CIRCULAR
Amending and supplementing certain articles of Circular No. 13/2018/TT-BTTTT
dated October 15, 2018 of the Minister of Information and Communications
stipulating the List of Network Security Products for Import under License and Procedures, Formalities, and Documents for Issuing Import Licenses for Network Security Products

On the basis of Law on Cybersecurity November 19, 2015;
On the basis of the Law on Foreign Trade Management June 12, 2017;
Decree No. Decision No. 17/2017/NĐ-CP dated February 17, 2017 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
Decree No. 69/2018/ND-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Management of Foreign Trade;
Decree No. Resolution No. 17/2017/NĐ-CP dated February 17, 2017 of the Government detailing the functions, tasks, powers, and organizational structure of the Ministry of Information and Communications;
At the request of the Director of the Cybersecurity Agency,
The Minister of Information and Communications issues this Circular amending and supplementing certain articles of Circular No. 13/2018/TT-BTTTT dated October 15, 2018 of the Minister of Information and Communications stipulating the List of Network Security Products for Import under License and Procedures, Formalities, and Documents for Issuing Import Licenses for Network Security Products.
Article 1. Amending and supplementing certain articles of Circular No. 13/2018/TT-BTTTT dated October 15, 2018 of the Minister of Information and Communications stipulating the List of Network Security Products for Import under License and Procedures, Formalities, and Documents for Issuing Import Licenses for Network Security Products.
1. Amend Clause 6 as follows:
"The Cybersecurity Agency - Ministry of Information and Communications is the agency issuing Import Licenses."
2. Repeal Clause 2, Article 7.
3. Amend Clause 5, Article 8 as follows:
"For online submission, it shall be conducted through the Ministry of Information and Communications' Public Service Portal at https://dichvucong.mic.gov.vn or the National Public Service Portal."
4. Amend Clause 6, Article 8 as follows:
"Enterprises may collect Import Licenses directly at the Cybersecurity Agency's office, via postal service, or electronically through the Public Service Portal."
5. Amend Clause 3, Article 9 as follows:
"Within five working days from the date of receipt of a valid application, the Cybersecurity Agency - Ministry of Information and Communications will review and issue the result to the enterprise. If all conditions set forth in Clause 3, Article 48 of the Cybersecurity Law are met, the Cybersecurity Agency - Ministry of Information and Communications will issue an Import License to the enterprise according to Model No. 03 in Appendix II of this Circular. In case the conditions are not met, the Cybersecurity Agency - Ministry of Information and Communications will notify the enterprise in writing, specifying the reasons for non-issuance."
6. Amend Article 10 as follows:
"1. For Import Licenses that are still valid but have been lost or damaged, enterprises must submit a request for reissue of the Import License according to Model No. 02 in Appendix II of this Circular to the Cybersecurity Agency - Ministry of Information and Communications.
2. Within two working days from the date of receipt of a valid application, the Cybersecurity Agency - Ministry of Information and Communications will reissue the Import License to the enterprise."
7. Replace Appendix I and Appendix II of Circular No. 13/2018/TT-BTTTT dated October 15, 2018 of the Minister of Information and Communications with Appendix I and Appendix II attached to this Circular.
Article 2. Transitional Provisions
1. Import Licenses issued before the effective date of this Circular remain valid until their expiration date.
2. Harmonized System Code 8517.62.43 in Appendix I of this Circular will apply from December 1, 2022.
Article 3. Effectiveness and Responsibility for Implementation
1. This Circular takes effect from September 15, 2022.
2. During implementation, if any difficulties arise, organizations and individuals are requested to report them to the Cybersecurity Agency - Ministry of Information and Communications for consideration and resolution.
3. In cases where there is a discrepancy between the Harmonized System Code of products and goods listed in Appendix I of this Circular and the Vietnam Export and Import Goods List, the Ministry of Information and Communications (Cybersecurity Agency) will coordinate with the Ministry of Finance (General Department of Customs) to determine the Harmonized System Code for exported and imported goods.
4. The Head of the Office, the Director of the Cybersecurity Agency, the Heads of agencies and units under the Ministry of Information and Communications, and related enterprises, organizations, and individuals are responsible for implementing this Circular./.
