JOINT RESOLUTION

GUIDING THE NEGOTIATION PROCEDURE AND NOMINATION OF CANDIDATES

FOR MEMBERS OF THE NATIONAL ASSEMBLY, MEMBERS OF THE PEOPLE'S COUNCILS

FOR THE SIXTEENTH TERM FROM 2026 TO 2031

Pursuant to the Constitution of the Socialist Republic of Vietnam amended and supplemented by Resolution No. 203/2025/QH15;

WHEREAS Law on Election of National Assembly Deputies and People's Council Members No. 85/2015/QH13 has been amended and supplemented with some articles according to Law No. 83/2025/QH15;

The Standing Committee of the National Assembly, the Government, and the Presidency of the Central Committee of the Vietnam Folklore Front issue this Joint Resolution guiding the negotiation procedure and nomination of candidates for members of the National Assembly and members of the People's Councils for the term from 2026 to 2031.

PART I

ORGANIZATION OF THE FIRST NEGOTIATION MEETING TO REACH AGREEMENT ON THE STRUCTURE, COMPOSITION, AND NUMBER OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES AND PEOPLE'S COUNCIL MEMBERS

Section 1

REGARDING THE NEGOTIATION AND NOMINATION

OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES

Article 1. Organization of the first negotiation meeting

1. The first negotiation meeting shall be held within the period from December 1, 2025 to December 10, 2025.

2. The first negotiation meeting at the central level shall be convened, chaired by the Presidency of the Central Committee of the Vietnam Folklore Front, and carried out in accordance with Article 38 of the Law on Election of National Assembly Deputies and People's Council Members.

3. The first negotiation meeting at the provincial level shall be convened, chaired by the Provincial Committee of the Vietnam Folklore Front, and carried out in accordance with Article 39 of the Law on Election of National Assembly Deputies and People's Council Members.

Article 2. Content, procedures, and formalities for organizing the first negotiation meeting

1. The meeting shall elect the chairperson in the Presidency of the Central Committee of the Vietnam Folklore Front (for the central-level negotiation meeting) or in the Provincial Committee of the Vietnam Folklore Front (for the local-level negotiation meeting) and the secretary of the meeting.

2. For the first negotiation meeting at the central level, representatives of the Standing Committee of the National Assembly shall present the proposed structure, composition, and number of people from political organizations, the Central Committee of the Vietnam Folklore Front, political-social organizations, social organizations, state agencies, and military units at the central level who will be nominated as candidates for National Assembly deputies.

For the first negotiation meeting at the local level, representatives of the Standing Committee of the People's Council at the provincial level shall present the proposed structure, composition, and number of people from political organizations, the Vietnam Folklore Front, political-social organizations, social organizations, state agencies, and military units at the local level who will be nominated as candidates for National Assembly deputies.

3. The meeting shall discuss and reach agreement on the structure, composition, and number of people nominated as candidates for National Assembly deputies from agencies, organizations, and units, ensuring the surplus number of candidates, the ratio of female candidates, and ethnic minority candidates in accordance with the Law on Election of National Assembly Deputies and People's Council Members.

In case an agreement cannot be reached on any issue, the meeting shall decide to vote by raising hands or secret ballot. The meeting shall elect a counting team consisting of five to fifteen people. If the decision is made to vote by secret ballot, the ballots must bear the seal of the Vietnam Folklore Front Committee convening the negotiation meeting. Only delegates present at the negotiation meeting may vote.

4. The meeting shall approve the minutes (in Model No. 01/BCĐBQH-MT issued together with this Resolution).

Sending the minutes of the first negotiation meeting at the central level shall be carried out in accordance with Clause 3, Article 38 of the Law on Election of National Assembly Deputies and People's Council Members; at the provincial level, it shall be carried out in accordance with Clause 3, Article 39 of the Law on Election of National Assembly Deputies and People's Council Members.

Article 3. Adjustment and guidance on introducing candidates for nomination

1. Based on the results of the first round of consultation, no later than December 15, 2025, the Standing Committee of the National Assembly shall conduct the first adjustment to the structure, composition, and number of people from central and local agencies, organizations, and units eligible for nomination as National Assembly deputies according to Article 40 of the Law on Elections of National Assembly Deputies and People's Council Deputies. The adjustment document shall be immediately sent to the People's Committee of the Vietnam Fatherland Front at the level organizing the consultation meeting.

2. On the basis of the first adjustment made by the Standing Committee of the National Assembly regarding the structure, composition, and number of people from agencies, organizations, and units eligible for nomination as National Assembly deputies, the Standing Committee of the People's Committee of the Vietnam Fatherland Front at the level organizing the consultation meeting shall have the responsibility to notify the agencies, organizations, and units allocated the number of people eligible for nomination as National Assembly deputies and provide guidance on the content, procedures, and formalities for nominating candidates and preparing candidate files according to the Law on Elections of National Assembly Deputies and People's Council Deputies, Resolution No. 101/2025/UBTVQH15 of the Standing Committee of the National Assembly (hereinafter referred to as Resolution No. 101/2025/UBTVQH15) and Chapter II of this Resolution.

Section 2

NOMINATION AND INTRODUCTION OF CANDIDATES FOR PEOPLE'S COUNCIL DEPUTIES

Article 4. Organization of the First Round of Consultation Meetings

The first round of consultation meetings at each level shall be organized within the period from December 1, 2025 to December 10, 2025, convened and chaired by the Standing Committee of the People's Committee of the Vietnam Fatherland Front at the same level, and carried out according to Article 50 of the Law on Elections of National Assembly Deputies and People's Council Deputies.

Article 5. Contentprocedure, formalities for organizing the first round of consultation meetingsnghịconsultation

1. The meeting appoints the chairperson from the Standing Committee of the People's Committee of the Vietnam Fatherland Front and the meeting secretary.

2. Representatives of the Standing People's Council at the provincial and communal levels present the proposed structure, composition, and number of people eligible for nomination as People's Council deputies of their respective political organizations, People's Committee of the Vietnam Fatherland Front, political-social organizations, social organizations, military units, state agencies at the same level, and public institutions, economic organizations, administrative units below or villages, residential wards (for the communal level).

3. The meeting discusses to agree on the structure, composition, and number of people eligible for nomination from agencies, organizations, units, and villages, residential wards (for the communal level), ensuring the surplus number of candidates, the ratio of female and ethnic minority candidates for People's Council deputies as stipulated by the Law on Elections of National Assembly Deputies and People's Council Deputies.

In case an agreement cannot be reached on any issue, the meeting shall decide to vote by raising hands or secret ballot. The meeting shall elect a counting team consisting of five to fifteen people. If the decision is made to vote by secret ballot, the ballots must bear the seal of the Vietnam Folklore Front Committee convening the negotiation meeting. Only delegates present at the negotiation meeting may vote.

4. The meeting approves the minutes (according to Model No. 01/BCDHND-MT issued together with this Resolution).

The submission of the consultation meeting minutes at the provincial and communal levels shall be carried out according to Clause 4 of Article 50 of the Law on Elections of National Assembly Deputies and People's Council Deputies.

Article 6. Adjustment and Guidance on Introducing Candidates for Nomination

1. Based on the results of the first round of consultation, no later than December 15, 2025, the Standing People's Council at the provincial and communal levels shall conduct adjustments to the structure, composition, and number of people from agencies, organizations, units, and villages, residential wards (for the communal level) eligible for nomination as People's Council deputies of their respective levels according to Article 51 of the Law on Elections of National Assembly Deputies and People's Council Deputies. The adjustment document shall be immediately sent to the People's Committee of the Vietnam Fatherland Front at the level organizing the consultation meeting.

2. On the basis of the adjustments made by the Standing People's Council at each level regarding the structure, composition, and number of people eligible for nomination as People's Council deputies from agencies, organizations, units, and villages, residential wards (for the communal level), the Standing Committee of the People's Committee of the Vietnam Fatherland Front at the provincial and communal levels shall have the responsibility to notify the agencies, organizations, units, villages, residential wards allocated the number of people eligible for nomination as People's Council deputies and provide guidance on the content, procedures, and formalities for nominating candidates and preparing candidate files according to the Law on Elections of National Assembly Deputies and People's Council Deputies, Resolution No. 101/2025/UBTVQH15, and Chapter II of this Resolution.

Chapter II

AGENCIES, ORGANIZATIONS, UNITS INTRODUCING CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES AND PEOPLE'S COUNCIL DEPUTIES

Section 1

NOMINATION AND INTRODUCTION OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES

Article 7. Agencies and units introducing candidates for electionorganizationto representatives of the National Assemblyđạibiểu Quốc hội

1. The introduction of candidates for election to representatives of the National Assembly by agencies, organizations, and units shall be conducted within the period from December 17, 2025 to January 25, 2026.

2. Agencies, organizations, and units allocated to introduce candidates for election to representatives of the National Assembly shall implement the introduction of their own candidates for election to representatives of the National Assembly according to the following procedures:

a) Organize a meeting of the leadership of the agency, organization, or unit to propose candidates for election to representatives of the National Assembly;

b) Organize a meeting of voters at the place of work or workplace (hereinafter referred to as the place of work) to seek opinions on the proposed candidates for election;

c) Based on the comments and trust of the meeting of voters at the place of work regarding the proposed candidates for election, the leadership of the agency, organization, or unit organizes an expanded meeting of the leadership to discuss and introduce candidates for election to representatives of the National Assembly.

Article 8. Meeting of the leadership of the agency, organization, or unit to propose candidates for election to representatives of the National Assembly

1. Participants in the meeting:

a) Leadership body of the political organization for political organizations, Vietnam Fatherland Front Committee, political-social organizations, social organizations;

b) Leadership body of the state agency for state agencies;

c) Leadership body of the organization or unit for public service units, economic organizations, and the Executive Committee of the Trade Union of the organization or unit (if any);

d) Commanding officer of the unit for people's armed forces units;

đ) The membership of the leadership body of the agency, organization, or unit is determined according to the charter and regulations on the organizational structure and operation of the agency, organization, or unit. In cases where the charter and regulations do not specify the membership of the leadership body, the head of the agency, organization, or unit shall determine the membership based on the organizational structure regulations of the agency, organization, or unit.

2. Procedures and formalities for organizing the meeting:

a) Representatives of the leadership of the agency, organization, or unit, commanding officers of people's armed forces units introduce the purpose and requirements of the meeting, propose the structure, membership, number of candidates allocated for introduction, qualifications of representatives of the National Assembly, and steps to establish a list of candidates for introduction;

b) Participants in the meeting discuss the proposal to introduce candidates for election to representatives of the National Assembly of their own agency, organization, or unit to seek comments from the meeting of voters at the place of work;

c) Approve the minutes of the meeting (according to Model No. 02/BCĐBQH-MT issued together with this Resolution).

Article 9. Meeting to seek opinions of voters at the place of work on the proposed candidates for election to representatives of the National Assembly

1. The organization of meetings to seek opinions of voters at the place of work on the proposed candidates for election to representatives of the National Assembly shall be carried out in accordance with Articles 1, 3, and 4 of Resolution No. 101/2025/UBTVQH15.

2. Minutes of the meeting are recorded according to Model No. 01/HNCT (for meetings organized in person) or Model No. 05/HNCT (for meetings organized online or through distribution of ballots for opinion collection) issued together with Resolution No. 101/2025/UBTVQH15.

3. In cases where the proposed candidate for election to representatives of the National Assembly does not receive the trust of more than 50% of the total number of voters attending the meeting of voters at the place of work, the leadership of the agency, organization, or unit shall organize the introduction of another candidate.

The procedures and formalities for reintroducing the proposed candidate for election are implemented in accordance with Article 7 of this Resolution.

Article 10. The expanded leadership conference of the agency, organization, or unit to discuss and introduce candidates for National Assembly deputies. 1. Participants at the conference:

a) For political organizations, participants include the leadership body and representatives of the heads of subordinate units;

b) For the Vietnam Fatherland Front Committee, political-social organizations, social organizations, participants include the Presidium, the head of member organizations (in cases where there are no member organizations, it extends to representatives of the heads of subordinate units) or the Standing Committee, the Executive Committee (for organizations without a Presidium) and representatives of the heads of subordinate units introducing candidates;

c) For state agencies, participants include the leadership body and representatives of the heads of subordinate units;

d) For public service units, economic organizations, participants include the leadership body, representatives of the Trade Union Executive Committee (if any), and representatives of the heads of subordinate units;

đ) For people's armed forces units, participants include the unit commander, representatives of the Trade Union Executive Committee (if any), military personnel representatives, and commanders of directly subordinate units;

e) Subordinate units or directly subordinate units of agencies, organizations, and units specified in points a, b, c, d, and đ of this clause shall be determined according to the regulations, charters, or organizational and operational provisions of the agencies, organizations, and units.

2. Procedures and formalities for organizing the conference:

a) Representatives of the leadership of the agency, organization, or unit, and the commander of the people's armed forces unit report on the situation and results of the meeting to seek opinions from voters regarding each person proposed to be introduced as a candidate;

b) Participants at the conference discuss and express their approval for each person proposed as a candidate through raising hands or secret ballot as decided by the conference. The conference appoints a Counting Team consisting of three to five persons. In cases where secret ballot voting is decided upon, the nomination form must bear the stamp of the agency, organization, or unit. The Counting Team conducts the vote counting and prepares minutes (according to Model No. 06/BBKPHN issued together with this Resolution);

c) The conference approves the minutes and list of persons proposed as candidates (according to Model No. 03/BCĐBQH-MT and Model No. 04/BCĐBQH-MT issued together with this Resolution).

Article 11. Submission of candidacy application files of candidates for National Assembly deputies and conference minutes.

1. Based on the results of the expanded leadership conference, the agency, organization, or unit has the responsibility to guide its selected and introduced candidates for National Assembly deputies to prepare candidacy application files in accordance with Article 35 of the Law on Elections of National Assembly Deputies and People's Council Deputies and the guidelines of the National Election Council.

2. By no later than 17:00 on February 1, 2026, candidates must complete the submission of their candidacy application files for National Assembly deputies.

The submission of candidacy application files for National Assembly deputies is carried out in accordance with Clause 1 of Article 36 of the Law on Elections of National Assembly Deputies and People's Council Deputies and the guidelines of the National Election Council.

3. The submission of voter meeting minutes at the workplace and leadership conference minutes of central-level agencies, organizations, and units is carried out in accordance with Clause 5 of Article 41 of the Law on Elections of National Assembly Deputies and People's Council Deputies; at provincial level, it is carried out in accordance with Clause 5 of Article 42 of the Law on Elections of National Assembly Deputies and People's Council Deputies, to be completed no later than February 1, 2026.

4. For agencies, organizations, and units connected to the national document interconnection system, voter meeting minutes at the workplace and leadership conference minutes of central-level agencies, organizations, and units are sent through this system.

INTRODUCTION OF CANDIDATES FOR PEOPLE'S COUNCIL DEPUTIES

Section 2

Article 12. Agencies, organizations, units conducting the introduction of candidates for provincial People's Council deputiesat commune level

1. The introduction of candidates for People's Council deputies by agencies, organizations, and units shall be carried out within the period from December 17, 2025 to January 25, 2026.

2. A person introduced as a candidate for a People's Council deputy of a certain administrative unit must be a resident or regularly working in that administrative unit.

3. Agencies, organizations, and units that are expected to allocate the number of people to be introduced as candidates shall carry out the introduction of their own candidates for People's Council deputies according to the following procedures:

a) Organize a meeting of the leadership board of the agency, organization, or unit to propose candidates for People's Council deputies;

b) Organize a conference to gather opinions of voters at the place of work regarding the proposed candidates;

c) Based on the comments and trust of the voter conference at the place of work regarding the proposed candidates, the leadership board of the agency, organization, or unit organizes an expanded leadership board meeting to discuss and introduce candidates for People's Council deputies.

4. The introduction of candidates from villages, residential wards for commune-level People's Council deputies shall be implemented according to the provisions of Chapter II of Resolution No. 101/2025/UBTVQH15.

Article 13. Meeting of the leadership board of the agency, organization, or unit to propose candidates for People's Council deputies

1. Participants in the meeting:

a) Leadership body of the political organization for political organizations, Vietnam Fatherland Front Committee, political-social organizations, social organizations;

b) Leadership body of the state agency for state agencies;

c) Leadership body of the organization or unit for public service units, economic organizations, and the Executive Committee of the Trade Union of the organization or unit (if any);

d) Commanding officer of the unit for people's armed forces units;

d) The composition of the leadership board of the agency, organization, or unit is determined by the regulations and charter concerning the organizational structure and operation of the agency, organization, or unit. In cases where the regulations and charter do not specify the composition of the leadership board, the head of the agency, organization, or unit shall determine the composition based on the organizational structure regulations of the agency, organization, or unit.

2. Procedures and formalities for organizing the meeting:

a) Representatives of the leadership of the agency, organization, or unit, and the commander of the people's armed forces introduce the purpose and requirements of the meeting, propose the structure, composition, and number of candidates to be allocated, the standards for People's Council deputies, and the steps to establish the list of candidates;

b) Participants in the meeting discuss the proposal to introduce candidates for People's Council deputies from their own agency, organization, or unit to gather the comments of the voter conference at the place of work;

c) Approve the minutes of the meeting (according to Model No. 02/BCĐBHĐND-MT attached to this Resolution).

Article 14. Conference to gather opinions of voters at the place of work regarding the proposed candidates for People's Council deputies

1. The organization of the conference to gather opinions of voters at the place of work regarding the proposed candidates for People's Council deputies shall be conducted according to the provisions of Articles 1, 3, and 4 of Resolution No. 101/2025/UBTVQH15.

2. Minutes of the meeting are recorded according to Model No. 01/HNCT (for meetings organized in person) or Model No. 05/HNCT (for meetings organized online or through distribution of ballots for opinion collection) issued together with Resolution No. 101/2025/UBTVQH15.

3. In cases where the proposed candidate for People's Council deputy does not receive the trust of more than 50% of the total number of voters attending the voter conference at the place of work, the leadership board of the agency, organization, or unit shall organize the introduction of another candidate.

The procedure and process for reintroducing the proposed candidate shall be carried out according to the provisions of Article 12 of this Resolution.

Article 15. An expanded leadership meeting of the agency, organization, or unit to discuss and introduce candidates for People's Council representatives.c) For provincial-level People's Councils, the attendees at the meeting include the Standing Committee of the People's Council, representatives of the heads of the People's Council's Committees, and representatives of the heads of the Office of the National Assembly Delegation and the People's Council;

a) For political organizations, participants include the leadership body and representatives of the heads of subordinate units;

b) For the Vietnam Fatherland Front Committee, political-social organizations, social organizations, participants include the Presidium, the head of member organizations (in cases where there are no member organizations, it extends to representatives of the heads of subordinate units) or the Standing Committee, the Executive Committee (for organizations without a Presidium) and representatives of the heads of subordinate units introducing candidates;

c) For state agencies, participants include the leadership body and representatives of the heads of subordinate units;

d) For provincial-level People's Committees, the attendees at the meeting include the leadership of the People's Committee and representatives of the heads of specialized agencies and other administrative organizations under the People's Committee;

đ) For communal-level People's Councils, the attendees at the meeting include the Standing Committee of the People's Council and representatives of the heads of the People's Council's Committees. For communal-level People's Committees, the attendees at the meeting include the leadership of the People's Committee and representatives of the heads of subordinate units under the People's Committee;

e) For specialized agencies under provincial-level People's Committees and other state agencies, the attendees at the meeting include the leadership and representatives of the heads of subordinate units (if any);

g) For public service units, the attendees at the meeting include the leadership, representatives of the heads of subordinate units (if any), and representatives of the Trade Union Executive Committee (if any);

h) For economic organizations, the attendees at the meeting include the leadership, heads of departments, sections, workshops, stations, farms, and representatives of the Trade Union Executive Committee (if any);

i) For people's armed forces units, the attendees at the meeting include the unit commander, representatives of the Trade Union Executive Committee (if any), representatives of military personnel, and commanders of directly subordinate units;

k) In cases where the head of the agency, organization, or unit is proposed as a candidate for People's Council representative, the deputy head of the agency, organization, or unit shall convene and chair the meeting;

1) The subordinate units or directly subordinate units of the agencies, organizations, or units specified in points a, b, d, e, g, and i of this clause shall be determined according to the regulations, charters, or organizational and operational provisions of the agencies, organizations, or units.

c) The meeting adopts the minutes and list of persons introduced as candidates (in accordance with Model No. 03/BCĐBHĐND-MT and Model No. 04/BCĐBHĐND-MT issued together with this Resolution).

a) Representatives of the leadership of the agency, organization, or unit, and the commander of the people's armed forces unit report on the situation and results of the meeting to seek opinions from voters regarding each person proposed to be introduced as a candidate;

b) Participants at the conference discuss and express their approval for each person proposed as a candidate through raising hands or secret ballot as decided by the conference. Article 16. Submission of candidacy application files of candidates for People's Council representatives and meeting minutes.

1. Based on the results of the expanded leadership meeting, the agency, organization, or unit is responsible for guiding its selected and introduced candidates for People's Council representatives to prepare their candidacy application files in accordance with Article 35 of the Law on Election of National Assembly and People's Council Deputies and the guidelines of the National Election Council.

2. By no later than 17:00 on February 1, 2026, the candidates must complete the submission of their candidacy application files for People's Council representatives.

3. The submission of candidacy application files for People's Council representatives is carried out in accordance with Clause 2 and Clause 3 of Article 36 of the Law on Election of National Assembly and People's Council Deputies and the guidelines of the National Election Council.

4. By no later than February 1, 2026, the minutes of the voters' meetings at the workplace, the minutes of the leadership meetings of the agency, organization, or unit, and the minutes of the voters' meetings in villages or residential wards shall be sent in accordance with Clause 6 of Article 52 of the Law on Election of National Assembly and People's Council Deputies.

FOR THE ORGANIZATION OF THE SECOND BUSINESS MEETING TO NEGOTIATE AND ESTABLISH A PROVISIONAL LIST OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES

Chapter III

NEGOTIATION AND INTRODUCTION OF CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIESĐẠI BIỂU HỘI ĐỒNG NHÂN DÂN

Section 1

Article 17. Organization of the Second Consultative Conference

1. The Second Consultative Conference shall be held from February 2, 2026 to February 3, 2026.

2. The Second Consultative Conference at the central level shall be convened, chaired, and conducted by the Central Steering Committee of the Vietnam Fatherland Front in accordance with the provisions of Article 43 of the Law on Election of Deputies to the National Assembly and People's Councils.

3. The Second Consultative Conference at the provincial level shall be convened, chaired, and conducted by the Standing Board of the Provincial Vietnam Fatherland Front Committee in accordance with the provisions of Article 44 of the Law on Election of Deputies to the National Assembly and People's Councils.

4. The list of candidates proposed for presentation to the Second Consultative Conference must ensure the necessary surplus to allow the conference to consider and select a preliminary list of candidates for deputies to the National Assembly.

Article 18. Contentprocedures and procedures for organizing the Second Consultative Conference

1. The Central Steering Committee of the Vietnam Fatherland Front (for the central consultative conference), the Standing Board of the Provincial Vietnam Fatherland Front Committee (for the local consultative conference) shall report on the situation regarding the introduction of candidates by agencies, organizations, units, and self-nominated candidates in the locality (if any).

2. The conference shall discuss and establish a preliminary list of candidates for deputies to the National Assembly based on the following contents:

a) The criteria for National Assembly deputies;

b) The results of the first adjustment by the Standing Committee of the National Assembly concerning the proposed structure, composition, and number of candidates introduced for deputies to the National Assembly by organizations and units;

c) The results of the agreement reached at the First Consultative Conference;

d) The files and minutes of the introduction of candidates for deputies to the National Assembly submitted by agencies, organizations, and units;

đ) Opinions and trust of voters where the candidate works regarding the introduction of candidates for deputies to the National Assembly.

3. In cases where agreement cannot be reached on any issue, the conference shall decide to vote by raising hands or secret ballot. The conference shall elect a Counting Team consisting of five to fifteen people. If voting by secret ballot is decided, the ballots must bear the stamp of the Vietnam Fatherland Front Committee convening the consultative conference. Only delegates present at the consultative conference may vote.

4. The conference shall discuss plans to collect opinions and trust of voters residing in the locality regarding candidates introduced by agencies, organizations, and units, and plans to collect opinions and trust of voters residing in the locality and working place (if any) regarding self-nominated candidates (for the local consultative conference); raise issues that need to be verified and clarified regarding candidates.

5. The conference shall approve the minutes and preliminary list of candidates for deputies to the National Assembly (in Form No. 01/BCĐBQH-MT and Form No. 05/BCĐBQH-MT issued together with this Resolution).

6. The dispatch of the minutes of the Second Consultative Conference at the central level shall be carried out in accordance with Clause 3 of Article 43 of the Law on Election of Deputies to the National Assembly and People's Councils; at the provincial level, it shall be carried out in accordance with Clause 3 of Article 44 of the Law on Election of Deputies to the National Assembly and People's Councils.

Section 2

REGARDING THE NEGOTIATION AND NOMINATION

CANDIDATES FOR DEPUTIES TO THE PEOPLE'S COUNCILS

Article 19. The second round of consultation meetings

1. The second round of consultation meetings at each level shall be organized from February 2, 2026 to February 3, 2026, convened, chaired by the Standing Committee of the Vietnam Fatherland Front Committee at the same level, and carried out in accordance with the provisions of Article 53 of the Law on Election of National Assembly Deputies and People's Council Deputies.

2. The list of candidates introduced for the second round of consultation meetings must ensure the necessary surplus for the meeting to consider and select the preliminary list of candidates for People's Council deputies.

Article 20. Content, procedure, and process of organizing the second round of consultation meetings

1. The Standing Committee of the Vietnam Fatherland Front Committee at the level organizing the consultation meeting reports on the situation of introducing candidates from agencies, organizations, units, and village associations (for commune level), and the situation of self-nominated candidates (if any).

2. The meeting discusses and establishes a preliminary list of candidates for People's Council deputies based on the following contents:

a) The criteria for People's Council deputies;

b) The results of adjustments by the Standing Committee of the People's Council regarding the structure, composition, and number of people introduced as candidates for People's Council deputies from agencies, organizations, and units;

c) The results of the agreement reached at the First Consultative Conference;

d) The files and minutes of introducing candidates for People's Council deputies submitted by agencies, organizations, and units;

đ) The opinions and trust of voters at the workplace regarding the candidates introduced;

3. In case agreement cannot be reached on any issue, the meeting decides to vote by raising hands or secret ballot. The meeting elects a Counting Team consisting of five to fifteen members. If voting by secret ballot is decided, the ballots must bear the stamp of the Vietnam Fatherland Front Committee organizing the consultation meeting. Only representatives present at the consultation meeting have the right to vote.

4. The meeting discusses plans to organize the collection of voter opinions and trust regarding candidates introduced by agencies, organizations, and units, self-nominated candidates, and voter opinions at the workplace (if any) of self-nominated candidates and those introduced by village associations for commune-level People's Council deputies; raises issues that need verification and clarification for candidates.

5. The meeting approves the minutes and the preliminary list of candidates for People's Council deputies (in Model No. 01/BCĐBHĐND-MT and Model No. 05/BCĐBHND-MT issued together with this Resolution).

6. Sending the minutes of the consultation meeting and the preliminary list of candidates for People's Council deputies at provincial and commune levels shall be carried out in accordance with Clause 3 of Article 53 of the Law on Election of National Assembly Deputies and People's Council Deputies.

Chapter IV

ORGANIZING MEETINGS TO COLLECT VOTER OPINIONS AND TRUST AT THE PLACE OF RESIDENCE FOR CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES AND PEOPLE'S COUNCIL DEPUTIES

Article 21. Organizing voter meetings for candidates for National Assembly deputies

1. The Standing Committee of the Vietnam Fatherland Front Committee at the provincial level convenes a meeting with representatives of the Standing Committee of the Vietnam Fatherland Front Committee at the commune level where the candidate for National Assembly deputy resides and representatives of agencies, organizations, and units with candidates to guide the organization of collecting voter opinions and trust.

2. The organization of the meeting of voters at the place of residence for candidates for National Assembly deputies takes place in the village association where the candidate resides, convened and chaired by the Standing Committee of the Vietnam Fatherland Front Committee at the commune level in coordination with the People's Committee at the same level.

The Standing Committee of the Vietnam Fatherland Front Committee at the commune level exchanges with the organization and unit where the candidate is introduced to organize the voter meeting.

3. The organization of the meeting to collect voter opinions and trust at the place of residence for candidates for National Assembly deputies and voter opinions at the workplace (if any) for self-nominated candidates for National Assembly deputies shall be carried out from February 4, 2026 to February 8, 2026, in accordance with Articles 45 and 46 of the Law on Election of National Assembly Deputies and People's Council Deputies and Articles 2, 3, and 4 of Decision No. 101/2025/UBTVQH15.

Article 22. Organization of elector meetings for candidates for People's Council deputies

1. Immediately following the second round of consultations, the Standing Committee of the Vietnam Fatherland Front Organization shall convene a meeting with the responsible personnel for organizational work, staff members from agencies, organizations, and units where candidates are nominated; representatives of the Standing Committee of the Vietnam Fatherland Front Organization at the next lower level, and for commune level, invite the Head of the Mass Mobilization Team in the locality; the Chairman of the Vietnam Fatherland Front Organization at the commune level where the candidate for provincial-level People's Council resides to guide the organization of collecting opinions from electors residing in the candidate's place of residence regarding those individuals listed in the preliminary list; guide the organization of collecting opinions from electors at the workplace (if applicable) for self-nominated candidates, and candidates introduced for nomination by village or neighborhood associations for commune-level People's Council deputies.

2. The organization of elector meetings to collect opinions on candidates for People's Council deputies residing in villages or neighborhoods where the candidates reside shall be organized by the Standing Committee of the Vietnam Fatherland Front Organization at the commune level in coordination with the People's Committee at the same level to convene and preside over.

The Standing Committee of the Vietnam Fatherland Front Committee at the commune level exchanges with the organization and unit where the candidate is introduced to organize the voter meeting.

3. The organization of elector meetings to collect observations and endorsements of candidates for People's Council deputies residing in their place of residence and electors at their workplace (if applicable) for self-nominated candidates and candidates introduced for nomination by village or neighborhood associations for commune-level People's Council deputies shall be carried out within the period from February 4, 2026 to February 8, 2026, as stipulated in Articles 54 and 55 of the Law on Election of Deputies to the National Assembly and People's Councils and Articles 2, 3, and 4 of Resolution No. 101/2025/UBTVQH15.

Article 23. Verification and Response to Matters Raised by Electors Regarding Candidates for National Assembly Deputies and People's Council Deputies

1. The responsibility for verification and response to matters raised by electors regarding candidates for National Assembly deputies and People's Council deputies shall be implemented according to the provisions of Articles 46 and 55 of the Law on Election of Deputies to the National Assembly and People's Councils.

2. By no later than February 8, 2026, the verification and response to matters raised by electors regarding candidates for National Assembly deputies and People's Council deputies must be completed.

Article 24. Second Adjustment of the Composition, Structure, and Number of Candidates for National Assembly Deputies

By no later than February 5, 2026, the Standing Committee of the National Assembly shall conduct the second adjustment of the composition, structure, and number of candidates from central and local agencies, organizations, and units introduced for nomination as National Assembly deputies in accordance with Article 47 of the Law on Election of Deputies to the National Assembly and People's Councils.

Chapter V

ORGANIZATION OF THE THIRD ROUND OF CONSULTATIONS TO SELECT AND ESTABLISH THE LIST OF ELIGIBLE CANDIDATES FOR NATIONAL ASSEMBLY DEPUTIES AND PEOPLE'S COUNCIL DEPUTIES

Section 1

Article 25. Organization of the Third Round of Consultations

1. The third round of consultations shall be held during the period from February 9, 2026 to February 20, 2026.

2. The third round of consultations at the central level, convened and chaired by the Central Steering Committee of the Vietnam Fatherland Front Organization, shall be conducted in accordance with Article 48 of the Law on Election of Deputies to the National Assembly and People's Councils.

3. The third round of consultations at the local level, convened and chaired by the Standing Committee of the Vietnam Fatherland Front Organization at the provincial level, shall be conducted in accordance with Article 49 of the Law on Election of Deputies to the National Assembly and People's Councils.

4. The list of candidates presented for the third round of consultations must ensure a surplus greater than that specified in Clause 6 of Article 57 of the Law on Election of Deputies to the National Assembly and People's Councils.

Article 26. Content, procedure, and organization of the first negotiation meetingProcedurefor organizing the first negotiation meeting

1. The Presidium of the Central Committee of the Vietnam Fatherland Front (for central-level negotiation meetings), the Standing Committee of the Vietnam Fatherland Front Provincial Committee (for provincial-level negotiation meetings) shall report on the situation and results of soliciting opinions and trust from voters regarding candidates, including cases that need to be considered due to issues raised by voters and the list of individuals proposed to be recommended as candidates for National Assembly deputies.

If a candidate does not receive the trust of more than 50% of the total number of voters attending the voter meeting at their place of residence, they will not be included in the list of recommendations for the third negotiation meeting, except in special cases that require clear reporting for the negotiation meeting to consider and decide.

2. The meeting shall discuss, select, and establish a list of individuals who meet the criteria to run as National Assembly deputies.

In case of disagreement, the meeting shall decide to vote by raising hands or secret ballot. The meeting shall appoint a counting team consisting of five to fifteen people. If voting by secret ballot is decided, the ballots must bear the stamp of the Vietnam Fatherland Front Committee at the level of the negotiation meeting. Only representatives present at the negotiation meeting have the right to vote.

3. The meeting shall approve the minutes and list of individuals who meet the criteria to run as National Assembly deputies (according to Model No. 01/BCĐBQH-MT and Model No. 05/BCĐBQH-MT issued together with this Resolution).

4. The sending of the minutes of the third central-level negotiation meeting and the list of individuals who meet the criteria to run as National Assembly deputies shall be carried out according to the provisions of Clause 1, Article 57 of the Law on Election of National Assembly Deputies and People's Council Deputies; at the provincial level, it shall be carried out according to the provisions of Clause 2, Article 57 of the Law on Election of National Assembly Deputies and People's Council Deputies no later than February 22, 2026.

Section 2

REGARDING THE NEGOTIATION AND NOMINATION

CANDIDATES FOR DEPUTIES TO THE PEOPLE'S COUNCILS

Article 27. Organization of the third negotiation meeting

1. The third negotiation meeting at each level shall be organized within the period from February 9, 2026, to February 20, 2026, convened and chaired by the Standing Committee of the Vietnam Fatherland Front Committee at the same level, and implemented according to the provisions of Article 56 of the Law on Election of National Assembly Deputies and People's Council Deputies.

2. The list of candidates recommended to the third negotiation meeting must ensure a surplus greater than the surplus specified in Clause 3, Article 58 of the Law on Election of National Assembly Deputies and People's Council Deputies.

Article 28. Content, procedure, and organization of the third negotiation meeting

1. The Standing Committee of the Vietnam Fatherland Front Committee at the level of the negotiation meeting shall report on the situation and results of soliciting opinions and trust from voters regarding candidates, including cases that need to be considered due to issues raised by voters and the list of individuals proposed to be recommended as candidates for People's Council deputies.

3. The meeting shall approve the minutes and list of individuals who meet the criteria to run as People's Council deputies (according to Model No. 01/BCĐBHĐND-MT and Model No. 05/BCĐBHĐND-MT issued together with this Resolution).

4. The sending of the minutes of the negotiation meeting and the list of individuals who meet the criteria to run as People's Council deputies at the provincial and commune levels shall be carried out according to the provisions of Clause 1, Article 58 of the Law on Election of National Assembly Deputies and People's Council Deputies no later than February 22, 2026.

Chapter VI

IMPLEMENTING PROVISIONS

Article 29. Implementation Provisions

1. This Resolution shall take effect from November 1, 2025.

2. The Vietnam Fatherland Front Committees at all levels shall be responsible for organizing the negotiation process and recommending candidates for National Assembly deputies for the 16th term and People's Council deputies for the 2026-2031 term according to the provisions of this Resolution.

Negotiation meetings must be held in person. In cases of force majeure due to disease outbreaks or natural disasters where it is impossible to hold negotiation meetings in person, the Standing Committee of the Central Committee of the Vietnam Fatherland Front shall consider and decide on holding negotiation meetings online.

In cases where provinces or cities have communes in mountainous or island areas with difficult travel conditions, the Standing Committee of the Vietnam Fatherland Front Committee at the provincial level may consider and decide to hold provincial-level negotiation meetings in a combined form of in-person and online.

Holding negotiation meetings online or in a combined form of in-person and online must ensure technical conditions, information security, cybersecurity, and be appropriate to the actual situation of the locality.

3. Relevant agencies, organizations, and units shall cooperate with the Standing Committees of the Vietnam Fatherland Front Committees at all levels to implement the tasks stipulated in this Resolution.
