Circular No. 10/2024/TT-BLDTBXH amending and supplementing certain provisions of Circular No. 07/2023/TT-BLDTBXH dated August 28, 2023, issued by the Minister of Labor - Invalids and Social Affairs, concerning job title codes, job title standards; salary classification, and promotion to job titles for vocational education professionals.

Article 1. Amending and supplementing certain Articles of Circular No. 07/2023/TT-BLDTBXH dated August 28, 2023, issued by the Minister of Labour - Invalids and Social Affairs, on job code, qualification standards for occupational titles; salary grading and promotion of occupational titles for vocational education professionals.

1. Amending and supplementing Clause 1 of Article 1 as follows:

"1. This Circular stipulates job codes, qualification standards for occupational titles; salary grading; criteria and conditions for promotion to Level II and Level I for teaching staff in public vocational colleges, intermediate vocational schools, and vocational training centers (hereinafter referred to as public vocational education institutions) and other related organizations and individuals."

2. Amending and supplementing Article 2 as follows:

"Article 2. Job codes for levels of occupational titles for vocational education professionals

1. Job code for the occupational title of vocational education lecturer

a) Senior vocational education lecturer (Level I) - Job code: V.09.02.01;

b) Principal vocational education lecturer (Level II) - Job code: V.09.02.02;

c) Theoretical vocational education lecturer (Level III) - Job code: V.09.02.03;

d) Practical vocational education lecturer (Level III) - Job code: V.09.02.04.

2. Job code for the occupational title of vocational education teacher

a) Senior vocational education teacher (Level I) - Job code: V.09.02.05;

b) Principal vocational education teacher (Level II) - Job code: V.09.02.06;

c) Theoretical vocational education teacher (Level III) - Job code: V.09.02.07;

4. Amending and supplementing Article 14 as follows:

"Article 14. Salary grading for occupational titles of vocational education professionals

Public officials assigned to the occupational titles of vocational education professionals as specified in this Circular shall apply the corresponding salary scale promulgated together with Decree No. 204/2004/NĐ-CP dated December 14, 2004, of the Government on salary system for cadres, civil servants, public officials, and armed forces personnel, specifically as follows:

1. Senior vocational education lecturer (Level I) - Job code: V.09.02.01, shall apply the salary coefficient of public official type A3 group 1 (A3.1) from salary coefficient 6.20 to salary coefficient 8.00.

2. Principal vocational education lecturer (Level II) - Job code: V.09.02.02, shall apply the salary coefficient of public official type A2 group 1 (A2.1) from salary coefficient 4.40 to salary coefficient 6.78.

3. Theoretical vocational education lecturer (Level III) - Job code: V.09.02.03, shall apply the salary coefficient of public official type A1 from salary coefficient 2.34 to salary coefficient 4.98.

4. Practical vocational education lecturer (Level III) - Job code: V.09.02.04, shall apply the salary coefficient of public official type A0 from salary coefficient 2.10 to salary coefficient 4.89.

5. Senior vocational education teacher (Level I) - Job code: V.09.02.05, shall apply the salary coefficient of public official type A3 group 2 (A3.2) from salary coefficient 5.75 to salary coefficient 7.55.

6. Principal vocational education teacher (Level II) - Job code: V.09.02.06, shall apply the salary coefficient of public official type A2 group 1 (A2.1) from salary coefficient 4.40 to salary coefficient 6.78.

7. Theoretical vocational education teacher (Level III) - Job code: V.09.02.07, shall apply the salary coefficient of public official type A1 from salary coefficient 2.34 to salary coefficient 4.98.

8. Practical vocational education teacher (Level III) - Job code: V.09.02.08, shall apply the salary coefficient of public official type A0 from salary coefficient 2.10 to salary coefficient 4.89.

9. Vocational education teacher (Level IV) - Job code: V.09.02.09, shall apply the salary coefficient of public official type B from salary coefficient 1.86 to salary coefficient 4.06.

The salary coefficient prescribed in this Article shall be replaced and applied according to the guiding document issued by the competent authority regarding the new wage system for cadres, civil servants, public officials, and armed forces personnel replacing Decree No. 204/2004/NĐ-CP.

5. Amending and supplementing Article 15 as follows:

Article 15. Transfer of Salary Rank from Education and Training Professional Civil Servant Grade to Vocational Education Professional Civil Servant Grade

Civil servants currently engaged in teaching at public vocational education institutions, who are currently ranked under the grades of education and training civil servants specified in Decision No. 202/TCCP-VC dated June 8, 1994, of the Minister, Head of the Organizational-Cadre Department of the Government (now the Minister of Home Affairs) on issuing the standards for the grades of education and training civil servants; Circular Joint No. 81/2005/TTLT-BNV-BTC dated August 10, 2005, of the Minister of Home Affairs and the Minister of Finance guiding the implementation of the transfer from old to new salaries for some newly added or reclassified civil servant and public official grades in the Water Resources, Education and Training, Culture and Information, Health, and Market Management sectors; and Circular Joint No. 36/2014/TTLT-BGDĐT-BNV dated November 28, 2014, of the Minister of Education and Training and the Minister of Home Affairs stipulating the code and standards for the positions of teachers in public higher education institutions appointed to the positions of vocational education professional civil servants as specified in this Circular shall be ranked according to the guidance provided in Clause 2 Section II of Circular No. 02/2007/TT-BNV dated May 25, 2007, of the Minister of Home Affairs guiding the ranking of salaries when upgrading, transferring grades, or classifying civil servants and public officials, specifically as follows:

1. Rank in the Senior Lecturer in Vocational Education (Grade I) - Code: V.09.02.01 for civil servants currently holding the Senior Lecturer - Code 15.109 specified in Decision No. 202/TCCP-VC or Senior Lecturer (Grade I) - Code V.07.01.01 specified in Circular Joint No. 36/2014/TTLT-BGDĐT-BNV.

2. Rank in the Principal Lecturer in Vocational Education (Grade II) - Code: V.09.02.02 for civil servants currently holding the Principal Lecturer - Code 15.110 or High School Advanced Teacher - Code 15.112 specified in Decision No. 202/TCCP-VC or Principal Lecturer (Grade II) - Code V.07.01.02 specified in Circular Joint No. 36/2014/TTLT-BGDĐT-BNV.

3. Rank in the Theoretical Lecturer in Vocational Education (Grade III) - Code: V.09.02.03 for civil servants currently holding the Lecturer - Code 15.111, or High School Teacher - Code 15.113 specified in Decision No. 202/TCCP-VC or Lecturer (Grade III) - Code V.07.01.03 specified in Circular Joint No. 36/2014/TTLT-BGDĐT-BNV.

4. Rank in the Practical Lecturer in Vocational Education (Grade III) - Code: V.09.02.04 for civil servants currently holding the High School Teacher (not yet qualified) - Code 15c.207 specified in Circular Joint No. 81/2005/TTLT-BNV-BTC.

5. Rank in the Principal Teacher in Vocational Education (Grade II) - Code: V.09.02.06 for civil servants currently holding the High School Advanced Teacher - Code 15.112 specified in Decision No. 202/TCCP-VC.

6. Rank in the Theoretical Teacher in Vocational Education (Grade III) - Code: V.09.02.07 for civil servants currently holding the High School Teacher - Code 15.113 specified in Decision No. 202/TCCP-VC.

7. Rank in the Practical Teacher in Vocational Education (Grade III) - Code: V.09.02.08 for civil servants currently holding the High School Teacher (not yet qualified) - Code 15c.207 specified in Circular Joint No. 81/2005/TTLT-BNV-BTC.

8. Rank in the Vocational Education Teacher (Grade IV) - Code: V.09.02.09 for civil servants currently holding the High School Teacher (not yet qualified) - Code 15c.207 specified in Circular Joint No. 81/2005/TTLT-BNV-BTC.

6. Amend and supplement Article 16 as follows:

Article 16. Standards and Conditions for Applying for Promotion to the Position of Vocational Education Professional Civil Servant Grades I and II

A vocational education professional civil servant may apply for promotion to a higher position when meeting all the following standards and conditions:

1. Meeting all the standards and conditions prescribed in Clause 16 Article 1 of Decree No. 85/2023/NĐ-CP dated December 7, 2023, of the Government amending and supplementing certain articles of Decree No. 115/2020/NĐ-CP dated September 25, 2020, on recruitment, employment, and management of public officials.

2. Public vocational education institutions have a need and vacant positions corresponding to the grade of the position being promoted.

3. Being nominated by the competent authority to participate in the promotion examination for the position of vocational education professional civil servant.

4. Meeting the standards of the grade of the position being applied for according to the provisions of Chapter II of this Circular.

7. Amend and supplement Clause 2 Article 21 as follows:

“2. Prepare a list of civil servants who meet the standards and conditions for applying for promotion to the position, report to the head of the competent authority managing public officials for consideration and decision on nominating civil servants to participate in the promotion examination; bear responsibility under the law for the standards and conditions of the civil servants nominated to participate in the promotion examination.”

Article 2. Implementation clause

1. Repeal Article 17, Article 18, Article 19, and Clause 1 Article 20 of Circular No. 07/2023/TT-BLDTBXH dated August 28, 2023, of the Minister of Labor, Invalids, and Social Affairs stipulating the code, standards for the positions of vocational education professional civil servants; ranking of salaries, and promotion of positions of vocational education professional civil servants.

2. This Circular takes effect from December 10, 2024.
