DECISION

Regarding the issuance of the Regulations on the organization and operation of the Banking Times

GOVERNOR OF THE STATE BANK OF VIETNAM

Pursuant to the Law on the State Bank of Vietnam No. 01/1997/QH10 dated December 12, 1997 and the Law Amending and Supplementing Certain Provisions of the Law on the State Bank of Vietnam No. 10/2003/QH11 dated June 17, 2003;

Pursuant to the Press Law  dated 28/12/1989 and the Law amending and supplementing certain articles of the Press Law No. 12/1999/QH10 dated 12/6/1999;

Pursuant to Decree No. 86/2002/NĐ-CP dated 5/11/2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to the Government Decree No. 52/2003/NĐ-CP dated 19/5/2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the State Bank of Vietnam; Male;

Pursuant to Decree No. 10/2002/NĐ-CP dated 16/01/2002 of the Government on financial regime applicable to units of public service with income;

Pursuant to Decree No. 116/2003/NĐ-CP dated 10/10/2003 of the Government on recruitment, utilization, and management of cadres and civil servants in state-owned public service units;

Pursuant to Decree No. 112/2004/NĐ-CP dated 8/4/2004 of the Government stipulating the mechanism for managing staffing levels for state-owned public service units;

At the proposal of the Editor-in-Chief of the Banking Times and the Director of the Cadre and Organization Department,

 

ON  DECIDE:

Article 1To issue together with this Decision the "Regulations on the organization and operation of the Banking Times".

Article 2This Decision shall take effect 15 days from the date of publication in the Official Gazette, replacing Decision No. 122/1999/QĐ-NHNN dated April 8, 1999 of the Governor of the State Bank of Vietnam on the issuance of the Regulations on the organization and operation of the Banking Times.

Article 3The Heads of the Office, the Director of the Cadre and Organization Department, the Editor-in-Chief of the Banking Times, and the Heads of relevant units under the State Bank of Vietnam are responsible for implementing this Decision.

REGULATIONS

ORGANIZATION AND OPERATIONSOF THE BANKING TIMES

(Issued together with Decision No. 1049/2004/QĐ-NHNN

dated 23  August  2004 of the Governor of the State Bank of Vietnam)

 

PART I

GENERAL PROVISIONS

Article 1.  The Banking Times is a public service unit within the organizational structure of the State Bank of Vietnam, serving as a media outlet, a social forum, and a tool for propaganda and dissemination of the Party's policies, the State's laws, and the activities of the banking sector according to the Press Law and regulations of the Governor of the State Bank of Vietnam.

Article 2. The Banking Times has its own bank account and seal for transactions in accordance with the law, and implements the financial mechanism for public service units with income as currently prescribed.

Article 3. The Editor-in-Chief manages the operations of the Banking Times; assisting the Editor-in-Chief are several Deputy Editors-in-Chief. The Editor-in-Chief and Deputy Editors-in-Chief are appointed by the Governor of the State Bank of Vietnam. The operations of the Banking Times are conducted under the principle of centralized democracy and the headship system.

PART II

TASKS AND POWERS

Article 4. The Banking Times has the following tasks and authorities:

1. Timely and accurately provide information about economic and social conditions and banking activities, as well as directives and management activities of the Governor of the State Bank of Vietnam, in accordance with the Press Law.

2. Propagate and disseminate, contribute to building and protecting the Party's policies and the State's laws, the development orientation of the banking sector, and implement publicity programs and plans as directed by the Governor of the State Bank of Vietnam.

3. Reflect and guide public opinion on banking activities; publish opinions, exchanges, and disseminate knowledge and experience on banking activities both domestically and internationally; exercise freedom of speech and raise public awareness according to the Press Law and other related legal documents.

4. Identify and promote good people and deeds, new factors, and combat violations of the law and negative phenomena related to banking activities.

5. Organize editing, publishing, and distributing the Banking Times in compliance with its mission and purpose and the provisions of the Press License issued.

6. Organize editing, publishing, and distributing other lawful publications to promote and introduce the activities of the banking sector abroad as well as introduce foreign banks' activities to domestic readers.

7. Cooperate, joint venture, and associate with domestic and foreign units to carry out press activities in accordance with the Press Law and other related legal provisions.

8. Implement management of capital, assets, and financial mechanisms in accordance with the law.

9. Perform other tasks assigned by the Governor of the State Bank of Vietnam.

CHAPTER III

ORGANIZATIONAL STRUCTURE AND MANAGEMENT

Article 5. The organizational structure of the Banking Times includes:

1. Reader and Reference Section;

2. Reporter and Editing Section;

3. Editorial Secretary Section;

4. Distribution and Advertising Section;

5. Administration, Synthesis, and Financial Section;

6. Representative Office in Ho Chi Minh City.

The tasks and authorities of each unit mentioned above are defined by the Editor-in-Chief.

Article 6. Tasks and authorities of the Editor-in-Chief:

1. Be responsible before the Governor of the State Bank of Vietnam and the law when performing the tasks and authorities stipulated in Article 4 of these Regulations.

2. Recruit, utilize, and manage cadres and civil servants (referred to as staff members) in the unit in accordance with national regulations and those of the banking sector.

1. Organize the implementation of legal provisions regarding staff members.

a. Implement recruitment and termination of employment for staff members, specifically: based on job requirements, staffing plans, and approved financial resources, develop recruitment plans, decide on recruitment methods, and conduct recruitment, sign employment contracts, probation periods, and appointment to staff positions, and terminate employment in accordance with current regulations.

b. Manage and assign duties to staff members under their jurisdiction;  increase salaries for staff members at the Specialist level and below in accordance with the law. Propose the Governor of the State Bank of Vietnam to increase salaries, upgrade positions, and transfer salary grades for staff members at the Senior Specialist level and above.

d. Appoint, relieve from duty, and dismiss leaders of units within the organizational structure of the Banking Times in accordance with current regulations.

đ. Propose the Governor of the State Bank of Vietnam to appoint, reappoint, relieve from duty, reward, and discipline Deputy Editors-in-Chief.

e. Implement staff member evaluations in accordance with current regulations.

g. Implement state and banking sector policies for staff members.

h. Implement rewards and disciplinary measures for staff members within their authority and propose higher authorities to reward and discipline staff members in accordance with the law.

i. Statistics and report on the staff member workforce.

k. Implement staff member file management in accordance with regulations.

l. Resolve complaints and accusations against staff members within their authority.

3. Implement management of capital and assets in accordance with the law.

4. Implement the financial mechanism as prescribed by the Governor of the State Bank and applied to units with income according to Decree No. 10/2002/NĐ-CP dated January 16, 2002 of the Government.

5. Cooperate with news agencies and press organizations, as well as units within and outside the banking sector, in the field of journalism in accordance with the provisions of the law.

6. Sign documents within the scope of authority. Enter into printing, publishing, distribution, and advertising contracts in accordance with the provisions of the law.

, Clause 1, Clause 2 Article 7a of this Regulation.. Duties and powers of the Deputy Editor-in-Chief:

1. Assist the Editor-in-Chief in directing and managing certain aspects of the work of the Banking Times according to the assignment of the Editor-in-Chief and be responsible to the Editor-in-Chief for those assigned tasks.

2. Sign on behalf of the Editor-in-Chief documents as assigned by the Editor-in-Chief.

3. When the Editor-in-Chief is absent, a Deputy Editor-in-Chief authorized to manage the general operations of the Banking Times and be responsible for the matters resolved and report back when the Editor-in-Chief is present.               

PART IV

IMPLEMENTING PROVISIONS

Article 8. Amendments and supplements to this Regulation shall be decided by the Governor of the State Bank.
