THE MINISTER OF FINANCE

Pursuant to Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 24/2006/NĐ-CP dated March 6, 2006 of the Government amending and supplementing some Articles of Decree No. 57/2002/NĐ-CP dated June 3, 2002 of the Government detailing the implementation of the Ordinance on Fees and Charges;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

After receiving the opinion of the Ministry of Transport at Circular No. 7104/BGTVT dated September 26, 2008;

At the proposal of the Director of the Policy Department;

DECISION:

Article 1. Amending and supplementing Decision No. 10/2003/QĐ-BTC dated January 24, 2003 of the Minister of Finance on the issuance of the fee rates for safety technical inspection and quality inspection of motor vehicles and special-purpose vehicles (hereinafter referred to as Decision No. 10/2003/QĐ-BTC) as follows:

1. Amending and supplementing Clause 1 Article 5 of Decision No. 10/2003/QĐ-BTC as follows:

"1. Motor vehicles include: Cars, tractors, trailers and semi-trailers, two-wheeled motorcycles, three-wheeled motorcycles, motorized bicycles, electric motorcycles, and similar types of vehicles, including motor vehicles for disabled persons."

2. Amending and supplementing the provisions in the Fee Schedule of Decision No. 10/2003/QĐ-BTC as follows:

2.1. Amending and supplementing Item I Fee Schedule for Safety Technical Inspection of Motor Vehicles in Circulation as follows:

Unit of measurement: 1,000 dong/vehicle

2.2. Amending and supplementing Clause 3 Item I Fee Schedule for Safety Technical Inspection of Motor Vehicles in Circulation as follows:

"3. Safety technical inspection for issuing temporary certificates of safety technical condition and environmental protection (valid for no more than 15 days) shall be charged at 100% of the fees specified in Table 1."

2.3. Amending and supplementing Table 3 Item III Fee Schedule for Safety Technical Inspection and Quality Inspection of Motor Vehicles and Special-Purpose Vehicles during Overhaul as follows:

Testing technical safety and environmental protection quality for various types of cars; trailers and semi-trailers manufactured based on certified chassis

2.4. Amending and supplementing Item IV Fee Schedule for Quality Inspection of Parts and Motor Vehicles during Testing for Production Assembly as follows:

"1. Basic fee rate:

Testing technical safety and environmental protection quality for various types of cars; trailers and semi-trailers manufactured based on certified chassis

2. The fee rate specified in Point 8 of Table 4 when testing multiple samples of the same type shall not exceed 2,000,000 dong per type.

3. The fee rate specified in Table 4 also applies to quality inspection during testing for importation for:

- General safety requirements testing of motorcycles and scooters,

- Chassis or engine testing for motorcycles and scooters,

- Other parts testing of motorcycles and scooters."

2.5. Amending Clause 3 Item V as follows: "For motor vehicles and special-purpose vehicles that require design approval, the design approval fee shall be calculated at 8% of the design cost, with a minimum charge of 1,000,000 dong per design."

2.6. Amending and supplementing Item IV Fee Schedule for Quality Inspection of Parts and Motor Vehicles during Testing for Production Assembly as follows:

"1. Basic fee rate:

Unit of measurement: 1,000 dong/equipment

2. In cases where the equipment fails to meet the manufacturer's standards upon inspection and requires repair, adjustment, and re-inspection, the re-inspection fee shall be charged at 50% of the fee rate specified in Table 7.
3. In cases where the inspection equipment suddenly breaks down and requires repair and re-inspection before the scheduled time, the fee shall be calculated according to the inspection fee rate specified in Table 7.
4. In cases where inspection and evaluation are conducted to report on the quality of motor vehicles and inspection equipment, the fee shall be charged at 100% of the fee rate specified in Table 7."

Article 2. This Decision shall take effect 15 days after its publication in the Official Gazette.

Article 3. Organizations and individuals subject to payment of fees, inspection agencies, and related agencies are responsible for implementing this Decision./.
