certain Provisions of the Law on Disaster Prevention and Control and the Law on Dike Management; number Pursuant to Decree No. 86/2017/NĐ-CP dated July 25, 2017 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Planning and Investment;

In accordance with the proposal of the Director of the Department of Agricultural Economy,

The Minister of Planning and Investment issues this Circular guiding the integration of disaster prevention and control content into planning and development plans for industries and socio-economic development.

This Circular guides the integration of disaster prevention and control content into national planning systems (referred to collectively as "Planning") and industry development plans and socio-economic development plans (referred to collectively as "Plans") at various levels as specified in Article 16 of the Law on Disaster Prevention and Control. 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

2. Applicability:

This Circular applies to agencies, organizations, and individuals involved in drafting, reviewing, approving, and implementing the integration of disaster prevention and control content into Planning and Plans.

Integrating disaster prevention and control content into Planning and Plans involves selecting and implementing disaster prevention and control measures identified in the disaster prevention and control plan, climate change adaptation plan of the same level (or other disaster prevention and control measures approved by competent authorities) to be carried out together with the contents of Planning and Plans to enhance investment efficiency and promote socio-economic development.

Article 2. Explanation of terms

Article 3. Views and Principles of Integrating Disaster Prevention and Control Content into Planning and Plans

1. Integration views:

a) Integrating disaster prevention and control content into Planning and Plans is implemented in a multi-objective approach to increase adaptability to disasters, reduce disaster losses, and avoid generating new risks and dangers both in the short term and long term.

b) Harmoniously integrate both engineering and non-engineering measures across all three stages: before, during, and after disasters.

c) Integrating disaster prevention and control content into Planning and Plans aims to enhance the effectiveness of resources (financial, human, and natural) and minimize overlap and waste in investment activities and development programs.

2. Integration principles:

a) Planning and Plans containing disaster prevention and control content and integrated appropriately according to the characteristics of each region and locality to ensure sustainable development, contribute to industry development, socio-economic development, and proactively adapt to climate change.

b) Integrating disaster prevention and control content is part of the task of building Planning and Plans. If Planning and Plans have been approved without disaster prevention and control content, they should be supplemented when adjusting those Planning and Plans. The method of supplementary integration is carried out in accordance with this Circular.

c) Disaster prevention and control measures when integrated are conducted with focus, prioritization, ensuring feasibility, effectiveness, and suitability to the economic and social conditions of each industry and locality. Disaster prevention and control measures included in Planning and Plans must comply with the provisions of this Circular.

d) The integration process needs to consider and determine the scale of disaster risk for development areas. Risk assessment and reduction measures are proposed for each area.

d) The integration process must consider and determine the scale of natural disaster risks for various development sectors. The assessment, identification of risks, and proposed risk mitigation measures should be conducted on a sector-by-sector basis.

Article 4. Measures for preventing and combating natural disasters to be integrated into Planning and Plans

1. The measures for preventing and combating natural disasters selected for integration into Planning and Plans include: preventive measures to reduce the impact of natural disasters on economic and social development processes; measures to minimize negative impacts on the environment and increase the risk of natural disasters; measures to build infrastructure systems with the goal of preventing and combating natural disasters.

2. The measures for preventing and combating natural disasters used for integration into Planning and Plans are proactively evaluated and selected by ministries, sectors, and localities from the same-level disaster prevention and control plans, climate change adaptation plans, relevant programs, projects, and proposals that have been approved by competent authorities.

3. At the time of developing Planning and Plans, if the disaster prevention and control plan or the progress of implementing related programs, projects, and proposals has not yet been approved, the leading unit responsible for developing Planning and Plans shall coordinate with relevant units to select measures for preventing and combating natural disasters to integrate into the plans.

Chapter II

INTEGRATING CONTENT ON PREVENTING AND COMBATING NATURAL DISASTERS INTO PLANNING AND PLANS

Article 5. Integrating content on preventing and combating natural disasters into Planning

The integration of content on preventing and combating natural disasters into Planning is carried out in accordance with the provisions of the Law on Planning, guiding documents for implementing the Law on Planning, and the viewpoints and principles of integrating and measures for preventing and combating natural disasters stipulated in Articles 3 and 4 of this Circular.

Article 6. Procedure for integrating content on preventing and combating natural disasters into Plans

1. Establishing viewpoints and orientations for integrating content on preventing and combating natural disasters into Plans according to the guidance provided in Article 7 of this Circular.

2. Selecting measures for preventing and combating natural disasters to integrate into Plans according to the guidance provided in Article 8 of this Circular.

3. Directing the integration of measures for preventing and combating natural disasters into Plans according to the guidance provided in Article 9 of this Circular.

4. Monitoring and evaluating the results of integrating content on preventing and combating natural disasters into Plans according to the guidance provided in Article 10 of this Circular.

Article 7. Establishing viewpoints and orientations for integrating content on preventing and combating natural disasters into Plans

1. Viewpoints and orientations serve as the basis for the leading unit to integrate content on preventing and combating natural disasters into Plans. These viewpoints and orientations must clearly express the objectives, contents, and directions for selecting measures for preventing and combating natural disasters to be integrated into Plans.

2. Viewpoints and orientations are reflected in the following documents:

a) Resolutions, Decisions, and other forms of normative legal documents related to policies and orientations for industry and socio-economic development by the Government, Prime Minister, ministries, sectors, and localities.

b) Documents guiding the development of medium-term and annual socio-economic development plans by the Government, Prime Minister, ministries, sectors, and localities.

Article 8. Selecting measures for preventing and combating natural disasters to integrate into Plans

1. The unit developing the Plan bases its selection on the viewpoints and orientations for developing the Plan and the measures for preventing and combating natural disasters stipulated in Article 4 of this Circular to integrate into the Plan:

a) Select all measures for preventing and combating natural disasters to integrate into the Plan if resources are guaranteed.

b) Select priority measures for preventing and combating natural disasters to integrate if resources are limited. The method of selecting priority measures is as follows:

- For non-engineering measures, the unit developing the Plan bases its selection on the specific content and activities of each measure.

- For engineering measures, the unit developing the Plan selects according to the guidance provided in Clauses 2, 3, and 4 of this Article.

2. Economic efficiency assessment:

Assessing the economic efficiency of an engineering measure for integration is conducted as follows:

a) Determine total investment costs including construction costs, operation costs, and other costs (if any).

b) Determine total benefits in economic, social, and environmental aspects: The unit developing the Plan actively establishes criteria to determine total benefits suitable for each locality. Among these, focus should be placed on certain criteria such as protecting economic activities (agriculture, forestry, fisheries, industrial production, tourism, trade, and services), protecting technical infrastructure facilities, protecting residential buildings and people's assets, and protecting natural resources and ecosystems.

c) Determine economic efficiency: If total benefits exceed total investment costs, the measure has higher economic efficiency.

Refer to the method of assessing economic efficiency in the Appendix of this Circular.

3. Assessment of the scope of protection for people's lives:

Assessing the scope of protection for people's lives of an engineering measure for integration is conducted as follows:

a) Estimate the number of people who will not die or go missing due to being protected by measures for preventing and combating natural disasters when integrated.

b) Estimate the number of people who will not suffer injuries due to being protected by measures for preventing and combating natural disasters when integrated.

c) Determine the scope of protection for people's lives: The more a measure reduces the number of deaths, disappearances, and injuries among people during natural disasters, the wider the scope of protection for people's lives.

Refer to the method of assessing the scope of protection for people's lives in the Appendix of this Circular.

4. Selecting priority measures for integration into Plans:

The results of economic efficiency assessments and the scope of protection for people's lives are the basis for selecting priority measures for integration. Measures with a wider scope of protection for people's lives and higher economic efficiency are chosen first; continue selecting until the available resources match the Plan.

Selection is based on the following priorities:

a) Measures with a wider scope of protection for people's lives are prioritized for selection.

b) Among measures having the same scope of protecting people's lives, the measure with higher economic efficiency shall be prioritized for selection.

c) When measures have the same scope of protecting people's lives and the same economic efficiency, the unit drafting the Plan shall consider and decide based on resource availability.

d) When assessing the scope of protecting people's lives, special priority shall be given to vulnerable groups such as children, elderly persons, pregnant women or those nursing infants under 12 months old, persons with disabilities, persons suffering from serious illnesses, poor persons, and single mothers heading households, while taking into account other gender-specific needs.

Article 9. Orientation for Integrating Measures to Prevent and Combat Natural Disasters into the Plan

1. Engineering measures:

Engineering measures selected under Article 8 of this Circular shall be integrated into tasks promoting the development of social infrastructure, technical infrastructure, urban and rural infrastructure in the Plan and clearly reflected in the medium-term and annual public investment plans.

2. Non-engineering measures:

a) Measures to establish mechanisms, policies, improve organizational structures, and enhance capacity for preventing and combating natural disasters shall be integrated into tasks to perfect institutional frameworks and policies.

b) Measures to raise awareness and knowledge among the community about preventing and combating natural disasters shall be integrated into tasks of propaganda and implementation of the Plan.

c) Soft measures based on nature, such as planting, managing, protecting, and developing forests, shall be integrated into tasks of developing agriculture, forestry, and fisheries industries and developing green infrastructure to prevent and combat natural disasters.

d) Measures to rearrange population settlements to avoid areas at high risk of natural disasters shall be integrated into orientation and tasks of economic and social development; development of urban and rural systems.

e) Measures to adjust agricultural land use structure and cropping patterns to suit each type of natural disaster and level of disaster risk shall be integrated into tasks of restructuring the economy and guiding the development of agriculture, forestry, and fisheries industries.

g) Other measures, the unit drafting the Plan shall examine and select appropriate integration positions.

Article 10. Monitoring and Evaluating the Results of Integrating Content on Prevention and Combating Natural Disasters into Planning

1. Contents of monitoring and evaluation:

a) The number of measures, amount of capital, and proportion of capital of measures for prevention and combating natural disasters that are selected for integration into Planning.

b) The degree of impact and effectiveness of implementing integrated measures for prevention and combating natural disasters on the development process of industries, economic and social development, and prevention and combating natural disasters.

2. Timeframe for monitoring and evaluating the results of integrating content on prevention and combating natural disasters into the Plan shall be carried out according to the period of the Plan.

3. The results of integrating content on prevention and combating natural disasters into Planning shall be reflected in the Report on the Implementation Results of Planning. The report shall clearly state strengths, limitations, causes, and directions for overcoming limitations in the implementation of integration.

Article 11. Sources of Capital for Integrating Content on Prevention and Combating Natural Disasters into Planning

1. Sources of capital for integrating content on prevention and combating natural disasters into Planning include state budget capital and non-state budget capital in accordance with the State Budget Law; Public Investment Law; Disaster Prevention and Control Law; Law Amending and Supplementing Certain Provisions of the Disaster Prevention and Control Law and the Dike Law, and other relevant laws.

2. Priority shall be given to using medium-term and annual public investment capital to implement engineering measures integrated into the Plan.

Chapter III

IMPLEMENTATION

Article 12. Effective Date

1. This Circular takes effect from February 10, 2022.

2. This Circular replaces Circular No. 05/2016/TT-BKHĐT dated June 6, 2016, issued by the Ministry of Planning and Investment guiding the integration of content on prevention and combating natural disasters into planning and development programs and plans for industries and socio-economic development.

Article 13. Responsibility for Implementation

1. The Ministry of Planning and Investment:

a) Shall take the lead and coordinate with relevant agencies to determine viewpoints, orientations, and contents of prevention and combating natural disasters to be integrated into Planning when drafting draft Decisions and Directives of the Prime Minister and Guidelines of the Ministry of Planning and Investment on building medium-term and annual socio-economic development plans and related guidance documents on planning and industry development.

b) Shall guide, disseminate, and popularize this Circular. Organize monitoring and evaluating the implementation results of this Circular at ministries, sectors, and localities.

c) Shall integrate content on prevention and combating natural disasters into Plans drafted or reviewed by the Ministry of Planning and Investment.

2. Ministries and agencies at the ministerial level:

a) Shall clearly define viewpoints, priorities, and integration positions of content on prevention and combating natural disasters when drafting guiding documents on development orientation and guidelines for planning and building industry development plans within their jurisdiction.

b) Shall organize the integration of measures to prevent and combat natural disasters into industry development plans within their jurisdiction.

c) Shall select units to take the lead in organizing activities related to integrating content on prevention and combating natural disasters into industry development plans within their jurisdiction. Notify information on the selected units to the Ministry of Planning and Investment (Department of Agricultural Economy) for coordination.

3. People's Committees at all levels:

a) Shall allocate state budget capital under their management and mobilize non-state budget capital to organize and implement the integration of content on prevention and combating natural disasters into local plans.

b) Shall instruct the department of Planning and Investment to take the lead and coordinate with the department of Agriculture and Rural Development and relevant departments to clearly define viewpoints and orientations for integrating content on prevention and combating natural disasters when drafting resolutions, decisions on industry and socio-economic development, and guidance documents for annual and five-year socio-economic development plans of the locality.

c) Direct the Ministry of Planning and Investment to take the lead, coordinate with the Ministry of Agriculture and Rural Development and relevant agencies to organize the implementation of integrating, monitoring, and evaluating the results of integrating disaster prevention and control content into planning and plans at the local level.

d) Direct the Ministry of Finance to balance the sources of funds to advise the competent authority to allocate budget for organizing and implementing activities to integrate disaster prevention and control content into planning and plans at the local level.

4. In the course of implementation, if there are difficulties, please reflect them to the Ministry of Planning and Investment (Department of Agricultural Economy) for research and appropriate amendments and supplements.

 

Appendix
