Repeals in whole or in part certain regulatory legal documents issued by the Minister of Health concerning the prevention and control of HIV/AIDS

On the basis ofDecree No. Decision No. 78/2025/NĐ-CPonApril 1 2025 of This Decree No. 141/2024/NĐ-CP dated October 28, 2024 of the Government detailing certain provisions of the Law on Prevention and Control of HIV/AIDS;
On the basis ofDecree No. Decree No.onOctober 28, 2024, of the Government detailing certain provisions of the Law on Prevention and Control of Viruses Causing Acquired Immunodeficiency Syndrome (AIDS);
Pursuant toDecree No. Decision No. 42/2025/NĐ-CPFebruary 27This Decree No. 27/2025/NĐ-CP dated February 27, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;
At the proposal of the Director of the Preventive Medicine Department;
The Minister of Health issues this Circular to repeal in whole or in part certain regulatory legal documents issued by the Minister of Health concerning the prevention and control of HIV/AIDS.
Article 1. Repeals in full two regulatory legal documents issued by the Minister of Health
1. Joint Circular No. 03/2010/TTLT-BYT-BCA dated January 20, 2010 of the Ministry of Health and the Ministry of Public Security regarding the issuance, distribution, management, and use of Community Access Cards for implementing harm reduction interventions to prevent HIV transmission.
2. Circular No. 04/2019/TT-BYT dated March 28, 2019 of the Minister of Health regarding the delegation of authority for issuing, adjusting, and revoking certificates confirming eligibility for HIV confirmatory testing and suspending such testing activities.
Article 2. Repealing part of two legal normative documents issued by the Minister of Health.
1. Repeals Point a Clause 1 Article 1, Article 3, and Article 4 of Circular No. 06/2012/TT-BYT dated April 20, 2012 of the Minister of Health regarding conditions for establishment and operational content of organizations providing counseling services for HIV/AIDS prevention and control.
2. Repeals Article 6 and Clause 1 Article 7 of Circular No. 01/2015/TT-BYT dated February 27, 2015 of the Minister of Health guiding counseling services for HIV/AIDS prevention and control at healthcare facilities.
Article 3. Implementation Provisions
1. This Circular takes effect from the date of issuance.
2. The Director of the Ministry's Office, Heads of Departments under the Department of Legal Affairs, Inspectorate, Departments, and Bureaus under the Ministry of Health, and relevant agencies, organizations, and individuals are responsible for implementing this Circular.
