Regulations on the functions, tasks, powers, and organizational structure of the Customs Supervision Management Department under the General Department of Customs
THE MINISTER OF FINANCE
Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 02/2010/QD-TTg dated January 15, 2010 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Customs under the Ministry of Finance;
Considering the proposal of the Director General of the General Department of Customs and the Head of the Personnel Department;
DECISION:
Article 1. Position and Functions
1. The Customs Supervision Management Department is a unit under the General Department of Customs, with the function of advising and assisting the Director General of the General Department of Customs in managing, directing, and guiding units within the customs sector to implement customs procedures, customs inspection, and supervision for exported, imported, and transited goods, and vehicles exiting, entering, and transiting the country (hereinafter referred to as customs supervision operations); directly directing the organization and implementation of customs supervision operations in accordance with the law.
2. The Customs Supervision Management Department has legal personality, its own seal, and is entitled to open accounts at the State Treasury and banks in accordance with the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Director General of the General Department of Customs for submission to the Minister of Finance:
a) Regulatory legal documents; documents concerning customs procedures and customs inspection and supervision within the authority to issue by the Minister of Finance;
b) Programs and projects concerning customs procedures and customs inspection and supervision;
c) Opinions on participation with other ministries and sectors regarding regulatory legal documents guiding the export, import of goods, and exit and entry of transport vehicles related to customs procedures and customs inspection and supervision;
d) Decisions on establishing locations outside ports for customs procedures, inland container depots (ICD); issuing customs declaration forms;
đ) Resolving issues related to customs supervision operations that exceed the decision-making authority of the Director General of the General Department of Customs.
2. Submit to the Director General of the General Department of Customs for consideration and decision:
a) Rules and procedures for customs procedures and customs inspection and supervision;
b) Documents responding to policies, systems, and customs procedures and customs inspection and supervision within the authority of the Director General of the General Department of Customs;
c) Opinions on recommendations to other ministries and sectors regarding resolving issues related to customs procedures and customs inspection and supervision;
d) Establishing bonded warehouses, centralized inspection areas, container freight stations (CFS), and border export inspection areas within special economic zones; equipping inspection and supervision equipment;
đ) Handling issues related to customs procedures and customs inspection and supervision from organizations and individuals that exceed the authority of the Customs Supervision Management Department.
3. Organize the implementation of regulations on customs procedures and customs inspection and supervision:
a) Guide and explain customs procedures and inspection and supervision rules and procedures according to the law and the Director General of the General Department of Customs;
b) Promote and disseminate laws, rules, and procedures in the assigned management field;
c) Resolve issues related to customs procedures and customs inspection and supervision for customs authorities at all levels, enterprises, organizations, and individuals within the scope of the law and the General Department of Customs' procedural rules.
4. Direct and inspect customs authorities at all levels in:
a) Implementing customs procedures and customs inspection and supervision;
b) Organizing the establishment of locations outside ports for customs procedures, inland container depots (ICD), bonded warehouses, centralized inspection areas, container freight stations (CFS), and border export inspection areas within special economic zones according to the decisions of competent authorities.
5. Organize the implementation of work on reform, modernization, and integration of customs procedures and customs inspection and supervision in accordance with the law and the assignment of the Director General of the General Department of Customs.
6. Study and apply scientific and technological progress in the field of customs procedures and customs inspection and supervision.
7. Participate in building programs, curricula, and teaching customs procedures and customs inspection and supervision.
8. Summarize, analyze, and evaluate the results of implementing customs-related policies and laws concerning customs procedures and customs inspection and supervision.
9. Manage staff, civil servants, and finances and assets allocated in accordance with the law and the Ministry of Finance's delegated management.
10. Perform other tasks assigned by the Director General of the General Department of Customs and as prescribed by law.
Article 3. Organizational Structure
The Customs Supervision Management Department has the following divisions:
1. General Division.
2. Export-Import Goods Supervision Division (referred to as Division 1).
3. Investment, Processing, and Export Zone Goods Supervision Division (referred to as Division 2).
4. Exit-Entry Vehicles and Other Goods Supervision Division (referred to as Division 3).
Specific tasks of each division are stipulated by the Director General of the General Department of Customs.
The staffing of the Customs Supervision Management Department is decided by the Director General of the General Department of Customs within the total number of positions allocated.
Article 4. Leadership of the Department
1. The Customs Supervision Management Department has a Director and several Deputy Directors.
The Director of the Customs Supervision Management Department is responsible before the Director General of the General Department of Customs and the law for all activities of the Department; Deputy Directors are responsible before the Director and the law for the fields of work they are assigned to manage.
2. The appointment, dismissal, and removal of the Director, Deputy Directors, and other leadership positions in the Customs Supervision Management Department shall be carried out in accordance with the law and the Ministry of Finance's delegated management of cadres.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from the date of signature.
The Director of the General Department of Customs, the Head of the Cadre Organization Department, the Director of the Ministry of Finance’s Office, and the Heads of units under the General Department of Customs shall be responsible for implementing this Decision./.
