REGARDING THE ENFORCEMENT OF STRONGER INSPECTION OF AQUATIC PRODUCTS FOR EXPORT TO JAPAN

BASED ON DECREE NO. 43/2003/NĐ-CP DATED MAY 2, 2003 OF THE GOVERNMENT ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF AQUATIC RESOURCES;

BASED ON DIRECTIVE NO. 37/2005/CT-TTg DATED OCTOBER 28, 2005 OF THE PRIME MINISTER ON CERTAIN MEASURES TO STRENGTHEN MANAGEMENT OF CHEMICALS AND ANTIBIOTICS USED IN FOOD PRODUCTION AND BUSINESS;

BASED ON ANNOUNCEMENT NO. 2936/TB-BTS DATED DECEMBER 13, 2006 OF THE MINISTRY OF AQUATIC RESOURCES ON THE CONCLUSIONS OF THE MINISTER OF AQUATIC RESOURCES AT THE CONFERENCE "DISCUSSING MEASURES TO PREVENT PROHIBITED CHEMICALS AND ANTIBIOTICS IN AQUATIC PRODUCTS";

PURSUANT TO THE PROPOSAL OF THE DIRECTOR OF THE SCIENCE AND TECHNOLOGY DEPARTMENT AND THE DIRECTOR OF THE QUALITY CONTROL, FOOD SAFETY AND VETERINARY SERVICES DEPARTMENT.

DECISION:

Article 1. IMPLEMENT RESIDUE TESTING FOR PROHIBITED CHEMICALS AND ANTIBIOTICS IN AQUATIC PRODUCTS FOR EXPORT TO THE JAPANESE MARKET (EXCEPT LIVE PRODUCTS) FROM DECEMBER 20, 2006 AS FOLLOWS:

- INSPECT 100% OF SHIPMENTS OF SHRIMP AND SQUID FROM ENTERPRISES THAT HAVE BEEN RECOGNIZED AS MEETING FOOD SAFETY STANDARDS FOR CHEMICAL AND ANTIBIOTIC RESIDUES IDENTIFIED BY JAPANESE AUTHORITIES AFTER NOVEMBER 24, 2006;

- INSPECT 100% OF SHIPMENTS OF SHRIMP AND SQUID FROM ENTERPRISES THAT HAVE NOT BEEN RECOGNIZED AS MEETING FOOD SAFETY STANDARDS FOR ALL CHEMICAL AND ANTIBIOTIC RESIDUES IDENTIFIED BY JAPANESE AUTHORITIES.

Article 2. THE QUALITY CONTROL, FOOD SAFETY AND VETERINARY SERVICES DEPARTMENT (NAFIQAVED) SHALL BE RESPONSIBLE FOR:

- ISSUING SANITARY AND EPIDEMIOLOGICAL CERTIFICATES FOR SHIPMENTS SUBJECT TO INSPECTION AS PROVIDED IN ARTICLE 1 IF THE ANALYSIS RESULTS MEET JAPANESE REQUIREMENTS;

- REGULARLY NOTIFYING THE GENERAL CUSTOMS DEPARTMENT OF THE LIST OF ENTERPRISES ELIGIBLE FOR NON-INSPECTION AND ENTERPRISES REQUIRED TO OBTAIN CERTIFICATION FOR PROHIBITED CHEMICAL AND ANTIBIOTIC RESIDUES AS PROVIDED IN ARTICLE 1 OF THIS DECISION.

Article 3. THE TESTING SHALL BE PERFORMED IN NAFIQAVED LABORATORIES OR OTHER LABORATORIES THAT HAVE BEEN CERTIFIED TO MEET ISO 17025 STANDARDS FOR RESIDUE ANALYSIS. NAFIQAVED SHALL UPDATE THE LIST OF COMPETENT LABORATORIES AND NOTIFY ENTERPRISES.

Article 4. This Decision takes effect from the date of signature.

Article 5. THE HEAD OF THE MINISTRY'S OFFICE, HEADS OF MINISTRY UNITS, DIRECTORS OF PROVINCE AQUATIC RESOURCES SERVICES, DIRECTORS OF PROVINCE AGRICULTURE AND RURAL DEVELOPMENT DEPARTMENTS WITH OVERSIGHT OF AQUATIC RESOURCES, AND ENTERPRISES PROCESSING AND EXPORTING AQUATIC PRODUCTS ARE RESPONSIBLE FOR IMPLEMENTING THIS DECISION./.
