Pursuant to the Law on Adoption 2010;

Pursuant to Decree No. 19/2011/NĐ-CP dated March 21, 2011 of the Government detailing certain provisions of the Law on Adoption; Decree No. 24/2019/NĐ-CP dated March 5, 2019 of the Government amending and supplementing certain articles of Decree No. 19/2011/NĐ-CP dated March 21, 2011 of the Government detailing certain provisions of the Law on Adoption; Decree 06/2025/NĐ-CP dated 08 the 01 day5 of the Government amending and supplementing certain articles of decrees on adoption;

Pursuant to Decree No. 39/2025/NĐ-CP dated February 26 the 02 day5 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

At the proposal of The Director of the Department of Administrative Justice;

The Minister of Justice issues this Circular amending and supplementing certain Articles of Circular No. 10/2020/TT-BTP dated December 28, 2020 issued by the Minister of Justice guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files has been amended and supplemented VIOLATION Circular No. 10/2020/TT-BTP dated December 28, 2020 issued by the Minister of Justice guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files has been amended and supplemented some articles according to Circular No. 7/2023/TT-BTP on some articles according to Circular No. 7/2023/TT-BTP.

Article 1. Amending and supplementing some articles of Circular No. 10/2020/TT-BTP dated December 28, 2020 issued by the Minister of Justice guiding the recording, use, management, and storage of Adoption Registers, sample documents, and adoption files has been amended and supplemented some articles according to Circular No. 7/2023/TT-BTP

1. Amending and supplementing Clause 3 of Circular No. 10/2020/TT-BTP amended and supplemented in 2023 as follows:

"Article 3. Issuing models of Registers and sample documents
a) Two Register models (Annex I);
a) Two models of Registers (Annex I);
d) Seven common forms for both domestic and international element adoption registrations (Annex IV);
đ) Electronic version of the Certificate of Adoption for Domestic Adoption (Annex V).
2. Standards regarding size, color, technical details of Register and form models are described specifically in the Annexes issued together with this Circular.
3. Information in application forms and declarations is simultaneously used to build interactive electronic forms when state agencies provide online public services. Individuals performing administrative procedures sign digital signatures on electronic application forms and declarations.
4. Signatories of the electronic versions of documents resulting from administrative procedure resolutions shall implement digital signing in accordance with the law.
3. Information in the application forms and declaration forms shall be simultaneously used to build interactive electronic forms when state management agencies provide online public services. The person handling administrative procedures signs the electronic application form with an electronic signature.

4. The person signing the electronic version of the documents resulting from the processing of administrative procedures must sign electronically in accordance with the law."

2. Amending and supplementing Article 5 of Circular No. 10/2020/TT-BTP amended and supplemented in 2023 as follows:

"Article 5. Requirements for recording and methods of recording the Adoption Registration Register, the Issue, Extension, Amendment Register of Foreign Adoption Organizations' Operating Licenses in Vietnam and adoption documents
1. The commune-level civil servant, provincial Department of Justice staff, diplomatic and consular officials, and civil servants of the Department of Administrative Justice under the Ministry of Justice (hereinafter referred to as the personnel responsible for adoption registration) who perform the procedures must directly record in the Adoption Registration Register, the Issue, Extension, Amendment Register of Foreign Adoption Organizations' Operating Licenses in Vietnam and adoption documents.

The recorded content must be accurate, handwriting must be clear and legible, no abbreviations or erasures are allowed, and the same color of ink must be used, excluding red ink.

The recording of the Issuance, Renewal, and Amendment of the Permit for Foreign Adoption Organizations to Operate in Vietnam shall be done using a computer.
2. The surname, middle name, given name of the adoptive parents, adopted child, and person surrendering the child for adoption must be recorded in capital letters according to the Identity Card/Electronic Identity Card/Passport/Birth Certificate or other substitute documents with attached photos and personal information issued by competent authorities and still valid.
3. The Place of Birth of the adopted child must be fully recorded according to the Birth Certificate.
4. The Place of Residence shall be recorded as follows:
a) In cases where the adoptive parents are Vietnamese citizens residing in Vietnam or foreign nationals permanently residing in Vietnam, their address should be recorded according to the permanent residence registration and include two administrative levels (commune and province). In cases where a stepfather adopts his wife's child or a stepmother adopts her husband's child or an aunt, uncle, or cousin adopts a niece or nephew, if there is no permanent residence registration, the temporary residence registration address should be recorded.
b) In cases where the adoptive parents are foreign nationals permanently residing abroad, their address should be recorded according to their permanent residence address abroad. In cases where foreign nationals working or studying in Vietnam for at least one year without being granted a permanent residence card, both their permanent residence address abroad and their temporary residence address in Vietnam should be recorded.
c) The place of residence of the adopted child should be recorded according to the permanent residence registration address of the adopted child and include two administrative levels (commune and province). If there is no permanent residence registration, the temporary residence registration address should be recorded; if there is neither a permanent nor a temporary residence registration, the actual living address should be recorded.

In cases where the adopted child lives in a care facility, the name and address of the care facility's headquarters should be recorded. In cases where the care facility has multiple branches, the name and address of the branch where the child resides should be recorded.
5. The Adoption Registration Agency shall be recorded as follows:
a) In cases where domestic adoption is registered domestically, the name of the Commune People's Committee and the name of the provincial location where the registration takes place shall be recorded.
b) In cases where domestic adoption is registered at a Vietnamese representative office abroad, the name of the Vietnamese representative office abroad shall be recorded.

c) In cases of registering international adoptions, the Provincial Department of Justice where the registration takes place should be recorded."

Article 2. Replacing and abolishing certain provisions, Appendices issued together with Circular No. 10/2020/TT-BTP amended and supplemented in 2023

1. Replacing and abolishing certain provisions

a) Replacing the phrase "Ministry of Justice" in Clause 5, Article 2 and Clause 3, Article 7 of Circular No. 10/2020/TT-BTP amended and supplemented in 2023 with the phrase "Administrative Justice Department under the Ministry of Justice".

b) Abolishing the phrase "People's Committee at the district level" in Clause 3, Article 7 of Circular No. 10/2020/TT-BTP amended and supplemented in 2023.

2. Replacing and abolishing Appendices

a) Replacing Appendix 1, Appendix 2, Appendix 3, Appendix 4, and Appendix 6 with Appendices I, Appendix II, Appendix III, Appendix IV, and Appendix V issued together with this Circular.

b) Abolishing Appendix 5.

Article 3. Implementation Provisions

1. This Circular takes effect from August 4, 2025.

2. For adoption registration files within the country, adoption registration files outside the country, and files for issuing, extending, and amending the Operating License of foreign adoption organizations in Vietnam received by competent state agencies before the effective date of this Circular but not yet resolved, the adoption-related documents already included in these files shall continue to have legal validity according to the provisions of Circular No. 10/2020/TT-BTP amended and supplemented in 2023./.
