RESOLUTION

On the Implementation of the Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Judges and Lay Judges of People's Courts

SOCIALIST REPUBLIC OF VIET NAM

BASED ON THE CONSTITUTION OF THE SOCIALIST REPUBLIC OF VIETNAM IN 1992 AS AMENDED AND COMPLEMENTED BY RESOLUTION NO. 51/2001/QH10;

Based on the Law on the Organization of People's Councils and People's Committees No. 11/2003/QH11;

Pursuant to the Law on the Organization of People's Courts No. 33/2002/QH10.

RESOLUTION:

Article 1

The Ordinance Amending and Supplementing Certain Provisions of the Ordinance on Judges and Lay Judges of People's Courts was adopted by the Standing Committee of the National Assembly of the XIIth term on February 19, 2011, and shall take effect from July 1, 2011.

Article 2

The Supreme People's Court shall coordinate with relevant agencies to organize the implementation of the transfer of provincial-level People's Court judges, military court zone judges and equivalent incumbents to the mid-level judge rank; district-level People's Court judges, military court region judges and equivalent incumbents to the junior-level judge rank.

The term of office of mid-level judges and junior-level judges upon transfer shall continue to be calculated according to the term of office of judges when appointed.

Article 3

1. The salary of mid-level judges and junior-level judges of People's Courts shall correspond to the salary of provincial-level People's Court judges and district-level People's Court judges as stipulated in the Table of Professional and Vocational Salaries for the Judiciary and Prosecution sectors issued together with Decision No. 730/2004/NQ-UBTVQH11 dated September 30, 2004 of the Standing Committee of the National Assembly.

2. The responsibility allowance for mid-level judges and junior-level judges of People's Courts shall correspond to the responsibility allowance for provincial-level People's Court judges and district-level People's Court judges as stipulated in Decision No. 171/2005/QĐ-TTg dated July 8, 2005 of the Government regarding the allowance system for responsibility allowances for judges, court clerks, and judicial examiners in the judiciary sector. The Prime Minister, the Supreme People's Court, and relevant agencies within their respective functions and powers shall be responsible for implementing and guiding the enforcement of this Decision.

3. The uniform model, distribution and usage regulations, and Judge Identification Card for mid-level judges and junior-level judges of People's Courts and mid-level judges and junior-level judges of military courts shall correspond to the uniform model, distribution and usage regulations, and Judge Identification Card for provincial-level People's Court judges, district-level People's Court judges, military regional court judges and equivalent positions, and military court region judges as stipulated in Decision No. 221/2003/NQ-UBTVQH11 dated January 9, 2003 of the Standing Committee of the National Assembly concerning uniforms for judicial and lay judge personnel.

Article 4

The Government, the Supreme People's Court, and relevant agencies within their respective functions and powers shall be responsible for implementing and guiding the enforcement of this Decision.
