CIRCULAR
GUIDELINES FOR THE FUNCTION, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF PROVINCE AND CITY CULTURAL CENTERS UNDER THE CENTRAL GOVERNMENT
Pursuant to Decree No. 79/2017/NĐ-CP dated July 17, 2017, of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Culture, Sports and Tourism;
Pursuant to Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;
Pursuant to Decree No. 107/2020/NĐ-CP dated September 14, 2020 of the Government amending and supplementing certain articles of Decree No. 24/2014/NĐ-CP dated April 4, 2014 of the Government on the organization of specialized agencies under provincial People's Committees and municipal People's Committees directly under the Central Government;
Pursuant to Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government stipulating the establishment, restructuring, and dissolution of public service organizations;
Pursuant to Decree No. 32/2019/NĐ-CP dated April 10, 2019 of the Government stipulating the assignment of tasks, ordering goods or services, or tendering for the provision of public products and services using state budget funds from regular expenditure;
At the proposal of the Director of the Department of Cultural Institutions;
The Minister of Culture, Sports and Tourism issues this Circular guiding the function, tasks, powers and organizational structure of Provincial and City Cultural Centers.
Article 1. Scope of Regulation and Applicability
1. This Circular guides the implementation of the function, tasks, powers and organizational structure of Provincial and City Cultural Centers.
2. This Circular applies to Provincial and City Cultural Centers under Departments of Culture, Sports and Tourism, Departments of Culture and Sports of provinces and centrally-administered cities (hereinafter referred to as Provincial Cultural Centers).
3. Cultural facilities; cultural and sports facilities under Ministries, sectors, political organizations, political-social organizations, armed forces, agencies, units, enterprises and other cultural and sports facilities shall apply the provisions of this Circular, relevant Party regulations and other laws.
Article 2. Functions
1. A Cultural Center is a public service unit under the Department of Culture, Sports and Tourism or the Department of Culture and Sports (hereinafter referred to as the Department) with the function of propagating and disseminating the Party’s guidelines and policies and State laws; implementing political, economic, cultural, social tasks and other tasks of the locality; providing public services and supporting state management.
2. Provincial Cultural Centers have legal personality, their own seals, bank accounts, and premises as prescribed by law.
Article 3. Duties and Authorities
1. Tasks and powers related to serving state management:
a) Developing work plans; activity standards (mobile propaganda, film screening, artistic performances, and other activities); submitting urgent tasks for approval by competent authorities and organizing their implementation annually or over a period;
b) Organizing training, capacity building; creating works; providing professional guidance for cultural and artistic activities, mobile propaganda, exhibitions, visual propaganda, clubs, interest groups, and other forms of activity;
c) Promoting cultural and artistic works; establishing and implementing exemplary models in the field of culture and art; compiling and distributing promotional materials and professional guidance;
d) Exploiting, collecting, restoring, preserving, and promoting intangible cultural values in the community;
đ) Inspecting professional activities according to assigned responsibilities;
e) Implementing coordination with relevant departments, agencies, and organizations in the implementation of tasks to develop cultural facilities and organize cultural and artistic activities within and outside the locality.
2. Tasks and powers related to providing public services:
a) Providing basic and essential public services:
Organizing and participating in cultural and artistic activities; mass cultural and artistic competitions, festivals; mobile propaganda; visual propaganda serving political tasks; other public services as prescribed by competent authorities.
b) Providing public services in the field of culture:
Organizing cultural and artistic services, propaganda, exhibitions, advertising, entertainment, and other services.
c) Jointly operating with organizations and individuals to organize cultural, sports, tourism, and entertainment activities in accordance with the law.
3. Other tasks and powers:
a) Cooperating, exchanging, and networking with related units both domestically and internationally;
b) Managing organizational structures, finances, assets, and physical infrastructure in accordance with the law;
c) Implementing regular statistical reporting as prescribed;
d) Implementing other tasks and powers assigned by competent authorities or as prescribed by law.
4. In addition to the tasks and powers stipulated from Clause 1 to Clause 3 of this Article, Provincial Cultural Centers may also implement the following additional tasks and powers:
a) Serving state management tasks in the fields of cinema and performing arts;
b) Public services in the field of cinema:
- Cooperating, joint ventures, and partnerships in the field of cinema; releasing, promoting films and other cinema entertainment services, organizing propaganda and film screenings for national and local events and political tasks; meeting the spiritual cultural needs of the people regarding cinema; coordinating with functional units to inspect and evaluate compliance with regulations on business operations, content quality of audiovisual discs, films, publications, and local cinema activities;
- Organizing mobile and theater-based film screenings; producing, releasing, and promoting film tapes, documentaries, videos, clips, dubbing, and narrating ethnic films and other types in the field of Cinema;
- Organizing or coordinating the organization of film weeks and special film screenings commemorating major events and national holidays; participating in organizing international film events in the locality;
c) Public services in the field of performing arts: Organizing the creation, staging, and performance of professional artistic programs serving local political tasks; participating in nationwide and international professional art contests organized by the Ministry of Culture, Sports and Tourism;
d) For localities that consolidate and integrate public service units in the field of cinema, they shall perform tasks and powers as stipulated in point a and b of this clause, in the field of performing arts as stipulated in point a and c of this clause, and other public services as prescribed by competent authorities.
Article 4. Organizational Structure
1. The provincial Cultural Center shall have a Director and not more than two Deputy Directors as prescribed; the Director of the Center shall be responsible to the Department Director and before the law for all activities of the Center; the Deputy Director of the Center shall be responsible to the Director of the Center and before the law for the assigned areas of work.
2. Professional and technical organizations:
The provincial Cultural Center shall have an Administrative and General Affairs Office, and other offices, groups, teams (hereinafter referred to collectively as offices) to implement tasks according to the following groups of tasks: cultural business; visual propaganda, exhibitions; mobile propaganda; performing arts (in cases of merger or consolidation with public service units in the field of performing arts); film screening (in cases of merger or consolidation with public service units in the field of cinema); other specialized tasks.
3. The establishment of offices and the number of deputy heads of the office leaders shall be implemented in accordance with the provisions at point d clause 1 and point c clause 3 Article 6 Decree No. 120/2020/NĐ-CP dated October 7, 2020 of the Government.
Article 5. Transitional Provisions
1. Provincial Cultural Centers that have submitted project proposals and reports to the competent authority for establishing and restructuring before the date this Circular takes effect, but have not yet received decisions, must review and complete their projects in line with the guidance provided in this Circular, and submit them to the competent authority for decision.
2. Provincial Cultural Centers that have completed restructuring before the date this Circular takes effect shall conduct reviews and submit to the competent authority for amendments and supplements to relevant regulations in accordance with the guidance provided in this Circular.
Article 6. Implementation Provisions
1. This Circular shall take effect from November 19, 2021, replacing Circular No. 03/2009/TT-BVHTTDL dated August 28, 2009 of the Ministry of Culture, Sports and Tourism on the functions, tasks, powers, and organizational structure of provincial cultural centers.
2. In cases where legal normative documents cited in this Circular are amended, supplemented, or replaced by other legal normative documents, they shall be implemented in accordance with the new documents.
3. During implementation, if there are difficulties or obstacles, it is requested that agencies, organizations, and individuals promptly reflect these issues to the Ministry of Culture, Sports and Tourism (through the Grassroots Cultural Administration Bureau) for consideration and appropriate amendments and supplements./.
