Regulations on the functions, tasks, powers, and organizational structure of the Center for Analyzing and Classifying Export and Import Goods under the General Department of Customs

THE MINISTER OF FINANCE

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 02/2010/QD-TTg dated January 15, 2010 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Customs;
Upon the proposal of the Director-General of the General Department of Customs and the Head of the Personnel Department,

DECISION:

Article 1. Position and Functions

1. The Center for Analyzing and Classifying Export and Import Goods is a public service unit under the General Department of Customs, with the task of assisting the Director-General of the General Department of Customs in performing the work of analyzing and classifying export and import goods as the basis for determining the name and code of goods in customs inspection, managing export tax, import tax, and other revenues as prescribed by law.

2. The Center for Analyzing and Classifying Export and Import Goods has legal personality, its own seal, and is entitled to open accounts at the State Treasury and banks in accordance with the provisions of the law.

Article 2. Tasks

1. Develop the development strategy of the Center within the overall strategy for developing the customs sector, submit it to the Director-General of the General Department of Customs for submission to the Minister of Finance.

2. Submit to the Director-General of the General Department of Customs:

a) Rules and procedures for analyzing and classifying export and import goods;

b) Annual programs, projects, plans on analyzing and classifying export and import goods and their implementation after approval;

c) Proposals for amending and supplementing regulations in the activities of analyzing and classifying export and import goods.

3. Participate in researching and building scientific foundations for determining and amending codes for items listed in the export and import goods catalog and the export and import tariff schedule; build codes for new goods, goods difficult to determine codes, or not detailed enough.

4. Directly analyze and classify export and import goods in the northern region and analyze and classify export and import goods that branches cannot implement.

5. Build and manage a library of samples of export and import goods.

6. Guide and inspect the implementation of rules and procedures for analyzing and classifying export and import goods by branches; build, guide, and inspect the application of standard analytical methods for the laboratories of the Center.

7. Provide final opinions on the results of analyzing and classifying export and import goods of branches when there are questions or complaints from units.

8. Study and apply scientific and technological advances in the analysis and classification of construction materials and imported goods.

9. International cooperation in analyzing and classifying export and import goods in accordance with the law and the assignment of the Director-General of the General Department of Customs.

10. Train and enhance the skills of customs officials working in the analysis and classification of export and import goods of the Center; participate in training and enhancing the skills of customs officials working in the inspection of export and import goods in units within the customs sector.

11. Summarize, evaluate, and report on the results of assigned tasks according to the prescribed regime.

12. Manage staff, civil servants, and employees; manage financial resources and assets allocated in accordance with the law and the delegation of the Minister of Finance.

13. Perform other tasks assigned by the Director-General of the General Department of Customs and as prescribed by law.

Article 3. Powers and Duties

1. Request units and individuals to provide documents, files, and materials related to the performance of assigned tasks in accordance with the provisions of the law.

2. Sign guiding, explanatory, answering, or work-related documents within the scope of assigned tasks in accordance with the provisions of the law and the General Director of the General Department of Customs.

3. Independently conduct or coordinate with agencies and units inside and outside the sector to perform analysis and classification of export and import goods in accordance with the provisions of the law.

Article 4. Organizational Structure

The organizational structure of the Export and Import Goods Analysis and Classification Center includes:

1. Planning and Processing Department.

2. Analysis and Classification Department 1.

3. Analysis and Classification Department 2.

4. Administrative and Financial Department.

5. Branch in Ho Chi Minh City.

6. Branch in Da Nang City.

Specific tasks of the Departments and Branches shall be stipulated by the General Director of the General Department of Customs.

Branches under the Export and Import Goods Analysis and Classification Center have legal personality, separate seals, and are allowed to open accounts at the State Treasury and banks for their operations in accordance with the provisions of the law.

The organizational structure of Branches includes: Administrative and Financial Department and Analysis and Classification Department.

Article 5. Leadership of the Center

1. The Export and Import Goods Analysis and Classification Center has a Director and several Deputy Directors.

The Director of the Export and Import Goods Analysis and Classification Center is responsible before the General Director of the General Department of Customs and the law for all activities of the Center; Deputy Directors are responsible before the Director and the law for the areas of work they are assigned to manage.

2. Appointment, dismissal, and removal from office of the Director, Deputy Directors, and other leadership positions of the Export and Import Goods Analysis and Classification Center shall be carried out in accordance with the provisions of the law and the cadre management delegation of the Ministry of Finance.

Article 6. Staffing and Operating Budget

1. The staffing of the Export and Import Goods Analysis and Classification Center shall be decided by the General Director of the General Department of Customs within the total number of staff allocated.

2. The operating budget of the Export and Import Goods Analysis and Classification Center shall be funded from the budget of the General Department of Customs and other revenues in accordance with the provisions of the law.

Article 7. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of signature and replaces Decisions No. 32/2003/QD-BTC dated March 17, 2003, issued by the Minister of Finance on the functions, tasks, powers, and organizational structure of the Northern, Central, and Southern Export and Import Goods Analysis and Classification Centers under the General Department of Customs; and No. 101/2007/QD-BTC dated December 10, 2007, issued by the Minister of Finance amending and supplementing Decision No. 32/2003/QD-BTC dated March 17, 2003.

2. The General Director of the General Department of Customs, the Head of the Cadre Organization Department, the Director of the Ministry of Finance's Office, and the Heads of units under and affiliated with the General Department of Customs are responsible for implementing this Decision./.
