CIRCULAR

Guidelines for closing accounting books at year-end and preparing

annual final accounts reports on state budget

 

The work of closing accounting books at year-end and preparing annual final accounts reports on the state budget has been stipulated in Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance, Decision No. 130/2003/QD-BTC dated August 18, 2003 of the Minister of Finance on the accounting system for the state budget and the operations of the State Treasury, Circular No. 10/2004/TT-BTC dated February 19, 2004 of the Ministry of Finance guiding the review, examination, and notification of annual final accounts for administrative agencies, public institutions, and budgets at all levels, and Circular No. 53/2005/TT-BTC dated June 23, 2005 of the Ministry of Finance guiding the preparation, examination, and finalization of investment capital construction projects within the state budget according to the fiscal year.

 

The Ministry of Finance supplements guidelines on certain aspects of the work of closing accounting books at year-end and preparing annual final accounts reports on the state budget as follows:

I. Closing Accounting Books at Year-End:

1. The latest deadline for spending from the state budget for tasks allocated in the annual budget estimate is specified in Point 4.2.1, Section V, Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance. For investment capital construction projects included in the annual budget estimate, the spending period may be extended until January 31 of the following year to settle the construction volume completed up to December 31 of the previous year, provided that it meets the settlement conditions under the prescribed regulations and is settled in the previous fiscal year; except for cases regulated in Points 4.3 and 6, Section I, of this Circular.

2. Remaining funds from education bonds for solidifying schools and classrooms, and government bonds for key transportation and irrigation projects, etc., which were not spent within the time limit specified in Point 1, Section I, of this Circular, can be carried over to the next year to continue implementation according to the designated objectives.

3. Cash balances and account balances with the State Treasury from state budget sources of budgetary units as of December 31 shall be handled as follows:

3.1. Cash balances must be returned to the state budget at the State Treasury where the unit conducts transactions no later than January 10 of the following year, except for amounts due but not yet paid according to the regulations (wages, allowances, subsidies for eligible groups, scholarships for students) and cases specified in Points 3.3, 3.4, and 3.5, Section I, of this Circular. When returning, the unit must clearly specify the amount returned according to the Chapters, Types, Items, Sub-items of the State Budget Classification for both the unit and the State Treasury to reduce expenditures from the previous fiscal year.

3.2. Account balances from state budget sources must be reduced from state budget expenditures, except for cases specified in Points 3.3, 3.4, and 3.5, Section I, of this Circular.

Account balances of cases specified in Point 3.3, Section I, of this Circular can continue to be used until the end of the adjustment period for finalizing the accounts at each level of the budget and settled in the previous fiscal year. After the adjustment period, if there is still a balance, it can be transferred to the next year for use and settled in the next fiscal year. The budgetary unit must report to the State Treasury where it conducts transactions (in detail according to Chapters, Types, Items, and Sub-items) so that the State Treasury can aggregate according to the primary budget unit and submit to the financial authority at the same level within 45 days after the end of the adjustment period for each level of the budget to process the reduction of expenditures in the previous year and transfer the source to the next year.

3.3. Cash balances and account balances of the following cases can be carried over to the next year to continue implementing tasks according to the prescribed regulations, including:

a) Allocated operating expenses of administrative agencies implementing self-management and self-financing according to the regulations of the Government;

b) Regular operating expenses of public institutions with income implementing financial autonomy according to the regulations of the Government;

c) Expenses for implementing scientific and technological programs, projects, and research topics during their implementation periods, as assigned by competent authorities or agreed upon in contracts signed with the program leaders;

d) Operating expenses of agencies of the Communist Party of Vietnam;

e) Support expenses for creative cultural-artistic works and press activities according to Circular Joint No. 52/2003/TTLT-BVHTT-BTC dated August 29, 2003 of the Ministry of Culture, Sports and Tourism and the Ministry of Finance (excluding regular operating support expenses);

g) Expenses for policies towards persons meritorious to the revolution managed by the Labor, Invalids, and Social Affairs sector;

h) Other expenses permitted to be carried over to the next year for use according to the prescribed regulations.

3.4. Cash balances and account balances of units under the Ministry of National Defense and the Ministry of Public Security shall be handled according to Circular Joint No. 23/2004/TTLT-BTC-BQP dated March 26, 2004 of the Ministry of Finance and the Ministry of National Defense, and Circular Joint No. 54/2004/TTLT-BTC-BCA dated June 10, 2004 of the Ministry of Finance and the Ministry of Public Security.

3.5. Cash balances and account balances of commune-level budgets can be carried over to the next year for use according to the prescribed regulations.

4. Regarding the handling of budget surplus:

4.1. Regular expenditure tasks allocated in the annual budget of a given year can only be spent in that fiscal year. After the deadline for spending from the state budget specified in Point 1, Section I, of this Circular, unspent portions of the budget allocation (referred to as budget surplus) cannot be spent further; except for cases specified in Point 4.2, Section I, of this Circular and special cases allowed to continue spending according to the decision of the Minister of Finance (for the central budget) or the Chairman of the People's Committee or the head of the financial authority authorized (for local budgets) as stipulated in Point 4.1.3, Section V, Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance.

Cases requiring the transfer of budget surplus shall be handled as follows:

- Budgetary units shall attach relevant documents and the original confirmation from the State Treasury at the transaction location according to Form No. 01/ĐVDT issued together with this Circular and send them to the higher-level budgetary unit, which will consolidate and submit to the same-level financial authority for consideration and transfer (together with relevant documents, the original consolidated balance of each budgetary unit's budget estimate, and the original confirmation from the State Treasury at the budgetary unit's transaction location).

- The deadline for the first-level budgetary units under the central budget to submit the application for consideration and transfer to the Ministry of Finance is no later than February 15 of the following year; the Ministry of Finance must complete the examination and resolution before March 1 of the following year. The deadlines for submitting applications for transfer and the time limits for examination and resolution for budgetary units under local budgets shall be decided by the Chairman of the People's Committee, but must ensure the settlement deadline for each level of budget as prescribed.

- In cases where the financial authority accepts the transfer of the remaining budget estimate balance to the next year for continued expenditure, if implemented during the period of adjusting the final accounts of each level of budget, it shall be settled in the previous year's budget; if implemented after the period of adjusting the final accounts of each level of budget, the financial authority shall transfer the source to the next year's budget for continued expenditure; in cases where the financial authority does not accept, the remaining budget estimate balance shall be cancelled.

4.2. The remaining balances of the regular expenditure budget estimates specified in items a, b, c, d, e, g, h of Point 3.3, Section I of this Circular and sources for implementing salary reform as allocated to budgetary units but not yet used or not fully utilized shall be transferred to the next year for continued use in accordance with the prescribed regulations.

The procedures for transferring the remaining budget estimate balance are as follows:

- Based on the prescribed regulations, budgetary units shall issue a request to the State Treasury at the transaction location to process the transfer to the next year. After completion, the State Treasury shall consolidate and submit to the same-level financial authority (for same-level budgetary units) or the higher-level State Treasury (for budgetary units under higher-level budgets) according to Form No. 01C/KB within 45 days after the end of the adjustment period for the final accounts of each level of budget.

- The financial authority shall examine and process the transfer of funds to the next year based on the report from the same-level State Treasury.

4.3. The budget estimate for construction investment expenditures according to the fiscal year, allocated and assigned to projects and works, shall be paid up to December 31 of the following year; any remaining balance may not be spent further unless authorized by the competent authority to extend the payment period:

- In cases where the competent authority authorizes an extension of the payment period (for construction work completed up to December 31 of the previous year), if payment is made during the adjustment period for the final accounts of each level of budget, it shall be settled in the previous year's budget; if payment is made after the adjustment period for the final accounts of each level of budget, it shall be settled in the next year's budget.

- In cases where the competent authority authorizes an extension of the implementation period for work beyond December 31 of the previous year:

+ If payment is made during the adjustment period for the final accounts of each level of budget, it shall be settled in the previous year's budget;

+ If payment is made after the adjustment period for the final accounts of each level of budget, it shall be settled in the next year's budget.

The State Treasury shall transfer the remaining balance of the budget estimate (up to the end of the adjustment period for the final accounts of each level of budget) of projects and works extended to the next year's budget; consolidate and report to the same-level financial authority within 45 days after the end of the adjustment period for the final accounts of each level of budget (according to Form No. 02/KB attached to this Circular). The financial authority shall examine and process the transfer of funds to the next year's budget based on the report from the State Treasury.

5. Upon the expiration of the annual budget spending period as stipulated in Point 1, Section I of this Circular, the State Treasury shall prepare a report on the budget estimate usage of the first-level budgetary units of each level of budget and submit it to the same-level financial authority (for same-level budgetary units) or the higher-level State Treasury (for budgetary units under higher-level budgets) for consolidation and submission to the same-level financial authority (according to the following Forms: Form No. 01A/KB, 01B/KB, 01C/KB attached to this Circular); specific deadlines are as follows:

- State Treasury at the district level: no later than January 10 of the following year;

- State Treasury at the provincial level: no later than January 20 of the following year;

- Central State Treasury: no later than January 31 of the following year.

6. Regarding the handling of advances from the previous year's budget:

Budgetary units are responsible for settling advance payments with the State Treasury before closing the accounting books at the end of the year. State Treasuries at all levels are responsible for urging budgetary units to settle advance payments (including construction investment advances) within the prescribed deadlines. Advances within the budget that have not been settled by December 31 can continue to be settled during the adjustment period for the final accounts of each level of budget and settled in the previous year's budget according to the prescribed regulations. Specifically, construction investment advances not settled by January 31 shall be transferred to the next year for settlement and finalization in the next year's budget; except in cases where the competent authority permits an extension of the settlement period during the adjustment period for the final accounts, which can be settled in the previous year's budget.

After the above deadline, any remaining advances cannot be settled further, except in the cases specified in Points 6.1 and 6.2, Section I of this Circular.

6.1. In cases where the regular expenditure advance payment funds from the previous year's budget plan of the budget-using entity are insufficient for settlement documentation within the period of adjusting the final accounts and need to be transferred to the following year for settlement, the budget-using entity shall report to the direct superior budgetary unit along with relevant documents and the confirmation from the State Treasury at the transaction location regarding the balance of advance payment funds (original copy) according to Form No. 02/ĐVDT issued together with this Circular; the first-level budgetary unit shall consolidate and report to the same-level financial authority (along with relevant documents, a summary of the balance of advance payment funds of each budget-using entity and a reconciliation and confirmation from the State Treasury at the budget-using entity's transaction location - original copy) for the same-level financial authority to consider and resolve; except for cases that are automatically transferred to the following year as stipulated in Point 6.2, Section I of this Circular.

The deadline for submitting the application file for transferring the advance payment balance to the same-level financial authority is within 15 days from the end of the period for adjusting the final accounts. The financial authority has 15 days from the date of receipt of the application file to examine and resolve.

If the financial authority agrees to transfer the advance payment balance to the following year's budget for settlement, it will be settled in the following year's budget.

Not later than 30 days after the end of the period for adjusting the final accounts of each level of budget, if there is no written consent from the same-level financial authority to transfer the advance payment to the following year's budget, the State Treasury shall recover the advance payment by recording the corresponding expenditure items in the budget allocation for the entity in the following year, reducing the advance payment expenditure of the previous year's budget; if the following year's budget does not allocate these expenditure items or allocates less than the amount to be recovered, the State Treasury shall notify the same-level financial authority to take appropriate measures.

6.2. The balance of advance payment funds of each level of budget up to the end of the period for adjusting the final accounts of the previous year for the cases specified in Subparagraphs a, b, c, d, e, g, h of Point 3.3, Section I of this Circular and the balance of advance payment funds for construction investment capital as stipulated in Point 6, Section I of this Circular shall be transferred to the following year's budget for settlement.

6.3. The State Treasury shall process the transfer of the advance payment balance from the previous year's budget to the advance payment of the following year's budget for the cases allowed to be transferred to the following year as stipulated in Points 6.1 and 6.2, Section I of this Circular; simultaneously, it shall compile and submit to the same-level financial authority according to Form No. 01A/KB, 01C/KB, and Form No. 03/KB attached to this Circular (in detail by each first-level budgetary unit) within 45 days after the end of the period for adjusting the final accounts of each level of budget; the financial authority shall examine and process the transfer to the following year's budget.

7. For the balance of the budget estimate and the advance payment balance of the previous year permitted by the competent authority to be transferred to the following year's budget as stipulated in Point 4.1 and Point 6.1, Section I of this Circular, the financial authority shall be responsible for notifying each first-level budgetary unit in detail for each budget-using entity (down to the expenditure item groups as prescribed in Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance), and send the State Treasury at the same level for coordination in implementation. Each first-level budgetary unit shall notify each budget-using entity according to the prescribed form about the allocation and assignment of the budget estimate.

8. The balance of the account of entrusted budget funds deposited until December 31, the State Treasury must remit to the entrusted budget and record a reduction in the expenditure of the entrusted budget, except in cases where permission is granted to transfer to the following year under the prescribed regulations. In case further use is required, the financial authority receiving the entrusted budget funds shall report to the entrusting financial authority (with related documents and confirmation from the State Treasury regarding the balance of the entrusted budget funds already remitted to the entrusted budget) for examination and handling according to the procedures and deadlines stipulated in Point 4, Section I of this Circular.

9. For revenues from fees, charges, and proceeds from public services that must be recorded as income and expenditure in the state budget according to the prescribed regulations, the procedures for recording income and expenditure in the state budget must be completed before the end of the period for adjusting the final accounts of each level of budget as stipulated currently.

10. Borrowed funds, foreign aid, and other external loans shall be recorded as income and expenditure in the state budget according to the prescribed regulations, and the procedures for recording income and expenditure must be timely and no later than the period for adjusting the final accounts of each level of budget for amounts arising during the year. For loans and aid implemented through additional allocations from the central government to local budgets, the recording of income and expenditure must be completed no later than the end of the period for adjusting the final accounts of the local budget. Any income and expenditure recorded in the state budget of a given year shall be settled in the income and expenditure of that year's state budget. When processing the recording of income and expenditure, the financial authority must attach the approval notice for the budget estimate, a list of amounts by each budget-using entity, project, Chapter, Type, Clause, Section, and Subsection as prescribed in the State Budget Manual, and send it to the subordinate first-level budgetary unit or lower-level financial authority (in the case of additional allocations to lower-level budgets) and the State Treasury at the same level for full accounting and settlement in the state budget according to the prescribed regulations.

11. The annual budget settlement expenditure amount is the actual expenditure that has been fully documented for settlement within the fiscal year according to the prescribed regulations and the expenditure transferred to the following year's budget. Expenditure transferred to the following year's budget includes:

- The balance of the budget estimate permitted to be transferred to the following year for continued expenditure;

- The balance of advance payments that have not yet been fully documented for settlement but are permitted to be transferred to the following year's budget for settlement;

- Other unallocated amounts: unallocated budget estimates (if any), excess revenue over the budget estimate that has not been allocated... permitted by the competent authority or transferred to the following year according to the prescribed regulations.

The accounting for revenue and expenditure transfers from the previous year to the following year shall be conducted according to the current State budget classification, specifically as follows: Expenditure transferred to the following year: Chapter 160, Type 10, Clause 10, Section 134, Subsection 07; revenue transferred from the previous year to the following year: Chapter 160, Type 10, Clause 10, Section 062, Subsection 06.

12. Regarding the accounting and settlement of sources for implementing salary reform:

12.1. Sources for implementing salary reform under the State budget that are allocated by the competent authority in a given year may be expended until the end of the adjustment period for finalizing the settlement at each level of the budget and settled within the fiscal year. In cases where expenditures have not been made or have not been fully made, they shall be handled in accordance with Point 4.2 of Section I of this Circular.

12.2. Sources for implementing salary reform from non-State budget revenues of units (such as income from service activities of profit-making public institutions after tax payment as prescribed) shall not be accounted for or settled into the State budget.

13. Financial agencies, State Treasury, and revenue collection agencies (Tax and Customs) at the same level shall urge relevant agencies to process or handle, according to their respective authorities, temporary receipts and temporary holds to be deposited into the State budget in accordance with prescribed regulations; ensure reconciliation of newly generated State budget revenues on their territory and the revenues and expenditures of all levels of the budget (including supplementary revenues and expenditures between different levels of the budget and central government bond and treasury bill revenues) in detail according to the State budget classification before closing the annual accounting books.

II. Settlement work and reporting of annual State budget settlements:

1. Regarding the settlement of State budget expenditures for scientific and technological research programs and other projects lasting more than 12 months as follows:

a) For programs and topics under the science and technology source implemented according to specific regulations.

b) For other programs and projects:

- In cases managed under the regular expenditure mechanism, settlement shall be carried out according to the regulations for regular expenditures;

- In cases managed under the investment construction mechanism, settlement shall be carried out according to the regulations for investment construction expenditures.

c) The amount of funds settled annually according to the fiscal year shall be separately tracked and accumulated annually to serve as the basis for settling the entire program, topic, or project upon completion in accordance with the regulations.

2. Primary budgetary units shall prepare comprehensive settlements of the State budget funds used by subordinate budgetary units (including loans, non-repayable aid, and other items to be recorded as revenues and expenditures according to prescribed regulations) and submit them to the financial agency at the same level within the prescribed time limit. The settlements of primary budgetary units must match the figures of subordinate budgetary units approved and notified by the competent authority in terms of total amounts and details according to the State budget classification.

3. When reviewing and auditing settlements, if irregularities in revenues and expenditures or insufficient conditions for settlement are discovered, the reviewing and auditing agency must reverse the transactions. If expenditures were incorrect, they must be recovered for the budget; if the conditions for settlement are not met, they must be carried over to the next year for settlement.

Based on the decision on handling the settlement mentioned above by the competent authority, the unit and the State Treasury shall reduce the State budget expenditures accordingly, compile, and report the reduced expenditures according to the State budget classification to the financial agency at the same level before the financial agency submits the settlement of its own budget to the Government and People's Council for approval.

4. Budgetary units and localities subject to audit and inspection must thoroughly address and report the results of addressing the recommendations of the State Audit Agency sent to higher-level budgetary units and financial agencies. Primary budgetary units shall aggregate and report to the financial agency at the same level according to Form 12 of Appendix 8 stipulated in Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance. Lower-level financial agencies shall aggregate and submit to higher-level financial agencies according to Form 11 of Appendix 8 stipulated in Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance.

5. The explanatory reports on the settlement of the State budget of budgetary units and local government budgets must clearly and detailedly explain the reasons for increases and decreases in revenues and expenditures for each task and field compared to the budget allocated by the competent authority. For local government budgets, they must also provide detailed explanations: other revenues outside the budget, other expenditures outside the budget; use of reserves; use of increased local budget revenues; use of excess revenue bonuses from higher-level budgets; implementation of important tasks as decided by the Prime Minister accompanying the settlement of local budget revenues and expenditures.

6. For delegated funds: Prepare and report the settlement of delegated funds according to Point 9 of Section V of Circular No. 59/2003/TT-BTC dated June 23, 2003 guiding the decentralization, preparation, execution, and settlement of the State budget and related guidance documents issued by the Ministry of Finance. In cases where delegated funds are allocated in the budget of primary budgetary units under the delegated budget level, the primary budgetary units shall prepare and report the settlement together with the portion of funds they manage and submit it to the financial agency at the same level according to the regulations.

7. Settlement of expenditures from education bond issuance capital and government bond capital shall be carried out as follows:

7.1. Consolidation of expenditures for solidifying school buildings and classrooms from education bond capital into the budget settlement of budgetary units and local budgets according to the regulations;

7.2. Expenditures for important transportation and water conservancy projects from government bonds, project sponsors, budgetary units, State Treasuries, and financial agencies at all levels shall report separately, not consolidated into the budget settlement of the unit or locality.

7.3. The investors report to the supervising authorities, which have the responsibility to aggregate and report to the financial authorities at the same level and subordinate financial authorities responsible for aggregating and reporting detailed figures on final accounts for expenditures on solidifying school facilities from educational treasury bonds, investment in important transportation and irrigation projects from government bonds, according to the prescribed regulations, along with the annual state budget settlement; the Ministry of Finance aggregates it into the settlement according to the regulations.

8. People's Committees at all levels send the annual state budget settlement to the higher-level financial authority within the time limit specified in point 7 of Section V of Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance. After the People's Council approves the state budget settlement, within five days, the financial authority sends the Resolution of the People's Council approving the state budget settlement to the higher-level financial authority for the basis of auditing the state budget settlement and aggregating it into the state budget settlement according to the regulations. In case the approved state budget settlement differs from the state budget settlement sent by the People's Committee, the financial authority must submit it for signature by the People's Committee and send a supplementary report on the differences to the higher-level financial authority.

9. Model forms for annual state budget settlement:

Implement according to the provisions of Circular No. 59/2003/TT-BTC dated June 23, 2003, Circular No. 10/2004/TT-BTC dated February 19, 2004, Circular No. 53/2005/TT-BTC dated June 23, 2005 of the Ministry of Finance, Decision No. 130/2003/QĐ-BTC dated August 18, 2003 of the Minister of Finance, and the guidance provided in this Circular. Specifically, include:

9.1. Administrative agencies and public service units prepare and submit settlements according to the provisions of Circular No. 10/2004/TT-BTC dated February 19, 2004, and Circular No. 53/2005/TT-BTC dated June 23, 2005 of the Ministry of Finance, and the following forms: Form No. 12 attached as Appendix No. 8 to Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance; Form No. 03/ĐVDT attached to this Circular. Level I budgetary units under the central budget send two copies of the settlement to the Ministry of Finance accompanied by electronic data files (one copy sent to the State Budget Department of the Ministry of Finance in writing and accompanied by electronic data files or transmitted via email: [email protected]); simultaneously sending one copy of the settlement to the National Audit Office (in writing). For the Ministry of Defense and the Ministry of Public Security, they send one copy of the settlement in writing to the Ministry of Finance.

9.2. Provincial Departments of Finance establish explanatory reports on the settlement and revenue collection of the state budget; annual revenue and expenditure of local budgets, and submit them for approval by the provincial People's Committee and send them to the Ministry of Finance, while also sending them to the National Audit Office according to the prescribed forms in Circular No. 53/2005/TT-BTC dated June 23, 2005, Circular No. 59/2003/TT-BTC dated June 23, 2003, except for Form No. 02/QT in Appendix No. 8, which is replaced by Form No. 01/TC attached to this Circular; Form No. 03/ĐVDT attached to this Circular; and simultaneously sending electronic data files to the Ministry of Finance (State Budget Department) or transmitting via email: [email protected].

For reports on centrally authorized funds, prepare and submit reports according to the provisions in point 6 of Section II of this Circular.

9.3. The deadline for submitting the annual state budget settlement shall be implemented according to the provisions in point 7.4.2 of Section V of Circular No. 59/2003/TT-BTC dated June 23, 2003 of the Ministry of Finance. Beyond this deadline, Level I budgetary units and lower-level budgets that fail to submit the annual settlement within the prescribed timeframe will be temporarily suspended from receiving budget funds from the Level I budgetary unit's office or temporarily suspended from transferring additional funds to lower-level budgets until the annual settlement is received, except for salaries, salary supplements, allowances, scholarships, and certain essential expenses necessary to ensure the operation of the administrative machinery but excluding expenses for purchasing equipment and maintenance.

9.4. Simultaneously with the annual periodic reports according to Decision No. 130/2003/QĐ-BTC dated August 18, 2003, Circular No. 53/2005/TT-BTC dated June 23, 2005 of the Ministry of Finance, and the reporting forms in points 3.2, 4.2, 4.3, 5, and 6.3 of Section I of this Circular, the State Treasury reports to the same-level financial authority on the use of funds and the results of handling various balances according to the attached forms in this Circular as follows:

- Report on the use of state budget funds (Form No. 01A/KB, 01B/KB, 01C/KB);

- Report on the use of allocated capital investment budgets for projects and works permitted to extend payment into the next year (Form No. 02/KB).

- Summary report on the use of allocated capital investment budgets for basic construction for the fiscal year (Form No. 03/KB).

The State Treasury must send these reports within 45 days after the end of the adjustment period for the annual settlement according to each level of budget. For the report on the use of funds (Form No. 01A/KB, 01B/KB, 01C/KB), the State Treasury must send the data up to December 31 of each year according to the provisions in point 5 of Section I of this Circular, and the data up to the end of the adjustment period for the annual settlement within 45 days after the end of the adjustment period according to each level of budget.

III. Implementation:

This Circular takes effect 15 days after its publication in the Official Gazette and applies to the closing of accounting books at the end of the year and the preparation and submission of annual state budget settlements starting from the 2005 fiscal year. Any provisions regarding the closing of accounting books at the end of the year and the preparation and submission of annual state budget settlements that conflict with the provisions of this Circular are not enforceable.

Ministries, ministerial-level agencies, agencies under the Government, central-level agencies, and People's Committees at provincial and municipal levels directly under the Central Government, and the State Treasury are responsible for guiding subordinate units to implement the closing of accounting books and the preparation and submission of annual state budget settlements according to this Circular.

During implementation, if there are any difficulties, they should be promptly reported to the Ministry of Finance for review and specific guidance./.
