Pursuant to Decree No. 77/2017/NĐ-CP dated July 3, 2017 of the Government on management and security protection at port border gates;
At the proposal of the Minister of National Defense,
The Prime Minister issues this Decision on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense[1].
Chapter I. GENERAL PROVISIONS
Article 1. Scope of Regulation
1. This Decision regulates the implementation of electronic border procedures for persons, drivers, passengers, vehicles exiting and entering at international border gates, main border gates on land borders; domestic Vietnamese ships operating routes to and from port border gates; issuance of visas at international border gates on land borders and port border gates managed by the Ministry of National Defense (hereinafter referred to as the implementation of electronic border procedures in visa issuance at border gates).
2. Electronic border procedures at sea ports managed by the Ministry of National Defense for Vietnamese ships entering and exiting; foreign ships, crew members entering and exiting, transiting, changing ports shall be implemented in accordance with Decision No. 10/2016/QĐ-TTg dated March 3, 2016 of the Government Chairman on the implementation of electronic border procedures at sea ports.
Article 2. Applicability
1. Border Guard Posts at International Border Gates, Border Guard Posts at Main Border Gates, and Border Control Stations at International Border Gates, Main Border Gates on land borders (hereinafter referred to as Border Guards at Land Border Gates); Command Posts at Port Border Gates, Border Guard Posts at Port Border Gates, and Border Stations at Port Border Gates under Border Guard Posts (hereinafter referred to as Border Guards at Port Border Gates).
2. Vietnamese citizens exiting and entering (individuals or groups) at international border gates, main border gates on land borders; foreigners (individuals or groups) entering and exiting Vietnam for sightseeing and tourism according to programs organized by international travel agencies in Vietnam (hereinafter referred to as Tourist Groups); foreigners obtaining visas at international border gates on land borders and port border gates managed by the Ministry of National Defense (hereinafter referred to as Visa Holders at Border Gates).
3. Vietnamese citizens, foreigners exiting and entering at international border gates, main border gates on land borders in groups dispatched abroad or invited to Vietnam by ministries, agencies at the level of ministries, provincial People's Committees, or equivalent bodies (hereinafter referred to as Official Delegations).
4. Drivers, passengers, vehicles exiting and entering, including:
a) Drivers, passengers, vehicles of foreign mechanical means entering and exiting to participate in traffic in Vietnam in accordance with Decree No. 152/2013/NĐ-CP dated November 4, 2013 of the Government on the management of foreign mechanical means brought into Vietnam for tourism and Decree No. 57/2015/NĐ-CP dated June 16, 2015 of the Government amending and supplementing certain provisions of Decree No. 152/2013/NĐ-CP dated November 4, 2013 of the Government on the management of foreign mechanical means brought into Vietnam for tourism;
b) Drivers, passengers, vehicles exiting and entering operating in accordance with agreements on road transport between Vietnam and neighboring countries and international treaties to which the Socialist Republic of Vietnam is a party.
5. Domestic Vietnamese ships operating routes to and from port border gates.
6. Agencies, organizations, and individuals related to the implementation of electronic border procedures at border gates managed by the Ministry of National Defense.
Article 3. Explanation of Terms
In this Decision, the following terms shall be understood as follows:
1. Electronic border procedure at land border gates is the process where the person handling the procedure reports information, and the Border Guard at the land border gate receives, processes, exchanges information, and confirms the completion of the electronic border procedure report for persons and vehicles entering and exiting through the Electronic Border Procedure Portal or through the National Single Window Portal in accordance with the regulations on the implementation of the national single window mechanism and this Decision when the Electronic Border Procedure Portal is fully connected to the National Single Window Portal.
2. Electronic border procedure for domestic Vietnamese ships operating routes to and from port border gates includes border procedures, where the person handling the procedure reports information, and the Border Guard at the port border gate receives, processes, exchanges information, and confirms the completion of the border procedure for crew members, passengers, and domestic Vietnamese ships operating routes to and from port border gates through the National Single Window Portal or through the Electronic Border Procedure Portal in case the National Single Window Portal has technical issues.
3. Electronic border procedure in visa issuance at border gates is the process where the person handling the procedure reports information, and the Border Guard at the land border gate, the Border Guard at the port border gate receives, processes, and confirms the completion of the information reporting in visa issuance for foreigners at land border gates and port border gates through the Electronic Border Procedure Portal or through the National Single Window Portal in accordance with the regulations on the implementation of the national single window mechanism and this Decision when the Electronic Border Procedure Portal is fully connected to the National Single Window Portal.
4. Persons handling electronic border procedures (hereinafter referred to as the person handling the procedure)
a) The person handling the procedure for Vietnamese citizens exiting and entering is an individual Vietnamese citizen exiting and entering or a person authorized by a Vietnamese citizen exiting and entering to handle the electronic border procedure at the land border gate.
b) The person handling the procedures for the Tourist Group and the visa recipient at the border gate is the person authorized by the international travel service business enterprise in Vietnam to declare and handle the electronic border control procedures for the Tourist Group and the visa recipient at the border gate;
c) The person handling the procedures for the Official Group is the person authorized by the agency or organization specified in Clause 3, Article 2 of this Decision to declare and handle the electronic border control procedures for the Official Group;
d) The person handling the procedures for the driver, passenger on the vehicle, and the vehicle exiting or entering the country is the person authorized by the international travel service business enterprise in Vietnam or the enterprise, cooperative engaged in international road transport to declare and handle the electronic border control procedures for the driver, passenger on the vehicle, and the vehicle exiting or entering the country;
đ) The person handling the procedures for the Vietnamese vessel operating domestic routes arriving at or departing from the port border gate is the ship owner or ship manager, ship charterer, ship operator, captain, or the person authorized to perform the declaration and handling of the electronic port border control procedures for the Vietnamese vessel operating domestic routes arriving at or departing from the port border gate. 5. The electronic border control procedure portal is an access point on the internet, built upon the basis of the electronic port border control procedure portal stipulated in Clause 2, Article 3 of Decision No. 10/2016/QĐ-TTg dated March 3, 2016 of the Government Chairman regarding the implementation of electronic port border control procedures, to carry out electronic border control procedures for land borders and ports; it integrates information, services, and applications (creating electronic forms and declarations, supporting extraction for printing forms and declarations), through which users can exploit, utilize, and personalize the display of information at the address http://thutucbienphong.gov.vn.
6. The electronic border gate declaration form is an electronic declaration form that the person handling the procedures must fill out when implementing the electronic border control procedures at the land border gate.
7. The electronic border control file at the land border gate is a collection of electronic border gate declaration forms.
8. Declaring the electronic border control procedures at the land border gate is the act of the person handling the procedures using the Internet to declare the electronic forms and send them to the Border Guard at the land border gate through the electronic border control procedure portal.
9. The manual border control procedures at the land border gate are the procedures carried out between the person handling the procedures and the Border Guard at the land border gate through paper declarations.
10. Confirmation of completion of the electronic border control declaration procedures at the land border gate is the act of the Border Guard at the land border gate receiving, checking, processing the information, and sending the Confirmation of Completion of the Electronic Border Control Declaration Procedures at the Land Border Gate to the person handling the procedures through the electronic border control procedure portal.
9. Manual border guard procedures at land border gates involve the completion of paper declarations by the person handling the procedures and the implementation of border guard procedures by the border gate border guards through paper forms.
10. Confirmation of the completion of electronic border guard declaration procedures at land border gates refers to the act of the border gate border guards receiving, inspecting, processing information, and sending the Confirmation of Completion of Electronic Border Guard Declaration Procedures at Land Border Gates to the person handling the procedures via the Electronic Border Guard Procedures Portal.
Article 4. Principles for Implementing Electronic Border Control Procedures
1. Ensuring equality, transparency, clarity, speed, safety, convenience; complying with Vietnam's legal regulations on electronic transactions, entry and exit, and being consistent with relevant international treaties to which the Socialist Republic of Vietnam is a party.
2. Individuals conducting procedures may choose to implement electronic border control procedures or conduct border control procedures manually.
Chapter II. IMPLEMENTATION OF ELECTRONIC BORDER CONTROL PROCEDURES AT LAND BORDER GATES
Section 1. GENERAL PROVISIONS ON THE IMPLEMENTATION OF ELECTRONIC BORDER CONTROL PROCEDURES AT LAND BORDER GATES
Article 5. Time and Location for Implementing Electronic Border Control Procedures at Land Border Gates
1. Time:
Electronic border control procedures at land border gates are implemented 24/24 hours daily, including holidays and public holidays.
a)[2] Individuals declaring electronic border control forms and receiving confirmation of completed electronic border control declarations at land border gates can do so through an electronic identity account established and verified according to the legal provisions on electronic identification and authentication and the provisions of this Decision, from anywhere with internet access;
b) The border guards at land border gates implement electronic border control procedures at the Joint Inspection House of international border gates and main border gates.
Article 6. Use of Digital Signatures in Implementing Electronic Border Control Procedures at Land Border Gates
1. Agencies, units, and individuals within the Border Guard Force shall use digital signatures in accordance with the legal provisions on providing, managing, and using specialized digital signature authentication services for Party and State agencies, political-social organizations.
2. Individuals conducting procedures who represent agencies, organizations, and enterprises must use digital signatures in accordance with the legal provisions on digital signatures and digital signature authentication services when implementing electronic border control procedures at land border gates.
Individuals conducting procedures who are Vietnamese citizens exiting or entering the country are not required to use digital signatures when implementing electronic border control procedures at land border gates.
3. Digital signatures must be issued by legitimate service providers of digital signature authentication and registered with the Electronic Border Control Procedure Portal at the address http://thutucbienphong.gov.vn or registered on the National Single Window Portal.
4. After registering digital signatures, individuals conducting procedures implement electronic border control procedures at land border gates on the Electronic Border Control Procedure Portal at the address http://thutucbienphong.gov.vn.
Article 7. Use of Electronic Identity Accounts to Log In to the Electronic Border Control Procedure Portal for Implementing Electronic Border Control Procedures at Land Border Gates[3]
1. Individuals conducting procedures use electronic identity accounts created by the electronic identification and authentication system, integrated and connected to the Electronic Border Control Procedure Portal, to log in to the Electronic Border Control Procedure Portal to implement electronic border control procedures at land border gates in accordance with the legal provisions on electronic identification and authentication and the provisions of this Decision.
2. The process of using electronic identity accounts to log in to the Electronic Border Control Procedure Portal to implement electronic border control procedures at land border gates:
a) Individuals conducting procedures access the address: http://thutucbienphong.gov.vn to log in to the Electronic Border Control Procedure Portal;
b) At the login interface of the Electronic Border Control Procedure Portal, individuals conducting procedures select the type of account as individual (for those conducting procedures for agencies and organizations, they select the type of account as agency or organization), then select to log in with an electronic identity account issued by the Ministry of Public Security for Vietnamese citizens (for those conducting procedures for agencies and organizations, they log in with an electronic identity account issued by the Ministry of Public Security for agencies and organizations); the system automatically redirects to the electronic identification and authentication system;
c) At the interface of the electronic identification and authentication system, individuals conducting procedures proceed to log in with their individual electronic identity account issued by the Ministry of Public Security (for those conducting procedures for agencies and organizations, they log in with their agency or organizational electronic identity account issued by the Ministry of Public Security);
d) After successful login, the system automatically redirects to the interface of the Electronic Border Control Procedure Portal for individuals conducting procedures to declare electronic border control procedures.
Article 8. Suspension of use of electronic identity account for logging into the Electronic Border Procedures Portal to implement electronic border procedures at land border gates.[4]
In cases where there is a risk of affecting the security and safety of electronic border procedure data, the Gate Commander of the Land Border Gate has the right to temporarily suspend the use of the electronic identity account for logging into the Electronic Border Procedures Portal and notify the person handling the procedures, clearly stating the reason for not accepting electronic data.
Section 2. IMPLEMENTATION OF ELECTRONIC BORDER PROCEDURES AT LAND BORDER GATES UNDER THE NATIONAL SINGLE WINDOW MECHANISM AND THROUGH THE ELECTRONIC BORDER PROCEDURES PORTAL
Article 9. Implementation of electronic border procedures at land border gates under the National Single Window Mechanism
1. When the Electronic Border Procedures Portal is fully connected with the National Single Window Portal, the Border Guard at the land border gate and the person handling the procedures shall implement electronic border procedures at the land border gate through the National Single Window Portal in accordance with regulations on implementing the National Single Window Mechanism and the provisions of this Decision.
2. During the period when the Electronic Border Procedures Portal has not yet been fully connected with the National Single Window Portal to implement electronic border procedures or in cases where the National Single Window Portal experiences technical issues, the Border Guard at the land border gate and the person handling the procedures shall implement electronic border procedures at the land border gate through the Electronic Border Procedures Portal in accordance with the provisions of this Decision.
Article 10. Implementation of electronic border procedures at land border gates through the Electronic Border Procedures Portal
1. Electronic border procedures at land border gates for Tourist Groups, Official Delegations departing or entering the country
a) Not later than six hours before the expected arrival of the Tourist Group or Official Delegation at the international border gate or main border gate, the person handling the procedures must declare the Declaration Form for the Tourist Group or Official Delegation according to Model No. 07 prescribed in the Appendix attached to this Decision and send it to the Border Guard at the land border gate through the Electronic Border Procedures Portal;
The time for initiating the electronic border procedures is determined from the moment the Border Guard at the land border gate receives the Declaration Form for the Tourist Group or Official Delegation through the Electronic Border Procedures Portal.
b) Not later than three hours after receiving the Declaration Form for the Tourist Group or Official Delegation, the Border Guard at the land border gate must send the Confirmation of Completion of Declaration for Electronic Border Procedures for the Tourist Group or Official Delegation according to Model No. 08 prescribed in the Appendix attached to this Decision to the person handling the procedures through the Electronic Border Procedures Portal;
The completion time of the declaration for electronic border procedures is determined from the moment the person handling the procedures receives the Confirmation of Completion of Declaration for Electronic Border Procedures for the Tourist Group or Official Delegation through the Electronic Border Procedures Portal.
c) When the Tourist Group or Official Delegation arrives at the international border gate or main border gate for departure or entry, the person handling the procedures must present passports or travel documents of the passengers to the Border Guard at the land border gate for inspection, control, and verification of departure or entry into Vietnam according to regulations.
2. Electronic border procedures at land border gates for Drivers, Passengers, Vehicles departing or entering the country
a) Not later than six hours before the expected arrival of the vehicle at the international border gate or main border gate, the person handling the procedures must declare the Declaration Form for the Driver, Passengers, and Vehicle according to Model No. 09 prescribed in the Appendix attached to this Decision and send it to the Border Guard at the land border gate through the Electronic Border Procedures Portal;
The time for initiating the electronic border procedures is determined from the moment the Border Guard at the land border gate receives the Declaration Form for the Driver, Passengers, and Vehicle through the Electronic Border Procedures Portal.
b) Not later than three hours after receiving the Declaration Form for the Driver, Passengers, and Vehicle, the Border Guard at the land border gate must send the Confirmation of Completion of Declaration for Electronic Border Procedures for the Driver, Passengers, and Vehicle according to Model No. 10 prescribed in the Appendix attached to this Decision to the person handling the procedures through the Electronic Border Procedures Portal;
The completion time of the declaration for electronic border procedures is determined from the moment the person handling the procedures receives the Confirmation of Completion of Declaration for Electronic Border Procedures for the Driver, Passengers, and Vehicle through the Electronic Border Procedures Portal.
c) When the Driver, Passengers, and Vehicle arrive at the international border gate or main border gate for departure or entry, the person handling the procedures must present passports or travel documents of the Driver and Passengers and relevant documents of the vehicle according to Article 9 of Decree No. 112/2014/ND-CP dated November 21, 2014 of the Government on management of land border gates to the Border Guard at the land border gate for inspection, control, and verification of departure or entry into Vietnam according to regulations.
3. Electronic border procedures at land border gates for Vietnamese citizens departing or entering the country
a) Not later than three hours before the expected arrival at the international border gate or main border gate of Vietnamese citizens for entry or exit, the person handling the procedures must declare the Declaration Form for Vietnamese Citizens for Entry and Exit according to Model No. 11 as prescribed in the Appendix accompanying this Decision and send it to the Border Guard of the land border gate through the Electronic Border Procedures Portal;
The time for initiating electronic border procedures is determined from the moment the Border Guard of the land border gate receives the Declaration Form for Vietnamese Citizens for Entry and Exit through the Electronic Border Procedures Portal.
b) Not later than one hour from the time of receiving the Declaration Form for Vietnamese Citizens for Entry and Exit, the Border Guard of the land border gate must send the Confirmation of Completion of Electronic Border Procedures Declaration for Vietnamese Citizens for Entry and Exit according to Model No. 12 as prescribed in the Appendix accompanying this Decision to the person handling the procedures through the Electronic Border Procedures Portal;
The completion time of the electronic border procedures declaration is the moment when the person handling the procedures receives the Confirmation of Completion of Electronic Border Procedures Declaration for Vietnamese Citizens for Entry and Exit through the Electronic Border Procedures Portal.
c) When Vietnamese citizens arrive at the international border gate or main border gate for departure or entry, they must present their passport or valid travel document for departure and entry, or valid border area travel document to the Border Guard of the land border gate for inspection, control, and verification of departure and entry to Vietnam as prescribed.
4. In case of malfunction of the Electronic Border Procedures Portal, the Border Guard of the land border gate must notify the person handling the procedures in writing, by telephone, email, or announce on the Electronic Border Procedures Portal or the Ministry of National Defense's Electronic Portal so that the person handling the procedures can perform the border procedures manually.
Article 11. Amending and Supplementing the Electronic Border Gate File
1. The person handling the procedures may amend and supplement the electronic file in the following cases:
a) Discovering errors or updating information needed to be declared in the electronic file after receiving the Confirmation of Completion of Electronic Border Procedures Declaration for the land border gate but must obtain the approval of the Border Guard of the land border gate;
b) The Border Guard of the land border gate requests amendments and supplements to the declaration content in the electronic file;
c) Requests for amendments and supplements to the declaration content in the electronic file by the Border Guard shall be carried out according to Model No. 13, and the amended and supplemented Declaration Form by the person handling the procedures shall be carried out according to Model No. 14 as prescribed in the Appendix accompanying this Decision.
2. Processing the amended and supplemented electronic file
a) The Border Guard of the land border gate accepts the amended and supplementary declaration content in the electronic file through verification and clarification of the reasons for requesting amendments and supplements by the person handling the procedures;
b) The electronic file before and after amendment and supplementation is retained in the electronic border data processing system of the land border gate to serve as a basis for checking, comparing, and determining the authenticity of the electronic file declaration by the person handling the procedures.
3. Time limit for requesting amendments and supplements to the electronic file; sending the amended and supplemented electronic file; confirmation of completion of electronic border procedures declaration for the amended and supplemented electronic file
a) Time limit for requesting amendments and supplements to the electronic file by the Border Guard of the land border gate
Immediately upon discovering that the electronic border procedures declaration of the person handling the procedures is incomplete or inaccurate, the Border Guard of the land border gate sends a request for amendment and supplementary declaration to the person handling the procedures through the Electronic Border Procedures Portal.
b) Time limit for sending the amended and supplemented electronic file
In case the Border Guard of the land border gate requests amendments and supplements to the declaration content in the electronic file: Not later than one hour from the time of receiving the request for amendment and supplementary declaration content from the Border Guard of the land border gate, the person handling the procedures must declare the Amended and Supplementary Declaration Form for Electronic Border Procedures and send it to the Border Guard of the land border gate through the Electronic Border Procedures Portal;
In case the person handling the procedures discovers errors or updates information needed to be declared in the electronic file: Immediately upon discovering errors or updating information needed to be declared in the electronic file, the person handling the procedures must declare the Amended and Supplementary Declaration Form for Electronic Border Procedures and send it to the Border Guard of the land border gate through the Electronic Border Procedures Portal.
c) Time limit for confirming the completion of electronic border procedures declaration for the amended and supplemented electronic file
Not later than one hour from the time of receiving the Amended and Supplementary Declaration Form of the person handling the procedures, the Border Guard of the land border gate must send the Confirmation of Completion of Electronic Border Procedures Declaration for the Amended and Supplemented Electronic File according to Model No. 15 as prescribed in the Appendix accompanying this Decision to the person handling the procedures through the Electronic Border Procedures Portal.
Chapter III. IMPLEMENTATION OF ELECTRONIC BORDER PROCEDURES FOR VIETNAMESE SHIPS OPERATING ON DOMESTIC ROUTES ARRIVING AT AND DEPARTING FROM PORT GATES
Article 12. Implementation of electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port border gates through the National Single Window Portal
1. The electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port border gates shall be carried out through the National Single Window Portal in accordance with regulations on implementing the National Single Window Mechanism and the provisions of this Decision.
2.[5] In case of technical issues with the National Single Window Portal, the electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port border gates shall be carried out through the Electronic Border Procedures Portal in accordance with the provisions of this Decision.
The use of digital signatures in implementing electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port border gates shall be conducted in accordance with the regulations of the Ministry of National Defense on implementing electronic border procedures for seaports.
3. The port border guard shall refuse to implement electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port border gates in accordance with Decision No. 10/2016/QĐ-TTg dated March 3, 2016 of the Government Prime Minister on implementing electronic border procedures for seaports and the regulations of the Ministry of National Defense on implementing electronic border procedures for seaports.
Article 13. Implementation of electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving port border gates through the Electronic Border Procedures Portal
1. At least four hours before a Vietnamese vessel operating on a domestic route is expected to arrive at the port border gate, and at least two hours before a Vietnamese vessel leaves the port border gate, the person handling the procedure must declare the electronic forms according to the prescribed templates on the Electronic Border Procedures Portal, including:
a) General declaration form;
b) Crew list;
c) Passenger list (if applicable).
2. Within one hour from the time of receiving all valid electronic declarations, the port border guard must confirm the completion of the electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving the port border gate.
The start time of implementing electronic border procedures is determined from the moment the port border guard receives all electronic declarations through the Electronic Border Procedures Portal.
The completion time of electronic border procedures is the moment the person handling the procedure receives confirmation of the completion of electronic border procedures through the Electronic Border Procedures Portal.
3. Types of documents that the person handling the procedure must present, locations, and deadlines for presenting such documents to the port border guard after completing electronic border procedures for Vietnamese vessels operating on domestic routes entering and leaving the port border gate
a) Types of documents to be presented:
Passports of crew members; passports or international travel documents or Identity Cards or Citizen Identification Cards of passengers (if applicable);
Other documents required by the port border guard: Voyage Logbooks; documents related to cargo,if there is cargo on board, including: Cargo Transport Contracts; purchase and sale contracts and Value Added Tax invoices or internal shipment and transportation certificates; permits for transporting goods subject to conditions issued by competent authorities of Vietnam. b) Locations for presenting documents:
At the headquarters of the port border guard or the headquarters of the Maritime Port Authority or the representative office of the Maritime Port Authority.
c) Deadlines for presenting documents:
For Vietnamese vessels arriving at the port border gate: At most two hours after the vessel docks at the wharf, at most four hours after the vessel docks at other positions within the port waters;
For Vietnamese vessels leaving the port border gate: At most immediately before the vessel leaves the port border gate.
For Vietnamese sea vessels departing from port customs: At the latest immediately before the vessel departs from the port customs.
Article 14. Amending and supplementing electronic border control files for Vietnamese vessels operating on domestic routes entering and leaving port customs checkpoints
1. The person handling procedures may amend and supplement electronic files in the following cases:
a) Discovering errors or updating necessary information to be reported in the electronic file after receiving confirmation of completion of electronic border control procedures but must obtain approval from the port customs checkpoint border guard;
b) At the request of the port customs checkpoint border guard to amend and supplement the content reported in the electronic file;
c) The amended and supplemented electronic file declaration form of the person handling procedures and the request to amend and supplement the content reported in the electronic file of the port customs checkpoint border guard shall be carried out according to the prescribed forms on the Electronic Border Control Procedure Information Portal.
2. Processing amended and supplemented files
a) The port customs checkpoint border guard accepts the amended and supplementary declarations in the electronic file through verification and investigation to clarify the reasons for requesting amendments and supplements from the person handling procedures;
b) The electronic file before and after amendment and supplementation will be stored in the electronic border control data processing system at the seaport as a basis for checking, comparing, and verifying the authenticity of the electronic file declaration made by the person handling procedures.
3. Time limit for requesting amendment and supplementation of electronic files; submitting amended and supplemented electronic files and confirming completion of electronic border control procedures for amended and supplemented electronic files
a) Time limit for requesting amendment and supplementation of electronic files:
Immediately upon discovering that the electronic border control procedure declaration of the person handling procedures is incomplete or inaccurate, the port customs checkpoint border guard requests the person handling procedures to declare amendments and supplements;
b) Time limit for submitting amended and supplemented electronic files:
In case the port customs checkpoint border guard requests amendment and supplementation of the content reported in the electronic file: Within the latest 01 hour from the time of receiving the request to amend and supplement the content reported by the port customs checkpoint border guard, the person handling procedures must declare the amended and supplemented content report form of the electronic border control procedure and submit it to the port customs checkpoint border guard via the Electronic Border Control Procedure Information Portal;
In case the person handling procedures discovers errors or updates necessary information to be reported in the electronic file: Within the latest 02 hours after the vessel docks at the wharf, within the latest 04 hours after the vessel docks at other positions within the port water area for Vietnamese vessels arriving at the port customs checkpoint; within the latest immediately before the vessel leaves the port customs checkpoint for Vietnamese vessels departing from the port customs checkpoint, the person handling procedures must submit the amended and supplemented electronic file to the port customs checkpoint border guard via the Electronic Border Control Procedure Information Portal.
c) Time limit for confirming completion of electronic border control procedures for amended and supplemented electronic files:
Within the latest 01 hour from the time of receiving all amended and supplemented electronic files, the port customs checkpoint border guard must confirm the completion of electronic border control procedures for the amended and supplemented electronic files and send it to the person handling procedures via the Electronic Border Control Procedure Information Portal.
Chapter IV. IMPLEMENTATION OF ELECTRONIC BORDER CONTROL PROCEDURES IN VISA ISSUANCE AT THE CUSTOMS CHECKPOINT
Article 15. Electronic Border Procedures for Issuing Visas at Border Gates through the National Single Window Portal
1. When the electronic border procedure information portal is fully connected to the National Single Window Portal, the electronic border procedures for issuing visas at border gates shall be carried out through the National Single Window Portal in accordance with the regulations on implementing the National Single Window Mechanism and the provisions of this Decision.
2.[6] When the electronic border procedure information portal has not yet been fully connected to the National Single Window Portal or when there is a malfunction with the National Single Window Portal, the electronic border procedures for issuing visas at border gates shall be carried out through the electronic border procedure information portal in accordance with the provisions of this Decision.
The use of digital signatures in the implementation of electronic border procedures for issuing visas at seaport border gates shall be carried out in accordance with the regulations of the Ministry of National Defense on implementing electronic border procedures at seaports.
Article 16. Implementation of Electronic Border Procedures for Issuing Visas at Border Gates through the Electronic Border Procedure Information Portal
1. Not later than 12 hours before the visa recipient is expected to arrive at the international land border gate or at the seaport gate, the person handling the procedure must submit the Application Form for Visa Issuance at the Border Gate according to Model No. 16 prescribed in the Appendix attached to this Decision, along with a copy of the Reply Letter from the Exit and Entry Administration Department of the Ministry of Public Security regarding the request for visa issuance at the international border gate, and send it to the Border Guard of the land border gate (in case of requesting a visa at the international land border gate) or send it to the Border Guard of the seaport gate (in case of requesting a visa at the seaport gate) through the electronic border procedure information portal.
For foreign seafarers who are not exempted from visa requirements for entry into Vietnam and wish to depart from another port, not later than two hours before the expected departure from the seaport where the vessel is anchored, the person handling the procedure must submit the Application Form for Visa Issuance at the Border Gate according to Model No. 16 prescribed in the Appendix attached to this Decision, along with a copy of the Reply Letter from the Exit and Entry Administration Department of the Ministry of Public Security regarding the request for visa issuance at the international border gate, and send it to the Border Guard of the seaport gate through the electronic border procedure information portal;
The time for initiating the electronic border procedures for issuing visas at border gates is determined from the moment the Border Guard of the land border gate or the Border Guard of the seaport receives the Application Form for Visa Issuance at the Border Gate through the electronic border procedure information portal.
2. Not later than three hours from the time of receiving a complete and valid Application Form for Visa Issuance at the Border Gate, the Border Guard of the land border gate and the Border Guard of the seaport must send the Confirmation of Completion of Declaration of Electronic Border Procedures for Visa Recipients at the Border Gate according to Model No. 17 prescribed in the Appendix attached to this Decision to the person handling the procedure through the electronic border procedure information portal.
For foreign seafarers specified in Clause 1 of this Article, not later than one hour from the time of receiving the Application Form for Visa Issuance at the Border Gate, the Border Guard of the seaport must send the Confirmation of Completion of Declaration of Electronic Border Procedures for Visa Recipients at the Border Gate according to Model No. 17 prescribed in the Appendix attached to this Decision to the person handling the procedure through the electronic border procedure information portal;
The completion time of the declaration of electronic border procedures for issuing visas at border gates is the time when the person handling the procedure receives the Confirmation of Completion of Declaration of Electronic Border Procedures for Visa Recipients at the Border Gate through the electronic border procedure information portal.
3. When the visa recipient arrives at the international land border gate or seaport gate to enter Vietnam or when the foreign seafarer specified in Clause 1 of this Article departs from the seaport, the person handling the procedure must present their passport or other travel document, submit the original Reply Letter from the Exit and Entry Administration Department of the Ministry of Public Security regarding the request for visa issuance at the international border gate, and pay the visa issuance fee as prescribed to the Border Guard of the land border gate or the Border Guard of the seaport.
a) Immediately upon receipt of the passport or other travel document, the original Reply Letter from the Exit and Entry Administration Department of the Ministry of Public Security regarding the request for visa issuance at the international border gate, and the visa issuance fee, the Border Guard of the land border gate or the Border Guard of the seaport shall issue the visa in accordance with the regulations;
b) In cases where it is objectively impossible to submit the original Reply Letter from the Exit and Entry Administration Department of the Ministry of Public Security regarding the request for visa issuance at the international border gate immediately upon the visa recipient's entry into Vietnam, within three days from the date of receiving the visa at the border gate, the person handling the procedure must submit the original to the Border Guard of the land border gate or the Border Guard of the seaport.
Article 17. Amending and supplementing the electronic border control file for visa recipients at border gates
1. The person handling procedures may amend and supplement the electronic border control file for visa recipients at border gates in cases provided for in points a and b, Clause 1, Article 11 and points a and b, Clause 1, Article 14 of this Decision.
Requests for amendment and supplementation by Border Gate Guards and the amended and supplemented electronic file declaration form of the person handling procedures shall be carried out in accordance with point c, Clause 1, Article 11 of this Decision.
2. Processing of amended and supplemented files shall be carried out in accordance with Clause 2, Article 11 and Clause 2, Article 14 of this Decision.
3. Time limit for requesting amendment and supplementation; sending the amended and supplemented electronic file and confirming completion of the electronic border control procedure for the amended and supplemented electronic file
a) Time limit for requesting amendment and supplementation of the electronic file of land border gate guards and port border gate guards:
Immediately upon discovering that the electronic border control procedure declaration of the person handling procedures is incomplete or inaccurate, the land border gate guard or port border gate guard shall send a request to declare amendment and supplementation to the person handling procedures through the Electronic Border Control Procedure Portal.
b) Time limit for submitting amended and supplemented electronic files:
In case the land border gate guard or port border gate guard requests amendment and supplementation of the content declared in the electronic file: Within the latest 01 hour from receiving the request for amendment and supplementation of the content declared by the land border gate guard or port border gate guard, the person handling procedures must declare the Amendment and Supplementation Declaration Form for visa recipients at border gates and send it to the land border gate guard or port border gate guard through the Electronic Border Control Procedure Portal;
In case the person handling procedures discovers errors or updates information needed to be declared for supplementation in the electronic file: Immediately upon discovering errors or updating information needed to be declared for supplementation in the electronic file, the person handling procedures must declare the Amendment and Supplementation Declaration Form for visa recipients at border gates and send it to the land border gate guard or port border gate guard through the Electronic Border Control Procedure Portal.
c) Time limit for confirming completion of the electronic border control procedure declaration for the amended and supplemented electronic file:
Within the latest 01 hour from receiving the Amendment and Supplementation Declaration Form for visa recipients at border gates, the land border gate guard or port border gate guard must send the Confirmation of Completion of the Electronic Border Control Procedure Declaration for the Amended and Supplemented Electronic File according to Model No. 15 prescribed in the Appendix issued together with this Decision to the person handling procedures through the Electronic Border Control Procedure Portal.
Chapter V. IMPLEMENTATION
Article 18. Responsibilities of the Ministry of National Defense
1. To take the lead and coordinate with ministries, sectors, provincial People's Committees to cooperate with the Permanent Office of the National Steering Committee on the Single Window Mechanism, ASEAN Single Window Mechanism, and Facilitation of Trade in implementing the electronic border control procedure and ensuring smooth integration and connection with the National Single Window Portal in accordance with regulations.
2.[7] To coordinate with the Government Office to organize the connection of the Electronic Border Control Procedure Portal with the National Public Service Portal in accordance with Decree No. 61/2018/ND-CP dated April 23, 2018 of the Government on the implementation of the single window mechanism and the interlinked single window mechanism in administrative procedures; to coordinate with the Ministry of Public Security and relevant ministries, sectors, and localities during the process of implementing the use of digital identity accounts to log in to the Electronic Border Control Procedure Portal in accordance with Decree No. 69/2024/ND-CP dated June 25, 2024 of the Government on digital identification and authentication; to direct competent authorities to announce the completion of connections and integrations of digital identity accounts on the Electronic Border Control Procedure Portal for relevant agencies, organizations, and individuals to be aware and implement.
3. To take the lead in building plans and organizing the assurance of information security for the Electronic Border Control Procedure Portal; to organize propaganda and support related organizations, enterprises, and individuals to participate in implementing the electronic border control procedure; to coordinate with relevant ministries and sectors to inspect and handle arising issues.
4. To ensure funding and necessary conditions regarding infrastructure and equipment for the implementation of the electronic border control procedure.
5. To take the lead and coordinate with ministries, sectors, and provincial People's Committees to organize the implementation of this Decision.
6. To conduct mid-term reviews, summaries, evaluations, and report to the Prime Minister on the results of implementing the electronic border control procedure at border gates managed by the Ministry of National Defense.
7. To direct the General Cryptographic Department to provide sufficient specialized digital signatures for the Border Guard Force to resolve administrative procedures; to build solutions for verifying the digital signatures of individuals and organizations registering to implement the electronic border control procedure.
8. To direct the Border Guard Force
a) To build and implement projects to implement the electronic border control procedure for border gate systems managed by the Ministry of National Defense; to develop a roadmap for upgrading and perfecting the electronic data processing system, applying digital signatures, and eliminating paper documents required for the implementation of the electronic border control procedure; to organize training, briefing, and allocate staff with adequate qualifications, capabilities, and experience to meet the requirements of implementing the electronic border control procedure;
During the period of building and implementing projects to implement the electronic border control procedure for border gate systems managed by the Ministry of National Defense where installation of equipment and transmission lines for implementing the electronic border control procedure has not been completed, the person handling procedures and border gate guards shall carry out the border control procedure manually;
b)[8] To review, inspect, and approve organizations and individuals participating in the implementation of the electronic border control procedure; to guide the installation and declaration of information for persons handling procedures participating in the implementation of the electronic border control procedure;
c) Provide, share information related to persons and means of entry and exit at border gates managed by the Ministry of National Defense to relevant agencies; simultaneously receive shared information from specialized state management agencies at border gates regarding persons and means of entry and exit, exported and imported goods;
d) Ensure information security; handle violations and resolve complaints and denunciations; guide the implementation of issues arising during the process of connecting the Electronic Border Procedures Portal with the National Single Window Portal;
đ) Chair and coordinate with specialized state management agencies at border gates and local authorities in propaganda work and the implementation of electronic border procedures;
e) Handle in accordance with the provisions of the law acts of violation of the law by organizations and individuals in the implementation of electronic border procedures.
Article 19. Responsibilities of Relevant Ministries and Provincial People's Committees[9]
1. The Ministry of Public Security shall cooperate with the Ministry of National Defense to unify plans for connection and sharing of data to use electronic identity accounts to log into the Electronic Border Procedures Portal in accordance with Decree No. 69/2024/NĐ-CP dated June 25, 2024 of the Government on electronic identification and authentication and this Decision.
2. Ministry of Finance
a) Within their scope of duties and powers, they are responsible for directing and guiding specialized state management agencies under their jurisdiction to coordinate with the Border Guard Force in implementing electronic border procedures; coordinate with the Ministry of National Defense to guide enterprises, organizations, and individuals related to the implementation of electronic border procedures according to the national single window mechanism;
b) Coordinate with the Ministry of Planning and Investment to ensure funding for the Ministry of National Defense to build, manage, and operate the Electronic Border Procedures Portal and implement this Decision;
c) Direct the integration of electronic identity accounts on the National Single Window Portal, connect with specialized systems to implement electronic procedures according to the national single window mechanism.
3. The Ministry of Planning and Investment
Annually, chair and coordinate with the Ministry of Finance and the Ministry of National Defense to balance the budget for construction investment in the medium-term public investment plan to ensure the implementation of this Decision.
4. Relevant ministries and sectors within their scope of duties and powers are responsible for coordinating with the Ministry of National Defense in implementing electronic border procedures and deploying the use of electronic identity accounts to log into the Electronic Border Procedures Portal in accordance with Decree No. 69/2024/NĐ-CP dated June 25, 2024 of the Government on electronic identification and authentication.
5. Provincial People's Committees
Within their scope of duties and powers, provincial people's committees are responsible for directing and guiding functional departments and agencies in the locality where electronic border procedures are implemented to coordinate and create favorable conditions for border gate border guards to implement electronic border procedures locally.
Chapter VI. IMPLEMENTING PROVISIONS[10]
Article 20. Effective Date
This Decision takes effect from June 1, 2019.
Article 21. Stages Implementing electronic border procedures at land border gates
1. Stage 1
a) Time of Implementation: From the date this Decision takes effect until the end of 2019;
b) Location of Implementation: At international border gates: Mong Cai in Quang Ninh Province, Huu Nghi in Lang Son Province, Cau Treo in Ha Tinh Province, Cha Lo in Quang Binh Province, Moc Bai in Tay Ninh Province;
c) After completing Stage 1, the Ministry of National Defense will chair the summary, evaluation, and draw lessons to implement Stage 2.
2. Stage 2
From 2020 onwards, implement at all international border gates and main border gates along the land border.
Article 22. Responsibility for enforcement
Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairmen of provincial/municipal people's committees directly under the central government, and related organizations and individuals are responsible for enforcing this Decision./.

[1] Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, based on the following grounds:
“Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on National Border dated June 17, 2003;
Pursuant to the Law on Information Technology dated June 29, 2006, which has been amended and supplemented by Law No. 21/2017/QH14, Law No. 20/2023/QH15, and Law No. 24/2023/QH15;
Pursuant to the Law on Border Defense of Vietnam dated November 11, 2020;
Pursuant to the Law on Electronic Transactions dated June 22, 2023;
Pursuant to the Law on Identity Cards dated November 27, 2023;
Pursuant to Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates; Decree No. 34/2023/NĐ-CP dated June 16, 2023 of the Government amending and supplementing certain provisions of Decree No. 112/2014/NĐ-CP dated November 21, 2014 of the Government on management of land border gates;
Pursuant to Decree No. 69/2024/NĐ-CP dated June 25, 2024 of the Government on digital identity and authentication;
"Based on the proposal of the Minister of National Defense;"
The Prime Minister issues this Decision amending and supplementing some articles of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense”.
[2] This point is amended according to the provision of Clause 1, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[3] This provision is amended according to the provision of Clause 2, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[4] This provision is amended according to the provision of Clause 3, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[5] This clause is amended according to the provision of Clause 4, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[6] This clause is amended according to the provision of Clause 5, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[7] This clause is amended according to the provision of Point a, Clause 6, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[8] This point is amended according to the provision of Point b, Clause 6, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[9] This provision is amended according to the provision of Clause 7, Article 1 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defense, which took effect from April 1, 2025.
[10Article 3 Decision No. 03/2025/QĐ-TTg amending and supplementing certain provisions of Decision No. 15/2019/QĐ-TTg dated March 28, 2019 of the Government Chairman on the implementation of electronic border procedures at border gates managed by the Ministry of National Defenseshall take effect from April 1, 2025, as follows:
“Article 3. Provisions 1. This Circular takes effect from February 15, 2026; Circular No. 24/2013/TT-BKHCN dated September 30, 2013 of the Minister of Science and Technology on activities related to calibration, verification, testing of measuring instruments, and measurement standards shall cease to be effective from the date this Circular takes effect.
1. THIS DECISION SHALL TAKE EFFECT FROM THE DATE 01 the 4 2025
2. The validity period of accounts established through the electronic border control procedure portal shall be implemented in accordance with the provisions of Decree No. 69/2024/NĐ-CP dated June 25 2024 of the Government on digital identity and authentication. "."
