REGULATIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE CUSTOMS RESEARCH INSTITUTE SUBORDINATE TO THE GENERAL DEPARTMENT OF CUSTOMS

THE MINISTER OF FINANCE

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government on the functions, tasks, powers and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 02/2010/QD-TTg dated January 15, 2010 of the Prime Minister on the functions, tasks, powers and organizational structure of the General Department of Customs;
Considering the proposal of the Director-General of the General Department of Customs and the Head of the Personnel Department,

Article 1. Position and Functions

1. The Customs Research Institute is a public service unit subordinate to the General Department of Customs, with the task of assisting the Director-General of the General Department of Customs in organizing scientific research activities related to customs, building and developing customs forces, modern customs management technology application; managing scientific research activities within the customs sector; organizing scientific information activities to serve research and customs operations.

2. The Customs Research Institute has legal personality, its own seal, and is entitled to open accounts at the State Treasury and banks in accordance with the provisions of the law.

Article 2. Tasks

1. Submit to the Director-General of the General Department of Customs for submission to the Minister of Finance the long-term scientific research plan of the customs sector, the annual plans for implementing national and ministry-level scientific research projects.

2. Submit to the Director-General of the General Department of Customs the program and plan for implementing research tasks at the general department level; the plan for international cooperation in scientific research of the General Department of Customs.

3. Regarding scientific research:

a. Organize the implementation of scientific research on customs, customs procedures, and the application of modern customs management methods into operational work and force building;

b. Analyze, evaluate, and forecast the current status and development trends of customs management activities to meet management requirements and international integration in customs;

c. Summarize practical experiences, propose and recommend policies and measures for state management of customs activities;

d. Organize research and compile the history of Vietnam's Customs.

4. Regarding the management of scientific research activities:

a. Implement and manage scientific research programs and projects and research funding within the customs sector according to the law and the division of labor assigned by the Director-General of the General Department of Customs;

b. Organize the evaluation and acceptance of customs research results; propose plans and measures for the implementation and application of research results;

c. Guide units within the customs sector in organizing scientific research activities to support management and professional operations;

d. Perform the standing duties of the Scientific Council of the customs sector.

5. Regarding scientific information activities:

a. Manage materials and documents on customs activities according to the law and the instructions of the Director-General of the General Department of Customs;

b. Build and manage a customs library to serve research and management activities of the customs sector;

c. Publish publications in various forms such as specialized information, reference books, internal newsletters in accordance with the law. Organize the transfer and application of research results, analysis, and forecasting to meet management requirements of the customs sector;

d. Provide information, advisory, and professional knowledge training services, disseminate and apply scientific and technological knowledge and practical experience on customs policies and systems to help organizations and individuals understand and comply with customs management policies and regulations.

6. Carry out international cooperation activities within the scope of assigned tasks in accordance with the law and the division of labor assigned by the Director-General of the General Department of Customs.

7. Participate in teaching, compiling textbooks and materials to support training and capacity building for customs officials.

8. Report periodically and urgently; summarize and evaluate the results of assigned tasks according to prescribed regulations.

Article 3. Powers and Duties

1. Request units and individuals to provide documents, files, and materials related to the performance of assigned tasks in accordance with the provisions of the law.

2. Sign guiding, explanatory, answering, or work-related documents within the management domain of the Institute.

3. Collaborate with domestic and foreign organizations and individuals to carry out scientific research tasks on customs; the application of modern customs management technology, information exchange, and participation in research project activities in the customs field.

4. Enter into and implement research, information, and training contracts with domestic and foreign organizations and agencies in accordance with the provisions of the law.

5. Organize scientific conferences, seminars, or forums; participate in international customs conferences and seminars serving research work and international integration according to programs and plans approved by the General Director of Customs.

Article 4. Organizational Structure

The organizational structure of the Customs Research Institute includes:

1. Scientific Research Department;

2. Scientific Management and Information Department;

3. Administrative and Financial Affairs Department.

Specific tasks of each department shall be stipulated by the General Director of the General Department of Customs.

Article 5. Leadership of the Institute

1. The Customs Research Institute has a Director and several Deputy Directors.

The Director of the Customs Research Institute is responsible to the General Director of the General Department of Customs and to the law for all activities of the Institute; Deputy Directors are responsible to the Director and to the law for the areas of work they are assigned to manage.

2. The appointment, dismissal, and removal from office of the Director, Deputy Directors, and other leadership positions at the Customs Research Institute shall be carried out in accordance with the provisions of the law and the delegation of personnel management authority by the Ministry of Finance.

Article 6. Staffing and Operating Budget

1. The staffing of the Customs Research Institute shall be decided by the General Director of the General Department of Customs within the total number of staff allocated.

2. The operating budget of the Customs Research Institute shall be funded from the budget of the General Department of Customs and other revenues in accordance with the provisions of the law.

Article 7. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of signing and replaces Decision No. 31/2003/QĐ-BTC dated February 17, 2003 issued by the Minister of Finance on the organizational regulations and operations of the Customs Research Institute under the General Department of Customs.

2. The General Director of the General Department of Customs, the Head of the Personnel Organization Department, the Director of the Ministry of Finance's Office, and the Heads of units subordinate to the General Department of Customs are responsible for implementing this Decision.
