JOINT CIRCULAR
REGULATING THE COLLECTION AND MANAGEMENT OF USE OF FEES FOR CIVIL SERVICE SELECTION EXAMINATIONS AND RANK PROMOTION EXAMINATIONS FOR CIVIL SERVANTS
Pursuant to the Law on Fees and Charges, Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Law on Fees and Charges and other guiding documents;
Pursuant to the Civil Servant Law (amended and supplemented) dated April 29, 2003 and other Government documents guiding the recruitment, utilization, and management of civil servants;
The Ministry of Finance and the Ministry of Home Affairs hereby regulate the collection and management of use of fees for civil service selection examinations and rank promotion examinations for civil servants as follows:

I. OBJECTS AND AMOUNT OF COLLECTION:

1. The subjects required to pay examination fees for civil service selection and rank promotion examinations as stipulated in this Circular are candidates who meet the criteria and are notified by the competent authority organizing the examination to participate in the civil service selection examination or the rank promotion examination for civil servants.

2. The amount of fees for civil service selection and rank promotion examinations is regulated as follows:

a) For civil service selection examinations, the examination organizing body shall apply the following rates based on the number of eligible candidates:

- Less than 100 candidates participating, collect: 130,000 (one hundred thirty thousand) VND per candidate per examination.

- From 100 to less than 500 candidates participating, collect: 100,000 (one hundred thousand) VND per candidate per examination.

- From 500 to less than 1,000 candidates participating, collect: 70,000 (seventy thousand) VND per candidate per examination.

- 1,000 candidates participating or more, collect: 60,000 (sixty thousand) VND per candidate per examination.

b) For rank promotion examinations for civil servants, the examination organizing body shall apply the following rates based on the approved quota:

b1) For senior specialist rank and equivalent:

- Less than 50 candidates participating, collect: 900,000 (nine hundred thousand) VND per candidate per examination.

- From 50 to less than 100 candidates participating, collect: 800,000 (eight hundred thousand) VND per candidate per examination.

- 100 candidates participating or more, collect: 700,000 (seven hundred thousand) VND per candidate per examination.

b2) For main specialist rank and equivalent, collect: 300,000 (three hundred thousand) VND per candidate per examination.

b3) For specialist rank and equivalent or lower:

- Less than 100 candidates participating, collect: 200,000 (two hundred thousand) VND per candidate per examination.

- From 100 to less than 500 candidates participating, collect: 180,000 (one hundred eighty thousand) VND per candidate per examination.

- 500 candidates participating or more, collect: 150,000 (one hundred fifty thousand) VND per candidate per examination.

II. ORGANIZATION OF COLLECTION, PAYMENT, AND MANAGEMENT OF USE OF FEES:

1. The examination organizing bodies for civil service selection and rank promotion examinations for civil servants have the responsibility to:

a) Publicly post at the fee collection location information about the subjects and rates of collection according to the provisions of this Circular. When collecting money, issue a receipt (as prescribed by the Ministry of Finance) to the payer (the receipt is obtained from the local Tax Office where the collecting agency is located and managed and used according to current regulations).

b) Open a temporary account for holding collected examination fees at the State Treasury where the main office is located; daily or at least once a week, prepare a list and deposit the collected fees into the account opened at the State Treasury and must manage strictly according to current financial regulations.

2. The agencies collecting fees for civil service selection and rank promotion examinations for civil servants may use the collected examination fees to cover expenses serving the organization of the examination as follows:

For civil service selection examinations, including:

- Announcing on mass media the quota and conditions for participation in the examination;

- Checking applications, entering data, and sending notifications to participants;

- Reviewing the list of candidates meeting the eligibility requirements for the examination at the Examination Board of the Ministry and of the province; - Preparing examination materials, renting halls, hiring teachers to train candidates, opening the examination period;

- Printing and purchasing receipts;

- Renting examination rooms, organizing the examination;

- Expenditures for the activities of the Examination Board: convening meetings, preparing questions and answers, invigilating, marking, rechecking papers...;

- Other direct expenditures for the organization of civil servant recruitment examinations at Ministries, agencies equivalent to ministries, government agencies; People's Committees of provinces and centrally-administered cities.

b) For rank promotion examinations for civil servants, including:

In addition to the similar expenditure items as those specified for civil service selection examinations under point a, clause 2, Section II of this Circular, the following additional items may be covered:

- Expenses for issuing certificates for appointment to the rank being examined;

- Travel and accommodation expenses for lecturers and members of the Examination Board;

- Other expenditures serving the organization of rank promotion examinations for civil servants at Ministries and provinces according to current delegation levels.

3. Agencies and units responsible for organizing civil service selection and rank promotion examinations for civil servants must annually prepare a budget for the collection and expenditure of examination fees for civil service selection and rank promotion examinations together with their own agency budgets. The preparation and execution of the budget must comply with the guidance provided in Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance guiding the implementation of Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget. Management of income and expenditure from fee collections must comply with current financial regulations and be consolidated into the annual financial settlement report of the entity according to the delegated budget management level, ensuring the principles of public and democratic financial management.

4. Financial agencies and tax agencies have the responsibility to guide and inspect the implementation of the collection and management of use of fees for civil service selection and rank promotion examinations for civil servants in accordance with the provisions of this Circular and Circular No. 63/2002/TT-BTC dated July 24, 2002 of the Ministry of Finance guiding the implementation of laws on fees and charges.

III. IMPLEMENTATION:

1. This Circular takes effect 15 days after its publication in the Official Gazette; Circular No. 32/2001/TT-BTC dated May 23, 2001 of the Ministry of Finance guiding the collection and use of examination fees for civil service selection and rank promotion examinations for civil servants is abolished.

2. The subjects paying the examination fee for civil service recruitment and grade promotion examinations for civil servants, the agencies assigned the task of collecting such fees, and related agencies shall be responsible for implementing this Circular.

3. During the implementation process, if there are any difficulties, they are requested to promptly reflect them to the Ministry of Finance - Ministry of Home Affairs for study and resolution./.
