DECISION OF THE MINISTER OF FINANCE
Regulations on the ratio of maritime fees and charges to be retained and paid by agencies and organizations collecting such fees and charges
THE MINISTER OF FINANCE
Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges,
DECISION:
Article 1This Decision stipulates the ratio of maritime fees and charges to be retained by agencies and organizations assigned the task of collecting maritime fees and charges.
Agencies and organizations assigned the task of collecting maritime fees and charges (Maritime Port Control Units, Vietnam Marine Safety Assurance, Pilotage Companies) shall collect maritime fees and charges according to the prescribed rates set forth in Decision No. 88/2004/QD-BTC dated November 19, 2004 of the Minister of Finance on the collection of maritime fees and charges.
Article 2: Specific provisions:
- Collect tonnage dues; anchorage fees at ports and harbors; fees for using bridges, wharfs, and buoys (invested by the State budget and managed by port control units); port entry and exit fees; certification fees (marine protest fees).
- Are entitled to retain 65% of the total amount of collected fees and charges; the Vietnam Maritime Administration will regulate the retained funds among the port control units as prescribed.
- Manage and utilize the retained maritime fees and charges according to the current financial mechanism.
2. Vietnam Marine Safety Assurance:
- Collect marine safety assurance fees; authorize port control units to collect these fees on their behalf and retain a percentage of the total collected fees as a reward for the port control units as prescribed.
- Retain 100% of the collected fees to cover marine safety assurance activities.
- Manage and utilize the retained marine safety assurance fees according to the current financial mechanism.
3. Pilotage Companies:
- Collect pilotage fees.
- Manage and utilize the annual collected pilotage fees to offset the operating costs of the pilotage business for that year, allocate funds to various reserves, and remit to the state budget as prescribed.
Article 3This Decision takes effect fifteen days from the date of its publication in the Official Gazette; all other regulations inconsistent with this Decision are hereby abolished.
Agencies and organizations collecting maritime fees and charges and related entities are responsible for implementing this Decision.
