Regulations on the functions, tasks, powers, and organizational structure of the Post-Clearance Inspection Department under the General Department of Customs

THE MINISTER OF FINANCE

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 02/2010/QD-TTg dated January 15, 2010 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Customs under the Ministry of Finance;
Considering the proposal of the Director General of the General Department of Customs, the Head of the Personnel Department;

DECISION:

Article 1. Position and Functions

1. The Post-Clearance Inspection Department is a unit directly under the General Department of Customs, with the function of advising and assisting the Director General of the General Department of Customs in managing, directing, guiding, and inspecting units within the customs sector in implementing post-clearance inspection work; directly conducting post-clearance inspections within its assigned duties and as prescribed by law.

2. The Post-Clearance Inspection Department has legal personality, its own seal, and is entitled to open accounts at the State Treasury and banks in accordance with the provisions of the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. To submit to the Director General of the General Department of Customs for submission to the Minister of Finance:

a) Legal regulatory documents; documents concerning post-clearance inspection within the authority to issue by the Minister of Finance;

b) Proposals and programs on post-clearance inspection within the authority to decide by the Minister of Finance;

c) Proposals to competent authorities to consider amendments and supplements to legal regulatory documents on post-clearance inspection;

d) Resolving issues related to post-clearance inspection that exceed the decision-making authority of the Director General of the General Department of Customs.

2. To submit to the Director General of the General Department of Customs:

a) Documents guiding internal procedures and measures for organizing post-clearance inspections;

b) Documents responding to policies, systems, and procedures for post-clearance inspections within the authority of the Director General of the General Department of Customs;

c) Proposals to relevant ministries and sectors regarding resolving issues related to post-clearance inspections;

d) Decisions on recovering taxes after post-clearance inspections;

đ) Handling issues related to post-clearance inspections that exceed the authority of the Director of the Post-Clearance Inspection Department.

3. Directing, guiding, and inspecting post-clearance inspection activities at customs units in provinces, centrally-administered cities, and provincial-level cities in accordance with the law.

4. Organizing the collection, consolidation, analysis, and processing of information to serve post-clearance inspection work. Applying investigative measures, conducting transactions with domestic and foreign organizations and individuals, receiving reports and denunciations; requesting relevant agencies and units to provide information and documents to serve post-clearance inspection work.

5. Directly implementing post-clearance inspection work as prescribed by law.

6. Handling administrative violations related to post-clearance inspections within its authority; resolving complaints about decisions on administrative violations and other administrative decisions related to post-clearance inspections within its authority.

7. Applying coercive measures to enforce administrative decisions within its authority according to the provisions of the law.

8. Implementing international cooperation tasks related to post-clearance inspections as prescribed by law and assigned by the Director General of the General Department of Customs.

9. Organizing research and application of scientific and technological progress in post-clearance inspection work.

10. Participating in building programs, contents, and teaching post-clearance inspection business skills for officers and civil servants of the General Department of Customs.

11. Statistics, summarizing, reporting, and evaluating the situation and results of post-clearance inspection work and customs file review work in the customs sector.

12. Organizing the storage of files and documents related to post-clearance inspection work in accordance with the law and the regulations of the Director General of the General Department of Customs.

13. Managing personnel and finance and assets allocated according to the law and the delegation of the Minister of Finance.

14. Performing other tasks assigned by the Director General of the General Department of Customs and as prescribed by the law.

Article 3. Organizational Structure

The Post-Clearance Inspection Department has the following divisions:

1. General Division.

2. Valuation Inspection Division (referred to as Division 1).

3. Tariff Classification and Rate Inspection Division (referred to as Division 2).

4. Post-Clearance Inspection Division for Export and Import Goods under Processing and Production-Export Models (referred to as Division 3).

5. Trade Policy Implementation Inspection Division (referred to as Division 4).

6. Southern Post-Clearance Inspection Division.

7. Information Collection and Processing Division.

Specific tasks of each division shall be stipulated by the Director General of the General Department of Customs.

The staffing of the Post-Clearance Inspection Department shall be decided by the Director General of the General Department of Customs within the total number of staff allocated.

Article 4. Leadership of the Department

1. The Post-Clearance Inspection Department has a Director and several Deputy Directors.

The Director of the Post-Clearance Inspection Department is responsible before the Director General of the General Department of Customs and the law for all activities of the Department; Deputy Directors are responsible before the Director and the law for the areas of work they are assigned to manage.

2. The appointment, dismissal, and removal from office of the Director, Deputy Directors, and other leadership positions in the Post-Clearance Inspection Department shall be carried out in accordance with the law and the delegation of personnel management by the Ministry of Finance.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of signing and replaces Decisions No. 33/2006/QD-BTC dated June 6, 2006 of the Minister of Finance stipulating the functions, tasks, powers, and organizational structure of the Post-Clearance Inspection Department under the General Department of Customs; No. 56/2007/QD-BTC dated June 29, 2007 of the Minister of Finance amending and supplementing Decision No. 33/2006/QD-BTC dated June 6, 2003.

2. The Director General of the General Department of Customs, the Head of the Personnel Department, the Director of the Ministry of Finance's Office, and the Heads of units under and affiliated with the General Department of Customs are responsible for implementing this Decision./.
