PROVINIAL PEOPLE'S COMMITTEE OF LAM DONG PROVINCE

Pursuant to the Law on the Organization of People's Councils and People's Committees (amended) dated June 21, 1994;

Pursuant to Decree No. 58/LCT/HĐND dated August 19, 1991 of the President, "Regarding the Announcement of the Law on Protection and Development of Forests";

Pursuant to Resolution No. 64/KL dated September 12, 1997 of the Provincial Party Committee of Lam Dong Province, regarding the proposal for reforming the organizational structure and management mechanism of the Forestry Sector in the province; Following Directive No. 58/CV-UB dated December 8, 1997 of the Provincial People's Committee on implementing the proposal "Reform of the management mechanism and policies of the Forestry Sector"; and Circular No. 2710/CV-UB dated December 15, 1997 of the Provincial People's Committee on establishing procedures for transferring the management board;

Considering the proposal in Circular No. 369/CV-NN&PTNT dated April 9, 1997 of the Provincial Department of Agriculture and Rural Development, "Regarding the Proposal to Transfer Tan Thượng Forest Management Unit to Tan Thượng Protective Forest Management Board, directly managed by the People's Committee of Di Linh District";

At the suggestion of the Property Management Board of Lam Dong Province,

DECISION:

Article 1: Now, transfer Tan Thượng Forest Management Unit under the Provincial Department of Agriculture and Rural Development to be directly managed, led, and comprehensively directed by the People's Committee of Di Linh District; At the same time, it shall be subject to professional guidance on forest protection and development from the Provincial Department of Agriculture and Rural Development and the Forest Inspection Sub-Department.

Article 2: The functions and responsibilities of Tan Thuong Forest Management Board shall be implemented according to the contents of Decision No. 1171/QD dated November 30, 1986 of the Ministry of Forestry (now the Ministry of Agriculture and Rural Development), "Regarding the Issuance of Regulations on Various Types of Forests: Protective, Special-Purpose, and Production Forests." And the decision defining the functions, responsibilities, organization, staffing, and salary of district-level forest management boards within Lam Dong Province.

Article 3: Entrust the Director of the Provincial Department of Agriculture and Rural Development to coordinate with the Chairman of the People's Committee of Di Linh District and relevant provincial departments to direct Tan Thuong Forest Management Unit to inventory and settle accounts to transfer all current assets and personnel to Tan Thuong Forest Management Board under the direct management of the People's Committee of Di Linh District; The handover process must be completed before May 31, 1998; From June 1, 1998, all activities of Tan Thuong Forest Management Board shall be directed by the People's Committee of Di Linh District.

Article 4: This Decision takes effect from the date of issuance. All previous decisions that conflict with this Decision shall cease to be effective.

Article 5: The Heads of the Office of the Provincial People's Committee, the Property Management Board of the Province, the Directors of the Departments of Finance and Prices, Agriculture and Rural Development, and other relevant provincial departments, the Chief Inspector of the Forest Inspection Sub-Department, the Chairmen of the People's Committee of Di Linh District, and the Tan Thuong Forest Management Board shall implement this Decision accordingly./.
