PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 08/2000/NĐ-CP dated March 10, 2000 of the Government on registration of secured transactions;

To manage and implement registration of secured transactions;

Considering the proposal of the Minister of Justice and the Heads of the Government’s Organizational and Civil Servant Affairs Department.

DECISION:

Article 1. Establish the National Registration Agency for Secured Transactions under the Ministry of Justice to carry out state management over registration of secured transactions, organize registration, and provide information on secured transactions according to its authority.

The National Registration Agency for Secured Transactions has legal personality, its own seal and separate account, with its main office located in Hanoi City.

Article 2. The National Registration Agency for Secured Transactions shall have the following tasks and powers:

1. Drafting, participating in drafting draft regulatory legal documents on registration of secured transactions for the Ministry of Justice to submit to the Government or for the Ministry of Justice to promulgate according to its authority, and organizing the implementation of regulatory legal documents on registration of secured transactions;

2. Submitting to the Minister of Justice for issuance or issuing according to its authority regulations on specialized technical and operational matters related to secured transaction registration work, guiding and inspecting the implementation of such regulations; managing and uniformly guiding the use of forms, documents, and registration books, organizing and managing the National Database of Secured Transactions;

3. Implementing registration of secured transactions according to its authority; providing information on secured transactions stored in the National Database of Secured Transactions;

4. Directing and organizing training and capacity building in specialized technical and operational matters and skills related to secured transaction registration for the registration staff;

5. Statistics on secured transaction registration, compiling and reporting to the Minister of Justice on secured transaction registration work nationwide;

6. Inspecting organizational structure and activities of secured transaction registration; resolving complaints and denunciations regarding secured transaction registration according to its authority;

7. Implementing international cooperation on secured transaction registration according to the division of labor by the Ministry of Justice.

Article 3. The Minister of Justice shall issue Regulations on the organization and operation of the National Registration Agency for Secured Transactions; appointing the leadership of the National Registration Agency for Secured Transactions.

Article 4. The National Registration Agency for Secured Transactions shall have several branches located in localities.

Branches of the National Registration Agency for Secured Transactions shall implement registration of secured transactions and provide information on secured transactions according to their authority.

Branches of the National Registration Agency for Secured Transactions shall have their own seals and separate accounts.

The Minister of Justice shall decide on the establishment of branches of the National Registration Agency for Secured Transactions and appointing the leadership of these branches.

Article 5. The Ministry of Justice shall coordinate with the Government’s Organizational and Civil Servant Affairs Department, the Ministry of Finance, and relevant agencies to provide detailed guidance on implementing this Decision.

The Ministry of Transport, the Civil Aviation Administration of Vietnam, People's Committees of provinces and centrally governed cities shall be responsible for coordinating with the Ministry of Justice to effectively implement secured transaction registration activities.

Article 6. This Decision shall take effect 15 days from the date of issuance.

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
