CIRCULAR
Amending and supplementing Circular No. 141/2009/TT-BTC dated July 13, 2009 of the Ministry of Finance on financial regulations for implementing the Project "Training and Capacity Building for Leaders and Managers Abroad with State Budget"- Training and capacity building for leaders and managers abroad with state budget

- Pursuant to Notification No. 165-TB/TW dated June 27, 2008 of the Central Committee's Office regarding the Resolution of the Politburo on the Project "Training and Capacity Building for Leaders and Managers Abroad with State Budget";
- Pursuant to Decree No. 60/2003/NĐ-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the Law on State Budget;
- Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
- Pursuant to Decision No. 2460-QĐ/BTCTW dated March 24, 2009 of the Central Organization Department on issuing the "Regulations on Selecting Leaders and Managers for Overseas Training and Capacity Building with State Budget";
Upon consideration of the proposal of the Office of Project 165, the Ministry of Finance amends and supplements some financial regulations for implementing the Project "Training and Capacity Building for Leaders and Managers Abroad with State Budget" (Project 165) as follows:
Article 1. Amending and supplementing some articles of Circular No. 141/2009/TT-BTC dated July 13, 2009 of the Ministry of Finance on financial regulations for implementing the Project "Training and Capacity Building for Leaders and Managers Abroad with State Budget" as follows::
1. Amending Clause 1, Article 2:
The Project 165 funding shall be guaranteed by the central and local budgets.
2. Amending Clause 2, Article 4 - Support costs for trainees:
+ Domestic language training: 750,000 VND/person/month;
+ Master’s degree level: 900,000 VND/person/month;
+ Doctoral degree level: 1,050,000 VND/person/month.
3. Amending and supplementing Clause 3, Article 4: Travel expenses and accommodation allowances for trainees from their agencies to the place of study (one round trip for a continuous course; or each session for courses with multiple sessions; public holidays during the course period; or in cases where family members including parents, spouse, children die): the amount of expenditure shall be implemented according to the regulations of the Ministry of Finance on travel expenses and conference organization costs for state agencies and public service units, paid by the agency or organization sending the trainees.
4. Supplementing Clause 4, Article 4 - Rent for accommodation during training:
+ If the Project organizes centralized accommodation, the cost will be based on the contract signed with the facility.
+ If the Project does not organize accommodation for students, the standard cost will be decided by the Steering Committee of the Project but shall not exceed the standard cost specified by the Ministry of Finance on travel expenses and conference organization costs for state agencies and public service units at the time of implementation.
5. Supplementing Clause 5, Article 4 - Rent for foreign experts: Hiring high-level foreign experts for training purposes, the cost of hiring experts will be determined by the Steering Committee based on the publicly announced results of international bidding..
6. Amending and supplementing Clause 2, Article 5 - Visa fees will be reimbursed by Project 165 based on actual expenses incurred.
7. Amending and supplementing Clause 3, Article 5: Living expenses include food, accommodation rental, daily travel expenses, material costs (excluding reference materials) and learning supplies. The living expense rate is stipulated in Appendix No. 01 attached to Circular No. 141/2009/TT-BTC dated July 13, 2009, and is provided based on the actual overseas study period (from the date of enrollment to the end date but not exceeding the time specified in the decision of the Project 165 Steering Committee). In case of exceeding the specified time, the Project 165 Steering Committee will consider and resolve specifically.
8. Amending Clause 4, Article 5: Minimum health insurance applicable uniformly for foreign students in the host country shall be issued in US dollars or the currency of the host country based on the limit specified in Appendix No. 02 attached to Circular No. 141/2009/TT-BTC dated July 13, 2009.
In case the minimum health insurance requirement for admission in the host country is higher or lower than the provisions in the aforementioned Appendix No. 02, it shall be implemented according to the regulations of the host country as notified by the foreign educational institution in the acceptance letter.
For countries not listed in Appendix No. 02, the Project 165 Steering Committee will consider and decide specifically.
In case the trainee (student) purchases health insurance at a higher rate than stipulated in this Circular, the trainee (student) must cover the difference themselves.
9. Amending Clause 8, Article 5: Passport processing fees, health check-up fees, and travel expenses for trainees from their agencies to airports, railway stations, bus terminals... (one round trip for one course): the amount of expenditure shall be implemented according to the regulations of the Ministry of Finance on travel expenses and conference organization costs for state agencies and public service units, paid by the agency sending the trainees.
10. Amending Clause 1, Subpoint b, Article 6: Travel expenses for trainees from their agencies to airports, railway stations, bus terminals... (one round trip for one course): the amount of expenditure shall be implemented according to the regulations of the Ministry of Finance on travel expenses and conference organization costs for state agencies and public service units, paid by the agency sending the trainees.
11. Supplementing Clause 3, Article 6 - Interpreting costs include:
+ If hiring external interpreters (domestic and foreign interpreters), it will be carried out under a lump-sum contract mechanism, with the cost standard determined by the Project 165 Steering Committee.
+ If the interpreter is a staff member of a state agency, they will enjoy the same benefits as other members of the training delegation.
12. Supplementing Clause 4, Article 6 - Air tickets apply to all participants attending training and capacity-building courses, uniformly at the economy class level.
13. Amending Clause 6, Article 7||| Reimburse travel expenses for officials from their agency to the training location and back for a continuous course and in cases where a family member including father, mother; father-in-law, mother-in-law; spouse; or child dies. The reimbursement level shall be implemented according to the regulations of the Ministry of Finance on working expense allowances and conference organization costs for state agencies and public service units, which will be settled by the agency sending the officials to study.
||| 14. Amend Clause 7, Article 7 ||| - Room rental fees during the training period:
+ If the Project organizes centralized accommodation, the cost will be based on the contract signed with the facility.
+ If the Project does not organize accommodation for students, the standard cost will be decided by the Steering Committee of the Project but shall not exceed the standard cost specified by the Ministry of Finance on travel expenses and conference organization costs for state agencies and public service units at the time of implementation.
||| 15. Amend Point a, Clause 2, Article 9||| - In case of death: The State Budget (Project 165 pays) covers the entire cost of transporting the body or urn from abroad back home, from the training location to the family, or subsidizes the remaining transportation costs after insurance has paid out.
||| 16. Amend and supplement Item c, Clause 2, Article 9 ||| - During the course attendance and overseas training period, if the father, mother; father-in-law, mother-in-law; spouse; or child dies and permission is granted by the Project 165 Steering Committee to return home, then the State (Project 165) will provide a round-trip air ticket (or train ticket).
||| 17. Supplement and amend Item b, Clause 3, Article 11||| - Unspent funds at year-end (including budget surplus, deposit balance, advance payments, cash reserves) may be carried over to the next year until the completion of Project 165.
||| 18. Supplement and amend Clause 4, Article 11||| - Report on fund usage:
||| The Project 165 Steering Committee (Project 165 Management Office) is responsible for compiling annual funding sources for implementing Project 165 and submitting them to the Central Party Office for consolidation and submission to the Ministry of Finance together with the preparation of the budget for implementing Project 165 for the planning year, clearly showing:
||| - The previous year's budget allocation received from the competent authority.
||| - Funds expended in the previous year (detailed according to assigned tasks and corresponding chapters, clauses, sections of the state budget).
||| - Unspent funds from the previous year carried over to the current year (including budget surplus, deposit balance, advance payments, cash reserves).
||| - Current year's budget allocation received from the competent authority and the current year's fund usage status up to the reporting date.
Article 2||| Implementation organization:
||| This Circular takes effect from July 1, 2010.
||| Other provisions set forth in Circular No. 141/2009/TT-BTC dated July 13, 2009, issued by the Ministry of Finance, regarding financial regulations for implementing the "Overseas Training and Capacity Building Program for Leaders and Managers Using State Budget" remain effective.
||| Any difficulties encountered during implementation should be reported to the Ministry of Finance and relevant agencies for resolution./.
