DECISION OF THE PRIME MINISTER

Regarding the pilot establishment of specialized construction inspection in Hanoi City

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Inspection Ordinance dated April 1, 1990;

Pursuant to the Ordinance on the Capital City of Hanoi dated December 28, 2000;

Based on the Administrative Violation Handling Ordinance dated July 2, 2002;

Pursuant to Decree No. 48/CP dated May 5, 1997 of the Government on administrative penalties for violations in construction management, housing management, and urban infrastructure works;

Considering the proposal of the Chairman of the People's Committee of Hanoi City at Proposal No. 98/TTUB dated November 5, 2001,

DECISION:

Article 1. Permitting the pilot establishment of specialized construction inspection in Hanoi City according to a two-level model: city level and district-county level, based on reorganizing urban construction order management forces, to perform specialized construction inspection functions, and to impose administrative penalties in the field of construction management, housing management, and urban infrastructure works.

The specialized construction inspection of Hanoi City is an organization with legal personality, having its own seal and separate account, with operational funds provided from the State budget.

Article 2. The Chairman of the People's Committee of Hanoi City shall promulgate the Regulations on the organization and operation of the specialized construction inspection of Hanoi City and appoint or relieve inspectors according to the laws on inspection.

Article 3.The People's Committee of Hanoi City shall implement this Decision, conduct interim and final reviews, draw lessons, and report periodically every six months and report promptly to the Prime Minister to address any arising issues in a timely manner.

Article 4.The Government Organizational and Cadre Affairs Office, the State Inspectorate, the Ministry of Construction, and the Ministry of Public Security shall provide comments to the People's Committee of Hanoi City in drafting and promulgating the Regulations referred to in Article 2 of this Decision.

Article 5. This Decision takes effect fifteen days after the date of signature.

The Chairman of the People's Committee of Hanoi City, the Ministers, the Heads of ministerial-level agencies, and the Heads of government-affiliated agencies are responsible for implementing this Decision./.
