DECISION NO. 107/TC/QD-TCHN OF THE MINISTER OF FINANCE ON FEBRUARY 24, 1997, AMENDING AND SUPPLEMENTING DECISION NO. 663 TC/QD-TCHN OF JUNE 24, 1995 OF THE MINISTRY OF FINANCE
THE MINISTER OF FINANCE
Pursuant to Decision No. 178/CP dated October 28, 1994 of the Government on the tasks, powers, and organizational structure of the Ministry of Finance;
- Pursuant to the Charter on "Investment Management and Construction" issued together with Decree No. 42/CP dated July 16, 1996 of the Government;
- Pursuant to Circular No. 65/TC/DTP dated November 2, 1996 of the Ministry of Finance guiding construction project insurance;
At the proposal of the Director of the Department of Financial Affairs of Banks and Financial Organizations.
DECISION:
Article 1: This Decision promulgates the Insurance Fee Table for certain construction projects supplementing the Construction Insurance Fee Table, Installation Insurance Fee Table, additional insurance fees, and deductible levels already promulgated with Decision No. 663/TC/QD-TCHN dated June 24, 1995 of the Ministry of Finance.
Article 2: Amends Article 2 of Decision No. 663 TC/QD-TCHN dated June 24, 1995 as follows: Based on ensuring payment capacity, insurance enterprises may independently adjust the insurance fee within 25% of the prescribed fee table at specific times.
Article 3: For construction projects with special characteristics not mentioned or inadequately addressed in the rules and fee tables issued by the Ministry of Finance, insurance enterprises and investors are permitted to negotiate conditions and insurance fee tables for special contents to promptly insure the project but must report to the Ministry of Finance for monitoring and management.
Article 4: The insurance fee is calculated in the project budget based on the construction and installation fee tables that have been issued.
Article 5: This Decision takes effect from the date of issuance and applies to insurance enterprises and investors, construction consulting organizations, equipment suppliers, and contractors as stipulated in Decree No. 42/CP dated July 16, 1996 of the Government and Circular No. 65/TC/DTP dated November 2, 1996 of the Ministry of Finance guiding construction project insurance.
Article 6: The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and cities shall be responsible for implementing this Decision to investors under their jurisdiction.
Article 7: The Director of the Department of Financial Affairs of Banks and Financial Organizations, the General Director of the General Investment and Development Department, the Head of the Office of the Ministry of Finance, and heads of related units shall be responsible for inspecting and supervising the implementation of this Decision.
