- Pursuant to Decree No. 96/CP dated December 7, 1993 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Labor, Invalids and Social Affairs;

Article 1. Now, we hereby stipulate the minimum salary levels according to positions applicable to experts and Vietnamese workers employed under contracts with foreign contractors winning bids in Vietnam as follows:

The aforementioned minimum salary does not include: 15% social insurance and 2% health insurance that the employer is responsible for paying for employees according to the provisions of the Labor Code.
Foreign contractors shall base on the minimum salary level to establish higher salary levels corresponding to each position as a basis for negotiating specific salary levels with Vietnamese experts and workers recorded in the labor contract to pay wages and implement social insurance, health insurance, overtime pay, night shift pay, stoppage pay, and termination pay according to the provisions of the Labor Code and guiding documents implementing the Labor Code of Vietnam.
Payment of wages to experts and Vietnamese workers shall be made in Vietnamese dong based on the average transaction rate in the inter-bank foreign exchange market announced by the State Bank of Vietnam at the time of wage payment.
Article 2. This Decision takes effect 15 days from the date of signature. All previous regulations conflicting with this Decision are abolished.
Article 3. Ministries managing sectors and fields, People's Committees of provinces and centrally governed cities, foreign contractors winning bids in Vietnam; Vietnamese experts and workers employed under contracts with foreign contractors winning bids in Vietnam are responsible for implementing this Decision.
