DECISION OF THE MINISTER
MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT
Regarding the amendment of the Regulation on the management and implementation of the project to protect natural resources and regenerate forests in the upper reaches of the Da River.
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT.
Pursuant to Decree No. 73/CP dated November 1, 1998 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development.
Pursuant to Decision No. 115/1998/QĐ-BNN dated August 12, 1998 of the Minister of Agriculture and Rural Development promulgating the Regulation on the management and implementation of the project to protect natural resources and regenerate forests in the upper reaches of the Da River (Debt Conversion).
Pursuant to the report dated April 20, 2000 of the Director of the Project Management Board for Forestry Aid Projects and the Director General of the Forest Development Department regarding the proposal to amend and supplement the Regulation on the management and implementation of the Debt Conversion project.
DECISION:
Article 1. Now amending the Regulation on the management and implementation of the project to protect natural resources and regenerate forests in the upper reaches of the Da River issued by the Ministry of Agriculture and Rural Development pursuant to Decision No. 115/1998/QĐ-BNN dated August 12, 1998 as follows:
1. Abolish Point 3 of Article 6.
2. Add Point 5 of Article 7 as follows:
Establish an acceptance committee: the membership of the acceptance committee includes: the Chairman of the committee being the Director or Deputy Director of the project management board at the district level. Members of the committee include the accountant and project coordinator at the district level, representatives from relevant departments at the district level (transportation, construction, water resources, agriculture and forestry), conducting acceptance in accordance with current regulations of the State.
3. Amend Article 13 entirely as follows:
The contents of the project plan are implemented through economic contracts A-B at the district-level project management boards. Upon completion or termination of the contract, the district-level project management board establishes an acceptance committee and conducts acceptance of basic construction works (forest production, agroforestry, and infrastructure construction) according to Point 5 of Article 7 newly added in this decision.
The district-level project management board is responsible for the results of acceptance, quantity, and quality of the works. Based on the results of the acceptance committee, the Director of the district-level project management board signs to confirm the volume of work as the basis for settling accounts with the contractor (b), prepares documents, reports for approval by the People's Committee of the province to settle the final accounts of completed works.
Article 2. This Decision takes effect from the date of signing.
Article 3. The Head of the Ministry's Office, related Departments and Units, the Central Project Management Board, the Director of the Central Project Management Board, and local directors in Son La and Lai Chau provinces are responsible for implementing this decision./.
