Regulations on the functions, tasks, powers, and organizational structure of the Customs Information Technology and Statistics Department under the General Department of Customs
THE MINISTER OF FINANCE
Pursuant to Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 02/2010/QD-TTg dated January 15, 2010 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Customs under the Ministry of Finance;
Considering the proposal of the Director General of the General Department of Customs and the Head of the Cadre and Civil Servant Affairs Department;
DECISION:
Article 1. Position and Functions
1. The Customs Information Technology and Statistics Department is a unit under the General Department of Customs, performing the function of advising and assisting the Director General of the General Department of Customs in researching, developing, and implementing the application of information technology and modernizing customs management and state statistics on customs according to the law.
2. The Customs Information Technology and Statistics Department has legal personality, its own seal, and is entitled to open accounts at the State Treasury and banks in accordance with the law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. To submit to the Director General of the General Department of Customs for submission to the Minister of Finance:
a) Long-term and medium-term strategies, programs, and plans regarding the application of information technology and statistics of the General Department of Customs;
b) Legal normative documents concerning the application of information technology in customs management and state statistics on customs;
2. To submit to the Director General of the General Department of Customs:
a) Documents guiding internal management procedures and regulations regarding the application of information technology in customs activities and state statistics on customs;
b) Annual development plans regarding information technology and customs statistics.
3. To organize implementation, provide guidance, and inspect units within the customs sector in applying information technology and state statistics on customs.
4. To centrally manage and take the lead in building, deploying, maintaining, and ensuring security for hardware systems, computer networks, system software, application software, and technical equipment connected to the information technology system in the customs sector.
5. To organize the construction and management of electronic databases for the customs sector; manage and operate the General Department of Customs' database center.
6. To take the lead in providing infrastructure and information technology (hardware, software) to support the deployment of electronic customs procedures; to take the lead in certifying conformity with the customs information technology system; to implement data exchange between the customs sector and related agencies and organizations in accordance with the law.
7. To build, develop, and ensure the operation of the General Department of Customs' electronic information portal.
8. To organize the implementation of state statistics on customs; compile and publish the Customs Statistical Yearbook on import and export goods.
9. To implement international cooperation on the application of information technology and customs statistics in accordance with the law and the assignment of the Director General of the General Department of Customs.
10. To summarize and evaluate the situation and results of the implementation of information technology and customs statistics work of the General Department of Customs.
11. To coordinate with the Financial Management Department of the General Department of Customs and relevant units to organize investment procurement, installation, deployment, and management of computing equipment for the customs sector in accordance with the law.
12. To study and propose issues requiring amendments, supplements, and improvements in the application of modern customs management methods regarding information technology and state statistics on customs to be consistent with the operations of the customs sector.
13. To conduct scientific research, participate in building training programs and curricula on information technology and state statistics on customs.

Article 3. Organizational Structure
The organizational structure of the Information Technology and Customs Statistics includes:
1. The Planning and Coordination Department.
2. The Information Technology Department.
3. The System Assurance Management Department.
4. The Customs Statistics Department.
5. The Transaction Management and Electronic Information Department.
6. The Customs Database Center (a public service unit).
Specific duties of the Departments and the Customs Database Center shall be stipulated by the General Department of Customs Director.
The Customs Database Center has legal personality, its own seal, and is authorized to open accounts at the State Treasury and banks in accordance with the provisions of law.
The staffing of the Information Technology and Customs Statistics Bureau shall be determined by the General Department of Customs Director within the total number of positions allocated.
Article 4. Leadership of the Department
1. The Information Technology and Customs Statistics Bureau shall have a Director and several Deputy Directors.
The Director of the Information Technology and Customs Statistics Bureau is responsible before the General Department of Customs Director and the law for all activities of the Bureau; Deputy Directors are responsible before the Director and the law for the tasks they are assigned to manage.
2. The appointment, removal, and dismissal of the Director, Deputy Directors, and other leadership positions in the Information Technology and Customs Statistics Bureau shall be carried out in accordance with the provisions of law and the cadre management delegation of the Ministry of Finance.
Article 5. Effectiveness and Responsibility for Implementation
1. This Decision takes effect from the date of signature and replaces Decision No. 18/2003/QĐ-BTC dated February 10, 2003 of the Minister of Finance on the functions, tasks, authorities, and organizational structure of the Information Technology and Customs Statistics Bureau under the General Department of Customs.
2. The General Department of Customs Director, the Cadre and Organization Department Director, the Ministry of Finance Office Director, and the Heads of units subordinate to the General Department of Customs are responsible for implementing this Decision./.
