Guidelines on the functions, tasks, and powers of specialized agencies

under the People's Committee at the provincial and communal levels concerning fields within the scope of

state management of the Ministry of Science and Technology

Pursuant to Decree No. 55/2025/NĐ-CP dated March 2, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology;

Pursuant to Decree No. 150/2025/ND-CPdated June 12, 2025 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally governed cities and communes, wards, and special administrative-economic zones under provinces and centrally governed cities;

Pursuant to Decree No. 132/2025/ND-CPdated June 12, 2025 of the Government stipulating the division of authority between two levels of local government in the field of state management of the Ministry of Science and Technology;

Pursuant to Decree No. 133/2025/ND-CPdated June 12, 2025 of the Government stipulating the delegation and decentralization in the field of state management of the Ministry of Science and Technology;

At the proposal of the Director of the Cadre and Civil Servant Organization Department and the Director of the Legal Department,

The Minister of Science and Technology promulgates this Circular guiding the functions, tasks, and powers of specialized agencies under the People's Committees at the provincial and communal levels (hereinafter referred to as provincial and communal levels, respectively) concerning fields within the scope of state management of the Ministry of Science and Technology.

PART I

DEPARTMENT OF SCIENCE AND TECHNOLOGY

Article 1. Position and Functions

1. The Department of Science and Technology (hereinafter referred to as the Department) is a specialized agency under the People's Committee at the provincial level, performing the function of advising and assisting the People's Committee at the provincial level in state management over: scientific research activities, technological development, innovation, high-tech development, strategic technology, development of science and technology potential; intellectual property; standardization, measurement, and quality control; radiation and radioactive isotope application; radiation and nuclear safety; postal services; telecommunications; radio frequency spectrum; information and communication technology industry; digital technology industry; information and communication technology application; electronic transactions; digital governance; digital economy, digital society, and digital transformation; information and communication infrastructure; management and organization of implementation of public service activities in the sectors and fields under the Department’s jurisdiction according to the provisions of the law.

2. The Department of Science and Technology has legal personality, its own seal and separate account according to the provisions of the law; it implements directives and management over organization and operation by the People's Committee at the provincial level within its authority; at the same time, it implements directives, guidance, and inspection over professional matters by the Ministry of Science and Technology.

Article 2. Tasks and Authorities

1. Submit to the provincial People's Committee:

a) Draft resolutions of the Provincial People's Council, draft decisions of the People's Committee at the provincial level related to sectors and fields under the Department’s jurisdiction and other documents assigned by the People's Committee at the provincial level;

b) Draft plans for sectoral and field development; programs, plans, projects, measures for organizing the implementation of tasks in sectors and fields within the provincial territory under the Department’s jurisdiction;

c) Draft decisions on the functions, tasks, powers, and organizational structure of the Department; draft decisions on the functions, tasks, powers, and organizational structure of district-level bureaus under the Department, the Provincial Science and Technology Development Fund, and public institutions under the Department (if any);

d) Draft decisions on implementing socialization of service provision activities in sectors and fields within the authority of the People's Committee at the provincial level and according to the delegation and decentralization.

2. Submitting draft documents within the authority to issue by the Chairman of the People's Committee of the provincial level as assigned.

3. Implementing legal normative documents, strategies, plans, programs, projects, and proposals after issuance and approval; providing information, propaganda, guidance, dissemination, education, monitoring, and enforcement of laws in fields under the assigned state management.

4. Implementing and being responsible for registration, issuance, reissuance, revocation, amendment, supplementation, extension, suspension, and termination of various licenses, certificates, confirmation letters, registrations, patents, certificates, and other documents within the Department’s jurisdiction according to the law and according to the delegation and decentralization of the competent authority.

5. Preparing plans, budgets, and proposing annual budget allocation structures and ratios for sectors and fields under the Department’s functional management based on the consolidation of plans and budgets of relevant departments, committees, People's Committees at the communal level, and related agencies. Monitoring and coordinating with related agencies and units to inspect the use of state budget funds in sectors and fields managed by the Department according to regulations.

6. Regarding scientific, technological, and innovative activities

a) Guiding the implementation of directions, goals, tasks in scientific research, technology, and innovation, promoting the development of key economic and technical sectors of the locality based on the application, innovation, and mastery of technology, developing new technologies, high technologies, digital technologies, strategic technologies, and commercializing technology, results of scientific research and technological development;

b) Managing research, development, and application of technology in economic and technical sectors within the locality's scope; guiding the People's Committee at the communal level on professional and operational management in sectors and fields under their jurisdiction;

c) Building, guiding, and implementing mechanisms and policies on high technology; organizing the certification of high technology activities and high technology enterprises according to the delegation and decentralization; building databases and information infrastructure on high technology within the delegated authority;

d) Organizing the identification, ordering, selection, direct assignment, evaluation, acceptance of scientific research, technological, and innovative tasks according to regulations; monitoring and summarizing the situation and results of transferring ownership and usage rights of research results, technological development, and innovation funded by the state budget. Exploiting, applying, commercializing technology, research results, and technological development; announcing, propagandizing research results, technological development, and innovation within the delegated authority.

d) Monitor, guide, inspect, and evaluate the implementation process and post-completion acceptance of scientific and technological tasks and innovation projects funded by the state budget according to the分级权限；组织独立评估科学研究、技术发展和创新成果；确定任务科研和技术成果以及知识产权的价值，依照法律规定；

e) Guide and manage the registration and inspection activities for scientific and technological organizations, representative offices, and branches of scientific and technological organizations within the scope of authority as prescribed by law;

g) Develop, guide, and organize the implementation of mechanisms and policies to encourage and support the development of applied technology research and technical progress, and technology incubation;

h) Support individuals and organizations on the local territory in conducting technology assessment, technological innovation, technology search, technology transfer, decoding, and mastering technology, exploitation of inventions; guide, assess technological level and capacity, and build technological development orientation and technological innovation roadmap for the locality according to the provisions of the law;

i) Receive or guide the receipt of research results, organize application, and evaluate the effectiveness of applying the results of scientific and technological tasks and innovation projects proposed by the provincial People's Committee for commissioning or post-assessment and acceptance;

k) Guide and manage the evaluation, certification, appraisal, and technology transfer activities on the local territory; certify technology transfer registration, issue technology transfer certificates, encourage technology transfer according to the分级权限; organize the identification of investment projects using outdated technology with potential environmental pollution risks, resource overuse; organize quality and value appraisals of machinery, equipment, and production lines of investment projects within the authority; review and provide opinions on the technology of investment projects according to the分级权限; review and provide opinions on the scientific and technological content of local planning, programs, and research projects according to the provisions of the law;

l) Coordinate with provincial departments, agencies, and relevant authorities to propose national scientific and technological tasks and innovation projects; participate in the process of building the list of national scientific and technological tasks and innovation projects when requested; coordinate to monitor and inspect during the implementation process and propose the reception of results, organization of application of the results of national scientific and technological tasks and innovation projects serving local socio-economic development;

Establish advisory councils on science, technology, innovation, and digital transformation according to regulations and分级权限or delegation from the provincial People's Committee, Chairman of the provincial People's Committee;

7. On Innovation and Development of Technology Markets

a) Manage innovation activities; develop, guide, inspect, and organize the implementation of preferential mechanisms and policies to support and encourage innovation development and mobilize investment resources for innovation at the local level;

b) Guide and organize the implementation of innovation activities; guide and implement the application of controlled sandbox frameworks for new technologies, processes, solutions, products, services, or business models; develop the local science and technology market and innovation system with enterprises at the center; establish local regulations supporting innovation;

c) Guide the establishment, management, and development of the local innovation organization system and innovation support organizations according to authority; organize the identification of innovation centers and innovation support centers according to the provisions of the law; build, operate, and develop the local innovation network;

d) Manage, guide, and organize the implementation of the development of the local technology market; promote the local technology market; intermediary organizations of the technology market, technology trading centers, and local technology exchanges;

d) Support enterprises in enhancing their technological capabilities according to the provisions of the law; build and implement programs and projects to support the development of the technology market; support individuals and organizations in technological innovation, commercialization of scientific research and technological development results, technology search, technology import, exploitation of patents, decoding, and mastery of technology; provide opinions on technology for investment projects; assess technological levels and capacities and build technological development orientations according to the provisions of the law;

e) Direct and organize technology and equipment markets, activities connecting supply and demand for technology; technology trading activities, promotion of technology transfer; science and technology exhibitions and innovation;

g) Take the lead in coordinating with relevant agencies to collect, compile, provide information, data, proposals, and implement solutions to serve the construction and improvement of the local innovation index;

8. On Innovative Start-ups and Science and Technology Enterprises

a) Manage and guide the activities of technology incubation, innovative start-ups, and science and technology enterprises; develop, guide, inspect, and organize the implementation of mechanisms and policies to identify, recognize, prefer, support, and encourage the development of technology incubation bases, enterprise incubation bases, technical facilities, shared workspaces, individual innovators, groups of individual innovators, innovative start-up enterprises, start-up innovation advisors, start-up support organizations, investors for start-ups, and other subjects of the start-up ecosystem according to authority;

b) Guide the establishment and issuance of business licenses for science and technology enterprises and innovative startups according to the authority; monitor, inspect, and compile the situation and results of activities of science and technology enterprises and innovative startups as prescribed; coordinate with relevant agencies to implement preferential mechanisms and policies of the State for science and technology enterprises, innovative startups, and scientific and technological organizations in accordance with the law;

c) Manage and develop the local startup ecosystem; promote resource mobilization for innovation, technology incubation, and science and technology enterprise incubation in the locality;

d) Manage, guide, and organize the development of a system of organizations supporting innovation, technology incubators, science and technology enterprise incubators and development centers, technical bases, and shared workspaces supporting innovation; build, operate, and develop networks of innovators, experts, advisors, and startup investors within the management scope of the province;

đ) Develop and implement programs, projects, and initiatives to support technology incubation, science and technology enterprise incubation, innovation, and support public higher education institutions, vocational training institutions, and public scientific and technological organizations established, participating in the establishment, or contributing capital to businesses to commercialize research outcomes and technological development; direct and organize events on technology incubation, science and technology enterprise incubation, and innovation within the authority and as prescribed by law;

9. On developing scientific, technological, and innovative potential

a) Take the lead and coordinate with departments and sectors to build and submit to the competent authority for implementation of planning for public scientific and technological organizations and implement after promulgation; guide the implementation of autonomy mechanisms for public scientific and technological organizations as prescribed; take the lead and coordinate with relevant agencies to submit to the competent authority for issuance and implementation of mechanisms, policies, programs, and investment projects to develop potential and enhance the autonomous capacity of public scientific and technological organizations within the management scope;

b) Manage the activities of scientific and technological organizations both public and private under provincial management; advise on the establishment, review the establishment, restructuring, and dissolution of public scientific and technological organizations; guide the functions, tasks, authorities, organizational structure, and operational regulations of the Management Board in public scientific and technological organizations under provincial management as prescribed;

c) Build and implement plans for training, upgrading, and developing human resources in science, technology, innovation, and digital transformation; plans for training, upgrading, and improving professional expertise in science, technology, innovation, and digital transformation; organize training and upgrading of professional expertise in science, technology, innovation, and digital transformation for the scientific and technological workforce within the management scope;

d) Issue or submit to the competent authority for issuance and implementation of mechanisms and policies on training, upgrading, using, and valuing individuals engaged in science and technology activities; policies to attract outstanding scientists, experts, and intellectuals who are overseas Vietnamese citizens according to the authority and decentralization, delegation of the Provincial People's Committee, Chairman of the Provincial People's Committee;

đ) Take the lead and coordinate with departments and sectors to build and implement communication plans about science, technology, and innovation of the province;

10. On intellectual property

a) Organize the implementation of strategies, planning, programs, plans, and tasks in the field of intellectual property within the assigned authority; implement measures to support the development of industrial property activities; guide industrial property procedures for organizations and individuals; manage, build, and develop geographical indications, trademarks using place names, and other signs indicating the origin of local products according to the law and the decentralization, delegation of the competent authority;

b) Guide and support organizations and individuals in conducting industrial property procedures; take the lead and coordinate with related agencies to protect industrial property rights and handle violations of industrial property laws as prescribed;

c) Manage activities of inventions and innovations. Lead the implementation of measures to popularize, encourage, and promote invention and innovation activities locally; organize the approval process for recognizing inventions created through state-funded expenses and material-technical means according to the law;

d) Assist the Provincial People's Committee in managing national affairs regarding intellectual property in related fields as prescribed by law and the decentralization, delegation of the Provincial People's Committee;

11. On standards, measurement, and quality

a) Organize the development and participate in the development of local technical standards; participate in the development and provide comments on national technical standards;

b) Organize the promotion and application of national technical standards, local technical standards, national standards, international standards, regional standards, foreign standards, and conformity assessment methods for standards and technical standards; guide the development of basic standards for organizations and individuals in the locality; inspect compliance with laws on standards and technical standards in the locality; organize the implementation of product and commodity quality surveys in the locality; warn consumers and relevant agencies in the locality about the risk of product safety hazards.

c) Organize, manage, and guide organizations and individuals engaged in production and business to implement the announcement of standards applicable to products, goods, services, processes, and the environment according to the division of responsibilities assigned by competent state agencies;

d) Receive declarations of conformity from organizations and individuals registered for production and business activities in the locality; receive declarations of compliance for products and goods that may cause safety risks (Group 2 goods) within the scope of management; receive national inspection programs on the quality of imported goods in the assigned field; advise on registering barcode numbers according to the division of responsibilities assigned by competent state agencies; implement state management over the traceability of products and goods in the locality;

đ) Implement tasks related to announcing and answering inquiries about standards, measurement, quality, and technical barriers to trade (referred to as TBT) in the locality; coordinate with the National TBT Point in handling inquiries, reviewing local TBT-related documents and draft measures, and promoting TBT awareness among enterprises to support exports in the locality;

e) Serve as the focal point for implementing tasks, programs, and projects in the field of standards, measurement, and quality within the scope of authority in the locality; organize calibration networks and testing systems for measurement to meet local requirements; organize the implementation of calibration, verification, and testing of measuring instruments and standards in registered fields and areas designated;

g) Manage, organize, and implement the announcement of quantitative marks on the labels of pre-packaged goods according to legal regulations; receive measurement assurance programs from organizations and enterprises in the locality, guide the establishment and application of measurement assurance programs for organizations and enterprises in the locality;

h) Organize the implementation of state inspections on measurement for measurement standards, measuring instruments, measurement methods, quantities of pre-packaged goods, calibration, verification, and testing activities of measuring instruments and standards according to legal regulations; organize the implementation of measures for relevant parties to monitor and inspect the implementation of measurement methods, measuring instruments, measurement standards, and product quality: organize the establishment, maintenance, preservation, and use of local measurement standards;

i) Organize the implementation of testing to serve state management requirements and the needs of organizations and individuals regarding product and good quality in the locality;

k) Take the lead and coordinate with relevant agencies to organize the implementation of quality inspections of products and goods in production, imported goods, circulating goods, and product labels, codes, and barcodes according to the division of responsibilities assigned by competent state agencies;

l) Organize the implementation of advanced quality management system construction, application, maintenance, and improvement in the operations of administrative state agencies in the locality according to legal regulations;

m) Guide organizations and enterprises participating in national and international quality awards; review, evaluate, and propose organizations and enterprises participating in the national quality award in the province according to regulations;

n) Organize the implementation of tasks related to improving productivity and quality of products and goods; serve as the focal point for implementing tasks under the national program supporting enterprises to improve productivity and quality of products and goods, projects on product and good traceability, and projects enhancing and innovating measurement activities to support Vietnamese enterprises in the locality;

o) Promote, disseminate, and guide standardization, measurement, and quality-related regulatory documents to organizations, individuals, and enterprises within the scope of management;

p) Organize the implementation of digital transformation solutions, barcode numbers, and traceability to strengthen state management over productivity and quality of products and goods;

q) Develop and train human resources in the field of standardization, measurement, and quality to ensure quantity and quality;

r) Coordinate in implementing the modernization and development of measurement activities, strengthening national measurement infrastructure capacity, and supporting enterprises to enhance their competitive capabilities within the scope of assigned authority;

12. On the application of radiation and radioactive isotopes; radiation and nuclear safety;

a) Organize the implementation of plans, programs, projects, and measures to promote the application of radiation and radioactive isotopes for economic and social development;

b) Manage environmental radiation monitoring activities in the locality; coordinate in managing the development and application of nuclear energy according to regulations;

c) Manage and implement the receipt of declarations for conducting radiation work using diagnostic X-ray equipment; PET/CT integrated devices; SPECT/CT integrated devices; X-ray emission devices used for X-ray fluorescence analysis, X-ray diffraction analysis, printed circuit board inspection, electron microscopy inspection, security inspection;

d) Lead and coordinate with relevant agencies to conduct inspections and checks on compliance with legal regulations on radiation and nuclear safety within the scope of management and handle violations according to delegated authority and assignments from the provincial People's Committee;

đ) Manage public service activities in the field of nuclear energy, radiation, and nuclear safety in the locality;

e) Lead and coordinate with relevant agencies to assist the provincial People's Committee in developing provincial emergency response plans for radiation and nuclear incidents for approval by competent authorities and implement them after approval; handle radiation and nuclear incidents in the locality according to assignments from the provincial People's Committee; receive, report, and coordinate with relevant agencies to verify information and organize searches and handling of uncontrolled radioactive sources, nuclear materials, and nuclear equipment;

g) To主持并与科学技术部职能单位合作收集在其管理区域内发现但无法确定所有者的放射性废物和放射源；按照法律规定管理其管理区域内的放射源；

h) 指导辖区内组织和个人采取措施管理已使用的放射性废物和放射源，实施在发现放射源、核材料和核设备失控时确保安全和安保的措施；

i) 建立地方辐射安全和放射源安保数据库，并将其与国家科技数据库整合；

13. 关于信息、统计、科技创新和数字化转型

a) 组织并参与制定地方的信息、统计、科技创新和数字化转型规定；

b) 组织分析、汇总并提供服务于领导、管理、研究、教育、生产和经济发展的地方科技信息和统计数据；

c) 指导实施科技任务、创新和数字化转型信息的收集、登记、保存和公布工作，符合相关规定；

d) 建设、管理和运营地方科技创新和数字化转型信息基础设施；更新和利用国家科技、创新和数字化转型数据库；连接和共享地方科技、创新和数字化转型数据库，确保同步和统一；建设和发展科技信息网络；在科技创新信息活动中应用信息技术、通信技术和先进工具；

đ) 实施地方数据项目开发；在教育、农业、医疗、文化、科技、创新和数字化转型等领域发展和集成地方管理系统中的数据和信息，以满足法律规定下的使用需求；

e) 指导组织实施地方科技行业和领域的统计报告制度；

g) 协同组织实施属于国家调查统计计划和非国家调查统计计划的地方科技、创新和数字化转型调查统计活动；组织地方科技、创新和数字化转型调查统计活动；

h) 组织和发展地方科技、创新和数字化转型信息来源；补充书籍、报纸和其他形式的资料；组织和发展图书馆、电子图书馆和数字图书馆工作；参加越南科技联合图书馆；

i) 组织科技信息交易平台，包括在线和互联网平台，举办科技展览和交易会；出版和提供科技、创新和数字化转型信息；

k) 组织科技信息服务活动，包括印刷和数字化服务；组织科技活动；

14. 关于邮政

a) 指导、组织和检查邮政机制、政策、战略、规划、计划、项目和方案的实施；组织检查邮政公共服务目录、支持机制和活动，符合法律规定；

b) 主持并协同相关机构指导和支持公共邮政网络的发展；

c) 管理并协同管理邮政企业的活动；邮政费用、服务质量、邮政安全；邮政邮票；

d) 监督和检查公共邮政网络的活动；邮政公共服务的供应；为机关党、政府服务的邮政业务；

15. 关于电信

a) 指导并实施电信、互联网和数字基础设施的战略、规划、计划、机制和政策，符合省级管理范围；

b) 指导、检查并指示电信企业根据法律规定执行电信活动中的基础设施安全保障工作；主持并建议省人民政府指导依法处理妨碍合法建设、破坏和侵犯电信基础设施的行为；

c) 主持或协同相关机构管理、监督和检查电信基础设施建设和发展活动；协助电信企业完成符合规划和地方发展计划以及法律规定的基本建设手续；

d) 主持或协同相关机构指导、创造便利条件，促进电信技术基础设施、数据中心和数字基础设施的发展，促进共享和共同使用，解决接入、共享和共同使用被动电信基础设施和技术交叉基础设施的问题；

đ) 指导、监督和检查电信企业遵守电信规定的情况；管理电信用户信息；

e) 协同管理、监督和检查为地方机关党、政府服务的电信网络的合规情况；

g) Chair and advise the Provincial People's Committee to propose areas eligible for subsidized public telecommunications services, lists of beneficiaries of such services, terminal equipment at the local level; organize the implementation of programs providing public telecommunications services according to assigned tasks; coordinate to inspect the operation of public telecommunications activities at the local level;

h) Implement quality inspections of equipment, networks, telecommunications services, telecommunications products, and goods within the managed area in accordance with the provisions of the law;

Perform other state management tasks related to telecommunications as prescribed by law and delegated authority;

16. On radio frequency spectrum

a) Guide and inspect the implementation of planning for channel frequency usage for broadcasting and television; technical conditions and operational conditions for exempted wireless devices on the provincial level;

b) Coordinate with regional frequency management organizations in monitoring, inspecting, handling interference, and administratively penalizing violations within the provincial area;

c) Coordinate in managing the quality of radio emissions, electromagnetic compatibility, and safety from radio emissions within the province in accordance with the law;

17. On information technology industry and digital industry

a) Organize the implementation of strategies, plans, programs, projects on the information technology industry, digital industry, semiconductor industry; mechanisms, policies, regulations for managing and supporting the development of the information technology industry, digital industry, semiconductor industry, and developing enterprises operating in these fields;

b) Chair or participate in the review of programs, plans, projects for developing the information technology industry, digital industry, semiconductor industry within the scope of assigned authority and delegated authority by the Provincial People's Committee;

c) Establish, manage, update information and data on the information technology industry, digital industry at the local level to serve regular or ad hoc reporting requirements of state management agencies, and update the digital industry database in accordance with the law;

d) Organize support activities for investment promotion and trade promotion in the information technology industry and digital industry; compile and evaluate the development results of the information technology industry and digital industry at the local level;

đ) Advise the Provincial People's Committee on proposing the establishment, expansion, recognition of concentrated information technology zones, concentrated digital zones, and supplementing the planning of concentrated information technology zones, concentrated digital zones, and other related tasks in accordance with the law and the division of responsibilities by the Provincial People's Committee;

e) Advise the Provincial People's Committee to build and submit to the Provincial People's Council for consideration and issuance of policies to support, provide incentives, and develop the digital industry, semiconductor industry, digital industry human resources, and other related tasks in accordance with the law and the division of responsibilities by the Provincial People's Council;

18. On digital transformation, application of information technology, electronic transactions, development of digital government, digital economy, and digital society

a) Carry out the duties of the permanent agency in the province's digital transformation work; act as the main coordinator, consolidating, advising, and coordinating activities among departments, agencies, and organizations to implement policies, strategies, mechanisms, and policies promoting digital transformation, application of information technology, electronic transactions, development of digital government, digital economy, and digital society, smart governance at the local level;

b) Carry out the duties of the specialized agency on information technology in accordance with the law; propose, establish, guide, and organize the implementation of mechanisms, policies, strategies, plans, programs, and projects of the locality on digital transformation, application of information technology, electronic transactions in state agencies, businesses, and citizens, development of digital government, digital economy, and digital society, smart governance; establish rules and regulations and organize activities on digital transformation, application of information technology, electronic transactions, development of digital government, digital economy, and digital society, smart governance; collect, store, process information to serve leadership guidance and management; organize the deployment, construction, management, operation, and guidance on the use of infrastructure for the local Electronic Information Portal and Government Portal; organize the deployment and ensure technical infrastructure for online public service delivery;

c) Guide the implementation of regulatory documents on managing investment in the application of information technology using state budget funds within the managed scope; monitor and inspect the implementation of programs, plans, projects on the application of information technology within the managed scope, ensuring focused investment, achieving goals, and being effective; inspect compliance with laws on investment in the application of information technology for organizations and individuals involved in managing investment in the application of information technology using state budget funds within the scope of authority; review investment projects in information technology applications, digital transformation, development of digital government, smart governance, digital economy, and digital society within the scope of authority;

d) Build, maintain, update, organize the implementation, and assess compliance with the architecture of digital government, information and communication technology (ICT) architecture for smart city development; act as the technical point of contact to guide the design and deployment of digital architecture for relevant departments and industries within the managed scope and field at the local level;

d) Organize the implementation, construction, management, and operation of unified local digital infrastructure, platforms serving digital transformation, information technology applications, electronic transactions, development of digital government, digital economy, and smart society within the scope of functions assigned by law;

e) Organize the implementation of activities to promote the transition of production and business operations of enterprises and citizens' activities onto Vietnamese digital platforms in accordance with the guidelines of the Ministry of Science and Technology;

g) Organize the implementation of activities to promote the use of digital signatures, time stamps, reliable and electronic authentication services by organizations, businesses, and citizens; coordinate with the General Office for Official Communications of the Government to promote the use of specialized digital signatures in state agencies; promote the application and development of digital signatures, time stamps, reliable and electronic authentication services at the local level in accordance with the guidelines of the Ministry of Science and Technology;

h) Take the lead and coordinate with relevant departments to compile, provide information and data, propose solutions for the annual evaluation index of digital transformation of the province;

i) Manage, inspect, supervise, and report on the operation of dedicated data transmission networks at the local level; coordinate with the Central Post and Telecommunications Administration and telecommunications enterprises to implement connections according to regulations;

19. Regarding public service provision

a) Guide organizations to implement public services in the fields of science and technology, innovation, digital transformation, and other areas within their assigned functions and tasks on the local territory;

b) Implement procedures, formalities, economic and technical norms for the supply of public services; guide and create conditions to support organizations providing public services within the scope of their assigned functions and tasks in accordance with the law;

c) Submit to the provincial People's Committee for issuance, amendment, and supplementation of the list of public services using local budget funds in the fields within the scope of their assigned functions and tasks in accordance with the law;

d) Develop and submit to the provincial People's Committee for issuance of quality criteria and standards for public services using state budget funds in the fields within the scope of their assigned functions and tasks in accordance with the law under local management; submit to the provincial People's Committee for issuance, amendment of economic and technical norms, cost standards (if applicable) for products and public services under local management; coordinate in participating in price management, unit prices of products and public services using local budget funds in accordance with the law on prices and the division of work by the provincial People's Committee;

đ) Submit to the provincial People's Committee for issuance of mechanisms for monitoring, evaluating, certifying quality, and inspection and acceptance regulations for public services using state budget funds in the fields within the scope of their assigned functions and tasks in accordance with the law;

20. Organize research, application of scientific and technological progress, innovation, digital transformation, and other fields within the scope of their assigned functions; exploit, commercialize, publish, and promote the results of scientific research, technological research and development, innovation, and other activities; coordinate in implementing national science and technology tasks funded by the state budget at the local level;

21. Carry out management responsibilities for specialized science and technology, innovation, and digital transformation investment projects at the local level in accordance with laws on investment, state budget, specialized laws, and the division of work and authority by the provincial People's Committee; advise the provincial People's Committee on organizing the implementation of projects and components of programs under their assigned functions and tasks in accordance with the guidance of ministries and the division of work and authority by the provincial People's Committee;

22. Manage, encourage, and support the development of enterprises, cooperatives, collective economies, private sectors, associations, and non-governmental organizations operating in the fields of science and technology, innovation, digital transformation, and other fields within the scope of their assigned functions and tasks in accordance with the law;

23. Carry out cooperation and collaboration activities domestically and internationally in accordance with the law and the division of work and authorization by the provincial People's Committee;

24. Implement commendation and reward activities in the assigned management field in accordance with the law on commendation and reward;

25. Carry out inspection activities, handle complaints and denunciations, prevent corruption, wastefulness, and extravagance in the assigned fields in accordance with the law and the division of work and authorization by the provincial People's Committee; organize citizen reception and implement regulations on preventing corruption, extravagance, and thrift; handle violations within their authority or recommend competent authorities to handle violations in accordance with the law;

26. Manage organizational structure, civil servant staffing, job positions, and the number of personnel in various units under the department according to occupational titles; implement salary systems and policies, usage, promotion, training, rewards, disciplinary actions, and other policies for civil servants, officials, and employees under their management in accordance with the law and the division of work and authorization by the provincial People's Committee;

27. Manage and be responsible for financial resources and assets allocated in accordance with the law and the division of work and authorization by the provincial People's Committee;

28. Carry out information and regular and ad hoc reporting on the situation and results of assigned tasks to the provincial People's Committee, the Ministry of Science and Technology, and related agencies when required;

29. Perform other tasks assigned by the provincial People's Committee and the Chairman of the provincial People's Committee in accordance with the law.

Chapter II

FUNCTIONS, TASKS, POWERS OF THE SOCIAL AND CULTURAL DEPARTMENT UNDER THE PEOPLE'S COMMITTEE AT THE COMMUNE LEVEL IN THE AREAS UNDER THE MANAGEMENT OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

RELATING TO THE PEOPLE'S COMMITTEE OF THE COMMUNE IN THE AREAS UNDER THE ADMINISTRATIVE MANAGEMENT OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

ADMINISTRATIVE MANAGEMENT OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

Article 3. Functions

The Social and Cultural Department is a specialized agency under the People's Committee at the commune level, responsible for advising and assisting the People's Committee at the commune level in managing state affairs in certain areas, including scientific research activities, application and development of technology, innovation and creative entrepreneurship; development of scientific and technological potential; standards, measurement, and quality; intellectual property; postal services; information technology application; electronic transactions; digital government; digital economy, digital society, and digital transformation; information infrastructure in accordance with the provisions of the law.

Article 4. Tasks and Powers

1. Submit to the People's Committee at the commune level

a) Draft resolutions of the People's Council at the commune level (if applicable), draft decisions of the People's Committee at the commune level related to the areas within its functional management scope and other documents as assigned by the People's Committee at the commune level and as stipulated by the law;

b) Draft plans for developing the relevant fields; programs, projects, measures to organize and implement tasks in the areas within the department’s functional management scope;

c) Draft decisions detailing the functions, tasks, powers, and organizational structure in the areas within the department’s functional management scope.

2. Implement legal documents, planning, programs, and plans in the areas within the department’s functional management scope after they are issued or approved; provide information, statistics, propaganda, guidance, dissemination, education, and monitoring of the implementation of laws in the areas assigned.

3. Assist the People's Committee at the commune level in implementing and be responsible for reviewing, registering, issuing various permits, certificates, and other documents in the areas within the assigned functional and task scope according to the law and the division of authority by competent authorities.

4. Assist the People's Committee at the commune level in managing state affairs, encouraging, and supporting the development of collective economic organizations, private enterprises, associations, and non-governmental organizations operating in the areas within the assigned functional and task scope according to the law.

5. Guide, manage, and organize the implementation of scientific and technological tasks, innovation, and digital transformation using state budget funds on the local territory; organize the application of scientific and technological progress, innovation, and digital transformation; develop a labor creativity movement; receive, disseminate, and select research results in science and technology, inventions, initiatives, technical improvements, and production rationalization to apply locally; organize scientific and technological activities and services, innovation, and digital transformation on the local territory.

6. Receive and implement model frameworks from the provincial level in the managed areas.

7. Manage, inspect, and guide postal service points and telecommunications and Internet service provision points on the local territory according to the law.

8. Implement legal provisions regarding product and commodity standards, measurement, and quality on the local territory.

9. Implement legal provisions regarding intellectual property on the local territory according to the law and the division of authority by competent authorities.

10. Inspect organizations and individuals in the assigned areas of responsibility for compliance with legal provisions; receive citizens, handle complaints and denunciations; prevent corruption, waste, and negativity according to the law and the assignment of the People's Committee at the commune level.

11. Manage job positions, civil servant quotas, and implement policies for cadres, civil servants, and public officials in the assigned areas according to the law and the assignment of the People's Committee at the commune level.

12. Build and maintain an information storage and provision system; carry out regular and ad hoc reporting work on the situation and results of activities in the assigned functional and task scope according to the People's Committee at the commune level, the Department of Science and Technology, and other state agencies when required.

13. Manage and operate the commune-level smart operation system, connecting with the provincial-level smart operation center to serve leadership, direction, management, and resolution of tasks within the assigned areas.

14. Guide, manage, and monitor the establishment and operation of community digital technology groups on the commune level according to regulations.

15. Manage and effectively utilize assets, working tools, finances, and budgets allocated according to the law.

16. Perform other tasks and powers as delegated, decentralized, authorized, and defined by competent authorities according to the law.

17. Perform other tasks assigned by the People's Committee at the commune level according to the law.

Chapter III

PUBLIC ENTERPRISES OPERATING IN THE AREAS UNDER THE MANAGEMENT OF THE MINISTRY OF SCIENCE AND TECHNOLOGY

AT THE LOCAL LEVEL

Article 5. Public service units conducting research activities, public service activities, and services in applying scientific and technological progress and technology

1. Position and Functions

Public service units conducting research activities, public service activities, and services in applying scientific and technological progress and technology (referred to as Science and Technology Application Centers or other names, hereinafter referred to as Application Centers) are public service units under the Department of Science and Technology, with the function of researching applications, implementing, and transferring technology, providing science and technology services within the province or centrally governed city.

The Application Center operates on an autonomous mechanism for public service units as prescribed by law.

The Application Center has legal personality, its own seal, and is allowed to open accounts at the State Treasury and banks for its operations as prescribed.

2. Tasks and Authorities

a) Participate in drafting legal documents, programs, and plans on the application, transfer of scientific and technological progress at the local level; develop long-term, annual programs and plans and organize their implementation after approval; organize monitoring, evaluation, summarization, and regular reporting on the application and transfer of scientific and technological progress at the local level;

b) Organize guidance, propaganda, and dissemination of mechanisms and policies encouraging the application, transfer, and innovation of technology within the scope and functions assigned;

c) Organize research and implementation of the application of scientific and technological achievements from both domestic and foreign sources into production, daily life, and environmental protection areas;

d) Implement pilot production projects; train, transfer, commercialize, and expand the results of pilot production projects;

đ) Organize the provision of services related to: technology transfer, assessment of technological levels and capabilities, support for building innovation technology roadmaps, support for technology innovation, and support for technology transfer within the scope of functions and tasks assigned as prescribed by law;

e) Select technical advancements and organize trials to perfect suitable technical procedures for local conditions for new products;

g) Organize the construction, installation, and manufacturing of equipment, production of products or works serving production and daily life after successful research or receipt of technology transfer from domestic and foreign scientific and technological organizations;

h) Carry out regular tasks, public service activities supporting state management work of the Department; implement training, upgrading, and professional skill enhancement services; carry out advisory, brokerage, promotion of technology transfer, and provision of scientific and technological services within the scope of functions and tasks assigned as prescribed by law;

i) Organize technology transfer activities, connect services, provide technical support in implementing technology applications, connect with markets, and promote products derived from technology applications. Participate and organize the implementation of activities to search, demonstrate, connect supply and demand for technology, and expand successful application models; organize conferences, seminars, exhibitions to introduce and promote technology and business of technology products within the scope of functions and tasks as prescribed by law;

k) Build and provide data on technology and technology experts to serve management work and support enterprises in technology innovation; organize training and workshops to transfer scientific and technological advancements to the people; organize visits to models of scientific and technological advancement applications within and outside the province;

l) Develop demonstration models on the application of new technologies, advanced techniques, and popularize them for expansion in accordance with local conditions;

m) Identify the need to complete research outcomes in science and technology development, the need for application, innovation, and technology transfer at the local level; implement solutions to support enterprises and people in applying technical advancements and innovating technology;

n) Carry out cooperation and collaboration activities within and outside the country within the scope of functions and tasks assigned as prescribed by law and according to the delegation of authority of the provincial People's Committee and the Department;

o) Manage organizational structure, personnel, finance, and assets of the Application Center as prescribed by law and according to the delegation of authority of the provincial People's Committee and the Department;

p) Perform other tasks assigned by the Director of the Department.

3. Organizational Structure

a) Leadership: The Application Center has a Director and Deputy Directors as prescribed.

The Director of the Application Center is responsible before the Director of the Department of Science and Technology and the law for all activities of the Center.

The Deputy Directors of the Application Center are responsible before the Director of the Center and the law for the areas of work they are assigned.

b) Professional and operational organizations

The Application Center has an Office and specialized departments to implement tasks within the assigned functions and tasks.

Based on the nature, characteristics, and specific requirements for research and application of science and technology at the local level, the Director of the Application Center will submit to the Director of the Department of Science and Technology for advice and submission to the competent authority to specifically define the functions, tasks, powers, and organizational structure of the Center as prescribed in this Circular and by law.

Article 6. Public service units carry out activities related to public services, information, statistics on science, technology, innovation, and digital transformation.

1. Position and Functions

Public service units carrying out activities related to public services, information, statistics on science, technology, innovation, and digital transformation (referred to as the Science and Technology Information and Statistics Center or other names, hereinafter referred to as the Information Center) are public service units under the Department of Science and Technology, with the function of providing information and statistics on science, technology, innovation, and digital transformation to serve the management work of the provincial or centrally governed city.

The Information Center operates under the autonomy mechanism for public service units as prescribed by law.

The Information Center has legal personality, its own seal, and is allowed to open accounts at the state treasury and banks to operate according to regulations.

2. Tasks and Authorities

a) Participate in drafting and implementing normative legal documents, programs, plans for public service activities, information, and statistical activities in fields within the scope of assigned functions after being issued by competent authorities.

b) Study, compile, analyze, and provide scientific and technological data and information to serve local leadership and state management work; edit, publish, and provide regular publications and special issues in the field of information and statistics on science, technology, innovation, and digital transformation.

c) Guide and organize the collection, registration, preservation, and publication of information on the results of science and technology tasks within the local management scope according to regulations.

d) Exploit, search, and provide domestic and foreign scientific and technological sources to serve the identification, selection, implementation, evaluation, and acceptance of science and technology, innovation, and digital transformation tasks and other tasks for important local programs and projects; serve scientific research, technological development, innovation, and digital transformation; serve economic and social development of the locality.

đ) Build, manage, operate, and develop infrastructure for information and statistics on science, technology, innovation, and digital transformation. Implement updates and exploitation of information in the National Database on Science, Technology, Innovation, and Digital Transformation. Build, manage, connect, and share local databases on science, technology, innovation, and digital transformation, ensuring synchronization and consistency.

e) Implement the connection and deployment of projects of the Vietnam Knowledge Digitization System at the local level. Deploy the construction of local data projects; develop, integrate, and manage local management data systems in areas such as education, agriculture, health, science, technology, innovation, and digital transformation, culture, and publicly share them on the Vietnam Knowledge Digitization System for community exploitation and use.

g) Exploit and develop the scientific and technological information network; apply advanced information technology means in scientific and technological information and statistical activities; build, develop, operate, and manage the electronic information portal of the Department of Science and Technology, electronic information portals, websites, forums on startup and innovation of the province.

h) Organize and implement the reporting system for statistics on science, technology, innovation, and digital transformation at the local level.

i) Participate in and implement national and non-national statistical surveys on science, technology, innovation, and digital transformation at the local level; organize and deploy local scientific and technological statistical surveys; compile, process, analyze, and update into databases on local statistical surveys on science, technology, innovation, and digital transformation within the management scope; disseminate and publish the results of local statistical surveys on science, technology, innovation, and digital transformation.

k) Organize and implement the dissemination of scientific and technological information and statistical information on science, technology, innovation, and digital transformation at the local level; coordinate with mass media agencies to bring scientific knowledge to all target groups; provide scientific and technological information, innovation, and digital transformation to serve local economic and social development.

l) Organize and develop local scientific and technological information resources, innovation, and digital transformation; supplement books, newspapers, materials in various forms such as purchase, gift, exchange; organize and develop library work, electronic libraries, digital libraries, local scientific and technological information networks, innovation, and digital transformation; participate in the Vietnam Library Union on scientific and technological information resources, innovation, and digital transformation.

m) Organize, coordinate, and participate in Technology Markets (Techmart), technology supply-demand connections (Techdemo), Startup and Innovation Day (Techfest), information technology trading centers, online and offline startup idea and product trading platforms, domestic and international science and technology exhibitions and fairs; collect and provide technological information, scientific and technological information products and services, research application results, technical progress in the locality; information about scientific and technological consulting experts, innovation, and digital transformation.

n) Implement and coordinate the implementation of science and technology tasks within the scope of assigned functions and responsibilities.

o) Organize and participate in organizing training activities and professional development; events, conferences, seminars organized annually by the Ministry of Science and Technology, units under the Ministry of Science and Technology, departments, provincial People's Committees on the fields of information, scientific statistics, technology, innovation, and digital transformation;

p) Organize and coordinate organizing visits, learning, cooperation, and sharing experiences regarding models of information, scientific statistics, technology, innovation, and digital transformation activities;

q) Organize, implement, and provide products and services serving scientific research and technological development, education and training, production, and business according to societal requirements in the fields of information, scientific statistics, technology, innovation, and digital transformation, and other fields as prescribed by law;

r) Carry out cooperation and linkage activities within and outside the country within the scope of functions and tasks assigned in accordance with the provisions of law and the分级授权的省级人民政府和局的权限规定；

s) Manage organizational work, personnel, finance, and assets of the Center in accordance with the provisions of law and the分级授权的省级人民政府和局的权限规定；

t) Perform other tasks assigned by the Director of the Bureau.

3. The organizational structure of the Center

Based on the nature, characteristics, and specific requirements for information, scientific statistics, technology, and innovation activities at the local level, the Director of the Information Center shall submit to the Director of the Bureau for approval by the competent authority to specify the functions, tasks, authorities, and organizational structure of the Center in accordance with the regulations.

Article 7. Public Service Units Implementing Activities Related to Standards, Measurement, Productivity, and Quality of Goods

1. Position and Functions

Public service units implementing activities related to standards, measurement, productivity, product quality, goods, codes, and barcodes (referred to as the Standardization, Metrology, and Quality Control Center or another name, hereinafter referred to as the TDC Center) are public service units under the Department of Science and Technology, assisting the Director of the Department in implementing technical service activities related to standards, measurement, productivity, product quality, goods, codes, and barcodes, origin tracing of products and goods to serve state management requirements and the needs of organizations and individuals as prescribed by law.

The TDC Center operates under the autonomy mechanism for public service units as prescribed by law.

The TDC Center has legal personality, its own seal, and is allowed to open accounts at the national treasury and banks to operate and conduct transactions in accordance with the law.

2. Tasks and Authorities

a) Participate in drafting and implementing regulatory documents, programs, plans for standard and technical regulation activities, measurement, product quality, goods, and productivity after being issued by the competent authority;

b) Establish, maintain, preserve, and utilize local measurement standards;

c) Conduct calibration, verification, testing of measuring instruments, measurement standards in registered fields and designated scopes; provide maintenance, repair, and servicing of measuring instruments, measurement standards, experimental equipment, materials, tools, and electrical equipment in accordance with the law;

d) Provide consulting, training, and support to organizations, individuals, enterprises on standardization, measurement, quality improvement, and international integration;

đ) Conduct testing and certification of product and goods quality to serve state management requirements and the needs of organizations and individuals regarding product quality;

e) Provide consulting and conformity assessment of products and goods in compliance with standards and technical regulations to serve state management requirements and the needs of organizations and individuals as prescribed by law;

g) Provide consulting on building and applying quality management systems and productivity improvement tools for organizations, agencies, and enterprises;

h) Assist in the publication of standards applicable to products, goods, services, processes, and environments;

i) Coordinate with relevant agencies to carry out specialized inspections on standards, measurement, labeling, product quality, circulating goods, exported goods, imported goods, codes, and barcodes according to the division of responsibilities or delegation by authorized state agencies;

k) Assist units and organizations participating in the National Quality Award; apply barcode technology;

l) Participate in drafting local technical regulations;

m) Organize and participate in specialized training and professional development courses on standards, technical regulations, measurement, quality, TBT, and productivity;

n) Apply and transfer scientific and technological progress in the fields of standards, measurement, quality, and productivity;

o) Organize promotional, dissemination, introduction, and publicity activities on standards, technical regulations, measurement, codes, and barcodes, productivity, and quality at the local level;

p) Organize visits, learning, cooperation, and experience sharing on standards, measurement, productivity, and quality;

q) Carry out domestic and international cooperation and linkage activities within the scope of assigned functions and tasks in accordance with the law and the分级授权的省级人民政府和局的权限规定；

r) Manage organizational work, personnel, finance, and assets of the Center in accordance with the provisions of law and the分级授权的省级人民政府和局的权限规定；

s) Carry out information and periodic or urgent reporting on the situation and results of assigned tasks as prescribed;

t) Perform other tasks assigned by the Director of the Department;

3. Organizational Structure

a) Leadership: The Center for Innovation Promotion has a Director and Deputy Directors as prescribed;

The Director of the Center for Innovation Promotion is responsible to the Director of the Department of Science and Technology and to the law for all activities of the Center;

The Deputy Directors of the Center are responsible before the Director and the law for the areas of work they are assigned.

b) Professional organizations under the Center for Innovation Promotion have offices and specialized departments to implement tasks within their assigned functions and responsibilities;

Based on the nature, characteristics, and specific requirements for public service activities related to standards, measurement, and quality at the local level, the Director of the Center for Innovation Promotion shall submit to the Director of the Department of Science and Technology for approval by the competent authority to specify the functions, tasks, authorities, and organizational structure of the Center in accordance with this Circular and relevant laws;

Article 8. Public Service Units Implementing Activities Related to Supporting and Promoting Innovation and Entrepreneurship

1. Position and Functions

Public service units implementing activities related to supporting and promoting innovation and entrepreneurship (referred to as the Startup and Innovation Support Center, Innovation Center, Innovation and Startup Support Center, or other names, hereinafter referred to as the Innovation and Startup Support Center) are public service units under the Department of Science and Technology, with the function of assisting the Director of the Department in conducting research activities, public service activities, and providing services related to supporting and promoting innovation and entrepreneurship to serve state management work and the needs of organizations and individuals as prescribed by law;

The Innovation and Startup Support Center operates under the autonomy mechanism for public service units as prescribed by law;

The Innovation and Startup Support Center has legal personality, its own seal, and is allowed to open accounts at the national treasury and banks to operate as prescribed;

2. Tasks and Authorities

a) Develop five-year and annual plans for the Center's tasks, organize implementation after issuance and approval; participate in building and lead or coordinate in disseminating mechanisms, policies, professional guidance, and organizing the implementation of legal documents, programs, and plans on innovation promotion and startup support at the local level within the scope of assigned functions and responsibilities;

b) Organize controlled testing (sandbox) for innovative activities involving new products, services, and new technology business models;

c) Organize activities to promote and develop the local startup ecosystem; mobilize investment resources for startups; support and encourage the development and enhance the capacity of technology incubators, science and technology enterprises, technical facilities, co-working spaces, individual entrepreneurs, entrepreneurial groups, startup advisors, startup support organizations, investors for startups, and other entities of the startup ecosystem;

d) Conduct research and public service activities serving state management work on innovation promotion and startup support at the local level; implement activities, programs, projects, and proposals on innovation promotion and startup support according to the law;

đ) Provide public service, scientific and technological services, consulting, support, incubation, training services; engage in production and business activities (through economic contracts and other types of contracts) consistent with assigned functions and responsibilities and in accordance with the law; advise on the formation and connection of organizations and individuals, networks for innovation and entrepreneurship to promote innovation and develop the local startup ecosystem;

e) Survey and assess the demand for enhancing the capacity of organizations and individuals regarding innovation promotion and startup support in the locality;

g) Promote collaboration between organizations and businesses in innovation activities and innovation support; build and develop domestic and international innovation partner networks;

h) Organize conferences, seminars, events; conduct international cooperation and investment promotion activities; implement cooperative programs to promote innovation and support startups for organizations, individuals, and businesses;

i) Provide professional training and coordination in implementing training activities for organizations and individuals within the scope of assigned functions and responsibilities and in accordance with the law;

k) Lead and coordinate with relevant agencies to collect, compile, provide information, data, proposals, and implement solutions to improve the local innovation index; provide advisory services and support for businesses to develop technology upgrade roadmaps, assist organizations and individuals in conducting innovation and startup activities;

l) Manage organizational work, human resources, files, documents, finance, and assets of the unit in accordance with the law, provincial People's Committee delegation, and the Department;

m) Monitor, compile information, and prepare regular and urgent reports on the content and operational situation within the scope of assigned functions and responsibilities;

n) Perform other tasks assigned by the Director of the Department;

3. Organizational Structure

a) Leadership: The Innovation and Startup Support Center has a Director and Deputy Directors as prescribed;

The Director of the Application Center is responsible before the Director of the Department of Science and Technology and the law for all activities of the Center.

The Deputy Directors of the Application Center are responsible before the Director of the Center and the law for the areas of work they are assigned.

b) Specialized units under the Center

The Innovation and Startup Support Center has an Office and several specialized departments to implement tasks within their assigned functions and responsibilities (such as: Innovation Promotion Department; Startup Support Department; Service Development Department...).

BASED ON THE CRITERIA, CONDITIONS FOR ESTABLISHMENT AND THE NATURE, CHARACTERISTICS, SPECIFIC REQUIREMENTS FOR INNOVATION ACTIVITIES AND LOCAL STARTUP SUPPORT, THE DIRECTOR OF THE DIGITAL TRANSFORMATION CENTER SHALL SUBMIT TO THE DEPARTMENT DIRECTOR FOR ADVISORY PURPOSES AND THEN PRESENT TO THE AUTHORIZED BODY TO ISSUE SPECIFIC REGULATIONS ON THE FUNCTIONS, DUTIES, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE CENTER IN ACCORDANCE WITH THIS CIRCULAR AND LEGAL PROVISIONS.

Article 9. Public Service Units Implementing Research Activities and Services on Digital Transformation, Infrastructure, and Information Technology Applications

1. Position and Functions

Public service units implementing research activities and services on digital transformation, infrastructure, and information technology applications (referred to as the Digital Transformation Center or the Digital Transformation and Information Technology Center or other names, hereinafter referred to as the Digital Transformation Center) are public service units under the Department of Science and Technology, with the function of assisting the Department Director in conducting research activities, performing public service tasks, and providing services related to digital transformation, infrastructure, and information technology applications, building digital government, digital economy, and digital society, smart governance in accordance with the regulations.

The Digital Transformation Center shall implement the autonomy mechanism for public service units in accordance with the provisions of the law.

The Digital Transformation Center has legal personality, its own seal, and is entitled to open accounts at state treasuries and banks for operation and transactions in accordance with the regulations.

2. Tasks and Authorities

a) Develop the five-year program, annual plan of tasks of the Center and organize implementation after issuance and approval; participate in developing and mainly or jointly promote and disseminate mechanisms, policies, professional guidance, organize the implementation of legal documents, programs, plans on digital transformation, infrastructure, and information technology applications, building digital government, digital economy, and digital society, smart governance at the local level within the assigned functions and duties;

b) Carry out public service activities serving state management on digital transformation, infrastructure, information technology applications, building digital government, digital economy, and digital society, smart governance at the local level; implement activities, programs, projects, proposals on digital transformation, infrastructure, information technology applications, building digital government, digital economy, and digital society, smart governance in accordance with the law; perform tasks related to the implementation of the digital government architecture, data governance strategy, digital transformation, digital government, digital economy, and digital society, smart governance of the locality;

c) Exploit and apply digital technologies, information technology, and data; promote and mobilize resources to provide convenient, easy, and secure digital services for individuals, organizations, and businesses; develop digital government, create impetus for digital economy, data-driven economy, and digital society;

d) Deploy and ensure the operation of provincial digital infrastructure, platforms, common information systems; guide and support technical assistance to agencies and units in the province to deploy and use common digital platforms, information systems; apply information technology and digital technology;

đ) Deploy, integrate, share, exploit provincial common data according to regulations; guide the implementation of activities to establish, manage, share, and exploit digital data in provincial agencies;

g) Ensure infrastructure for information technology, respond to incidents for common digital platforms, application platforms, information systems, common databases;

h) Provide technical support for the activities of provincial agencies, district-level People's Committees to implement solutions ensuring the security of information technology infrastructure in building digital government, digital economy, and digital society, smart governance;

i) Advise and supply services supporting agencies, units, enterprises in the province to implement digital transformation, information technology applications, and development of digital government, digital economy, and digital society, smart governance; support human resources for digital transformation work in state agencies, organizations, units, and enterprises under provincial management;

k) Organize the implementation of training programs, guidance, skill enhancement, transfer of technical solutions, digital technology training for leadership and management cadres, personnel engaged in advisory and specialized implementation of digital transformation, personnel using digital transformation applications in provincial agencies, organizations, and units when required;

l) Implement information and communication activities to serve the construction of digital government, digital economy, and digital society, smart governance;

m) Carry out domestic and international cooperation and collaboration on digital transformation, infrastructure, information technology applications, digital government, digital economy, and digital society, smart governance within the scope of assigned functions and duties;

n) Organize consulting on feasibility studies, economic-technical reports, budgets, project management, service procurement, bidding consultation, design consultation, supervision of implementation of programs, construction projects, and works on information technology; consulting, designing, supplying, developing, deploying, and transferring software products, hardware, digital content, technology applications;

o) Manage organizational structure, human resources, files, documents, finance, assets of the Digital Transformation Center in accordance with the law, decentralization and delegation of authority by the provincial People's Committee and the Department;

p) Monitor, compile information, and prepare regular and ad hoc reports on the content and situation of activities within the scope of assigned functions and duties;

q) Perform other tasks assigned by the Department Director.

BASED ON THE CRITERIA, CONDITIONS FOR ESTABLISHMENT, AND THE NATURE, CHARACTERISTICS, SPECIFIC REQUIREMENTS FOR DIGITAL TRANSFORMATION ACTIVITIES, INFORMATION TECHNOLOGY APPLICATIONS, CONSTRUCTION OF DIGITAL GOVERNMENT, DIGITAL ECONOMY, DIGITAL SOCIETY, AND SMART GOVERNANCE AT THE LOCAL LEVEL, THE DIRECTOR OF THE DIGITAL TRANSFORMATION CENTER SHALL SUBMIT TO THE DIRECTOR OF THE DEPARTMENT FOR ADVISORY AND PRESENTATION TO THE AUTHORIZED AUTHORITY TO SPECIFY IN DETAIL THE FUNCTIONS, DUTIES, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE CENTER IN ACCORDANCE WITH THIS CIRCULAR AND THE PROVISIONS OF THE LAW.

THIS CIRCULAR REPLACES CIRCULAR NO. 01/2021/TT-BKHCN OF MARCH 1, 2021 ISSUED BY THE MINISTER OF SCIENCE AND TECHNOLOGY GUIDING THE FUNCTIONS, DUTIES, AND POWERS OF SPECIALIZED AGENCIES FOR SCIENCE AND TECHNOLOGY UNDER THE PEOPLE'S COMMITTEES OF PROVINCES AND DISTRICTS, AND CIRCULAR NO. 11/2022/TT-BTTTT OF JULY 29, 2022 ISSUED BY THE MINISTER OF INFORMATION AND COMMUNICATIONS GUIDING THE FUNCTIONS, DUTIES, AND POWERS OF THE DEPARTMENTS OF INFORMATION AND COMMUNICATIONS UNDER THE PEOPLE'S COMMITTEES OF PROVINCES AND THE CULTURAL AND INFORMATION DEPARTMENTS UNDER THE PEOPLE'S COMMITTEES OF DISTRICTS.

THE STANDARDS MEASUREMENT QUALITY INSPECTION BRANCH SHALL CONTINUE TO OPERATE IN ACCORDANCE WITH THE GUIDANCE PROVIDED IN CIRCULAR NO. 01/2021/TT-BKHCN OF MARCH 1, 2021 ISSUED BY THE MINISTER OF SCIENCE AND TECHNOLOGY GUIDING THE FUNCTIONS, DUTIES, AND POWERS OF SPECIALIZED AGENCIES FOR SCIENCE AND TECHNOLOGY UNDER THE PEOPLE'S COMMITTEES OF PROVINCES AND DISTRICTS UNTIL A DECISION IS MADE BY THE AUTHORIZED AUTHORITY IN ACCORDANCE WITH THE PROVISIONS OF THE LAW.

Article 12. Responsibility for Implementation

1. THE PEOPLE'S COMMITTEES OF PROVINCES AND MUNICIPALITIES DIRECTLY UNDER THE CENTRAL GOVERNMENT

a) SPECIFY IN DETAIL THE FUNCTIONS, DUTIES, AND POWERS OF THE DEPARTMENT OF SCIENCE AND TECHNOLOGY IN ACCORDANCE WITH THE GUIDANCE PROVIDED IN THIS CIRCULAR; DECIDE THE ORGANIZATIONAL STRUCTURE OF THE DEPARTMENT OF SCIENCE AND TECHNOLOGY IN ACCORDANCE WITH THE REQUIREMENTS OF STATE MANAGEMENT, ENSURING COMPREHENSIVENESS IN MAJOR GROUPS OF AREAS: SCIENCE AND TECHNOLOGY; INNOVATION; DIGITAL TRANSFORMATION; DIGITAL INFRASTRUCTURE; POSTAL SERVICES; STANDARDS, MEASUREMENTS, AND QUALITY; INTELLECTUAL PROPERTY;

b) DECIDE THE ESTABLISHMENT, REORGANIZATION, AND DISSOLUTION OF PUBLIC SERVICE UNITS UNDER THE DEPARTMENT OF SCIENCE AND TECHNOLOGY IN ACCORDANCE WITH THE PROVISIONS OF THE LAW, ENSURING CONSISTENCY WITH THE GUIDANCE OF THE MINISTRY OF SCIENCE AND TECHNOLOGY, THE MINISTRY OF HOME AFFAIRS, AND THE PRACTICAL REQUIREMENTS OF THE LOCALITY;

c) PROVIDE DETAILED GUIDANCE ON THE FUNCTIONS, DUTIES, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE SOCIAL AND CULTURAL DEPARTMENT REGARDING THE AREAS OF SCIENCE AND TECHNOLOGY, INNOVATION, DIGITAL TRANSFORMATION, AND OTHER AREAS AS PROVIDED IN THIS CIRCULAR AND OTHER RELATED LEGAL DOCUMENTS.

2. THE CHAIRMAN OF THE PEOPLE'S COMMITTEE OF THE PROVINCE SHALL SPECIFY THE FUNCTIONS, DUTIES, POWERS, AND ORGANIZATIONAL STRUCTURE OF PUBLIC SERVICE UNITS UNDER THE DEPARTMENT OF SCIENCE AND TECHNOLOGY AND PUBLIC SERVICE UNITS UNDER THE BRANCHES BELONGING TO THE DEPARTMENT OF SCIENCE AND TECHNOLOGY (IF ANY) IN ACCORDANCE WITH THE PROVISIONS OF THE LAW.

3. THE PEOPLE'S COMMITTEE OF THE COMMUNE SHALL SPECIFY THE FUNCTIONS, DUTIES, AND POWERS OF THE SOCIAL AND CULTURAL DEPARTMENT REGARDING THE MANAGEMENT AREAS IN ACCORDANCE WITH THE GUIDANCE OF THE PEOPLE'S COMMITTEE OF THE PROVINCE, THE MINISTRY OF SCIENCE AND TECHNOLOGY, AND OTHER RELATED LEGAL DOCUMENTS AND THE PRACTICAL REQUIREMENTS OF THE LOCALITY.

4. DURING THE IMPLEMENTATION PROCESS, IF THERE ARE ANY NEW DEVELOPMENTS, DIFFICULTIES, OBSTACLES, OR NEEDS FOR AMENDMENTS AND SUPPLEMENTS, THE PROVINCES AND MUNICIPALITIES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL REPORT PROMPTLY TO THE MINISTRY OF SCIENCE AND TECHNOLOGY FOR RESOLUTION IN ACCORDANCE WITH THEIR AUTHORITY./.
