Regulations on the functions, tasks, powers, and organizational structure of the Vietnam Customs College under the General Department of Customs

THE MINISTER OF FINANCE

Pursuant to Decree No. 178/2007/ND-CP dated December 3, 2007 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decision No. 02/2010/QD-TTg dated January 15, 2010 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Customs under the Ministry of Finance;
Considering the proposal of the Director-General of the General Department of Customs and the Head of the Personnel Department;

DECISION:

Article 1. Position and Functions

1. The Vietnam Customs College is a public service unit under the General Department of Customs, with the task of assisting the Director-General of the General Department of Customs in organizing the implementation of training and professional development for customs officers and civil servants within the customs sector; organizing training and providing related services and consulting on training and development for organizations and individuals both domestically and internationally.

2. The Vietnam Customs College has legal personality, its own seal, and is entitled to open accounts at the State Treasury and banks in accordance with the provisions of the law.

Article 2. Tasks

1. Develop the strategic plan for the Vietnam Customs College within the overall strategic plan for the customs sector, report to the Director-General of the General Department of Customs for submission to the Minister of Finance for consideration and decision.

2. Submit to the Director-General of the General Department of Customs:

a) Annual plans for implementing training and professional development for customs officers and civil servants;

b) Plans for compiling and issuing textbooks and materials for training and professional development in the customs field.

3. Build and implement training and development programs for part-time lecturers and vocational teachers in the customs sector.

4. Organize training and development for customs officers and civil servants according to plans approved by competent authorities.

5. Train and develop policies and laws, as well as customs-related professional knowledge for business communities.

6. Cooperate and link with domestic and international training institutions to fulfill the training and development tasks for customs officers and civil servants in accordance with the law.

7. Organize scientific research to support training activities in the customs field.

8. Provide consulting services on training and development related to the customs field for organizations and individuals both domestically and internationally.

9. Implement information reporting and statistical systems for training and development activities as prescribed; compile and evaluate the results of assigned tasks.

10. Manage personnel and financial resources and assets allocated in accordance with the law and the delegation of personnel management by the Ministry of Finance.

11. Perform other tasks assigned by the Director-General of the General Department of Customs and as prescribed by the law.

Article 3. Powers

1. Request units and individuals to provide relevant documents, files, and materials for the performance of assigned tasks in accordance with the law.

2. Sign guiding, explanatory, response, or work-related documents within the scope of the College's management.

3. Link and cooperate with domestic and international organizations and individuals to perform training and development tasks for customs officers and provide related services and consulting on the customs training field in accordance with the assigned functions and tasks and the law.

4. Issue certificates to students who have completed training and development courses organized by the College in accordance with the law.

Article 4. Organizational Structure

The organizational structure of the Vietnam Customs College includes:

1. Department of General Knowledge and Foreign Languages.

2. Department of Clearance.

3. Department of Post-Clearance Inspection and Customs Control.

4. Training Management and Student Affairs Office.

5. Office.

The operational regulations of the Vietnam Customs College; specific tasks of departments, offices, and rooms shall be stipulated by the Director-General of the General Department of Customs.

Article 5. Leadership

1. The Vietnam Customs College has a President and several Vice Presidents.

The President of the Vietnam Customs College is responsible before the Director-General of the General Department of Customs and the law for all activities of the College; Vice Presidents are responsible before the President and the law for the areas of work they are assigned.

2. The appointment, dismissal, and removal of the President, Vice Presidents, and other leadership positions of the Vietnam Customs College shall be carried out in accordance with the law and the delegation of personnel management by the Ministry of Finance.

Article 6. Establishment and Operating Budget

1. The establishment of the Vietnam Customs School shall be decided by the Director General of the General Department of Customs within the total establishment assigned.

2. The operating budget of the Vietnam Customs School shall be provided from the budget of the General Department of Customs and other revenues as prescribed by law.

Article 7. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from the date of signature. Decree No. 08/QĐ-TCHQ dated January 6, 2006 issued by the Director General of the General Department of Customs on the organizational structure and tasks of the Customs Officer Training Center is hereby repealed.

2. The Director General of the General Department of Customs, the Head of the Cadre Organization Department, the Director of the Ministry of Finance's Office, and the Heads of units under the General Department of Customs shall be responsible for implementing this Decision./.
