REGARDING MEASURES TO CONTROL LOTTERY ACTIVITIES
Respectfully submitted to: Lottery Enterprises of provinces and cities.
Implementing Resolution No. 68/2006/QH11 of the eleventh session of the National Assembly dated October 31, 2006, and the directive of the Prime Minister in Letter No. 449/LĐCP dated September 22, 2006, the Ministry of Finance guides the implementation of certain policies to manage and control lottery activities as follows:
1. On consumption ratio and quantity of lottery tickets issued
To address the situation where the quantity of tickets issued exceeds market demand at a high level, causing waste in issuance costs and negative impacts during ticket sales, the Ministry of Finance stipulates the consumption ratio for traditional lottery types in each region as follows:
- For the Southern Region: The minimum consumption ratio for each issuance period must reach 55% of the total value of lottery tickets issued.
- For the Northern Region and Central Region: The average consumption ratio for the year 2007 must increase by at least 10% compared to the average consumption ratio of 2006.
Lottery Enterprises of provinces and cities shall calculate and develop issuance plans in accordance with the aforementioned consumption ratios and submit them to the Provincial Department of Finance; the Standing Committee of the Lottery Council of each region before February 28, 2007 for inspection and supervision of the organization and implementation, while also submitting to the Ministry of Finance for general monitoring.
The application date for the minimum consumption ratio regulation will be implemented from April 1, 2007.
2. On collateral system and debt repayment terms for agents
In the first quarter of 2007, Lottery Enterprises must implement active and resolute measures to recover overdue debts exceeding the time limit specified in signed contracts, and strictly fulfill their tax payment obligations according to the prescribed deadlines under relevant Tax Laws.
Starting from April 1, 2007, the payment term for agent debts will be set at a maximum of four weeks (28 days) and from January 1, 2008, it will be set at a maximum of two weeks (14 days), calculated from the date of receiving tickets for sale. Lottery Enterprises must apply a 100% collateral system for the value of tickets received for sale by each lottery agent in each issuance period. For collateral assets, Lottery Enterprises must assess their value at the time of receipt; periodically re-evaluate or conduct evaluations when necessary. The ratio of collateral value to asset value shall be agreed upon between Lottery Enterprises and agents, but must ensure the ability to recover debts in case of contract violations and safety in operations.
3. On prize structure
The payout ratio applied to each type of lottery shall be carried out according to the current regulations.
- Lottery Enterprises in the Northern and Central Regions shall continue to maintain the stability of the existing prize structure and values for traditional lottery types.
- For the Southern Region: Maintain the value of the special prize for the traditional five-digit lottery type. Adjust the value of the special prize for the traditional six-digit lottery type from 20.5% of the ticket issuance value (2,050,000,000 VND for 1,000,000 tickets) to 15% of the ticket issuance value (1,500,000,000 VND for 1,000,000 tickets).
The difference in value between the new special prize and the old special prize shall be used to increase the number and value of prizes following the special prize. The Lottery Council shall unify the number and value of prizes following the special prize for consistent application throughout the region.
The adjustment in the prize structure for the Southern region shall be uniformly applied from April 1, 2007.
4. On managing agents and paying agent commissions, supporting agents
- Provincial and municipal lottery companies have the responsibility to strictly implement the provisions of the Anti-Corruption Law in their lottery business operations. Lottery companies may not enter into agency contracts with organizations or individuals who are not eligible to act as lottery agents or do not have the capacity to serve as lottery agents.
The directors of lottery companies are responsible for ensuring equality in contract signing; ensuring fairness and objectivity in ticket distribution, allocation, and implementation of policies and benefits for lottery agents.
- Agent commission payments and support must comply with state regulations and ensure transparency and openness. Directors of lottery companies must establish rules for agent commission payments and support, register these with the Department of Finance for monitoring, management, and public disclosure to agents. It is strictly prohibited to form separate funds outside of official records for agent commission payments and support.
5. On auditing work and financial transparency
Lottery companies must strictly adhere to the annual mandatory financial statement audit system and the financial transparency system as prescribed by current laws (Government Decree No. 105/2004/NĐ-CP dated March 30, 2004 on independent auditing; Decision No. 192/2004/QĐ-TTg dated November 16, 2004 of the Prime Minister promulgating the Financial Transparency Regulations for state budget levels, budgetary units, organizations supported by the state budget, basic construction investment projects using state budget funds, state-owned enterprises, funds sourced from the state budget, and funds from people's contributions). Annual audited financial statements must be submitted to the Department of Finance and the Ministry of Finance within the stipulated deadlines.
Provincial and municipal lottery companies shall organize the issuance and distribution of lottery tickets according to the prescribed regulations based on the guidance provided in this document./.
