CIRCULAR
PROVISIONS ON TECHNICAL SAFETY QUALITY AND ENVIRONMENTAL INSPECTION OF SPECIAL PURPOSE MOTORCYCLES IN THE MINISTRY OF NATIONAL DEFENSE
Pursuant to Clause 6, Article 55 of the Road Traffic Law dated November 13, 2008;
Pursuant to Decree No. 164/2017/NĐ-CP dated December 30, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;
At the proposal of the Director of the General Department of Technology;
The Minister of National Defense issues this Circular on technical safety quality and environmental inspection of special purpose motorcycles in the Ministry of National Defense.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates technical safety quality and environmental inspection of special purpose motorcycles participating in road traffic within the Ministry of National Defense (hereinafter referred to as inspection).
Article 2. Applicability
1. This Circular applies to centers and stations for inspecting technical safety of military motorcycles (hereinafter collectively referred to as inspection facilities); agencies, units, enterprises, organizations, and individuals within the Ministry of National Defense related to the inspection of special purpose motorcycles.
2. This Circular does not apply to the inspection of special purpose motorcycles of enterprises within the Ministry of National Defense that have been equitized with State ownership below 50% of the registered capital.
Article 3. Explanation of Terms
In this Circular, the following terms are understood as follows:
1. Specialized motor vehicles including: Military special purpose motorcycles; construction motorcycles; agricultural and forestry motorcycles equipped for agencies, units, and enterprises specified in Appendix IV attached hereto.
2. Inspection of special purpose motorcycles is the periodic examination and evaluation of the technical safety quality and environmental protection status of special purpose motorcycles to certify that such motorcycles meet the conditions to participate in traffic.
3. is the period measured in months between two inspections. is the period measured in months between two inspections.
4. is the confirmation document of the results of the technical safety inspection and environmental protection of each motor vehicle during the inspection. is the summary record of the results of the technical safety quality and environmental protection inspection of special purpose motorcycles during inspection.
5. Certificate of Technical Safety and Environmental Protection (hereinafter collectively referred to as the Inspection Certificate) is the certificate confirming that the special purpose motorcycle has been inspected and meets the standards, regulations, and provisions on technical safety and environmental protection as prescribed, and is eligible to participate in traffic.
6. Inspection Seal of Technical Safety and Environmental Protection (hereinafter collectively referred to as the Inspection Seal) is the emblem issued by the competent authority and affixed to the special purpose motorcycle after it passes the technical standards and is permitted to participate in traffic according to the period indicated on the Inspection Seal.
7. is the director, deputy director of inspection centers; station chief of inspection stations under the Ministry of National Defense. is the individual responsible for signing and stamping on the Inspection Report, the Inspection Certificate, and the Inspection Seal.
Article 4. Prohibited Acts
1. Issuing an Inspection Certificate and affixing an Inspection Seal without conducting an inspection.
2. Unauthorized printing of blank Inspection Certificates and Inspection Seals for use; peeling off and reapplying Inspection Seals; modifying information printed on Inspection Certificates and Inspection Seals.
3. Assigning personnel to perform inspection work contrary to regulations.
4. Putting into traffic special purpose motorcycles that have not been inspected or whose inspection period has expired, or those that do not meet the technical safety quality and environmental protection requirements.
Article 5. Conditions for Operation and Standards for Inspectors and Statistical Staff
Conditions for operation and standards for officers, inspectors, and statistical staff conducting vehicle inspection for specialized motorcycles shall be implemented in accordance with Circular No. 18/2013/TT-BQP dated February 7, 2013, issued by the Minister of National Defense regarding conditions for operation and standards for officers, inspectors, and statistical staff at centers and stations inspecting safety and technical conditions of military vehicles.
Article 6. Inspection Levels
1. Hanoi area: Safety and Technical Inspection Center No. 01 under the Motor Vehicle Department/General Department of Logistics; Safety and Technical Inspection Station No. 02 under the Command of Hanoi Capital Military Region.
2. Northern Vietnam area: Safety and Technical Inspection Station No. 05 under Military Region 1.
3. Northwest Vietnam area: Safety and Technical Inspection Station No. 06 under Military Region 2.
4. Northeast Vietnam and North Coast area: Safety and Technical Inspection Station No. 07 under Military Region 3.
5. South Military Region 3 - North Military Region 4 area: Safety and Technical Inspection Station No. 09 under the 1st Corps.
6. North Central Vietnam area: Safety and Technical Inspection Station No. 10 under Military Region 4.
7. Central Vietnam - Central Highlands area: Safety and Technical Inspection Station No. 11 under the Motor Vehicle Department/General Department of Logistics; Safety and Technical Inspection Station No. 12 under Military Region 5; Safety and Technical Inspection Station No. 13 under the 3rd Corps; Safety and Technical Inspection Station No. 14 under the Motor Vehicle Department/General Department of Logistics.
8. Southeast Vietnam area: Safety and Technical Inspection Center No. 17 under the Motor Vehicle Department/General Department of Logistics; Safety and Technical Inspection Station No. 16 under Military Region 7.
9. Southwest Vietnam area: Safety and Technical Inspection Station No. 19 under Military Region 9.
10. Specialized motorcycles of the Engineering Corps: Safety and Technical Inspection Station No. 20 under the Engineering Corps.
Chapter II
REGULATIONS ON CERTIFICATION
Article 7. Inspection Cycle
1. For imported or domestically produced and assembled specialized motorcycles, the initial inspection cycle is 36 months, and the regular inspection cycle is 24 months.
2. For specialized motorcycles that have been modified or refurbished, the initial inspection cycle is 24 months, and the regular inspection cycle is 12 months.
3. For specialized motorcycles with a service life exceeding 10 years from the year of manufacture, the regular inspection cycle is 12 months.
4. In cases where imported specialized motorcycles; domestically produced and assembled specialized motorcycles; or specialized motorcycles requiring traffic participation to move to necessary locations after modification are inspected according to this Circular. If they meet the requirements, they will be issued a Certificate of Inspection and affixed with an Inspection Label valid for 30 days from the date of inspection.
Article 8. Inspection Documentation
1. Initial inspection documentation includes:
a) An introduction letter or request for inspection signed by the commander of a regiment or equivalent unit and stamped;
b) Registration certificate (in cases where specialized motorcycles have not yet been registered, the introduction letter or request must clearly state the brand name, frame number, and engine number);
c) Service history of specialized motorcycles (applicable only to registered specialized motorcycles);
d) A copy of technical documentation or basic technical specifications of specialized motorcycles. For modified specialized motorcycles, it is a copy of the overall drawing, basic technical specifications, quality and safety technical certification of the modified specialized motorcycle, or the acceptance report of the quality of the modified specialized motorcycle by the competent authority.
2. Regular inspection documentation includes: The documents specified in points a, b, and c of Clause 1 of this Article.
Article 9. Inspection Organization
1. Special-purpose motorcycles shall be inspected at inspection facilities or mobile inspection units.
2. The inspection of special-purpose motorcycles must comply with all contents as prescribed in Appendix I attached to this Circular. In cases of mobile inspections, additional contents as prescribed in Appendix II attached to this Circular must also be implemented.
Article 10. Inspection Results
1. The results of each inspection content for special-purpose motorcycles shall be evaluated and recorded on the Inspection Report by inspectors, reported to the inspection facility commander for conclusion, signed, and stamped according to regulations.
2. Issuance of the Inspection Certificate and Affixing of the Inspection Label
a) Special-purpose motorcycles that meet all requirements stipulated in Appendix 1 attached to this Circular after inspection shall be issued an Inspection Certificate and have an Inspection Label affixed.
b) The validity period of the inspection for special-purpose motorcycles shall be directly noted in the content of the Inspection Label.
Article 11. Inspection Report and Inspection Certificate
1. The Inspection Report shall be printed in black and white on one side of A4 paper according to Model No. 01 in Appendix III attached to this Circular.
2. The Inspection Certificate shall be printed in color on one side of A4 paper according to Model No. 02 in Appendix III attached to this Circular.
3. The Inspection Report and Inspection Certificate shall only be valid when fully completed with content and signed, stamped by the inspection facility commander according to regulations.
Article 12. Inspection Label
1. The Inspection Label shall be circular, with a diameter of 95mm, made of paper and protected by a plastic film; it shall be printed in color on both sides according to Model 03 in the accompanying Appendix of this Circular.
2. The Inspection Label shall only be valid when fully completed with content and signed, stamped by the inspection facility commander according to regulations.
3. Cases where the Inspection Label becomes invalid
a) After the effective date noted in the content of the Inspection Label;
b) When the special-purpose motorcycle is damaged to the extent that it does not ensure technical safety and environmental protection as prescribed;
c) When the Inspection Label is damaged due to peeling, flaking, or erasure. In cases where the Inspection Label is damaged due to objective reasons, the unit must submit a written request to the inspection facility (specifying the reason) to exchange for another Inspection Label.
4. Position for affixing the Inspection Label
a) For special-purpose motorcycles with a front windscreen: affixed inside the upper right corner of the windscreen facing the direction of travel of the vehicle;
b) For special-purpose motorcycles without a front windscreen: affixed inside the driver's cabin or at a position easily observable, avoiding external impacts that may damage the Inspection Label.
Article 13. Retention of Inspection Records and Data
Inspection records shall be established, retained, and destroyed at the inspection facility within three years (36 months) from the date of inspection, including:
1. Logbook of special-purpose motorcycles undergoing inspection.
2. Inspection Report of each special-purpose motorcycle.
3. Measurement and testing results of technical parameters according to each inspection content (if applicable).
4. Inspection data shall be stored in administrative information management software and inspection result databases.
Chapter III
RESPONSIBILITIES OF THE AGENCIES AND UNITS
Article 14. Responsibilities of the General Department of Technical Services
1. Shall be responsible before the Minister of National Defense and under the law for planning, organizing, and conducting inspections of special-purpose motorcycles throughout the military.
2. Direct the Motor-Cycle Bureau:
a) Guide, direct, and inspect inspection facilities; agencies, units, enterprises to properly implement the inspection work of special-purpose motorcycles as prescribed in this Circular;
b) Develop content and programs for training and issuing Inspection Certificates, Inspector Cards for relevant subjects as prescribed;
c) Develop information technology application software for directing and managing the inspection work of special-purpose motorcycles and guide inspection facilities and operating units;
d) Print and manage various types of Inspection Certificate forms and Inspection Labels as prescribed in Clause 2 of Article 11 and Clause 1 of Article 12 of this Circular.
Article 15. Responsibilities of the unit commander with specialized motor vehicles
1. Direct the agency, unit, enterprise under their authority to carry out the specialized motor vehicle inspection work in accordance with the provisions of this Circular.
2. Bear responsibility for maintaining the technical condition of specialized motor vehicles between two inspection periods.
Article 16. Responsibilities of the inspection facility
1. Print the Inspection Certificate for specialized motor vehicles.
2. Conduct inspections of specialized motor vehicles according to the contents stipulated in this Circular.
3. Honestly evaluate and conclude the results of the inspection of various types of specialized motor vehicles.
4. Issue the Inspection Certification and Inspection Label to specialized motor vehicles meeting the conditions for circulation.
5. Directly affix the Inspection Label on specialized motor vehicles.
6. Participate in evaluating and accepting the quality of specialized motor vehicles for technical assurance tasks: repair, extension of service life, and synchronization of specialized motor vehicle equipment when assigned by superiors.
7. Inspect specialized motor vehicles upon special requests.
8. Compile and report the inspection results to the superior business department and the Motor Vehicle Bureau/General Department of Technology in accordance with the regulations.
9. Retain inspection files and data and destroy them in accordance with the provisions of Article 13 of this Circular.
Chapter IV
IMPLEMENTING PROVISIONS
Article 17. Effective date and transitional provisions
1. This Circular takes effect from September 5, 2021.
2. In cases where the referenced documents in this Circular are amended, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replacement documents.
Article 18. Responsibility for Implementation
1. The Director of the General Department of Technology, heads of agencies, units, organizations, and individuals related to this Circular are responsible for its implementation.
2. During the implementation process, if there are difficulties or obstacles, agencies, units, organizations, and individuals related to this Circular should promptly reflect them to the Ministry of National Defense (through the General Department of Technology) for research and resolution./.
