Regulations on code numbers and standards

Pursuant to the Civil Servant Law dated November 15, 2010; and the Law Amending and Supplementing Certain Provisions of the Civil Servants and Public Officials Law and the Civil Servant Law dated November 25, 2019;

Pursuant to Decree No. 85/2023/NĐ-CP dated December 7, 2023 of the Government amending and supplementing certain provisions of Decree No. 115/2020/NĐ-CP dated September 25, 2020 of the Government stipulating recruitment, utilization, and management of public servants; Pursuant to Decree No. of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

The Minister of Information and Communication issues this Circular on regulations regarding receiving citizens, handling and resolving complaints, reports, petitions, and reflections of the Ministry of Information and Communication.98/2022/NĐ-CP dated November 29, 2022of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of the Director of the National Registration Agency for Security Interests;

The Minister of Justice issues this Circular to specify the code number and standards for the profession and position of Registration of Security Measures.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular specifies the code number and standards for the profession and position of Registration of Security Measures.

Article 2. This Circular applies to civil servants performing registration work, providing information on security measures, registering assets, and other transactions as prescribed by law (hereinafter referred to as registration of security measures) at Transaction Registration Centers under the National Registration Agency for Security Interests, Ministry of Justice (hereinafter referred to as Registration Centers); and other relevant agencies, organizations, or individuals.

Article 2. Code Numbers for the Profession and Position of Registration of Security Measures

1. Civil servant of the third grade in Registration of Security Measures - Code Number: V.00.01.03

2. Civil servant of the second grade in Registration of Security Measures - Code Number: V.00.01.02

3. Civil servant of the first grade in Registration of Security Measures - Code Number: V.00.01.01

Chapter II

OCCUPATIONAL STANDARDS

REGISTRATION OF SECURITY MEASURES

Article 3. General standards for professional ethics

1. Demonstrate a sense of responsibility and dedication to work; comply with discipline, administrative order, internal regulations, and rules of the agency; respect and not discriminate against organizations or individuals seeking administrative public service related to registration of security measures.

2. Demonstrate a cooperative spirit and facilitate colleagues, individuals, or organizations in fulfilling their responsibilities and in providing administrative public services related to registration of security measures.

3. Lead a healthy and civilized lifestyle suitable for the working environment and the provision of administrative public services related to registration of security measures.

4. Other standards according to the regulations of the Minister of Justice regarding ethical standards for civil servants in the Justice sector.

b) Lead or be primarily responsible for providing professional guidance on judicial records, developing materials and content for professional guidance for Grade II and Grade III Judicial Records Officers;

1. Graduated from university or higher in fields related to law.

2. Hold a certificate in training for registration of security measures according to the program of the Ministry of Justice.

Article 5. Tasks and Standards for Professional Competence for Civil Servants of the Third Grade in Registration of Security Measures

1. Tasks

a) Perform recording, updating information, and backing up documents in registration files and information provision files into the online registration system;

b) Guide or participate in supporting advisory services for organizations or individuals requesting registration of security measures or for other related organizations or individuals;

c) Participate in contributing opinions on programs, plans, documents, or projects on registration of security measures or on public services at Registration Centers or as assigned by competent authorities;

d) Other tasks as prescribed by law or as assigned by competent authorities.

Clause 2. Professional Competence Standards

a) Implement the policies and guidelines of the Party and the State's policies and laws on public services and administrative procedures in performing the tasks specified in Clause 1 of this Article;

b) Possess knowledge, expertise, and skills to perform the tasks specified in Clause 1 of this Article;

c) Possess the ability and skills to draft documents appropriate to the tasks specified in Clause 1 of this Article;

d) Possess the ability to coordinate with relevant agencies, organizations, or individuals in performing the tasks specified in Clause 1 of this Article.

Article 6. Tasks and professional competence standards for civil servants registering second-level security measures

1. Tasks

a) Check registration files and information provision files; propose issuance, refusal to issue registration certification documents for security measures, asset disposal notifications, or other documents; propose corrections to erroneous information, cancellation of registrations, and restoration of cancelled registrations within the functions, tasks, and authorities of the Registration Center; guide and advise relevant organizations and individuals in performing these tasks;

b) Provide professional guidance to third-level security measure registration civil servants according to the division of responsibilities by competent authorities;

c) Advise, propose, and comment on programs, plans, documents, or projects related to security measure registration or public service provision at the Registration Center according to the division of responsibilities by competent authorities;

d) Participate in resolving complaints from organizations and individuals in the field of security measure registration;

e) Other tasks as prescribed by law or assigned by competent authorities;

Clause 2. Professional Competence Standards

a) Proficiently understand and strictly implement the Party's guidelines and the State's policies and laws regarding public service provision and administrative procedures in carrying out the tasks specified in Clause 1 of this Article;

b) Possess knowledge, expertise, and skills to perform the tasks specified in Clause 1 of this Article;

c) Possess the ability to provide professional guidance to carry out the tasks specified in Point b, Clause 1 of this Article;

d) Possess the ability and skills to draft documents, analyze, and explain to carry out the tasks specified in Clause 1 of this Article;

đ) Have the ability to coordinate with relevant agencies, organizations, and individuals in performing the tasks specified in Clause 1 of this Article.

Article 7. Tasks and professional competence standards for first-level security measure registration civil servants

1. Tasks

a) Lead or be primarily responsible for issuing, refusing to issue registration certification documents for security measures, asset disposal notifications, or other documents, or for correcting erroneous information, cancelling registrations, and restoring cancelled registrations within the functions, tasks, and authorities of the Registration Center;

b) Lead or be primarily responsible for guiding and advising organizations and individuals requesting security measure registration or other related organizations and individuals;

c) Lead or be primarily responsible for developing content for professional guidance for second-level and third-level security measure registration civil servants; implement professional guidance for second-level security measure registration civil servants or third-level security measure registration civil servants according to the division of responsibilities by competent authorities;

d) Lead or be primarily responsible for developing and implementing programs, plans, documents, or projects related to security measure registration or public service provision consistent with the functions, tasks, and authorities of the Registration Center or according to the division of responsibilities by competent authorities;

e) Lead or be primarily responsible for resolving complaints from organizations and individuals regarding security measure registration;

f) Other tasks as prescribed by law or assigned by competent authorities;

Clause 2. Professional Competence Standards

a) Proficiently understand and strictly implement the Party's guidelines and the State's policies and laws regarding public service provision and administrative procedures in carrying out the tasks specified in Clause 1 of this Article;

b) Possess knowledge, expertise, and skills to perform the tasks specified in Clause 1 of this Article;

c) Possess organizational and content development capabilities to implement the tasks specified in Points c and d, Clause 1 of this Article;

d) Possess the ability and skills to draft documents, analyze, and explain to carry out the tasks specified in Clause 1 of this Article;

đ) Have the ability to coordinate with relevant agencies, organizations, and individuals in performing the tasks specified in Clause 1 of this Article.

Chapter III

IMPLEMENTING PROVISIONS

Article 8. Effectiveness and Responsibility for Implementation

1. This Circular takes effect from November 8, 2024.

2. In cases where laws on civil servants or normative legal documents cited in this Circular are amended, supplemented, or replaced, they shall be implemented according to the new provisions in the amended, supplemented, or replacing normative legal documents.

3. The Academy of Judicial Science is responsible for coordinating with the National Registry of Security Transactions and the Department of Cadre and Civil Servants Organization to develop training programs and content for issuing certificates for security measure registration business training as stipulated in Clause 2, Article 4 of this Circular, to be completed before May 8, 2025.

4. The Director of the National Registry of Security Transactions, the Head of the Department of Cadre and Civil Servants Organization, the Director of the Academy of Judicial Science, and related organizations and individuals are responsible for enforcing this Circular.

5. During implementation, if there are difficulties or obstacles, the relevant agencies, organizations, and individuals should report them to the Ministry of Justice for review and resolution./.
